A school login, a “private” label, or deleting a chat does not by itself show that a prompt was never retained, reviewed, shared, or used to improve a model.
Start with the school-approved tool
Do not assume a tutor is approved just because it is easy to access or offers an education account. Use the service and account method your school specifies, and follow its acceptable-use rules and minimum-age requirements. UK Department for Education guidance recommends checking tool approval, age restrictions, and how personal data is handled; if the tool or its terms are unclear, ask your teacher, school data protection officer, or IT lead before using it (UK Department for Education guidance).
Share less code and remove sensitive details
Before submitting a question, isolate the smallest excerpt needed to explain the bug. A short, synthetic example is usually a safer starting point than an entire assignment or repository. Replace real values with fictional ones, and remove information that identifies you, your school, or your accounts.
- Names, email addresses, student IDs, school and class identifiers.
- Passwords, API keys, access tokens, private repository URLs, and other credentials.
- Personal information or records copied from school systems, classmates, or other people.
- Unpublished work you are not permitted to share, including original code that may be protected by copyright.
Removing a name is not a guarantee of anonymity: surrounding details can still identify a person or reveal confidential information. UK guidance recommends avoiding personal data in generative AI tools where possible and suggests generating material without personal details, then adding identifying details outside the tool (UK Department for Education guidance).

Check how the tutor handles inputs
Read the terms and privacy information for the specific service, account, and school arrangement—not just a general product description. Look for clear answers to these questions:
- What does the service collect besides the text and code you enter? UK guidance notes that tools may also collect information such as location, IP address, system, or browser details.
- Are prompts or code used for model training, product improvement, safety review, or another purpose? Can that use be turned off, and does the school agreement control it?
- How long are chats, code, usage logs, and backups retained? What does deletion remove, how can it be requested, and what exceptions apply?
- Who can access submissions, including school administrators or service staff, and which other providers or subprocessors receive them?
- Where is information processed or stored, and what security, access-control, and breach procedures apply?
- Does the school’s privacy notice explain the tool’s collection, processing, storage, and use?
Pennsylvania’s Department of Education advises schools to examine data control, permitted uses, vendor obligations, third-party sharing, and whether stakeholder information is used to train AI. Its rule of thumb is that tools should collect, process, and retain only the minimum data needed to provide the service (Pennsylvania Department of Education, Implementing AI in Schools). The US Department of Education’s Student Privacy Policy Office also directs schools to educational technology privacy resources and a model terms-of-service checklist for reviewing how services collect, use, and transmit information (Privacy and Education Technology).

Ask the school when the answers are unclear
If approved materials do not explain retention, training use, access, or sharing, do not submit identifying or confidential content while you wait for an answer. Ask a teacher, data protection officer, or IT lead whether the particular tool and account configuration are approved for the information you want to use. For a school or district, service selection and contract review should be institutional decisions rather than judgments left to an individual student or teacher.
- Find the school’s approved-tool list and instructions for the account you are expected to use.
- Check the school privacy notice and the tutor’s applicable terms for data collection, use, retention, deletion, and sharing.
- If a material point is unclear, ask the school privacy or IT contact before entering student data, confidential school information, credentials, or unpublished work.
- Until you receive guidance, use a fictional example or ask your coding question without submitting the sensitive material.
Privacy, school records, and copyright are different issues
Personal data, confidential school information, account credentials, and original student work need not overlap. A code sample can contain no personal details and still be confidential or copyright-protected; removing identifying information does not automatically make it appropriate to share. UK Department for Education guidance says student work and prompts may be copyright material and advises that schools should not allow pupils’ original work to be used to train generative AI models without permission or an applicable exception (UK Department for Education guidance).

What the legal guidance does—and does not—establish
For US K–12 settings, FERPA, COPPA, state student-privacy laws, and the vendor’s actual agreement may all be relevant. FERPA concerns personally identifiable information in education records, but whether a particular disclosure to a service is allowed depends on the circumstances and applicable provisions. COPPA covers certain online collection from children under 13. The Federal Trade Commission describes a school-consent route when an operator collects children’s information for the school’s use and benefit and for no other commercial purpose; it also discusses operator notice duties, limits on additional commercial uses, and deletion when information is no longer needed for its educational purpose. These rules do not amount to a universal finding that any AI tutor is compliant (FTC, Complying with COPPA: Frequently Asked Questions; US Department of Education, Privacy and Data Sharing).
For UK schools, Department for Education guidance recommends not using personal data in generative AI tools where possible. If using it is strictly necessary, the school should protect the data and ensure the product and procedures comply with data-protection law and school policy. The guidance also addresses transparency with pupils and parents. Legal responsibilities depend on the jurisdiction, service, configuration, and school arrangement; a student should follow the school’s process rather than infer that a tool is approved from its marketing or account type (UK Department for Education guidance).
