A GST tax invoice and a bank transfer are necessary evidence, but they do not by themselves prove a genuine supply for input tax credit (ITC). A defensible claim connects six facts: the supplier is identifiable and registered, the invoice is complete and appears in the GST system, the goods were delivered or the service was performed, the invoicing supplier was paid, the input was used for business, and the tax and return records are consistent. Keep contemporaneous documents for each fact and reconcile them before claiming credit.

What the GST law requires before you claim ITC

Section 16 of the Central Goods and Services Tax Act (CGST Act) permits credit for goods or services used, or intended to be used, in the course or furtherance of business, subject to the prescribed conditions. In practical terms, your file must establish all of the following for the relevant tax period:

  • You hold an acceptable tax document, such as the supplier’s tax invoice or debit note. Rule 36 also recognises a bill of entry for imports and applicable Input Service Distributor (ISD) documents.
  • The invoice details were furnished by the supplier and communicated to you through the GST system, subject to the rules and portal process in force for that period.
  • You actually received the goods or services.
  • The other tax-payment and return conditions applicable to the claim have been met.
  • You paid the supplier the value of the supply plus GST within 180 days from the invoice date. If you do not, the second proviso to Section 16 requires reversal or payment consequences until the condition is satisfied.

Rule 36 requires the document to contain the applicable particulars. A document that omits material identity, value, tax or supply information is harder to defend even when a payment was made.

Statutory condition Evidence to retain What the evidence proves—and what it does not
Valid documentary basis Tax invoice, debit note, bill of entry or ISD document, with required particulars Shows the legal document supporting the claim; it does not alone prove that the underlying supply occurred.
Supplier-furnished details GSTR-2B or equivalent GST-portal evidence, plus your reconciliation Supports communication of invoice details through the system; it is not proof of delivery or service performance.
Receipt of supply Delivery, transport, warehouse, acceptance or service-performance records Connects the document to an actual supply received by your business.
Payment condition Bank statement, supplier ledger and payment reference Shows payment to the invoicing supplier and lets you monitor the 180-day rule.
Business use Stock, production, project, resale or consumption records Links the input to business activity rather than a personal or unexplained transaction.

1. Supplier identity and registration

Retain the supplier’s legal name, GSTIN, registered address and evidence of registration status for the transaction date. Preserve the purchase order or contract and the quotation or commercial terms that led to the order. Check that the name and GSTIN on the invoice, purchase order, delivery documents and bank beneficiary identify the same legal party. If a supplier changes its name, constitution or bank account, keep the change notice and your verification.

2. Invoice completeness and portal match

Review the invoice number and date, description, quantity, taxable value, tax rate and tax amount, place of supply and other particulars required by the rules. Match the invoice number, GSTIN, taxable value and tax amounts to the entry in GSTR-2B or equivalent portal evidence. Save a dated PDF or screenshot of the portal result with the period clearly visible; portal data can change as amendments and later filings are processed.

Do not treat a matching 2B entry as a substitute for receiving the goods or service. It demonstrates that a supplier furnished data that was communicated through the GST system, not that the supplier dispatched anything to you.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Physical movement or service performance

For goods, preserve a chain that shows dispatch, transport, receipt and acceptance. For services, preserve evidence of the work itself and your acceptance of it. The stronger the chain, the less your claim depends on a single document.

4. Payment and freight trail

Your ledger and bank statement should show payment to the same supplier named on the invoice, with a reference that lets the transaction be traced. Keep freight invoices and proof of freight payment where transport was separately charged. Reconcile the invoice value plus GST to the amount paid, accounting for credit notes, advances, retention, discounts and any contractual set-off. A payment to an unrelated account, cash settlement without a reliable trail or unexplained netting creates avoidable questions.

5. Stock and business-use linkage

For inventory, connect the purchase to the stock ledger, production records, internal issue notes, resale invoice or consumption record. For capital goods, retain the asset register, installation or commissioning record and project file. For services, identify the project, cost centre or operational activity that used the work. Where relevant, preserve subsequent outward-sale records or other onward-supply evidence.

6. Tax-payment and return consistency

Keep the purchase register, filed returns, electronic credit ledger extracts and reconciliations that show how the claim was reported. Investigate differences between your books, the supplier’s filing and the portal before filing the return. A consistent tax trail does not cure a fictitious supply, but inconsistencies can undermine an otherwise genuine transaction.

Evidence for goods: prove movement and receipt

Goods claims are strongest when documents form a chronological chain rather than a collection of disconnected files. Retain the documents that apply to the transaction:

  • Purchase order, contract, quotation and approved vendor record.
  • Supplier tax invoice or debit note showing the required particulars.
  • E-way bill where applicable, including the vehicle and movement details.
  • Transporter’s lorry receipt (LR), consignment note, delivery challan or equivalent freight record.
  • Vehicle number, driver or transporter details and freight invoice.
  • Weighbridge slip where weight was material to the transaction.
  • Gate entry, warehouse inward register and goods-receipt note (GRN).
  • Inspection report, quality-control record, photographs or discrepancy report where your procedures create them.
  • Stock ledger entry, production issue note, transfer record or subsequent sale.
  • Bank payment record and supplier ledger reconciliation.

Dates and quantities should make sense across the chain. For example, an e-way bill dated after the GRN, a vehicle that could not have covered the route, or a quantity received that does not match the invoice needs a documented explanation such as split delivery, return, short receipt or later amendment. Do not create a retrospective document merely to fill a gap; preserve the original record and an approval note explaining the event.

Evidence for services: prove performance, acceptance and use

Services do not usually generate a vehicle record, so the file must show what was performed and how your business used it. Retain:

  • Evidence of deployment or business use, such as a project file, campaign record, implementation record or operating report.
  • Supplier invoice, ledger, bank payment and any withholding, retention or credit-note reconciliation.

An invoice describing only “consultancy” without a scope, deliverable or acceptance record is weak. The appropriate evidence depends on the service: a completed engineering drawing, a support-ticket history, a signed training attendance record and a monthly facilities report are different forms of corroboration.

How to reconcile GSTR-2B and a missing supplier filing

Use the GST portal evidence as one control in the file, not as the entire case. For each invoice, compare the supplier GSTIN, invoice number and date, taxable value and tax amounts with your purchase register and books. Save the period-specific 2B or equivalent view and document the result.

When the invoice appears and matches

Record the match, retain the portal evidence and continue checking receipt, payment and business use. A match removes one discrepancy; it does not establish that the transaction was physically or commercially real.

When the invoice is absent from GSTR-2B

Do not silently treat the absence as proof that no supply occurred, and do not assume the invoice is safe merely because you possess a paper copy. Ask the supplier to verify the return period, invoice number, GSTIN and amendment status. Preserve the written correspondence and the supplier’s response. Check whether the invoice was reported in a different period, amended, cancelled or reported under an incorrect GSTIN.

Apply the eligibility and timing rules for the relevant tax period before claiming or retaining the credit. If the statutory communication condition is not met, obtain professional advice on whether to defer the claim, reverse it, or take another action permitted by the law then in force.

When the portal entry differs from your books

Compare the exact fields rather than only the total tax. A one-digit invoice-number error, an incorrect GSTIN, a taxable-value difference or a credit-note amendment can produce a mismatch. Classify the item as a clerical correction, supplier amendment, duplicate, cancellation or substantive dispute, then retain the resolution and revised records.

Track the 180-day payment condition

Set a due-date control for every invoice: invoice date plus 180 days. Reconcile the supplier ledger to the bank statement and identify unpaid balances, partial payments, debit notes, credit notes, retention amounts and contractual set-offs. The statutory condition concerns payment of the value of the supply plus tax to the supplier; do not assume that an unrelated payment or an unrecorded adjustment satisfies it.

Where the 180-day condition is not met, identify the affected credit, record the required reversal or payment consequence under the rules applicable to the period, and monitor the date on which the supplier is subsequently paid. Keep the calculation and approval with the return working papers so the treatment can be explained later.

Why an invoice and bank payment can still fail

A bank transfer proves that money moved; it does not prove what was delivered in exchange. An invoice proves that a document was issued; it does not prove that the described goods or services existed. A defensible file connects the documents to movement, performance, acceptance, business use and the tax system.

Evidence file Typical contents Defensibility
Weak Invoice, purchase-register entry and bank payment only Materially weaker because receipt, performance, portal corroboration and business-use linkage are not established.
Stronger Supplier verification, complete invoice, matching portal entry, transport or service records, receipt or acceptance, payment and freight trail, stock or project linkage, and return reconciliation Addresses all six evidence axes and allows the transaction to be reconstructed independently.

The Supreme Court authority commonly cited for this evidentiary approach states that “mere production of tax invoices would not be sufficient to claim ITC.” It refers to the seller’s name and address, vehicle details, freight payment, acknowledgement of delivery, tax invoices and payment particulars as relevant evidence of an actual transaction and physical movement. That matter arose under the Karnataka VAT Act, so it is persuasive guidance on how evidence is assessed, not a replacement for the CGST Act and rules.

Fake-invoice risk and the meaning of “genuine supply”

CBIC Circular 171/03/2022-GST, dated 6 July 2022, describes the risk directly:

“A number of cases have come to notice where the registered persons are found to be involved in issuing tax invoice, without actual supply of goods or services or both (hereinafter referred to as ‘fake invoices’), in order to enable the recipients of such invoices to avail and utilize input tax credit (ITC) fraudulently.”

An invoice with no underlying supply does not satisfy the statutory concept of supply. Claiming credit on that document can lead to demand, interest and penalty consequences, even if the invoice appears in the portal or the recipient paid an amount. If a supplier offers an invoice without delivery, proposes a circular transaction, asks you to pay a different entity without a documented commercial reason, or cannot explain the goods or service, stop the claim and obtain specialist advice.

A step-by-step process for building the file

  1. Approve the commercial need. Keep the purchase order, contract, quotation and business justification before or at the time of ordering.
  2. Verify the counterparty. Record the supplier’s legal name, GSTIN, address, registration status and authorised bank details. Resolve any mismatch before payment.
  3. Check the document. Confirm invoice or debit-note particulars, tax treatment, place of supply, quantities and values against the order and contract.
  4. Capture receipt or performance. For goods, complete the GRN and retain transport, e-way bill, gate and stock records. For services, obtain deliverables, milestone evidence and acceptance.
  5. Reconcile the portal. Match the invoice to GSTR-2B or equivalent evidence, save a dated copy and document any supplier follow-up.
  6. Record payment. Match the supplier ledger to the bank statement, freight invoices and any adjustments; set the 180-day reminder.
  7. Link to business use. Post the inventory, asset, project or operating-cost record and retain onward-sale or consumption evidence where relevant.
  8. Review before claiming. Have a reviewer sign off the six axes, unresolved discrepancies and the tax-period rules that apply.
  9. Preserve the package. Store the invoice and its supporting records together with a date-stamped index so the transaction can be reproduced without relying on an employee’s memory.

What to do if a notice or audit questions the purchase

Start with an invoice-level schedule rather than a general explanation. For every questioned item, show the supplier identity, invoice and portal match, receipt or service-performance record, payment and freight trail, business-use linkage and return treatment. Provide original or system-generated records in chronological order and explain genuine exceptions such as split deliveries, returns, amended invoices or delayed filing.

Do not submit a reconstructed narrative that is unsupported by contemporaneous records. If a document never existed, say so and assess the appropriate correction; fabricating a GRN, delivery record or acceptance email creates a separate and more serious risk. Check the CGST Act, rules, circulars, portal instructions and case law applicable to the tax period, and have a qualified Indian GST professional review a notice response or litigation position.

Common failure modes and corrective controls

  • Only an invoice is retained: require a GRN, acceptance or equivalent performance record before the invoice enters the ITC-eligible queue.
  • Payment went to another party: document an authorised commercial arrangement, or resolve the beneficiary mismatch before claiming credit.
  • 2B is relied on as proof of delivery: make transport, stock or service-acceptance evidence mandatory as a separate control.
  • Quantities do not reconcile: record short receipt, split delivery, return or amendment with dates and approvals.
  • 180 days is missed: run an ageing report from invoice date and post the required treatment promptly.
  • Business use cannot be shown: link the purchase to a cost centre, project, inventory movement, asset or outward supply.
  • Records are scattered: use one indexed electronic folder or case file per invoice, with access controls and dated exports of portal evidence.

Practical final checklist

  • Supplier legal name, GSTIN, address and registration status are verified.
  • Invoice or debit note has the applicable Rule 36 particulars.
  • Purchase order or contract supports the commercial terms.
  • GSTR-2B or equivalent portal evidence is saved and reconciled.
  • Goods movement and receipt, or service performance and acceptance, are documented.
  • Payment and freight records identify the invoicing supplier.
  • Invoice value plus GST is tracked against the 180-day condition.
  • Stock, project, asset, consumption or onward-supply records show business use.
  • Books, returns, supplier data and electronic credit records agree, or differences are explained.
  • The file is date-stamped and reviewed under the law and portal instructions applicable to the relevant tax period.
