Reply to a GST show-cause notice for excess input tax credit (ITC) by working from the complete notice, not just its portal summary. First record the cited section, tax periods, allegation, calculation, proposed interest and penalty, issuing officer, and deadline. If the notice summary is in FORM GST DRC-01, submit the response in FORM GST DRC-06 under rule 142(4). If you have received a pre-notice intimation in FORM GST DRC-01A, make submissions in Part B under rule 142(2A).
Then reconcile every disputed credit to the relevant return, purchase register, invoice or debit note, supplier evidence, ledger, payment record, and reversal or attribution working. State separately what you accept, dispute, have already reversed or paid, or say is protected by a statutory exception. A general denial without a line-by-line explanation rarely answers the grounds in the notice.
Start with a notice-control sheet
Before drafting, download and preserve the full notice, every attachment, the electronic summary, and any earlier communication. The summary in DRC-01 is not a substitute for reading the grounds and computation in the notice itself.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors- Identify the taxpayer. Record the GSTIN, legal name, case or reference number, officer, and jurisdiction exactly as shown.
- Identify the legal route. Note whether the notice cites section 73 or section 74, and record every other provision mentioned.
- Mark the periods. List each financial year, return period, invoice period, or adjustment period covered.
- Copy the allegation. Separate mismatch, blocked or ineligible credit, attribution or reversal, duplication, payment-related issue, timing, or any other stated ground.
- Reproduce the computation. Capture tax, interest, penalty, the disputed ITC, and how the officer reached each total.
- Record the response date. Include a hearing date if one is given and note the portal status.
- List departmental evidence. Note every document, statement, return comparison, or report cited by the department.
- Preserve chronology. If DRC-01A came first, keep it with the later notice and any Part B submission. Save the download date and an unaltered copy of each file.
This sheet prevents a common mistake: answering the amount shown in a summary while overlooking a separate ground, period, or penalty theory in the detailed notice.

Choose the correct procedural stage and form
| Stage | Communication | Where to submit | Rule and practical action |
|---|---|---|---|
| Pre-notice ascertainment | FORM GST DRC-01A | Part B of DRC-01A | Rule 142(2A) permits submissions against the proposed ascertainment. Answer the proposed amount and grounds before a formal notice is issued. |
| Formal show-cause notice | Notice with summary uploaded in FORM GST DRC-01 | FORM GST DRC-06 | Rule 142(4) ties DRC-06 to a notice whose summary has been uploaded electronically in DRC-01. Address the complete notice and attach an indexed reconciliation. |
| Order after adjudication | Order summary in FORM GST DRC-07 | Later appeal or other remedy applicable to the order | Compare the reasoned order and DRC-07 with the notice and reply. An appeal is a distinct stage; review the actual order and the applicable statutory deadline promptly. |
Do not file DRC-06 merely because any GST message mentions excess ITC. Confirm that the communication is a formal notice and that its summary is in DRC-01. A DRC-01A submission is not the same procedural step.
Work out what “excess ITC” means in this notice
“Excess ITC” is a description, not a complete legal ground. The notice may be alleging one problem or several. Match each allegation to its own evidence and calculation.
| Possible allegation | Reconciliation to perform | Evidence that may answer it |
|---|---|---|
| Return or supplier mismatch | Compare the notice line, period, return figure, purchase register, and supplier details. Identify whether the difference is timing, a correction, a credit note, or a genuine omission. | Relevant return, purchase register, invoice or debit note, supplier return evidence where relevant, and the ledger. |
| Blocked or otherwise ineligible credit | Identify the exact statutory restriction alleged and test each invoice against the stated facts and business use. | Invoice, description of goods or services, accounting treatment, and records showing the business purpose. |
| Attribution or reversal | Reperform the allocation or reversal for the affected period using the method applicable to the allegation. Show the portion retained and the portion reversed. | Attribution or reversal working, source ledger, return entry, and supporting invoices. |
| Duplicate credit or duplicate document | Trace each disputed entry to the invoice or debit note and search the ledger and returns for a second claim or reversal. | Invoice register, ledger extract, credit-note records, and proof of any reversal. |
| Payment or accounting issue | Check the amount recorded, the period claimed, and whether the notice says the credit was reversed, unpaid, or otherwise unsupported. | Ledger, payment or account evidence, invoice, and the return in which the credit or reversal was reported. |
| Late availment under section 16(4) | Determine the relevant financial year, the date credit was taken, the annual-return date if relevant, and the cutoff stated in the law. Check whether a statutory exception applies. | Invoice date, return filing record, annual-return record where relevant, and a calculation applying the applicable provision. |
The same invoice can appear under more than one theory. If the notice relies on both timing and another ineligibility ground, answer each ground separately rather than assuming that a timing amendment resolves the entire demand.

Use one row for each disputed invoice, debit note, credit note, return period, or adjustment, depending on how the notice is organized. Reconcile your totals to the notice; do not submit a large export without showing what it proves.

|---|---|
| Notice allegation and reference | The notice paragraph, annexure, or line number and the ground asserted. |
| Notice period and amount | The tax period and ITC amount used by the officer, with interest or penalty kept separate. |
| Taxpayer ledger or return amount | The amount actually recorded or claimed and the return in which it appears. |
| Invoice or debit-note details | Document number, date, supplier, taxable value, tax, and the relevant accounting entry. |
| Supplier and return evidence | Supplier details and return evidence where the allegation concerns a reported mismatch. |
| Business use or attribution basis | The facts and working supporting eligibility, allocation, or reversal where those issues are raised. |
| Duplicate, reversal, or payment status | Whether the item was duplicated, reversed, paid, or already settled, with the related period and record. |
| Taxpayer position | Accepted, partly accepted, disputed, or already reversed or paid, followed by a short reason. |
| Annexure number | The exact attachment that proves the entry and the page or row reference within it. |
After completing the rows, total each category and compare it with the notice total. If your figure differs, show the arithmetic and explain whether the difference comes from an omitted period, a duplicate entry, a credit note, a reversal, or a legal classification. Ask the officer to consider only the balance that remains genuinely disputed.
Distinguish section 73 from section 74
Read the cited section and the facts pleaded for invoking it. Section 74 concerns tax not paid or short paid, erroneous refund, or ITC wrongly availed or utilised by reason of fraud, wilful misstatement, or suppression of facts to evade tax. Section 74(1) states: “Where it appears to the proper officer that any tax has not been paid or short paid or erroneously refunded or where input tax credit has been wrongly availed or utilised by reason of fraud, or any wilful-misstatement or suppression of facts to evade tax, he shall serve notice on the person chargeable with tax…” Read that sentence with the current CGST Act text and the particular facts in your notice.
A section 74 reply therefore has two distinct jobs:

- Answer the fraud-related assertion. Identify the conduct the notice calls fraudulent, wilfully misstated, or suppressed; explain the contemporaneous records and disclosures; and address the evidence relied on by the officer.
Do not make an unsupported admission about intent merely to settle a numerical discrepancy. Conversely, do not ignore a live section 74 allegation by arguing only that the invoice exists. Section 75(2) deals with a later finding in specified appellate or court proceedings that the fraud-related charge has not been established, in which case tax is determined as if the notice were under section 73. It is not a reason to disregard a current section 74 notice.

Check the 2024 section 16(5) and 16(6) changes carefully
Section 16(4), as reproduced in Circular 237/31/2024-GST, sets a general cutoff for taking credit after 30 November following the relevant financial year or furnishing the relevant annual return, whichever is earlier, subject to statutory exceptions. The Finance (No. 2) Act 2024 inserted subsections 16(5) and 16(6) retrospectively from 1 July 2017 for specified cases.
First identify whether the notice denies credit solely because of section 16(4). Check the invoice period, the date credit was claimed, and the precise statutory exception against the wording of the notice. Do not describe the retrospective provisions as a blanket waiver for all excess-ITC disputes.
Circular 238/32/2024-GST clarifies that an amount may be deducted from a notice, statement, or order under section 73 on the basis of subsections 16(5) or 16(6) only where the ITC was denied solely for contravention of section 16(4). If another ground independently supports denial, the timing change does not eliminate that part of the demand.

Collect attachments that prove each answer
Organize attachments in the order of the reconciliation, not as an unlabelled data dump. An index should identify the annexure, document range, period, and allegation it supports.
Core records
- Complete notice, DRC-01 summary, or DRC-01A communication, including departmental annexures.
- Relevant GST returns and the working paper from which the disputed ITC was taken.
- Purchase register, invoice register, and the taxpayer’s ledger for each disputed period.
- Invoices, debit notes, and credit notes linked to each reconciliation row.
- Supplier details and supplier return evidence where the allegation is a mismatch.
Ground-specific records
- Attribution or reversal workings where common credit, business use, or another allocation rule is alleged.
- Proof of duplicate detection, reversal, or payment where the notice says the credit was duplicated, reversed, unpaid, or already settled.
- Records supporting the timing calculation, including invoice and return dates and the annual-return record where relevant.
- Accounting and business-use evidence where eligibility or a blocked-credit issue is raised.
Procedural records
- Any earlier DRC-01A Part B submission and the department’s response.
- Portal acknowledgements, uploaded-file confirmations, and hearing communications.
- A calculation sheet that ties the annexure totals to the amount admitted, disputed, reversed, or paid.
Every attachment should have a purpose stated in the reply. If a record does not prove an identified allegation, leave it out or explain its limited relevance.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Draft the reply in a predictable sequence
- Heading and authority. State the GSTIN, legal name, notice reference, date, issuing officer, and the form in which you are replying.
- Preliminary statement. Confirm the periods and amount understood from the notice. If any detail is inconsistent between the detailed notice and DRC-01, identify the inconsistency rather than silently choosing one figure.
- Ground-by-ground response. For each allegation, state what the department asserts, whether you accept, partly accept, or dispute it, the facts and legal basis, your calculation, and the annexure proving it.
- Accepted or already settled portion. Identify the exact period and amount accepted, reversed, or paid and attach the proof. Ask that only the unresolved balance be considered.
- Section 74 response where applicable. Address each alleged act of fraud, wilful misstatement, or suppression and the evidence cited. Do not leave the intent allegation unanswered.
- Relief and hearing request. Ask for dropping of the unsupported amount, correction of arithmetic, recognition of reversals or payments, and a personal hearing where oral clarification is necessary. State the issues that require hearing rather than making a bare request.
A useful paragraph for each line follows this order: “The notice treats the item as [the stated ground]. The taxpayer [accepts, partly accepts, or disputes] that treatment because [the material fact and legal reason]. The recalculated amount is [the amount shown in the attached working], supported by Annexure [the identified record].” If you use variable wording in a template, replace it with the actual notice reference and evidence before filing.

File the response and preserve proof
- Use the submission route specified for the procedural stage: Part B of DRC-01A for a pre-notice intimation or DRC-06 for a notice summarized in DRC-01.
- Upload the signed reply, reconciliation, and indexed annexures in the formats and size limits currently shown on the GST portal.
- Submit by the deadline stated in the notice. If a hearing is listed, preserve the communication and prepare the same reconciliation for oral explanation.
- Download the filed reply, acknowledgement, submission number, and uploaded attachments immediately after filing.
- Keep a read-only copy of the exact package and a chronology of later communications.
Portal labels and upload requirements can change. Verify the current screen instructions when filing, but do not change the legal form merely because a portal menu uses a different description.
What happens after the reply
The officer may consider the written explanation, request clarification, conduct a hearing, or issue an order. Rule 142 provides for an order summary in DRC-07. When DRC-07 is issued, compare the confirmed demand with the original notice, your reconciliation, and the reasons in the order. Check whether accepted, reversed, or paid amounts were credited and whether a new ground or computation appears.
An appeal is a separate later proceeding. The GST portal’s appeal guidance describes that stage, but the applicable deadline and filing requirements depend on the actual order and current law. Do not assume that filing the DRC-06 reply extends an appeal period or substitutes for an appeal.
Common mistakes and the correction
| Mistake | Why it weakens the response | Correction |
|---|---|---|
| Replying only to the DRC-01 summary | The detailed notice may contain additional grounds, periods, or calculations. | Read and answer the complete notice and reconcile its figures to DRC-01. |
| Using DRC-06 for every GST communication | Rule 142(4) links DRC-06 to a notice whose summary is uploaded in DRC-01. | Use Part B of DRC-01A for the pre-notice stage and DRC-06 for the specified formal-notice stage. |
| Submitting only a purchase register | A register alone may not show eligibility, attribution, duplicate status, payment, or reversal. | Link each row to the invoice, supplier evidence where relevant, ledger, return, and issue-specific working. |
| Giving one general denial | Different allegations require different facts and legal answers. | Use one section and reconciliation row for each ground and disputed item. |
| Ignoring a section 74 intent allegation | The fraud-related basis is part of the statutory route, not a separate formality. | Address the asserted conduct, records, disclosure, and evidence directly. |
| Claiming the 2024 amendment cures all late or excess credit | Sections 16(5) and 16(6) apply to specified cases, and Circular 238 limits deductions to credit denied solely under section 16(4). | Test the exact period and every independent ground in the notice. |
| Attaching unrelated records | Volume without explanation makes it difficult to identify proof. | Index every annexure and state the allegation and calculation it supports. |
| Failing to preserve acknowledgement | Without proof, it is harder to establish what was filed and when. | Save the portal acknowledgement, filed package, attachments, and hearing communications. |
Final filing checklist
- The legal section, case reference, periods, deadline, officer, and jurisdiction match the notice.
- The procedural form matches the stage: DRC-01A Part B or DRC-06 as applicable.
- Every disputed amount appears in a reconciliation row and totals agree with the notice or explain the difference.
- Each row states accepted, partly accepted, disputed, reversed, or paid status.
- Invoices, debit notes, credit notes, returns, purchase register, ledger, supplier evidence where relevant, and issue-specific workings are indexed.
- Attribution, reversal, duplication, payment, timing, and eligibility grounds are answered separately.
- Any section 74 allegation is answered on both the credit calculation and the alleged conduct.
- Section 16(5) or 16(6) is cited only if the precise case qualifies, and only timing-only denial is treated as potentially affected.
- A hearing is requested when the facts or computation need oral clarification.
- The filed reply, attachments, acknowledgement, and later communications are stored together.
When case-specific professional review is sensible
Consider having a qualified Indian GST practitioner or chartered accountant review the notice when the amount is material, several periods or entities are involved, the notice alleges fraud or suppression, the computation uses attribution or reversal rules, or an order has already been issued. A reviewer can test the arithmetic and legal route against the actual records; no generic article can determine whether a particular notice, amount, deadline, or jurisdiction is valid.
The rules PDF commonly consulted for this procedure is dated 1 January 2022, while the relevant circulars on the 2024 ITC changes are later. Before filing, check for subsequent notifications, amendments, and current portal instructions that affect your notice.
