Replace the entire expressive identity of a Nintendo-inspired element, not just its name or texture. Use a clean-room branch: inventory every Nintendo reference, remove the references from prompts and project files, write an independent design brief, regenerate or commission replacement assets, review the complete build for recognizable similarities, and keep records proving where each asset came from. A disclaimer, a palette swap, or Nintendo’s gameplay-sharing rules does not authorize a new game that uses its characters, story, music, visual elements, software, names, or logos.
What “replacement” has to cover
A game can retain a Nintendo reference even after the character model is deleted. The identity may survive in a class name, a sound effect, a level outline, a catchphrase, a logo in a texture atlas, or a screenshot used on a store page. Nintendo’s legal information identifies protection for game software, visual displays, music, characters, packaging, manuals, labels, artwork, and publications, while major names and logos can function as trademarks. Treat the whole project and its promotion as one review surface.

Why a name change or recolor is not enough
Copyright analysis looks at expressive elements, not only labels. A character can remain recognizable through the combination of silhouette, proportions, costume arrangement, emblem, props, animation mannerisms, voice, catchphrases, and backstory. Changing a red shirt to a blue one while retaining the same outline, accessories, movement, and role leaves the most recognizable choices intact.

A familiar name, logo, or presentation can make players believe a game is affiliated with or sponsored by Nintendo. Nintendo states, “You are not permitted to imply or state that your videos are officially affiliated with or sponsored by Nintendo.” That statement concerns videos, but it illustrates why an attribution disclaimer is not a substitute for changing branding and presentation. A disclaimer cannot turn copied expressive material into independent authorship.
Do not rely on Nintendo’s Game Content Guidelines as a game-development license. The guidelines, updated September 2, 2024, address certain gameplay footage and screenshots shared on participating platforms. They do not authorize a new game that uses Nintendo characters, story, visual elements, music, trademarks, or modified game software. If a Nintendo asset remains in a release build, obtain written permission from the rights holder or remove it. Nintendo also reserves removal and account-access remedies for apparent infringement.

Use a clean-room replacement branch
Separate the replacement work from the original experiment so an editor or reviewer can see what was removed and why. A clean-room process is a practical documentation method, not a legal safe harbor by itself.
1. Freeze the original and create a replacement branch
- Tag or archive the current prototype without distributing it.
- Create a new branch or project copy whose purpose is “original replacement.” Restrict access to people who need the source material for the audit.
- Record the date, contributors, tools, model versions, and asset sources in a change log.
- Decide the intended distribution level now: private prototype, public demo, or commercial release. The more public the build and its marketing, the less tolerance you should have for unresolved similarity.
2. Build a complete reference inventory
Search the repository, design documents, model-training inputs, asset folders, build output, and marketing workspace. Include text that is not shown in the game: comments, test scenes, localization keys, analytics events, package metadata, and unused files can leak into a release or reveal the original identity during review.

Add every franchise-specific term, abbreviation, filename pattern, and internal codename found during your inventory. Search packaged archives separately; a clean source tree does not prove that an old asset was excluded from the build.
3. Remove Nintendo terms from prompts and project text
Delete brand and character names from generation prompts, reference-image captions, negative prompts, comments, dialogue, UI strings, and store copy. Do not replace a name with a detailed description that intentionally reproduces the same character. Instead, describe the game’s functional needs: for example, “a compact platforming explorer with a readable jumping silhouette, a tool belt, and a cool-toned raincoat,” then add constraints that force a distinct design.
Rename classes, variables, files, achievements, quests, animation clips, and asset bundles. Rewrite story text and marketing language rather than using a synonym for a famous catchphrase. Keep the original inventory in a restricted audit record if necessary, but do not ship it or feed it back into generation.
4. Write an independent design brief
The brief should make the replacement character and world coherent without any Nintendo reference. Specify:

- Silhouette, body proportions, posture, age range, and locomotion.
- Costume construction, materials, closures, wear, and practical function.
- A new color system with a different dominant-to-accent ratio.
- Original symbols, tools, props, and interaction rules.
- Animation principles, timing, combat or traversal logic, and camera behavior.
- Voice qualities, vocabulary, humor, catchphrases, and speech rhythm.
- Backstory, motivation, relationships, setting, and stakes.
- Environmental architecture, map grammar, enemy logic, item economy, and progression.
Have a designer who was not merely tracing the old asset approve the brief before generation starts. The objective is a new set of expressive choices, not a disguised translation.
5. Generate, model, or commission replacements
Use the brief as the input for human artists, procedural tools, or AI systems. Generate multiple candidates and reject any output that is recognizably Nintendo-like, even if the prompt omitted the exact name. Similarity can arise from an unusual combination of outline, colors, props, animation, and setting.
For every accepted asset, save the prompt, model and version, seed or generation settings when available, reference inputs, source files, edits, and export date. If an AI tool supplies metadata for traceability, preserve it with the asset. Unity notes that some partner models block prompts likely to generate infringing content and attach metadata to generated assets, but also states that the user remains responsible for rights in the final build. A filter is a safeguard, not clearance.
6. Replace the nonvisual identity
Replace music and sound effects, not just art. Commission or license new compositions, instruments, samples, and vocal performances; verify that a “royalty-free” label actually grants the rights needed for your region, platform, commercial use, and modifications. Redesign maps and progression when their arrangement is distinctive. Rewrite dialogue, item names, tutorials, achievements, and credits so they express the new world rather than narrating the old one.

7. Rebuild UI and typography
Brand recognition often survives in menus and promotional frames. Replace logos, icons, fonts that imitate branded presentation, button shapes, color blocking, title treatments, loading screens, controller diagrams, and packaging-like layouts. Check accessibility screens, pause menus, error messages, and localization files; a forgotten debug label can appear in a screenshot or stream.
Perform a human similarity review
Automated scans find names and hashes, but they cannot decide whether a new character still evokes a protected one. A human reviewer should inspect the complete playable build side by side with the inventory and ask whether an ordinary player would identify the old source from the combined choices.

Review the character and performance
- View the silhouette as a solid black shape and at gameplay scale.
- Compare proportions, costume layout, palette relationships, emblem placement, props, and facial construction.
- Watch idle, jump, attack, hurt, victory, and traversal animations without sound.
- Listen to voice, catchphrases, music, and effects independently and in context.
- Read the biography, dialogue, item names, and role in the story.
Review the world and presentation
- Play representative levels for map structure, camera behavior, enemies, items, and progression.
- Inspect every menu, HUD element, font, icon, loading screen, credit, and accessibility panel.
- Open the final store listing, screenshots, trailer, thumbnails, social posts, and press materials exactly as a customer will see them.
- Ask reviewers who know the relevant games to identify any accidental resemblance, then document the decision to revise, retain, or remove each flagged element.
Keep a signed review record with the build number, reviewers, findings, changes, and unresolved questions. If the team cannot explain why a recognizable element is independent, replace it before release.
What AI can and cannot establish about authorship
AI generation does not automatically make an asset free of third-party rights. A model can reproduce a recognizable character even when the prompt avoids the exact name. Training-data provenance may be uncertain, and marketplace or engine terms can impose additional obligations.
The U.S. Copyright Office’s current position is that AI assistance or AI-generated material inside a larger human-created work does not automatically prevent copyrightability, but protection depends on human authorship. Its report process received 10,000 responsive comments in 2025. The office says prompts alone are insufficient; a human must determine sufficient expressive elements. Your records should therefore show meaningful human selection, arrangement, redraw, modeling, writing, editing, implementation, and rejection of unsuitable outputs.
Copyrightability and freedom to use are different questions. A human-edited asset may contain protectable authorship while still infringing another party’s work if its expressive choices remain substantially similar. Obtain legal advice for a high-value commercial release, especially when the game will launch in multiple countries.
Choose a replacement path by provenance and risk

Evaluate each path against five questions: Can you prove where the asset came from? Does its silhouette, costume, palette, props, animation, voice, story, and naming stand apart? Can you trace every edit? Does the license cover the planned distribution? What human creative decisions can you demonstrate?

Engine and marketplace responsibilities
Game engines and asset marketplaces may provide filters, metadata, or licensed content, but they do not transfer responsibility for your final build. Unity’s guidance says the developer remains responsible for rights in generated assets. A licensed Unreal Marketplace pack still requires you to read that pack’s current terms, including attribution, redistribution, seat, platform, territory, and modification limits. Save the exact license version and receipt; a marketplace listing can change after purchase.

Check third-party terms for model inputs, output ownership, commercial use, indemnity exclusions, required notices, and restrictions on training or uploading confidential material. If a partner model blocks a prompt, do not work around the block with coded names or a near-description. Redesign the brief instead.

- Merge only the replacement branch into a release candidate and record its commit or build identifier.
- Search source, generated assets, localization, configuration, and packaged files for Nintendo names, franchise terms, known asset identifiers, and old filenames. Repeat the search after compression and archive creation.
- Open the build on each target platform and inspect menus, credits, achievements, tutorials, loading screens, screenshots, and saved-game labels.
- Compare the asset manifest with your rights ledger. Every third-party file must have a matching license, contract, or permission record.
- Verify music, sound, fonts, icons, stock references, model inputs, and AI outputs separately; an art license does not cover an audio file in the same folder.
- Have an independent reviewer repeat the similarity pass on the release candidate, not on an editor preview.
- Remove superseded screenshots, trailers, demo packages, and download links that still show the old identity.
- Archive prompts, model versions, source layers, edit history, metadata, receipts, approvals, and the final manifest with the release records.
Common failure modes and fixes
“We changed the name and color.”
Why it fails: silhouette, costume geometry, props, animation, and story can still identify the source.
Fix: return to the design brief and replace the complete expressive identity, then repeat the side-by-side review.
“The prompt never used the Nintendo name.”
Why it fails: a near-description or reference image can produce a recognizable output without the exact word.
Fix: describe function and constraints, reject recognizable generations, and document human redesign and selection.
“A disclaimer makes it fair use.”
Why it fails: disclaimers address confusion at most; they do not grant copyright, trademark, music, or software rights.

Fix: remove the material or obtain written permission. Do not market the game as affiliated with Nintendo.
“Nintendo allows gameplay videos, so the game is allowed.”
Why it fails: the Game Content Guidelines cover specified sharing of gameplay footage and screenshots, not creation or sale of an unauthorized game.

Fix: treat the game and its promotional media as separate rights reviews and clear both.
“The asset came from an engine marketplace.”
Why it fails: marketplace terms vary, and a licensed asset can still be combined with copied character identity or used outside its permitted scope.
Fix: archive the exact license, verify the planned use, and review the combined scene for similarity.
“The source repository is clean.”
Why it fails: old assets can remain in bundles, caches, localization, screenshots, trailers, or build metadata.

When can you keep an original Nintendo asset?
Only when you have permission that actually covers your use, or when qualified counsel has assessed a specific legal exception for the relevant jurisdiction and facts. Do not infer permission from a fan-game tradition, a platform’s upload policy, a gameplay-video guideline, a model filter, or a disclaimer. If permission is absent or uncertain, remove the asset and its associated references from the game and its promotion.
A practical release decision
Release only when the build presents an independently authored character and world, every Nintendo name and asset reference has been removed from source and packaged material, nonvisual elements have been replaced, licenses are documented, and human reviewers have approved the complete player and marketing experience. If any reviewer can still identify the old character from the combined expressive choices, continue redesigning rather than relying on a label change or legal notice.
