Plan the giveaway before the stream
Choose a prize you can deliver
Decide exactly what the prize is: for example, a particular creator T-shirt or hoodie, not simply “merch.” For apparel, settle the available sizes and colors, where you will ship, who pays postage, and what happens if a chosen item or size is unavailable. State any geographic limits clearly.
Set eligibility and entry rules
Before entries open, decide who may enter, any minimum age, the entry start and close times, the number of entries allowed, and whether an account on the platform is required. State any exclusions you will apply, such as employees or family members, if relevant. Rules can vary by location, prize, and entry design; this guide is not jurisdiction-specific legal advice.
Write down how the winner will be selected—randomly or by judging—and how you will contact them, how long they have to respond, and what happens if they do not. Say what the prize includes and how it will be delivered. Publish the rules somewhere viewers can access before entering, and make the live explanation match those rules.

Keep the entry route free where required
YouTube requires contests to be free to enter and prohibits using a contest to manipulate views, likes, dislikes, or subscriber counts. Do not make a purchase, subscription, or engagement action a condition if it conflicts with the applicable rules. U.S. Federal Trade Commission guidance warns that sweepstakes requiring a purchase are illegal in the United States; state requirements may also include disclosures, registration, or a bond. Check the rules that apply to your locations and promotion design.
Write rules that fit the platform
YouTube
YouTube requires a set of official rules. Its contest policy also requires applicable disclosures, a privacy notice, a link to the YouTube Community Guidelines, and language explaining that YouTube is not the sponsor and releasing YouTube from contest liability. You remain responsible for complying with applicable federal, state, and local laws and for administering the contest and awarding the prize. Do not request full rights or ownership of an entrant’s submission, or imply that YouTube sponsors or endorses the giveaway. Read YouTube’s contest policies and guidelines before publishing your rules.

Twitch
Twitch places responsibility for legal compliance, rules, winner selection, prizes, expenses, and any required registration or bond on the promoter. Its Terms of Service require this disclaimer to be displayed or read aloud: “This is a promotion by [Your Name]. Twitch does not sponsor or endorse this promotion and is not responsible for it.” Twitch may remove a promotion it believes violates its terms or applicable law. See the Twitch Terms of Service.
Whatnot and other platforms
Whatnot’s in-app giveaway formats have their own mechanics. Its help page describes free standard giveaways, follower-only giveaways, and buyer appreciation giveaways; entry is in the app, random winners are announced during the show, and the seller pays shipping. These rules are specific to Whatnot and should not be copied into a YouTube or Twitch promotion. Check the rules of the platform you are actually using.

Run the giveaway during the livestream
- Explain the offer before entries open. Name the prize, eligibility limits, entry method, opening and closing time, winner-selection method, and where viewers can read the rules. Keep the explanation plain and consistent with the written terms.
- Open entries through the announced route. A chat keyword can be simple, but tell viewers exactly what to type and during which window. Explain how duplicate, late, or ineligible entries will be handled.
- Close entries on time. Stop accepting entries at the stated deadline. Do not quietly extend the window or change who qualifies after entries have begun.
- Draw or judge as promised. Use the method in your rules, then announce the next step and the channel through which the selected entrant should respond. Do not suggest a selection was random if it was judged, or vice versa.
- Repeat sponsor disclosures when applicable. If merch or another part of the stream is sponsored or gifted, clearly disclose that relationship. FTC guidance says livestream endorsements should be disclosed periodically so viewers who arrive partway through the stream see the disclosure. Twitch also requires use of its branded-content tool when applicable; that tool does not replace legal compliance.
For an optional Streamlabs workflow, its April 22, 2025 tutorial describes creating a merch store, enabling Cloudbot and its giveaway command, adding a merch giveaway, setting its duration and options, starting and closing the draw, selecting a winner, and collecting size, color, and shipping details through redemption. Treat this as vendor guidance, not a guarantee of current availability or legal compliance; confirm that the feature and its current terms suit your setup. See the Streamlabs merch giveaway tutorial.
Contact the winner and deliver the prize
- Contact the selected entrant privately through the channel stated in the rules. Verify only the eligibility details you said you would verify.
- Apply the response deadline and alternate process you announced. A 48-hour deadline appears in one StreamYard promotion’s U.S.-only rules, but it is an example—not a universal requirement. See the StreamYard official rules example.
- Collect only fulfillment details you need, such as size, color, and a shipping address. Do not ask the winner to post an address in public chat. Explain how you will use and retain the information, then follow that notice.
- Ship the prize and record completion. Keep an administration record consistent with your rules. If you announce that the prize was sent, do so without exposing the winner’s private information.
Protect entrant and winner information
Tell entrants what personal information you collect and how it will be used. For apparel, a winner may need to provide a size, color choice, and delivery address; those details are for fulfillment, not public chat or unrelated marketing unless you have a separate appropriate basis and have explained it. YouTube requires an appropriate privacy notice. StreamYard’s example rules say delivery information is used for fulfillment and deleted after shipment; that is one promotion’s policy, not a rule that automatically applies to yours.

Handle legal and sponsor obligations carefully
Platform policies do not replace local law. FTC small-business guidance is U.S.-focused and notes that state requirements may include disclosures, licensing, or a bond. Eligibility, geography, prize value, whether entry is based on chance or skill, and the entry mechanism can affect what applies. For a broad or high-value promotion, get advice specific to the jurisdictions involved rather than relying on a generic template.
If you endorse a sponsor or feature gifted merchandise, make the relationship hard to miss. FTC guidance recommends repeating a livestream disclosure periodically because viewers may join late.
