Employers should use the least intrusive method that can meet that purpose, assess the risks before deployment, minimise and secure the data, and tell workers what the system collects and does. The applicable legal duties depend on where the employer operates and what the system actually does.
What should an employer decide before using AI on work communications?
First define the concrete objective and what the AI will do to support it. For example, distinguish analysing aggregate service trends from inspecting message content or generating assessments about individual workers. Identify the applicable lawful basis for processing, and any additional condition required if sensitive information may be involved.
Then ask whether the proposed processing is necessary and proportionate to that objective. The UK Information Commissioner’s Office (ICO) cautions that “Just because a form of monitoring is available, does not mean it is the best way to achieve your aims.” A feature’s availability is not, by itself, a reason to use it.
Choose the least intrusive data that works
Before analysing email or chat contents, consider whether network information, metadata, or aggregate results can answer the question. These approaches are not automatically appropriate in every case, but they may avoid exposing the substance of workers’ conversations. If content inspection is genuinely needed, define the circumstances and scope rather than making it the default.

The table is a way to compare possible approaches, not a guarantee that a particular configuration complies with law. The purpose, context, data collected, and effects on workers all matter.
How should an employer assess risks and limit access?
Assess the impact before turning on monitoring. Under the ICO’s UK worker-monitoring guidance, monitoring email and messages calls for a data protection impact assessment (DPIA). Involve workers or their representatives where appropriate, and assess whether a less intrusive approach could achieve the same objective. The ICO guidance says that if a high residual risk cannot be reduced, the ICO should be consulted before proceeding.

A DPIA should examine what the system collects and produces, who may see the information, how long it is kept, how it is secured, and the likely effects on workers. Set access controls so only people who need the data for the stated purpose can use it. Choose and justify retention periods instead of keeping communications or AI outputs indefinitely. Establish a way to check accuracy and let workers challenge consequential inferences.
What should workers be told?
Give workers clear information before monitoring begins. Explain what is monitored, why, how the AI processes it, what data and outputs are involved, who can access them, and how long they are retained. Describe when exceptional access to message content may occur. Update privacy information if the system or its use changes.

Transparency matters especially when AI produces inferences about individual workers: people need to understand what information informs an output and how to raise a concern about an inaccurate or consequential result. Do not describe a system only as an “AI tool” or “productivity feature”; explain the actual collection and use of communications data.
Which communications and work settings need extra care?
Message content can reveal far more than work activity. Personal correspondence and communications with union representatives are sensitive contexts. Remote work can also expose information about a worker’s home, family, or personal life. Limit monitoring so that these communications and settings are not swept into routine analysis without a justified need.

When assessing a proposed system, consider whether the purpose can be met without identifying individuals or examining the content of personal communications. Where content access may be necessary in exceptional circumstances, define and explain those circumstances in advance, and restrict access accordingly.

An employer remains responsible for monitoring features supplied by a third party. Do not assume that a commercial platform is compliant by default or that its standard settings are appropriate for a particular workplace.

- Check the supplier’s role and document instructions, responsibilities, and relevant contract terms.
- Review security measures, data-use settings, access arrangements, and retention practices.
- Establish whether information is transferred internationally and assess the applicable requirements.
- Confirm that the configured service collects only what is needed for the defined purpose.
Whether a vendor uses customer data to train models, what its retention defaults are, and who can access outputs are system- and contract-specific questions. They cannot be answered for every platform in general; verify them for the service and configuration being considered.
What rules apply in the UK and European Union?
The ICO’s worker-monitoring guidance is UK regulatory guidance, not a universal legal test. The ICO has flagged its guidance as under review following the UK Data (Use and Access) Act, so employers should verify the current wording and their applicable obligations before deployment. Employment, privacy, communications, and AI rules can differ by jurisdiction.
In the EU, employers should determine whether a workplace AI system falls within the AI Act’s high-risk employment uses. If it does, employers deploying that high-risk system must inform worker representatives and affected workers before use. The classification depends on what the system does; AI applied to workplace communications is not automatically high-risk simply because it uses AI.
A practical deployment sequence
- Define the purpose. Record the specific objective and which decisions, analyses, or outputs the AI will support.
- Identify the legal basis and scope. Determine the applicable lawful basis and any additional condition needed for sensitive data in the relevant jurisdiction.
- Compare less intrusive options. Check whether aggregate or metadata approaches can meet the purpose before considering message-content analysis.
- Assess impact. Complete a DPIA for UK email or message monitoring in line with ICO guidance, consider worker or representative input, and address any high residual risk before proceeding.
- Set limits. Configure data collection, access, security, and retention to match the purpose; define any exceptional circumstances for content access.
- Inform workers. Explain collection, purposes, AI outputs, access, retention, and how workers can raise concerns; update the information when practices change.
- Review the supplier and jurisdictional duties. Check contracts, settings, security, data use, and transfers; for EU deployments, assess whether the AI Act’s high-risk employment provisions apply.
- Monitor the deployment. Check whether the system remains necessary and whether outputs are accurate enough for their intended use; provide a route to challenge consequential inferences.
What can a worker ask about an AI monitoring system?
A worker who is unsure how workplace communications are processed can ask their employer what information the system collects, what purpose it serves, whether it analyses message contents or only other information, who can see its outputs, and how long data is kept. They can also ask how personal or union communications are handled and how to challenge an inaccurate or consequential inference. The answers and any available rights depend on the applicable local rules and the employer’s actual system.
