A giveaway can grow an email audience, but entering is not the same as consenting to marketing. Build the campaign around a prize your prospective customers genuinely want, publish clear rules and data-use disclosures, capture a separate marketing permission where required, and measure opted-in subscribers and qualified leads—not raw entries.
What a giveaway can—and cannot—do for list growth
A giveaway exchanges a chance to win a prize for an entry. It can attract attention and give people a reason to share their contact details, but the entry count alone says little about future business value. Track these outcomes separately:

- People who affirmatively opted in to marketing
- Qualified leads who fit your target customer profile
- Subsequent email engagement, enquiries, purchases, or other defined actions
No general subscriber-growth rate, conversion benchmark, or return on investment is established for giveaways. Any forecast should come from your own campaign data or a study that matches your audience, channel, prize, and legal setup.
1. Define the audience, goal, and success measures
Decide what the promotion is meant to accomplish before choosing a prize. Possible goals include reaching prospective buyers, supporting a product launch, rewarding an existing community, or collecting qualified leads.

Describe the audience you actually want
Identify people who would plausibly buy or use your core offer. A broad audience may produce more entries but fewer relevant prospects. Write down the audience, the problem your offer solves, and the action you want after the giveaway.
Separate campaign metrics
Use a reporting sheet or dashboard that distinguishes entries from marketing subscribers and qualified leads. Record the entry source, consent status, and later actions so a large number of low-intent entrants does not appear to be list growth.
2. Choose a relevant, deliverable prize
Prize fit shapes who enters. A prize closely connected to your offer is more likely to attract people with a genuine interest than an unrelated, universally popular item. This is practical marketing guidance, not a quantified performance finding.
Check the operational trade-offs
- Relevance: Would your intended customer value it?
- Fulfillment: Can you obtain, ship, or deliver it as promised?
- Cost: Include taxes, shipping, service fees, and administration.
- Eligibility: Are there age, geographic, licensing, or other restrictions?
- Clarity: Can you describe the exact model, quantity, duration, and material limitations?
If another company supplies or sponsors the prize, disclose that relationship where applicable. Do not imply an endorsement or attribute that the prize does not have.

3. Publish rules and explain data use before promotion
Prepare the official rules and the entry-page disclosures before accepting entries. Make the following information easy to find:
- Sponsor or organiser identity and contact details
- Opening and closing dates, including the time zone
- Eligibility restrictions and excluded locations
- How to enter and any limits on entries
- Prize description, approximate value where required, and material restrictions
- Winner-selection method, verification steps, and notification process
- What happens if a selected entrant is ineligible or cannot be reached
- How entry information is collected, used, protected, retained, and deleted
- Platform-specific disclosures or disclaimers
Review the promotion in every jurisdiction where entries will be accepted. Whatnot’s Giveaway Rules & Requirements help page illustrates the platform-specific approach: it requires official rules and says the organiser remains responsible for compliance wherever the promotion runs. Those requirements do not replace local law.
Keep entry separate from marketing permission
Do not hide a newsletter offer inside the entry mechanism or suggest that entering automatically authorises unrelated marketing. Use a clear, separate choice where the applicable law requires consent, and store the wording, timestamp, source, and choice.
The UK Information Commissioner’s Office (ICO) states: “You must not send marketing emails or texts to individuals without specific consent.” Its Electronic mail marketing guidance describes a limited soft opt-in for certain existing customers and says the opportunity to opt out should be clear when details are collected and in every message. The ICO notes that its detailed guidance is under review following UK law changes, so verify the current position for your campaign.

4. Build an auditable entry and email workflow
A reliable setup normally contains an entry form, an official-rules page, consent capture, an email system that stores each person’s choice, and a documented winner-selection process.
- Design the form: Request only information needed to administer the giveaway and, if separately chosen, the marketing programme. Make it usable on mobile and accessible.
- Show the disclosures: Place links or readable text for the rules, privacy explanation, and marketing choice at the point of entry.
- Record the choice: Save the consent wording or version, timestamp, entry source, and whether the person opted in. Keep entrants who did not opt in in a separate segment.
- Confirm entry: Send an administrative confirmation if useful, and make clear whether it is transactional or promotional.
- Protect the data: Limit access, use appropriate security controls, and follow the retention or deletion period stated in your notices and required by applicable law. There is no universal retention period supplied for all giveaways.
- Prepare selection records: Preserve the closing time, eligible-entry list, selection method, result, verification, and fulfilment evidence.
Flodesk’s permission guidance is an example of a provider policy: it says the service is for emailing people who have already clearly permitted marketing email. A provider’s rule is not a substitute for your legal assessment.
5. Promote the giveaway without misleading people
Use channels whose current terms permit your promotion and entry method. Social-network and giveaway-service rules are platform-specific and can change, so check them before launch.
- Describe the prize, dates, eligibility, and entry steps accurately.
- Do not promise winning odds, endorsements, results, or prize features that are not true.
- Use any required platform disclaimer in the specified location and wording.
- Be cautious with “refer friends” or forwarding incentives. The Federal Trade Commission (FTC) notes that offering a benefit for forwarding commercial email or generating referrals can create CAN-SPAM responsibilities.
- Do not design sharing mechanics that pressure people to send unsolicited commercial messages.
6. Close entries and select the winner as promised
- Stop accepting entries at the published date and time.
- Apply the eligibility and entry-limit rules consistently.
- Use the selection method stated in the official rules, and document it.
- Contact the potential winner using the process and deadline in those rules.
- Verify eligibility, obtain any required confirmation, and arrange delivery.
- Record an alternate selection or failed-contact procedure only if the rules allow it.
Winning does not itself create permission for marketing. Add the winner to promotional mail only on the same valid consent basis and with the same disclosures that apply to other entrants.

7. Send follow-up email based on permission and location
United States
For commercial email covered by CAN-SPAM, the FTC’s CAN-SPAM Act: A Compliance Guide for Business requires accurate sender identification and headers, truthful subject lines, a valid postal address, and a working opt-out method. Opt-out requests must be honoured within 10 business days. Hiring an email service does not transfer the marketer’s compliance responsibility.
United Kingdom
For UK individuals, ICO guidance generally requires specific consent for marketing email, subject to the limited soft opt-in for a qualifying existing customer. Provide a clear opt-out when collecting details and in every marketing message, and assess related UK data-protection obligations for your particular campaign.
Other locations
US CAN-SPAM and UK electronic-marketing guidance do not cover every country, recipient type, or promotion structure. If entries are international, determine the applicable rules for each audience before launch rather than applying one country’s standard everywhere.
Make the first message match the expectation
Segment recipients according to what they selected. A first email can confirm the outcome, explain what they will receive, and provide the promised content. Keep the unsubscribe path obvious and avoid adding people who supplied an address only for administration.

How to choose the entry and email tools
Compare tools against the workflow you need rather than choosing on entry volume alone.

- Publishing rules after promotion starts or omitting the time zone.
- Collecting more personal data than administration requires.
- Failing to document consent and the winner-selection result.
- Assuming a platform’s terms replace local promotion, privacy, or email law.
- Using a service provider as if it assumed your compliance obligations.
- Reporting raw entries as proof of list quality or revenue.
