You usually cannot veto a lawful bank merger, acquisition, or FDIC resolution. When ownership of an institution changes, deposits can move automatically to a successor bank. Your practical control is over the estate’s rights: identify how the account is titled, prove your authority, preserve every record, and then keep, transfer, or close the funds when the bank permits it. If the money has already become unclaimed property, use the state’s claim process rather than a paid recovery service.

What a bank transfer changes—and what it does not

A successor bank may become the institution holding the account, but that change does not, by itself, change who owns the money. Ownership still follows the deposit agreement, beneficiary designation, survivorship language, probate order, trust instrument, and applicable state law.

In a purchase-and-assumption transaction, the FDIC says insured depositors immediately become depositors of the acquiring institution. The acquiring institution has no obligation to keep the failed bank’s interest rates or account terms. In many failed-bank transactions, insured depositors can establish a new account or withdraw insured funds without an early-withdrawal penalty. Those rights concern access to money; they do not give an heir a veto over the transaction.

An estate representative can often move the money after proving authority, even if the account has already migrated. An heir who is not the personal representative or named beneficiary may not be able to obtain information or withdraw funds simply by presenting a death certificate.

Identify the account structure before trying to move it

Ask the current or successor bank for the signature card, complete deposit agreement, beneficiary or payable-on-death (POD) designation, current balance, certificate-of-deposit (CD) maturity date, and any notice describing a merger or acquisition. The account contract is more reliable than an informal statement that a relative “left” you the account.

Account structure Who owns or controls it during life Who receives it at death Probate usually required? Who can act after death
Sole-name account The named owner Usually the estate unless a valid beneficiary designation applies Often yes, unless state law provides a small-estate or other shortcut The executor or administrator after appointment; the bank may require court documents
POD or informal revocable-trust account The owner, who can generally change or revoke the designation while alive The named beneficiary or beneficiaries under the account designation Generally no for the designated funds The beneficiary after presenting the death certificate and identification; the bank may require its claim forms
Joint account with rights of survivorship Joint owners, subject to the account agreement and state law The surviving joint owner or owners Generally no for the survivorship interest The surviving owner, after the bank verifies the death
Tenants-in-common account Each owner has a separate share The deceased owner’s share passes through that owner’s estate Usually yes for the deceased owner’s share The personal representative for the deceased owner’s share; surviving co-owners retain their own shares
Estate account The estate, administered by the personal representative Creditors, taxes, and heirs according to the estate administration The account exists because of probate or another estate appointment The executor or administrator named in the account records

The FDIC treats a POD account and certain revocable-trust arrangements as trust-category deposits for insurance purposes. By contrast, an account titled “Estate of [Name]” or “[Name], Decedent” is an estate account. Naming heirs on an estate account does not turn it into a trust account.

Follow this sequence to preserve access

1. Notify the bank and request a complete account review

Tell the bank that the named owner has died and that a merger, acquisition, or account transfer is pending or has occurred. Request written confirmation of:

  • the account title and ownership category;
  • all POD, beneficiary, trust, and survivorship designations;
  • the current balance, accrued interest, and any holds;
  • the maturity date and early-withdrawal rules for each CD;
  • the successor institution’s account number and contact channel;
  • the effective date of the transfer and any changed rates or terms; and
  • the procedure for an executor, administrator, surviving owner, or beneficiary to claim funds.

Ask for copies of the original signature card, deposit agreement, recent statements, transfer notice, and tax forms. Keep the old and new account numbers together; they may be needed to reconcile automatic payments, interest reporting, or an estate accounting.

2. Establish the correct authority

Most banks request a certified death certificate. Depending on the account type, they may also require:

  • the bank’s beneficiary claim or survivorship form;
  • an affidavit or small-estate order where state law permits a simplified transfer; or
  • a power-of-attorney document, if the proposed action occurred while the owner was alive and the bank accepts it.

FDIC guidance says someone seeking another person’s account information will probably need documentation proving the right to access it. A death certificate proves death; it does not, by itself, prove that you are entitled to control a sole-name account.

3. Use the proper account title for probate funds

For assets that belong to the probate estate, the personal representative commonly opens an account titled “Estate of [Name]” or “[Name], Decedent.” Deposit estate receipts there, pay approved debts and taxes, and distribute the remaining balance under the court’s instructions or applicable law.

For FDIC insurance, the agency treats a decedent estate account as the deceased owner’s single account. The standard maximum insurance amount for that ownership category is $250,000, subject to the applicable FDIC rules and aggregation of accounts in the same category. Listing heirs on the estate account does not create separate trust-category coverage.

4. Preserve evidence if a transfer is underway

Download or print statements before online access changes. Save the merger letter, FDIC notices, old checks, deposit slips, tax forms, CD certificates, and the successor bank’s deposit agreement. Record the names, dates, and reference numbers from every bank call.

Do not destroy the old checks immediately. Outstanding checks, automatic debits, direct deposits, and interest payments may continue during a transition, and the estate may need the documents for its final accounting.

5. Decide whether to stay, transfer, or close

Once the bank confirms your authority, ask for the exact options and any deadlines. Depending on the account, you may be able to:

  • leave the deposit at the successor bank under its new agreement;
  • transfer funds electronically to an estate or beneficiary account;
  • close a checking or savings account;
  • redeem a CD at maturity; or
  • withdraw an insured deposit in a failed-bank transaction without an early-withdrawal penalty, when the FDIC or acquiring bank provides that option.

For a CD, compare the maturity date, renewal instructions, interest rate, and penalty before giving closing instructions. A merger does not necessarily make a CD immediately payable. Get any promised penalty waiver in writing.

6. Reconcile the estate before distributing money

Before sending inherited funds to individual heirs, check for outstanding checks, funeral expenses, taxes, creditor claims, liens, and required court approvals. Keep a ledger showing the opening balance, interest, fees, transfers, and each distribution. A POD beneficiary may receive that account directly, but the beneficiary designation does not automatically resolve debts or disputes involving the broader estate.

7. Keep the account from becoming abandoned

Update the bank’s mailing address, email, and telephone records. Respond to account notices, log in periodically when appropriate, and keep evidence of activity. State dormancy periods commonly run about three to five years, but the exact period and definition of contact vary by state and account type.

What happens in a merger or FDIC resolution

Bank merger

When one healthy bank acquires another, the successor generally sends a conversion or transfer notice and supplies new routing or account information if needed. Your deposit contract may be replaced or amended. Review the new fee schedule, overdraft rules, interest rate, online-banking terms, statement cycle, and CD-renewal instructions rather than assuming they stayed the same.

FDIC guidance says deposits from merged institutions are separately insured for at least six months after the merger. CDs generally remain separately insured until the earliest maturity date after that period. This temporary treatment is an insurance rule, not a promise that the old bank’s branding, rates, or terms will continue.

Failed-bank purchase and assumption

In a failed-bank purchase-and-assumption transaction, the acquiring institution takes over deposits under the transaction’s terms. FDIC states that the acquiring institution has no obligation to maintain the failed bank’s rates or account-agreement terms. Follow the successor bank’s instructions for online access, checks, direct deposits, and withdrawals.

If you believe a transfer notice is wrong, ask the successor bank for a written explanation and contact the FDIC using the contact information in the official notice. A dispute about your beneficiary status or estate authority is different from a challenge to the bank transaction; the former may require probate or legal proceedings.

Understand the six-month death rule

When an account owner dies, FDIC says it will insure the deceased owner’s accounts as if the owner were still alive for six months after death. This gives survivors and the personal representative time to identify beneficiaries, retitle accounts, and restructure deposits.

The six-month period does not require the original bank to remain open, preserve its rates, or keep the account at the same institution. A bank can merge or fail during that period. Treat the rule as temporary insurance treatment while you complete the estate work, not as a right to block a transfer.

How abandonment and escheatment affect an inherited account

If the bank receives no qualifying contact for the state’s dormancy period, it may report and transfer the balance to the state’s unclaimed-property program. The state then holds the money for the owner or lawful claimant.

In certain failed-bank situations, FDIC guidance states that federal law requires unclaimed deposit accounts to be transferred to the state after 18 months. The applicable process depends on whether the bank failed and which institution currently holds the funds, so read the notice connected to the specific account.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Search the official unclaimed-property database for the state connected to the account. A personal representative should submit the appointment papers and death certificate; a beneficiary should submit the bank’s requested proof of identity and beneficiary status. FDIC says claimants can search and claim directly without paying a recovery service. Be cautious of anyone demanding an upfront fee or asking for unrestricted access to your estate documents.

FDIC insurance issues to check before moving large balances

Situation What to verify Practical action
Owner has died The six-month post-death treatment and the ownership category shown in the bank’s records Use the period to confirm beneficiaries, open an estate account if necessary, and restructure deposits
Institutions merged The six-month separate-insurance period and the earliest CD maturity after that period Keep merger records and plan any retitling before temporary coverage ends
Estate account Aggregation with other single accounts and the $250,000 standard maximum for that category Ask the bank’s deposit-insurance specialist to review the proposed account structure
POD or revocable-trust account Whether the designation is valid, current, and correctly recorded Provide the death certificate and claim documents before distributing funds

Insurance coverage is calculated by ownership category and institution, not simply by the number of account numbers. Ask the bank for a written coverage analysis if the estate holds more than the standard limit or has several ownership categories.

Common problems and how to resolve them

The bank refuses to discuss the account

Ask what document is missing and request the answer in writing. A front-line representative may not be authorized to interpret a will, trust, or probate order. Escalate to the bank’s deceased-account or estate department with the certified death certificate, appointment papers, and account number.

The bank says a beneficiary is not listed

Request the signed signature card and the bank’s beneficiary-record history. If no valid designation exists, the account may be a probate asset. Do not rely on a letter or family understanding that was never recorded in the account agreement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A joint owner withdrew money after death

Rights depend on whether the account provides survivorship, the source of the deposits, and state law. Preserve statements and consult the probate court or an estate attorney if the withdrawal is disputed. Do not label the withdrawal unauthorized solely because the other owner died.

The successor bank changed the interest rate or fees

That can be permitted after a merger or failed-bank acquisition. Compare the new agreement with the transfer notice, then decide whether to keep the account or move the funds. For a CD, confirm maturity and any applicable penalty before closing.

The account has already been sent to the state

Use the state’s official unclaimed-property process and submit proof of authority. The claim may be payable to the estate, a named beneficiary, or a surviving owner depending on the account title. Keep copies of every filing and follow up using the state’s claim number.

When state-specific legal advice is worthwhile

Federal FDIC guidance explains insurance and failed-bank procedures, but state law controls many ownership and probate questions. Obtain advice from a licensed probate or estate attorney when:

  • the will, trust, beneficiary form, and account title conflict;
  • the account is subject to community-property rules;
  • multiple heirs dispute a POD or survivorship designation;
  • a creditor, tax authority, or former spouse claims the funds;
  • you need a small-estate affidavit or court order;
  • the bank will not recognize your appointment; or
  • the balance, CD penalties, or insurance limits are substantial.

Bring the complete account agreement, statements, transfer notices, death certificate, will or trust, and court appointment to the consultation. The attorney can determine whether the issue is a bank-service dispute, a probate proceeding, or a claim against another beneficiary.

Bottom line

You generally cannot stop a lawful transfer of deposits to a successor bank. You can protect the inheritance by proving the right person’s authority, confirming the account’s ownership form, preserving records, monitoring temporary FDIC insurance treatment, and moving or restructuring the funds before inactivity or a changed account agreement creates a new problem. If the balance has escheated, claim it directly from the state with the documents that establish the estate’s or beneficiary’s right.
