You can change health insurance after a bad insurer experience, but a denied claim, rude service, or slow payment usually does not create an immediate right to switch. Keep your current coverage active while you identify the problem, use the correct appeal or complaint channel, and check whether Open Enrollment or a Special Enrollment Period (SEP) makes a change possible. Do not cancel the old plan until the replacement enrollment is accepted, its effective date is confirmed in writing, and any required first premium is paid.
Start by identifying what actually went wrong
The remedy depends on whether the insurer made a coverage decision, treated you improperly, or ended your policy. Using the wrong process can cost you time and, if you cancel prematurely, create an uninsured gap.
Denied claim, treatment, prescription, or prior authorization
This is an appeal issue. The insurer must explain why it denied the request and tell you how to file an internal appeal. A denial can involve a claim for care you already received, a refusal to authorize planned care, a prescription decision, or a determination that a service is not covered. Preserve the denial notice and its stated deadline.

Poor customer service, access, or quality of care
Long waits, discourteous conduct, inaccessible call centers, inaccurate directories, or problems obtaining medically appropriate care are generally handled as a grievance or complaint. A complaint does not automatically overturn a coverage denial. Medicare.gov draws the distinction plainly: file a complaint about the quality of care you got or are getting, and file an appeal when a plan refuses to cover a service, supply, prescription, or claim.

Coverage termination or cancellation notice
First determine the stated reason and the date coverage ends. For certain application-error cancellations, HealthCare.gov guidance says the insurer generally must give at least 30 days’ notice, giving you time to appeal or obtain other coverage. Intentional misrepresentation and nonpayment are separate grounds and follow different rules. Never assume a cancellation notice means you can enroll in any plan immediately; verify the applicable SEP or other enrollment path.
When you can change a Marketplace plan
Open Enrollment
On the federal Marketplace, the annual Open Enrollment window is November 1 through January 15, according to current HealthCare.gov guidance. During this window you can select a new plan for the next coverage year without proving a qualifying event. State-run Marketplaces can publish different dates, so use your state Marketplace calendar if it operates its own platform.
Special Enrollment Periods
Outside Open Enrollment, you generally need a qualifying life event or a listed complex situation. Common events include losing other qualifying coverage, moving, getting married, or having a baby. Many SEPs provide 60 days to enroll, although the exact window and documentation depend on the event. Losing COBRA in circumstances recognized by Marketplace rules can also qualify; voluntarily ending COBRA early usually does not create the same right.
Appeals that create an enrollment option
A successful Marketplace eligibility appeal can produce an enrollment or plan-change opportunity. HealthCare.gov also says that if you are already enrolled and receive an SEP, you can usually stay in your current plan or switch plans. Read the eligibility notice carefully: it may specify the event date, documents required, plans available, and the last day to act.
Appealing an eligibility notice
HealthCare.gov’s current guidance generally allows 90 days to appeal a Marketplace eligibility determination. This is different from the deadline for appealing a medical claim. Submit the eligibility appeal through the method and address in the notice, and retain proof that it was received.

What employer-plan members can and cannot do
Job-based plans commonly restrict midyear changes to Open Enrollment or a permitted status change, such as losing other coverage, marriage, birth, adoption, or a change in employment status. A bad call-center interaction or a single denied claim normally does not let you drop the plan immediately. Ask your human-resources or benefits administrator for the plan’s Summary Plan Description, qualifying-event rules, and deadline for submitting a change.
If the dispute concerns how an employer plan was administered, the U.S. Department of Labor’s Employee Benefits Security Administration can explain federal rights and complaint routes. Keep in mind that self-funded employer plans may be regulated differently from fully insured plans, so the correct regulator depends on the plan structure.

For Medicare Advantage or a Medicare prescription drug plan, use an appeal when the plan refuses to cover a service, supply, prescription, or claim. Use a complaint (also called a grievance) for quality, treatment, communication, or other service problems. Medicare.gov’s State Health Insurance Assistance Programs (SHIPs) provide free, local counseling and can help you identify the appropriate filing route and enrollment period.
A plan change may be available during a Medicare election period or after a qualifying event, but the dates and choices depend on whether you have Original Medicare, Medicare Advantage, or Part D coverage. Confirm the effective date of any new election before ending existing supplemental or drug coverage.
Use the appeal process before abandoning coverage
HealthCare.gov states that when an insurer refuses to pay a claim or ends coverage, you have the right to appeal and have the decision reviewed by a third party. Start with the internal appeal unless the notice or your state rules allow another route.

Internal appeal deadlines and decision times
HealthCare.gov guidance generally gives you 180 days (six months) after a claim denial to request an internal appeal. The denial notice controls if it sets an earlier date under the governing plan rules, so check it immediately.
| Situation | Insurer notice or decision timeframe | What you should do |
|---|---|---|
| Prior-authorization request | Generally 15 days for the insurer to decide | Submit clinical records and the ordering clinician’s rationale with the request. |
| Care already received (retrospective claim) | Generally 30 days for the insurer to decide the internal appeal | Attach the denial, itemized bill, explanation of benefits, and relevant medical records. |
| Urgent-care request | Generally 72 hours for the insurer to decide | Ask the clinician to document why waiting could seriously jeopardize health or recovery. |
| Completed internal appeal for prospective care | Generally up to 30 days | Track the submission date and request written confirmation of receipt. |
| Completed internal appeal for a retrospective claim | Generally up to 60 days | Continue monitoring bills and provider collection notices while the appeal is pending. |
These are general federal Marketplace timeframes; state law, plan type, and the urgency classification can change the details. If the denial is based on missing information, ask exactly what documentation would cure the problem and whether the appeal can be reopened after you supply it.
Build a persuasive appeal file
- Read the denial and identify the precise reason, such as an exclusion, medical-necessity determination, coding error, network rule, or missing prior authorization.
- Call the number on the denial only to clarify requirements; record the representative’s name, date, reference number, and promised next step.
- Ask the treating clinician for a letter that connects the requested service or medicine to your diagnosis, prior treatment, urgency, and accepted alternatives that have failed or are unsuitable.
- Include the denial notice, explanation of benefits, clinical notes, test results, prescriptions, bills, and any policy language supporting coverage.
- Send the appeal through the permitted portal, fax, mail, or designated phone process. Keep a complete copy and proof of delivery.
- Continue paying premiums and follow care instructions while the review is pending. An appeal does not extend a premium grace period or guarantee that a provider will wait for payment.
Request an external review when the denial is upheld
If the insurer upholds the internal denial, you may be entitled to an independent external review under applicable federal or state rules. The external reviewer is not employed by the insurer and can overturn the decision when the request meets the legal standards. The denial letter should explain eligibility, the filing deadline, and where to send the request.
Urgent cases can qualify for expedited external review. HealthCare.gov guidance states that, when the standards are met, an expedited external review can take no more than 72 hours after the request is received. Ask the clinician to explain the medical risk of delay and mark the request as urgent. An external review addresses the disputed coverage decision; it does not by itself move you into a different plan.
If the insurer is ending your coverage
Match the termination reason to the rules before choosing a replacement. For a specified application error, the generally required notice is at least 30 days. For nonpayment, check the grace-period language and pay any amount due if you intend to keep the policy. For alleged intentional misrepresentation, gather the original application and correction evidence and use the appeal route in the notice.

Ask for the exact termination date, the months of premium the insurer says are unpaid, the policy provision it relied on, and whether claims incurred before termination remain subject to processing. If the notice appears unlawful or the insurer refuses to explain it, contact your state Department of Insurance or Consumer Assistance Program while preserving the appeal deadline.
Compare a replacement plan on total exposure and access
A lower premium can still leave you worse off if the deductible, coinsurance, network, or drug rules make care inaccessible. Compare the following items side by side for the same coverage year.
| Comparison item | Questions to answer before enrolling |
|---|---|
| Eligibility and timing | Why are you eligible now, what documents prove it, and when can the new coverage start? |
| Premium and annual cost | What is the monthly premium after any subsidy, and what is a realistic annual total after premiums, deductible, copays, and coinsurance? |
| Deductible and out-of-pocket maximum | When does cost sharing begin, what services are exempt from the deductible, and what expenses count toward the annual maximum? |
| Doctors and hospitals | Are your primary doctor, specialists, preferred hospital, laboratories, and emergency facilities in network for this exact plan? |
| Prescription formulary | Are every medication and dosage covered, at what tier, and with what quantity limits, step therapy, or prior authorization? |
| Behavioral-health access | Can you obtain in-network therapy, psychiatry, substance-use treatment, and urgent behavioral-health care within a reasonable distance and wait time? |
| Referrals and prior authorization | Does the plan require referrals or authorization for the services you use, and who submits the paperwork? |
| Grievance and customer support | What phone, portal, language, accessibility, and written-complaint channels are available, and how are escalations tracked? |
| Continuity of care | Can you finish an active course of treatment, pregnancy, surgery plan, or cancer protocol with your current clinicians if they leave the network? |
| Effective date and transition | Does the new plan begin before the old one ends, and how will prescriptions, referrals, authorizations, and medical records transfer? |
Verify doctors and medicines directly with the new insurer or plan administrator. Online directories can be outdated, and a provider may be listed for one product but not the specific network attached to your replacement plan. Ask the provider’s billing office to confirm the exact plan name and network, then obtain the insurer’s confirmation in writing when possible.
Switch without creating a coverage gap
- Keep the current policy active while you appeal, complain, or apply for a new plan.
- Confirm that you have a valid Open Enrollment or SEP pathway and note the final submission date.
- Submit the application and every requested eligibility document promptly.
- Wait for written acceptance or an enrollment confirmation, not merely a completed web form.
- Confirm the new plan’s effective date and whether coverage is retroactive, prospective, or dependent on a qualifying event date.
- Pay the first premium by the stated deadline. An approved application can be terminated for nonpayment.
- Give doctors, pharmacies, and hospitals the new member ID and ask them to verify benefits before scheduled care.
- Only then request termination of the old policy, following its cancellation rules. Keep the final bill and termination confirmation.
Store denial letters, eligibility notices, enrollment confirmations, premium receipts, explanations of benefits, medical records, prescriptions, portal screenshots, and a call log with dates and reference numbers. These records protect you if the new plan says an authorization was never transferred or the old insurer later disputes the termination date.
Get neutral help when the insurer does not respond
- Marketplace individual coverage: HealthCare.gov directs consumers to state Consumer Assistance Programs and Departments of Insurance for help with appeals, complaints, and enrollment problems.
- Employer coverage: Contact the U.S. Department of Labor’s Employee Benefits Security Administration when the issue involves a job-based plan or benefits administration.
- Medicare: Contact a SHIP counselor for free, local guidance on grievances, appeals, and election periods.
- Licensed enrollment assistance: A licensed broker or certified Marketplace assister can compare available individual plans, explain networks, and identify documents needed for an SEP. Verify the person’s license, state availability, and whether advice is limited to particular insurers.
When escalating, state the outcome you want—reversal of a denial, correction of a billing error, continuation of treatment, or confirmation of enrollment—and attach a one-page timeline. Agencies can act more quickly when the dates, policy number, denial reason, and requested remedy are clear.

How the decision looks in common situations
A claim was denied, but you have no qualifying event
Keep the plan, file the internal appeal within the stated deadline, and request external review if the denial is upheld. A denial alone generally does not open a Marketplace SEP. You can compare other plans during Open Enrollment, but switching immediately would risk a gap unless another eligibility rule applies.
The insurer repeatedly gives inaccurate information
Document each interaction and file a grievance or complaint. If the misinformation caused a denied claim, appeal that claim separately with records showing what you were told. A customer-service complaint and a coverage appeal can proceed at the same time because they seek different remedies.
You lost employer coverage
Ask the employer for the official loss-of-coverage date and continuation options. Loss of qualifying coverage commonly triggers a Marketplace SEP, often with a 60-day window. Apply before the deadline, compare plans using the actual termination date, and keep continuation coverage active until the replacement effective date is confirmed.

Pick the symptom - the matching free tool is one click away.
You received a cancellation notice
Check the reason, notice period, and appeal instructions. If the cancellation is based on a specified application error, use the generally required 30-day notice period to appeal and shop for replacement coverage. Do not assume a cancellation caused by nonpayment or intentional misrepresentation receives the same treatment.
Quick Recap
Final decision checklist
- Have you classified the problem as an appeal, grievance, complaint, or termination dispute?
- Is your current coverage active and your premium paid?
- Have you identified Open Enrollment, an SEP, or another lawful enrollment path?
- Did you calendar the 90-day eligibility-appeal or 180-day internal-claim-appeal deadline that applies to your case?
- Did you compare total annual exposure, networks, drugs, authorization rules, behavioral-health access, and continuity protections?
- Do you have written acceptance, an effective date, and confirmation that the first premium was paid before canceling the old plan?
