Do not treat an AI interview score as a final verdict. It is an output of a configured system: the job description, interview questions, time limits, transcription, scoring rubric and human review can all affect the result. Preserve those inputs, ask the employer for a human review and a written explanation, identify the specific error or barrier, and request a corrected assessment or reasonable alternative.
There is no single nationwide appeal procedure for automated interview decisions. In New York City, Local Law 144 creates specific notice, audit and posting duties for covered automated employment decision tools (AEDTs), but those duties are not the same as a guaranteed right to have every score overturned. Your strongest case is a dated, evidence-based record showing what went wrong and what review or accommodation you need.
What an AI interview rejection actually means
An automated interview result can be a ranking, a score, a recommendation, a transcription, or a combination of these. The practical question is how much the software influenced the hiring decision. New York City rules distinguish tools that substantially assist or replace discretionary decision-making; a system that only records an interview raises different questions from one that determines who advances.

It reflects the employer’s configuration and the information the system received. A narrowly worded question, a short response timer, a speech-to-text mistake, a dropped connection or a rubric that rewards a particular communication style can change the recorded evidence before a recruiter sees it. Even when a person makes the final decision, that person may be relying on an incomplete transcript or a numerical band.

Start by finding out what role the software played:
- Transcription only: the platform converted speech to text, while a person evaluated the answer.
- Scoring or ranking: the platform applied criteria and ordered candidates.
- Recommendation: the platform suggested who should advance, but a recruiter could disagree.
- Decision support with human approval: the employer reviewed, revised or approved questions and criteria and used the model to inform a hiring decision.
- Automated exclusion: the output may have screened you out before meaningful human review.
Ask which description applies rather than arguing about “AI” in the abstract. The answer determines what records to request and whether a human can realistically correct the decision.
Preserve the complete decision trail before it disappears
Platforms, applicant portals and email systems can overwrite recordings or logs. Save your own copy as soon as possible, keeping original files and noting when each item was downloaded.
- Save the invitation and consent screens. Keep the email or portal page that identifies the interview provider, any consent language, privacy notice, monitoring disclosure and accessibility instructions.
- Save the job description. Include the version visible when you applied, not only a later posting. The description helps test whether the scored criterion was actually related to the role.
- Save every question and answer. Export the transcript if available and keep the video or audio recording. If the system does not provide a download, take dated screenshots and write down the exact wording while you still remember it.
- Save the result. Keep the score report, status page, rejection email, recruiter messages and any explanation of score bands or cutoffs.
- Record the conditions. Note the date and time, device, operating system, browser, camera and microphone, network interruptions, reloads, time-limit warnings and whether you asked technical support for help.
- Record people and dates. Identify the recruiter, accessibility contact, support representative and anyone who said a human reviewed the result. Maintain a simple chronological log.
- Preserve accommodation evidence. Keep requests, approvals, denials, medical or functional documentation you voluntarily supplied, and messages about alternate formats or extra time.
This packet is useful even when you are unsure whether discrimination occurred. It lets a reviewer compare the question, the intended answer, the transcript and the score instead of debating a feeling about fairness.
Request a human review in writing
Send a concise request to recruiting and, if listed, the employer’s accessibility or equal-employment contact. Ask for a response in writing and keep the sent message. You are asking for clarification and reconsideration, not asserting a legal right that may not exist in your jurisdiction.

Questions that identify the decision path
- What automated employment decision tool, interview provider or feature was used?
- Did the tool transcribe, score, rank or recommend candidates, and did its output materially influence my rejection?
- What questions, criteria, rubric, score bands or thresholds were applied to my interview?
- Was my recording or transcript reviewed by a human, and can that reviewer correct an inaccurate input?
- Can the employer conduct a fresh human evaluation without relying on the disputed score?
- What is the process and deadline for requesting reconsideration or an alternative assessment?
Ask for the specific record needed to understand the result, such as the transcript, the question-level score or the explanation of a cutoff. Employers may not disclose proprietary code or another candidate’s information, but that does not prevent you from describing an error and requesting a human review.
Describe the concrete failure, not only the unfair feeling
A reviewer can act on a verifiable defect. Match each problem to the record it affected.

Transcription or interpretation error
Quote the incorrect transcript and provide what you actually said, with the time stamp if available. Explain how the error changed the apparent answer. Request correction of the transcript and rescoring using the corrected text or the recording.
Time limit or technical interruption
Identify the question, the warning or interruption, the duration and any support ticket. A response cut short by a browser crash is different from an answer that simply missed the rubric. Ask for the affected question to be reviewed without penalizing the interruption, or for a new human-led response.
Accent, speech difference or language issue
State that the system misunderstood particular words or treated a speech pattern as a lack of knowledge. Provide the corrected wording and ask whether a human listened to the audio. Do not accept a claim that a low transcription confidence automatically proves a weak answer.

Disability-related barrier
Describe the functional barrier—such as inability to use a timed video interface, speech-related recognition errors, or a need for captions or another input method—and the assessment method that would measure the job skill instead. Request a reasonable accommodation or an alternative assessment. No national form or deadline is established, so follow the employer’s published process and keep the request factual.
Criterion unrelated to the job
Point to the question or scored behavior and explain why it is not a requirement of the advertised role. Ask the employer to identify the job-related competency it represents and to reassess if the connection cannot be explained.
Ask for an accommodation or alternative assessment
Make the request specific enough to implement. Examples include a live interview with a human, typed responses, additional response time, captions, a different recording method, or evaluation of the audio rather than automated speech features. The appropriate option depends on the barrier and the essential job skill; do not request a generic “AI exemption” without explaining what access problem it solves.
Use a short structure:
- Name the interview stage and the barrier.
- Describe how the barrier affected a particular question, transcript or score.
- Request the alternative assessment or human review that would remove that barrier.
- Attach the relevant transcript, support ticket or accommodation correspondence.
- Ask for confirmation of the next step and any deadline.
Keep medical details limited to what the employer’s legitimate accommodation process requires. You can ask which documentation is needed before sending sensitive information.
Use New York City’s Local Law 144 when it applies
Local Law 144 covers certain automated employment decision tools used by employers or employment agencies in New York City. The New York City Department of Consumer and Worker Protection (DCWP) states that a covered tool must have undergone a bias audit within one year of use, information about that audit must be publicly available, and required notices must be provided to employees or job candidates. DCWP enforcement began July 5, 2023. Its current guidance says the notice timing was clarified to 10 business days before AEDT use.

Coverage depends on the job, employer, agency and tool, so do not assume that every online interview is covered. Ask the employer whether the role and tool fall within the law and where the audit information and notice are posted. If the required audit, posting or notice is missing, DCWP says candidates can complain through its enforcement process. A complaint about a notice or audit failure is separate from proving that your individual score was wrong.
What Local Law 144 does not automatically provide
The NYC requirements establish transparency and audit duties; they do not create one universal appeal, rescoring or reinstatement process. A compliant notice does not prove that your result was accurate, and a missing notice does not by itself establish why you were rejected. Use the law to obtain the compliance information and then pursue human review, accommodation or another remedy appropriate to the facts.
How to read an employer’s bias-audit disclosure
Do not treat a “passed” audit as a guarantee that an individual decision was fair. Compare the report’s methods with the decision you are challenging.
| What to inspect | Questions to ask | Why it matters |
|---|---|---|
| Decision role | Did the system rank, score, recommend, transcribe or replace discretion? | A transcription error has a different remedy from an automated cutoff. |
| Data source | Were results based on real candidates, inferred labels or synthetic personas? | Synthetic or inferred data may not represent your circumstances. |
| Protected-group coverage | Which race, ethnicity, age, sex and intersectional groups were tested? Which were excluded? | An audit cannot speak to groups it did not examine. |
| Metric and denominator | Is the report using selection rate or scoring rate, what is the reference group, and how large is each sample? | The denominator and sample size affect interpretation. |
| Human control | Can a recruiter inspect the recording, correct the input, override the output and document the reason? | Real review authority determines whether an error can be fixed. |
| Freshness and disclosure | Is the audit within one year, publicly posted and paired with the required notice? | These are central Local Law 144 compliance conditions. |
NYC rules define scoring rate as the proportion of a demographic category scoring above the overall median. That is not the same as the probability that one named candidate was wrongly rejected. The federal four-fifths benchmark described in Eightfold AI/BABL AI’s 2026 disclosure treats an impact ratio below 0.80 as generally regarded as evidence of adverse impact. Both are group-level screening measures.

The same 2026 disclosure reports a female-to-male impact ratio of 0.990 and a below-40-to-above-40 ratio of 0.902 under its disclosed data and methodology. Those figures are vendor-reported audit results, not universal performance guarantees and not proof that every protected group was tested. The disclosure states that it used synthetic race/ethnicity and intersectional tests, inferred age labels and exclusions for several protected classes. It also expressly says: “The audit does not certify that the model is bias-free. No audit can make that claim.”

When reading any report, record the audit date, tool version or configuration, population, labels, reference group and excluded categories. A favorable ratio calculated on a different configuration or population may not describe the interview you completed.
Build an escalation packet if the employer will not fix the record
Give the employer a reasonable opportunity to answer, then escalate with an organized file rather than a chain of unstructured messages.
- Chronology: list application, interview, interruption, support request, rejection and review requests by date.
- Decision evidence: attach the invitation, notices, job description, questions, transcript or recording, score and rejection.
- Error statement: identify the exact question or criterion, what the system recorded, what actually happened and how the result changed.
- Requested remedy: specify corrected transcription, rescoring, human interview, accommodation, explanation or reconsideration.
- Compliance evidence: for a NYC role, note whether the audit information and 10-business-day notice were available and preserve screenshots.
- Response log: include names, dates, promises and refusals.
Depending on location and facts, recipients may include the relevant consumer or labor regulator, a civil-rights agency, a union, an employment lawyer, an accessibility specialist or a worker-rights clinic. Outside New York City, the available remedy and filing deadline vary by jurisdiction; the materials summarized here do not establish a single national route.

Subject: Request for human review of automated interview decision
I am requesting a human review of my interview for [role] on [date]. Please confirm the name of the automated interview or employment decision tool, whether its output materially influenced the rejection, and whether a human reviewed my recording and transcript.
The specific issue is [question/time stamp]. The system recorded [error or interruption], while my answer was [brief correction]. This affected [score, missing answer or criterion]. Please correct the record and reconsider my application using a human evaluation. If the format created an accessibility barrier, I request [alternative assessment or accommodation].
Please provide the reconsideration process, deadline, and the applicable rubric or score-band explanation. I have preserved the invitation, notices, job description, transcript/recording, result and support messages and can provide them securely.
Replace the bracketed text with facts, not conclusions. A short, precise request is easier for a recruiter or accessibility team to route than a broad accusation.
Common mistakes that weaken a challenge
- Deleting the original evidence: editing a transcript or screenshot without keeping the original makes comparison harder.
- Demanding source code: the actionable request is the tool’s role, criteria, record and human-review path, not proprietary code.
- Confusing an audit ratio with an individual finding: group metrics can signal adverse impact but do not establish what happened in your interview.
- Assuming a “human in the loop” solves everything: ask what the human actually inspected and whether the person could override the score.
- Making an accommodation request only verbally: put the barrier and requested alternative in writing.
- Missing local deadlines: preserve the date of the rejection and check the employer’s process and your jurisdiction’s filing rules promptly.
- Using one template for every error: a transcription correction, a disability accommodation and a missing NYC notice require different evidence and remedies.
Decision guide: which next step fits your situation?
| Your evidence | First request | Useful attachment |
|---|---|---|
| Wrong words in transcript | Corrected transcript and rescoring by a person | Time-stamped recording and quoted correction |
| Camera, microphone or network failure | New interview or human evaluation without the interrupted answer | Support ticket, browser/device details and timeline |
| Accent or speech-recognition problem | Human listening review or non-automated response method | Examples of misheard phrases and audio |
| Disability-related barrier | Reasonable accommodation or alternative assessment | Functional description and prior request |
| Unrelated scoring criterion | Explanation of job-relatedness and reconsideration | Job description and rubric language |
| Missing NYC notice or public audit | Employer compliance explanation; consider a DCWP complaint | Screenshots, job location and dates |
What a fair resolution looks like
A meaningful response identifies the tool’s role, explains the relevant criteria, confirms whether a person reviewed the underlying evidence, corrects demonstrable errors and offers an accessible way to demonstrate the job skill. It may result in a new assessment rather than an automatic job offer. If the employer cannot explain the decision or refuses to preserve and review the record, your chronology and evidence packet become the foundation for an external complaint or legal advice.
