Keep a qualified mortgage professional accountable for every consequential outcome, not merely for a final approval click. An AI agent may gather documents, extract fields, calculate values, identify missing information, and recommend an underwriting action. When its output could affect approval, pricing, conditions, or an adverse-action notice, a reviewer must be able to inspect the underlying evidence, challenge the recommendation, correct inputs, and own the final action. Maintain a record connecting source data, agent output, exceptions, reviewer changes, final decision, and the reasons communicated to the applicant.
This is a workflow and governance design recommendation. Existing law does not prescribe one agent architecture or require a person to approve every clerical action. It does require the creditor to make lawful decisions and provide accurate, specific reasons for adverse action, regardless of the technology used.
Why human review matters in an agentic mortgage workflow
Mortgage agents can perform several tasks in sequence: ingest an application, classify files, extract income and asset data, compare values with policy, request missing documents, calculate ratios, draft conditions, and route a recommendation. The risk increases when the system can also change an application record, communicate a decision, or trigger an adverse-action notice without an effective human challenge.
The key control is not a ceremonial approval button. It is a qualified person with enough evidence, authority, time, and escalation support to detect an error and change the outcome. That person remains accountable for the creditor’s action even when an agent performed most of the preparation.

What ECOA and Regulation B require when AI is involved
The Equal Credit Opportunity Act and Regulation B apply to adverse-action notices regardless of the technology used. In Circular 2022-03, the Consumer Financial Protection Bureau explains that a creditor using a complex algorithm, artificial intelligence, or machine learning still must provide accurate and specific principal reasons for an adverse action.
“A creditor cannot justify noncompliance with ECOA and Regulation B’s requirements based on the mere fact that the technology it employs to evaluate applications is too complicated or opaque to understand.”
That rule has two practical consequences. First, human review does not cure a discriminatory, inaccurate, or otherwise unlawful decision. The creditor is responsible for the decision. Second, the lender must be able to identify the actual factors that drove the decision well enough to explain them to the applicant. A generic statement such as “the model score was too low” is not an adequate substitute when the score itself does not identify specific principal reasons.

How the 2026 model-risk guidance fits—and where it does not
On April 17, 2026, the Federal Reserve issued SR 26-2, Revised Guidance on Model Risk Management. The revised interagency guidance supersedes SR 11-7 and uses a risk-based approach tailored to an institution’s model-risk profile, size, and operational complexity. The OCC described the same revision in Bulletin 2026-13.
The Federal Reserve’s current supervisory guidance discusses understanding model design and development, validating performance, and monitoring whether models—including vendor products—remain fit for purpose. However, it expressly treats generative and agentic AI as novel, rapidly evolving technologies outside that guidance’s scope. Do not present SR 26-2 as an agent-specific checklist. Instead, use its risk-based governance principles alongside your institution’s own controls for systems outside scope.
In practice, that means documenting why a particular agent is within or outside the model inventory, assigning ownership, assessing materiality, testing performance and limitations, controlling changes, and monitoring outcomes. The more authority an agent has over credit outcomes, the stronger those controls should be.

Map the mortgage process before assigning agent authority
Create a process map that lists every action an agent can take and the consequence of that action. A useful starting classification is:
| Action category | Examples | Default control |
|---|---|---|
| Information gathering | Requesting pay stubs, checking whether a required form is present, organizing an inbox | May be automated within approved templates; monitor for privacy, accuracy, and unauthorized disclosures |
| Document classification and extraction | Identifying a W-2, extracting income, reading an account balance | Store confidence and source location; require review when confidence is low or values conflict |
| Calculations | Debt-to-income calculation, loan-to-value calculation, reserve calculation | Use controlled formulas and versioned inputs; route unusual or contradictory data to a reviewer |
| Recommendation | Suggesting approval, conditions, a request for more information, or denial | Qualified reviewer evaluates evidence and can change or reject the recommendation |
| Consequential action | Changing terms, issuing a commitment, sending an adverse-action notice, or closing a file | Keep final authority with an authorized person unless a separately approved control framework establishes another lawful path |
Write the boundaries in system permissions, not only in a policy document. For each agent, specify what it may read, create, modify, send, or finalize; which records it may access; the maximum dollar or risk threshold for automated handling; and the events that force a human handoff.
Build a substantive review gate
1. Define the decision points
Mark the points at which an output can affect eligibility, pricing, conditions, timing, or applicant communications. A document-naming action may not need individual approval. A recommendation to deny an application does. If an apparently clerical change can alter a ratio or a stated reason, treat it as consequential.
2. Set explicit stop conditions
Stop automated progression when the agent encounters missing or conflicting source data, low-confidence extraction, an out-of-policy recommendation, an unexplained override, a material calculation change, or a proposed adverse action whose reasons cannot be tied to actual decision factors. These are practical safeguards rather than a regulator-prescribed list; tune thresholds to the lender’s products and risk assessment.
3. Assign a qualified reviewer
Define the competence required for each gate. A reviewer handling income documentation may need mortgage underwriting knowledge; a reviewer approving an adverse action must understand ECOA and Regulation B obligations and the lender’s notice process. Record the reviewer’s identity, role, and any required authorization.
4. Provide evidence, not just a score
The review screen should show the application facts used, document images or verified source references, extracted values, calculations, policy rules invoked, agent confidence, warnings, prior overrides, and the proposed action. Show which factors are principal to the recommendation. If the reviewer cannot see the evidence, the review is effectively a rubber stamp.
5. Give the reviewer real authority
Allow the reviewer to correct an extracted value, mark a source as unreliable, request another document, reject the recommendation, choose a different action, and escalate an uncertain case. Preserve the original agent output rather than overwriting it. A reviewer who can only click “approve” cannot provide effective challenge.

6. Capture the final rationale
Require the reviewer to select or write the factual reasons that actually drove the final decision. The reason set used for an adverse-action notice must come from the decision record, not from a generic template generated after the fact. If the reviewer changes the recommendation, record why and which evidence supported the change.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesRoute exceptions that deserve human attention
Exception queues should be specific enough to prioritize work and broad enough to catch unfamiliar failures. Common routing rules include:
- Source conflict: pay, employment, address, asset, or liability information differs across documents or from verified third-party data.
- Extraction uncertainty: the agent cannot read a field reliably, detects a handwritten correction, or produces a value outside expected formats.
- Policy boundary: a recommendation is close to a program limit or falls outside the rules the agent is authorized to apply.
- Unexpected override: an agent or user changes a value, rule, or recommendation without a recorded reason.
- Missing rationale: the proposed adverse action cannot be mapped to specific factors in the application record.
- System change: a model, prompt, retrieval source, vendor component, or policy version changed since validation.
- Fair-lending signal: monitoring identifies a disparity, error pattern, or unexplained difference that needs investigation.
Use service-level targets for each queue, identify who owns aging items, and prevent an exception from silently reverting to automated processing. Escalation should be available when the assigned reviewer lacks expertise or when evidence remains contradictory.
Design an auditable record from intake through notice
To reconstruct a decision months later, retain a linked record rather than scattered screenshots. At minimum, capture:
- the application and document versions used;
- source locations, extraction confidence, and any transformations;
- agent identity or version, instructions, tools, retrieval sources, actions, and outputs;
- rules, policy versions, and calculations applied;
- exceptions, warnings, and automated stop events;
- reviewer identity, qualifications or role, edits, comments, escalation, and final decision;
- the principal reasons and other content supplied to the applicant; and
- timestamps, access history, and any subsequent corrections.
Protect the log against unauthorized editing and define retention periods consistent with applicable recordkeeping requirements. Provide a way to export a human-readable case history for compliance, quality assurance, complaints, and examination requests. Logging is an implementation recommendation; the legal reason to make it reliable is that the creditor must be able to support accurate explanations under Circular 2022-03.

Monitor accuracy, fairness, and operational failure
Review the agent after launch and at a frequency proportionate to its risk. Track more than approval rates. Useful measures include extraction error categories, calculation defects, exception volume and aging, override frequency, repeat corrections, adverse-action reason changes, complaints, and outcomes by relevant prohibited-basis and product segments where lawful and appropriate to analyze.
Investigate clusters instead of relying on a single aggregate metric. For example, a stable overall error rate can conceal systematic failures on self-employed income, nonstandard documents, or particular property types. Compare agent recommendations with qualified human decisions using a defined sample, document disagreements, and feed confirmed defects into remediation and revalidation.

The CFPB identifies discrimination, opacity, privacy problems, and inaccurate predictions arising from biased data or model construction as risks in its AI/ML adverse-action discussion. The ECOA baseline review procedures, updated July 23, 2026, help CFPB examiners identify and analyze ECOA risks and violations. They provide examination context, not a universal operating procedure for every lender.

Compare workflow designs before choosing one
There is no single regulator-issued scorecard for agentic mortgage workflows. Compare designs using the following practical axes:
| Comparison axis | Questions to answer | Stronger design characteristic |
|---|---|---|
| Automated actions | What can the agent read, change, send, or finalize? | Permissions are narrow, documented, and technically enforced. |
| Decision ownership | Which outcomes require a person, and who is authorized? | Consequential actions have a named, qualified owner with escalation support. |
| Evidence access | Can the reviewer inspect source documents, transformations, calculations, and rationale? | The review interface exposes underlying evidence and uncertainty. |
| Challenge authority | Can the reviewer correct data, reject an output, and pause processing? | The reviewer can alter the path without workarounds or hidden overrides. |
| Exception handling | How are conflicts, low confidence, and policy boundaries routed? | Deterministic stop rules, queue ownership, aging alerts, and escalation exist. |
| Adverse-action reconstruction | Can the lender show which actual factors produced the notice? | Decision factors and notice reasons are linked to versioned evidence. |
| Monitoring | How are errors, overrides, disparities, and changes detected? | Ongoing testing has thresholds, owners, remediation, and documented closure. |
Use this comparison during design review and procurement. It evaluates control quality, not whether a particular product is approved by a regulator.

- Inventory use cases. List every current and planned agent task, the data it touches, and the potential effect on a borrower’s eligibility, terms, or communications.
- Classify authority. Label each task as informational, preparatory, recommendatory, or consequential. Set technical permissions and human gates for each label.
- Define evidence standards. Specify acceptable sources, confidence thresholds, conflict rules, and the minimum evidence a reviewer must see.
- Write stop and escalation rules. Include missing data, contradictions, low confidence, out-of-policy recommendations, unexplained overrides, and unexplainable adverse-action reasons.
- Configure the review workspace. Display source evidence, agent reasoning artifacts, calculations, policy versions, warnings, and editable fields together.
- Train and authorize reviewers. Test their ability to find errors, change outcomes, document rationale, and escalate cases. Remove access when authorization expires.
- Implement immutable case history. Link inputs, outputs, versions, reviewer actions, final decisions, and applicant notices with timestamps.
- Run preproduction testing. Use representative and difficult cases, including conflicting documents and edge conditions. Test notice reasons against the actual decision factors.
- Launch with heightened monitoring. Sample cases, review overrides and exceptions, and establish a rapid rollback path for material defects.
- Reassess continuously. Review performance, fair-lending indicators, complaints, vendor changes, and policy updates; revalidate or retire the agent when it no longer fits its purpose.

Conflicting documents are silently resolved
Change the workflow so conflicts create a visible exception with both sources, timestamps, and a required resolution. Retrospectively sample completed files to determine whether similar conflicts affected outcomes.
A vendor update changes recommendations
Invoke change control, compare the new and prior versions on a controlled sample, notify governance owners, and roll back or restrict use if material behavior is unexplained. Update validation evidence and reviewer instructions before re-enabling broad use.
Monitoring shows a disparity or recurring error
Segregate affected cases, determine whether the issue is data, extraction, policy, or model behavior, and document corrective action. Consider re-underwriting or notifying applicants when an error may have changed a credit outcome, with legal and compliance guidance.
Prepare for examination and internal audit
Maintain a concise governance package for each material agent: purpose and scope, authority matrix, owner, risk assessment, testing and validation, data and version controls, reviewer training, exception metrics, monitoring results, change history, incident records, and sample reconstructed cases. Be able to demonstrate how a final decision was reached and how the stated adverse-action reasons match the factors actually used.
The CFPB’s Supervision and Examination Manual is an internal examiner guide that includes mortgage-origination and ECOA resources. It should inform preparation for examination conversations, but its procedures are not automatically binding requirements for every lender.
Bottom-line control standard
Automate preparation where it is safe, but reserve meaningful authority for people. A defensible mortgage-agent workflow lets a qualified reviewer see the evidence, understand uncertainty, change or reject the recommendation, escalate difficult cases, and leave a traceable rationale that supports the applicant’s notice. That approach aligns operational design with the creditor’s continuing ECOA duties while acknowledging that the April 17, 2026 model-risk guidance does not itself prescribe controls for generative or agentic AI.
