Yes—if you own a lawful physical copy, you can generally resell that disc or cartridge, trade it to a retailer, or lend the same copy to a friend in the United States. The practical choice is between a higher but slower private-sale payout, a faster retailer offer that may be cash or store credit, and a temporary loan with no sale proceeds. Digital purchases are different: storefront terms commonly grant an account-bound license rather than ownership of a transferable object.
Before handing over a game, identify the exact edition and region, test it, disclose missing or redeemed codes, and check the current retailer policy and local law. Do not sell copied files, burned discs, downloaded ROMs, or an account containing digital games as if they were the original physical product.
What you are actually transferring
A physical disc or cartridge
For U.S. readers, 17 U.S.C. §109(a) generally allows the owner of a lawfully made copy to sell or otherwise dispose of possession of that particular copy without getting the copyright owner’s permission. In practical terms, the person who lawfully owns an original game disc or cartridge can normally transfer that object to another person. The transfer is of the copy, not of the copyright, source code, artwork rights, or a right to manufacture more copies.
The rule is tied to the specific copy. A buyer receives the disc or cartridge you listed, together with whatever original packaging and physical inserts you actually include. A borrowed copy remains the lender’s property. Neither transaction authorizes copying the game, extracting its files for distribution, or transferring an account that contains unrelated digital purchases.

Digital storefront content
Digital transactions commonly work as licenses attached to an account. For example, PlayStation’s current U.S. terms state that a Store purchase is a personal license for private, non-commercial use. Those terms also say content may not be sold, rented, leased, loaned, sublicensed, or transferred except where the terms or local law expressly allow it. The terms explain that words such as “own,” “purchase,” and “sale” do not transfer ownership of the software or content.
That language should not be applied automatically to every physical disc. Ask what was purchased, which account holds it, and which platform terms govern it. A physical game can change hands as an object even when a digital download of the same title remains tied to the original account.
Copies, backups, and archival files
The U.S. Copyright Office’s guidance on computer programs says a lawful archival copy must be transferred with the original copy and may not be sold separately. That means a downloaded file, burned disc, copied ROM, or “backup” file is not a substitute for the original physical game in a sale or trade. Keep any archival copy with the original only as the law permits, and do not distribute it to a buyer or borrower.

Which route fits your goal?
The right route depends less on the title’s launch price than on the value of your time, the item’s condition, and whether the buyer wants collectible packaging or merely a working game.

Prepare the game before it changes hands
Identify exactly what you have
- Record the platform—such as PlayStation 5, Xbox, or Nintendo hardware—and the precise title.
- Distinguish the edition, release region, cartridge or disc format, and any bundle or collector packaging.
- Separate physical contents from account-bound extras. Treat redeemed DLC, online passes, subscriptions, and used download codes as unavailable unless you can prove a code is unused and transferable.
- Note whether the original case, cover art, manual, inserts, map, steelbook, or other packaging is present. These details can matter to collectors and to a retailer’s inspection.
Test the copy on compatible hardware
Insert the disc or cartridge into compatible hardware and confirm that it boots, reaches the main menu, and behaves normally during a short play session. Check that a save can be created if the game supports local saves. Record whether an update, internet connection, platform subscription, or account sign-in is required for particular features. A test cannot prove that every console or online service will work, but it lets you describe the basic behavior honestly.
Inspect and clean without creating damage
Look for fingerprints, residue, scratches, dents, cracks, label lifting, bent contacts, or a case that no longer closes. Remove loose dust with a soft, dry, lint-free material suitable for the surface. Do not use abrasive substances, spray liquid onto electronics, or attempt a repair that could make a readable disc or cartridge unsafe. Cleaning may remove smudges or residue; it cannot guarantee that a deeply scratched disc will work or that a retailer will accept it.

Photograph the evidence
Take clear pictures of the disc or cartridge label, the case, cover art, rating label, serial or barcode where appropriate, and every included item. Keep personal account names, console identifiers, shipping labels, and redemption codes out of the frame. These photos document condition for a listing and help resolve a dispute about what was included.
How to sell a game privately
Choose a permitted sales channel
Use a marketplace, local classified listing, or in-person route that permits used physical games in your country. Read the service’s current rules for prohibited items, payment timing, buyer protection, returns, shipping, tracking, and seller fees. The rules differ by service and jurisdiction, so do not assume that a private sale has the same protections as a retailer trade.
Write a complete listing
Put the platform and exact edition in the title. State whether the copy is region-specific, whether the case and manual are included, and whether any DLC or online code has already been redeemed. Describe visible wear in plain language and include the test result, such as “boots to the menu; local save tested.” If online play requires a subscription or an account-linked entitlement, say so rather than implying that the physical copy includes it.
Set a defensible price
When completed-sale data is available, use it rather than optimistic asking prices. Calculate the amount you will actually keep:
Net proceeds = sale price − marketplace fee − payment fee − postage − packing − expected return cost.
Rare editions, complete packaging, manuals, inserts, and genuinely unused codes can raise value. A common disc with a damaged case may sell faster at a lower price. No single current payout table covers every title, platform, region, and date, so treat any estimate as a snapshot rather than a promise.

Pack and dispatch safely
Keep the disc in its case or the cartridge in a protective holder, then use a rigid mailer or padded packaging that prevents bending and scratching. Photograph the sealed parcel and retain the tracking number when the service offers tracking. For a local handoff, meet in a public place and confirm payment before releasing the item, consistent with the platform’s rules.
Handle returns and disputes with the listing as your baseline
Save the original photographs, description, messages, and postage receipt. If a buyer reports a problem, ask for a photo or video showing the disc or cartridge and the error, while avoiding requests for their account password. Follow the marketplace’s dispute process; do not promise a refund outside its rules unless you are prepared to honor it.
How a retailer trade-in works
Start with the store’s current estimator
Retailer websites may show an estimated value, but the estimate is not a guaranteed offer. Availability varies by location, and the final decision is made after an associate inspects the item in the store. Check the exact title and platform before traveling.

For a standalone game, bring the original disc or cartridge and its case, cover art, and manuals when available. For a console bundle, a retailer such as GameStop gives the example of bringing the console, power cable, HDMI cable, and the Sony wireless controller. Missing components can reduce the value or prevent the trade. Bring identification or other documentation if the store’s current policy requires it.
Understand the inspection standard
GameStop’s support guidance says eligible items should be fully functional, safe to handle, and free from major physical damage. Scratches, smudges or residue, dings, and ordinary cosmetic wear can reduce value. Smoke damage, strong odors, cracks that make an item unsafe or unusable, pests, or non-functionality can lead to rejection. The store’s inspection—not an online estimate—determines acceptance and value.
Choose cash or credit deliberately
Ask for both options before accepting the offer. Store credit may be worth more on the receipt but is usable only under the retailer’s terms and may expire or exclude certain transactions. Cash is more flexible but can be lower. Check the printed or electronic receipt before leaving and confirm whether any component was marked missing.

Know what refurbishment means
GameStop’s 2022 Form 10-K describes a trade-in program that exchanges pre-owned gaming products for cash or in-store credit and refurbishment centers that test, repair, sanitize, repackage, and redistribute used products. The filing reported 4,573 stores worldwide as of January 29, 2022; that is a historical figure, not a current store count or a guarantee that a location near you accepts a particular game.

Keep the loan temporary and specific
A person who owns the particular physical copy can normally hand that copy to a friend temporarily with an understanding that the same copy will be returned. Write down or message the return date, especially if you plan to sell or trade the game soon. Keep the case and disc or cartridge together, and do not lend a copy that is already promised to a buyer.
Explain what the borrower is—and is not—getting
The borrower receives possession of the object for the agreed period, not copyright ownership and not permission to duplicate it. Do not transfer your platform account, share passwords, or represent that the borrower owns the game permanently. Commercial rental, leasing, or lending raises more technical issues under 17 U.S.C. §109(b). That provision concerns commercial software rentals, while its statutory exception for programs embodied in limited-purpose computers designed for playing video games is distinct from running a rental business. A casual personal loan should not be described as a commercial rental program.
Set expectations for online and region features
- A disc or cartridge may start the game while DLC remains tied to the lender’s account.
- A redeemed online pass or download code normally does not travel with the physical object.
- Online multiplayer may require the borrower’s own platform subscription and account.
- Region restrictions, required updates, server shutdowns, and language options can affect play.
- Save data may remain on the borrower’s console or account rather than on the cartridge or disc.
Tell the borrower about these limits before handing over the game. Agree who pays for shipping if the loan is remote and what happens if the copy is lost or damaged.

With a physical game, the transferable thing is a particular manufactured object. Once you sell it, you no longer possess that copy; once you lend it, you expect that same copy back. With a digital game, the platform can authenticate an account, restrict simultaneous use, and reserve the right to limit transfer under its terms. A family-sharing feature, console designation, or account workaround is therefore platform-specific and may change when the terms change. It is not evidence that a general resale right exists.

When a trade-in is rejected or a sale goes wrong
The retailer rejects the game
Ask which condition or component caused the rejection. If the issue is residue, clean the exterior with a material-safe dry method and request a reinspection where the policy allows. If the disc is cracked, the cartridge contacts are damaged, the item smells strongly of smoke, or it fails to boot, do not conceal the defect; repair or replacement may cost more than the game is worth, and acceptance is never guaranteed.
The buyer says the game does not work
Compare the buyer’s report with your test notes and photographs. Ask whether the hardware is compatible, whether the required update completed, and whether the problem concerns an online entitlement rather than the disc or cartridge. Work through the marketplace’s return or dispute process instead of sending account credentials or a replacement digital file.
The buyer expected DLC or an online pass
Point to the listing language and the photograph of the included contents. A redeemed code cannot be recreated by copying the disc. If the listing was unclear, resolve the dispute under the platform’s policy and revise future listings to state “code redeemed” or “no code included.”
The borrower has not returned the copy
Send the agreed return date and the original loan terms in writing. If the copy is lost or damaged, discuss a replacement based on the title’s current used value and the condition documented at the loan. Do not retaliate by accessing the borrower’s account or attempting to disable their console.
A practical decision checklist
- Choose a private sale when you can photograph, list, pack, and wait for a buyer and the edition or packaging may attract a premium.
- Choose a trade-in when speed, a single inspection, and a predictable handoff matter more than maximizing cash, and you accept the retailer’s offer or restricted credit.
- Choose a loan when you want a friend to play the physical copy and expect it back by a defined date.
- Pause if the item is account-bound, copied, missing a required physical component, region-incompatible, or legally restricted in your location.
Before completing any route, verify the current retailer or marketplace terms and the law that applies where the transaction occurs. Prices, taxes, shipping, consumer protections, acceptance standards, and platform rules can change by country, state, title, edition, and date.
