Website monitoring can help a brand owner spot and document retailer listings that may conflict with a minimum advertised price (MAP) policy. It does not, by itself, establish a violation or decide what enforcement is lawful. Start with a current written policy, match listings carefully, preserve the page context, and have a trained person review every alert before acting.
What website monitoring can—and cannot—tell you
MAP ordinarily governs the price a retailer advertises under a particular policy. It is not necessarily the price at which a completed sale occurs. A displayed price, a price revealed only in a cart, a discount promotion, or a bundle may be treated differently depending on the policy’s wording and presentation.
A monitoring system collects listing information and flags apparent exceptions against rules or thresholds you configure. Treat each flag as a lead for review, not an automatic legal conclusion. Confirm the product, seller, price, availability, page context, and applicable policy version before recording a finding.
The distinction matters in practice. An FTC-hosted statement on prerecorded-music MAP policies noted that retailers could still sell below the advertised price in some instances. That historical example does not establish how every policy works; it illustrates why advertised price and actual sale price should not be conflated. Read the FTC commissioners’ statement.

Build a monitorable MAP policy
A monitor cannot reliably evaluate a rule it has not been given, or listings it cannot match to your products. Before setting up monitoring, define the policy’s scope and make the current version easy for reviewers to identify.
- Products: covered SKUs and identifiers, including relevant variants and bundles.
- Price rules: MAP levels and how advertised prices are treated, including promotions or prices displayed after a click or in a cart.
- Scope: effective dates, territory, sales channels, and any retailer or product exclusions.
- Exceptions: permitted promotions, exception approvals, and who can authorize them.
- Administration: the policy administrator, review process, and record of policy versions.
Reconcile listings and alerts against the policy version effective on the date of the observation. Do not assume a threshold remains correct after a policy update.
Set up monitoring around real listings
Map sellers and channels
Identify authorized retailers, relevant marketplaces, and retailer domains where the policy applies. Confirm whether the monitoring service covers the countries and channels in scope; coverage claims should be checked against your actual sales footprint.

Validate product and seller matching
Check how the service matches product identifiers, variants, and bundles to your catalog, and how it identifies the seller on marketplace listings. Test matches against known listings before relying on alerts. A wrong product match or an ambiguous marketplace seller can make a low-price flag misleading.
Choose collection and evidence settings
Ask how often pages are collected, how quickly alerts arrive, and whether the service retains price history or reviewable evidence. Determine how it handles hidden prices, promotions, bundles, and checkout prices in light of your policy. “Real time” or “complete coverage” is not a substitute for concrete answers about frequency and scope.
Review and document each potential exception
- Preserve the signal. Record the listing URL, observation timestamp, seller identity, product identifier, displayed price, availability, and relevant page context. Save a screenshot or other record that allows a reviewer to understand what the page showed at that time.
- Confirm the product and seller. Verify that the listing matches the covered item and that the identified seller is the party to which the policy applies.
- Apply the correct policy version. Compare the observation with the MAP level, dates, territory, channel, and advertised-price rules in effect at the time.
- Check the context. Review promotions, bundles, stock status, prices revealed only after interaction, and any approved exception that could explain the flag.
- Route uncertainty for review. Ask the policy administrator to decide how the company’s policy applies; involve legal counsel where the interpretation or proposed response raises legal questions.
- Record the decision. Document whether the flag was confirmed, dismissed, or left unresolved, and the basis for that decision under the company’s written process.
Monitoring vendors may only report data. For example, Prisync says its MAP monitoring reports prices below configured MAP/RRP thresholds but does not impose policies, contact retailers, or send violation alerts to them. PriceSpider describes Prowl as offering seller discovery, price monitoring, unauthorized-seller investigation, and MAP enforcement. TrackStreet describes a MAP/UPP/resale-policy platform and Amazon Buy Box suppression alerts. Choose monitoring software by operational fit
Compare services on the tasks your policy actually requires rather than on broad coverage or speed claims.
- Coverage: retailer domains, marketplaces, and geographic areas relevant to the policy.
- Matching: product identifiers, variants, bundles, and seller attribution.
- Collection: page-check frequency, alert timing, price history, and evidence retained for review.
- Price scenarios: handling of promotions, hidden or cart prices, bundles, and availability.
- Workflow: whether the service only reports data or also supports investigation, reseller communication, or enforcement.
- Implementation: catalog setup, integrations, team review workflow, and current total cost. Get current pricing directly; comparable current prices are not established here.
For a practical comparison, run a sample of known listings through each candidate and compare its matches and records with manual review. Check how it handles a correct match, a variant, an ambiguous seller, and a promotion before expanding coverage.

In the United States, FTC guidance says federal analysis of manufacturer-imposed vertical price programs follows a rule-of-reason approach after the Supreme Court’s 2007 decision. The FTC also cautions that some state antitrust laws and international authorities treat minimum-price rules differently. This is general context, not a determination about a specific policy or a complete survey of state law. A manufacturer-specific example shows how monitoring can be described in a written policy without making monitoring itself a legal conclusion. An Enerpac MAP policy effective May 2014, reproduced in an FTC-hosted paper, states: “Enerpac may engage in monitoring of advertised prices of Enerpac Products, either directly or via the use of third parties.” That policy also assigns its administrator responsibility for determining compliance. Periodically compare a sample of monitored listings with manual review. Investigate missed pages, stale prices, incorrect product matches, or seller attribution errors, then adjust the monitoring scope or review process. There is no universal audit cadence established here; choose one that fits the size of your catalog, the rate of listing changes, and the consequences of missed or false flags.
Keep the policy administrator responsible for resolving alerts and documenting decisions. Consistent records help distinguish an actual policy exception from a data or interpretation problem, and prevent automated reports from being treated as legal determinations.
