Verify a yacht in three independent tracks before paying: establish the correct registry, reconstruct ownership and recorded encumbrances, and corroborate maintenance with an independent condition-and-valuation survey. A federal Certificate of Documentation is not a substitute for an abstract-of-title review, and a state title is not necessarily a conclusive lien search. Make clear title, matching vessel identifiers, and documentary releases of every recorded mortgage or lien conditions of closing.
Start by identifying the yacht’s registration jurisdiction
The registry determines which records can establish ownership and where liens or mortgages are recorded. Ask the seller for the vessel’s Certificate of Documentation (COD), state title or registration, hull identification number (HIN), official number, vessel name, and hailing port. Compare those details with the permanently marked HIN, the builder’s plate, engine-room labels, and every document in the seller’s file.
- Federally documented vessel: Records are maintained by the U.S. Coast Guard National Vessel Documentation Center (NVDC). The vessel has a COD and usually an official number.
- State-registered vessel: The state that issued the title or registration maintains the principal ownership and lien records. A state may also require separate filings for lenders or dealers.
- Foreign-flag vessel: The flag state’s registry, mortgage, lien, deletion, and transfer rules apply. U.S. records alone cannot establish clean title to a foreign-flag yacht.
Do not accept a seller’s description of the registry without seeing the current document. A yacht can move between federal and state systems, change its name or hailing port, or be owned by a company or trust rather than the individual who is negotiating with you.
Federal documentation: order and read the complete record
For a documented yacht, obtain records directly from the NVDC before signing an unconditional purchase agreement. The NVDC eStorefront offers an abstract of title, certified copy of documentation, certificate of ownership, mortgage and related-instrument filings, claim-of-lien filings, satisfactions or releases, and bills of sale. The U.S. Coast Guard Port State Information Exchange currently lists an abstract of title at $25 per vessel and a certificate of ownership at $125 per vessel. Those are the stated federal record fees accessed in 2026; other document orders or expedited services can have different charges.

- Order the abstract of title. Use the vessel’s official number and confirm that the resulting record is for the same HIN, name, and hailing port shown on the yacht.
- Order the certificate of ownership or a certified copy when needed. A certified document can be important for a lender, closing agent, or counsel who must rely on an official copy.
- Collect every recorded instrument. Download or request each bill of sale, mortgage, preferred mortgage, assignment, claim of lien, satisfaction, and release listed in the abstract or related record.
- Read the record chronologically. Start with the earliest recorded owner and follow every transfer and encumbrance through the current seller. Do not stop at the latest entry.
- Check for open instruments. A mortgage or claim of lien remains a closing issue until the record shows a matching release or the closing documents provide a verified payoff-and-release procedure.
USCG initial-documentation guidance allows ownership to be established from a state title or state/foreign registration together with bills of sale from the registered owner in situations covered by its simplified method. If the yacht falls outside that method, expect to provide the complete chain of title and the required citizenship evidence. Ask maritime counsel or a documentation specialist to identify which path applies before relying on a partial file.
Reconstruct and reconcile the chain of title
A chain of title is reliable only when each transfer connects to the next without an unexplained gap. Build a one-page chronology and attach the underlying instrument to every line. The person or entity selling the yacht must have authority that can be traced to the recorded owner.

Do not “bridge” a missing transfer with a seller’s explanation alone. Require a corrective instrument, a recorded document, or a written legal opinion that explains why the apparent gap does not affect title. Keep copies of every version, including documents that were rejected or superseded, so the closing file shows how an error was resolved.

Obtain the title and lien record from the issuing state, not merely a photocopy supplied by the seller. Read the certificate’s disclaimer and the state’s search rules. State systems differ in indexing, notice requirements, and whether the title certificate represents an actual search of ownership history.

Nevada’s regulation illustrates the risk. Its certificate states: “The Department has not made a title search to establish conclusively the ownership or lienholders, or both, of the vessel and makes no warranty as to the truth of the statements contained in this certificate.” In that situation, a clean-looking certificate does not prove that no lien exists. You may need additional filings, releases, lender confirmations, court records, or a maritime attorney’s analysis.
Ask the state agency, in writing if possible, what its record covers, the date through which it is current, and whether it indexes liens under the owner’s name, the vessel identification number, or both. Search any prior state of registration identified in the chain, because a move to a new state does not necessarily extinguish an earlier security interest.
How to verify mortgages and liens
For a documented vessel, inspect the NVDC abstract and each related instrument for mortgages, preferred mortgages, assignments, claims of lien, and releases. Under 46 U.S.C. §31321, a bill of sale, conveyance, mortgage, assignment, or related instrument filed in substantial compliance is valid against most persons from the time it is filed. A filing must identify the vessel and parties, state the secured amount when applicable, describe the interests transferred or encumbered, and be signed and acknowledged.

Use this process for every encumbrance:
- Identify the secured party or claimant. Record its exact legal name, not an abbreviated trade name.
- Match the vessel. Confirm the HIN, official number, name history, and any other identifier in the instrument.
- Trace assignments. A loan may have been sold or assigned; the current secured party must be able to release it.
- Demand a recorded release or satisfaction. The release should identify the same vessel and secured party and state that the mortgage, claim, or debt is satisfied or discharged.
- Make release a contract condition. The purchase agreement should say that clear title and documentary release of all recorded encumbrances are conditions to closing.
- Verify immediately before funding. Escrow or closing counsel should check the record again shortly before funds are released and confirm that any payoff has produced the required filing.
A seller email saying that a loan was paid is evidence of intent, not a recorded discharge. If a lender cannot file the release before closing, use a written payoff-and-release arrangement that specifies the escrow amount, filing deadline, responsible party, and your remedy if the release is rejected or delayed. Do not accept a general promise to “take care of it later.”

Request a maintenance file that can be corroborated
Maintenance records are valuable only when dates, hours, parts, and vessel identifiers can be checked against independent evidence. Request a chronological file from the owner and the servicing yards, then ask the yards to confirm invoices directly when privacy and authorization permit.

Ask for engine-hour and generator-hour readings over time rather than a single current number. A neat spreadsheet without invoices, work orders, or yard confirmation is a lead, not proof. Compare the chronology with service stickers, electronic displays, haul-out dates, the seller’s written representations, and the independent survey. Large hour jumps, implausibly low hours on an older engine, or a service date that predates the recorded ownership transfer should be explained in writing.
There is no universal maintenance-record retention period established for every yacht, engine, or jurisdiction. The practical standard is continuity: preserve the oldest available invoices and logs, identify missing periods, and document what the seller and servicing yards could not locate instead of treating an undocumented interval as proof that no work occurred.

Commission an independent pre-purchase survey
The American Boat & Yacht Council describes a prepurchase survey as a comprehensive “Condition and Valuation” survey that often includes operational testing of systems and equipment and a sea trial. It can also satisfy insurance and bank-loan requirements. Hire the surveyor directly rather than relying on the seller, broker, or yard to select one.

Define the survey scope before booking
- Ask whether haul-out, moisture readings, structural inspection, rigging, electronics, oil analysis, and separate engine-specialist work are included or billed separately.
- Require the report to identify the HIN and registration numbers, describe construction and equipment, document condition and repair recommendations, include photographs, and state fair-market value.
- Confirm that operational testing covers propulsion, steering, generators, electrical systems, navigation, safety equipment, HVAC, plumbing, and other material systems for the yacht’s design.
- Schedule a sea trial long enough to reveal starting, cooling, charging, vibration, steering, alarm, and load-related problems.
Check independence and credentials
Marine surveying is not a universally regulated or licensed industry. Ask about training, professional affiliations, errors-and-omissions insurance, recent work on comparable yachts, and conflicts of interest. Insurers and lenders may require a credentialed member of the National Association of Marine Surveyors (NAMS) or the Society of Accredited Marine Surveyors (SAMS); verify their exact requirement before the inspection. A surveyor’s report is an informed condition assessment, not a title opinion and not a guarantee that every latent defect or lien has been found.
Compare the report with the documentary file
Give the surveyor the identifier list and ask the surveyor to note mismatches between the hull, engines, equipment, and paperwork. Reconcile reported engine hours, claimed recent repairs, replaced components, and damage history with what is visible and testable. A survey finding that contradicts a maintenance invoice should trigger a yard confirmation, a specialist inspection, a price adjustment, or a decision not to proceed.

- The HIN, official number, engine serial number, or registration number differs between the yacht and the documents.
- The seller is not the recorded owner and cannot produce authority to sell.
- A bill of sale is missing between two recorded owners, has inconsistent dates, or lacks required signatures or acknowledgments.
- An abstract lists a mortgage, assignment, or claim of lien without a matching recorded satisfaction or release.
- A release names a different vessel, old identifier, or different secured party and has not been corrected.
- The state certificate contains a disclaimer that it is not a conclusive title or lien search, yet no supplemental search has been performed.
- Engine or generator hours conflict with invoices, displays, survey observations, or seller representations.
- Major collision, storm, insurance, warranty, or structural work is absent from the maintenance file and cannot be confirmed by the yard.
- The seller refuses an independent survey, haul-out, sea trial, direct yard confirmation, or escrow verification.
Document each issue in the purchase agreement. Depending on the severity, require a cure before the inspection period expires, obtain a specialist opinion, renegotiate based on documented repairs, or terminate under the contract’s inspection and title contingencies.

Keep the final closing package with the signed purchase agreement, bills of sale, releases, survey, yard confirmations, title documents, and payment instructions. If the yacht is owned by an entity, retain evidence that the person signing the closing documents had authority on the closing date.

When the yacht is foreign-flagged or has international history
The federal U.S. workflow does not establish clean title for a foreign-flag yacht. Obtain the flag state’s current registry extract, mortgage and lien records, deletion or export certificate where applicable, and the complete transfer history required by that jurisdiction. A yacht that previously carried another flag may still require evidence that earlier mortgages or maritime claims were discharged under the former registry’s rules. Because filing effects, priority, language, notarization, and legalization requirements vary, use counsel familiar with the flag state, the owning entity, and the intended closing location.
There is no single universal international lien-search rule or retention period that applies to every vessel. Treat the governing registry’s written requirements as controlling and obtain a jurisdiction-specific legal opinion when the records, owner, lender, or transaction crosses borders.
Who should handle the legal review?
A maritime title attorney or vessel-documentation specialist can interpret priority, entity authority, state disclaimers, preferred-mortgage requirements, and corrective filings. An escrow agent can coordinate payoff instructions and confirm that releases are filed, but should not replace legal advice on whether a defect is cured. A marine surveyor addresses condition and value, not ownership or lien priority. For a significant purchase, use all three functions independently and put their responsibilities in writing.
The practical standard for a safe purchase
Proceed only when the registry record, chain of title, lien releases, maintenance evidence, and independent survey tell the same story. A low asking price does not compensate for an unverified owner, an open mortgage, an unexplained title gap, or machinery history that cannot be corroborated. Make the documentary and physical checks conditions of closing, and release funds only after the final record review confirms that the yacht you inspected is the yacht the seller is authorized to convey.
