AI has solved parts of content production, not accountability. Generative tools can draft, translate, illustrate and scale work quickly, but a publisher still has to prove what the system did, who reviewed it, whether the inputs and likenesses were authorised, and which disclosure rules apply. There is no single rule that makes every AI-generated article, image or video illegal or automatically safe.
Legality depends on the jurisdiction, audience, content type, degree of human creative control, use of real people’s identities, and the records your team can produce. The practical standard is an evidence trail: classify the work, apply the required disclosure or machine-readable marking, document human editorial responsibility, and retain rights and consent records.
What AI solved—and what it did not
AI reduces the time and cost of producing first drafts, variants and localisations. It does not decide whether a claim is accurate, whether a source may be used, whether a voice or face was licensed, or whether a regulator expects a disclosure. Those decisions remain with the organisation that publishes or deploys the output.

Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Compliance now spans several separate questions:
- Transparency: must a reader, viewer or user be told that they are interacting with AI or seeing content generated or altered by it?
- Provenance: can your team show how the file was created and changed, including metadata or other machine-readable signals?
- Copyright: which parts, if any, contain enough human creative expression to receive protection?
- Training and input rights: were text, images, recordings or other materials supplied to the system used with permission?
- Consent and identity: did a real person authorise use of their face, voice, name or likeness?
- Accountability: who checked the result, approved publication and can explain the decision later?
Treat these as separate controls. A watermark may help people identify synthetic media, but it does not grant copyright. A human edit may add protectable expression, but it does not by itself satisfy an AI-disclosure rule.

EU AI Act: the 2 August 2026 transparency deadline
Article 50 transparency obligations of the EU AI Act begin applying on 2 August 2026. The European Commission says the purpose is to help people recognise when they are interacting with AI or when content has been generated or altered by AI. The exact duty depends on whether your organisation provides an AI system, deploys it, or publishes the resulting content.
Provider duties
Covered providers must inform people when they interact directly with an AI system. They must also mark AI-generated or manipulated content so that it can be detected. Marking needs to be designed for the relevant medium and should remain detectable where technically feasible, rather than relying only on a caption that can be removed during reposting.
Deployer duties
Deployers have additional obligations for deepfakes and for certain text published to inform the public on matters of public interest when it was generated or manipulated by AI without human review or editorial control. If a journalist, editor or subject-matter reviewer genuinely checks and controls the final text, that fact is important to record; it is not a reason to assume every other transparency duty disappears.

The European Commission’s Code of Practice is a voluntary implementation tool. It can help an organisation choose technical and governance measures, but the underlying Article 50 duties are legal obligations. Following the code is not a blanket safe harbour, and declining to use it does not remove the need to assess Article 50.

The limited grace period
A limited grace period cited by the Commission extends to December 2026 for marking obligations affecting certain systems already placed on the market before 2 August 2026. That transitional point is narrow. It does not postpone every Article 50 assessment, and it does not make an otherwise covered deployment exempt. Record the system’s market date, version and role so you can determine whether the transition applies.
United States copyright: human creativity is the dividing line
The U.S. Copyright Office’s position is that protection turns on human creative contribution. An output can be protected when a person determines sufficient expressive elements, including through selection, arrangement or substantial modification. Merely supplying prompts to a generative system is not enough to make the resulting expression human-authored.
As Register of Copyrights and Director Shira Perlmutter put it, “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” The practical implication is to separate the machine-produced material from the human-authored contribution in your files and, where relevant, in a copyright registration or rights statement.
What to preserve for a copyright analysis
- The prompt or instruction that initiated generation.
- Human-written passages, sketches, shot lists or musical structures supplied before generation.
- Material selections, sequencing and composition decisions made by an editor or designer.
- Substantial rewrites, retouching, editing, compositing or other expressive changes.
- The final publication file and earlier versions showing where human expression entered.
Copyright law around AI is still developing. The Copyright Office received more than 10,000 comments by the December 2023 deadline and continues work on training data, licensing and liability. That volume demonstrates the scale of the issue, not a settled answer for every model or output. Obtain jurisdiction-specific advice for valuable or contested work.

Provenance is evidence, not a legal shield
Provenance means keeping a credible history of an asset: its source, transformations, tools, people and approvals. NIST describes authentication, metadata, watermarking, detection, testing, auditing and maintenance as complementary approaches. No single method is reliable in every format or after every platform conversion.
Use several signals together
- Metadata: retain creation and editing information where the file format and publishing system support it.
- Content credentials: use a signed, machine-readable history when your creation tools and distribution channel support one.
- Visible disclosure: add a clear label or caption where a person needs to understand that content is synthetic or manipulated.
- Watermarking and detection: treat these as supporting controls; cropping, recompression or a new recording can defeat them.
- Audit records: keep prompts, source files, model or tool version, edits, reviewer identity and approval time.
Provenance helps answer an investigation or a reader’s question, but it cannot legalise an unlicensed photograph, prove that a model’s training data was lawful, or create copyright in an output with no human authorship.
Digital replicas raise consent and reputation risks
A realistic synthetic voice, face or performance can affect a person even when no conventional copyright work is copied. The U.S. Copyright Office has recommended federal protection against unauthorised realistic digital replicas and describes potential harm to reputations and livelihoods.
Before generating or publishing a replica, identify the person, obtain a permission that covers the intended medium and duration, and retain the underlying agreement. A release should address voice, face, name, mannerisms, territories, platforms, editing, advertising and revocation or takedown processes. Do not infer consent from a person’s public profile or from a licence to an unrelated photograph.

A publication workflow that produces proof
Use the following workflow for articles, images, audio, video and translations. Adapt the controls to the jurisdiction and the risk of the subject.
- Inventory AI use. List every step where a model is used for drafting, editing, imagery, audio, video, translation, search or moderation. Include tools used by contractors and agencies.
- Classify the output. Record the publishing country, intended audience, public-interest subject matter, whether a real person is depicted or imitated, and whether the system is provider-facing or an internal deployment.
- Assign a human owner. Name an editor or other accountable reviewer. For high-impact or public-interest material, require documented editorial responsibility rather than an informal spot check.
- Apply disclosure and marking. Add the visible notice required by the applicable law or platform policy. Preserve machine-readable marking or content credentials where available, and check that export or content-management steps do not strip them.
- Clear rights and consent. Record licences or permissions for copyrighted inputs, stock material, datasets, voices, faces and digital replicas. Escalate uncertain sources instead of assuming that a publicly accessible file is free to use.
- Capture the creation chain. Retain prompts, major iterations, model or tool identifiers, human edits, reviewer identity, approval and the exact publication version. Keep enough context to reproduce the decision without retaining unnecessary personal data.
- Recheck before release. Confirm the current law, implementation guidance and platform rules immediately before publication. Rules and litigation are changing, so a workflow that passed last year may need a new assessment.
Minimum evidence record
A lightweight record can be attached to the asset or stored in the project system. The fields below make a later explanation possible without forcing a reader to trust an unsupported claim.
| Record | What to capture | Why it matters |
|---|---|---|
| Jurisdiction and date | Target countries, audience, publication date and applicable rule version | Transparency duties and deadlines vary by location and time |
| AI involvement | Tool, model or service, version if shown, task performed and files affected | Shows whether the system generated, altered, translated or merely assisted |
| Human contribution | Author, editor, selections, arrangement, rewrites, retouching and final approval | Supports copyright and editorial-accountability analysis |
| Disclosure and provenance | Visible label, machine-readable marking, credential status and export checks | Demonstrates how users were informed and how origin can be detected |
| Rights and consent | Input licences, permissions, releases and restrictions on likeness or voice | Provides evidence for copyright, privacy and replica questions |
| Versions | Prompt or instruction, major edits, review notes and published file hash or identifier | Shows the chain from generation to publication |
Choosing tools and controls by risk
Do not evaluate a product only by how realistic its output looks. Compare the function and the evidence it leaves behind.

Publishing first and adding a label later
A later caption may not reach copies already downloaded, syndicated or embedded. Classify the output before release and preserve the marking through the export and distribution path.

Assuming a prompt makes the result yours
Prompts can reflect skill, but the U.S. Copyright Office’s test focuses on human determination of expressive elements. Preserve the human-authored and human-edited portions instead of claiming the whole output automatically.
Treating a watermark as proof of legality
Watermarks and detectors address authenticity signals, not permission, copyrightability or consent. Pair them with licences, releases and a review record.
Calling an automated check a human review
A plagiarism scan, safety filter or spell-check is not the same as an editor exercising judgment. Record the person who assessed accuracy, context, rights and the final wording or image.
Ignoring version and geography
Model updates, platform policies and national rules can change the result. Store the tool version, publication date and target countries, then reassess material that is republished or substantially modified.
What to do before 2 August 2026
- Map every generative feature used by your newsroom, marketing team, product or agency.
- Identify deployments that interact directly with users and outputs that depict people or address public-interest subjects.
- Choose a visible disclosure style and a machine-readable marking or credential approach for each medium.
- Make human review and approval mandatory for high-impact and public-interest work.
- Standardise records for prompts, edits, rights, consent, provenance and publication versions.
- Test exports, content-management systems and social platforms to see whether labels or metadata survive.
- Review the result against current Article 50 guidance and the limited December 2026 transition only where a pre-existing system genuinely qualifies.
The useful question is not whether AI is involved. It is whether your team can explain the involvement, meet the applicable transparency duty, demonstrate human responsibility, and show permission for the material and identities used. AI has made production scalable; accountable publishing still requires deliberate human control.
