Your rights depend mainly on the route, the airline operating each flight, what went wrong, and what you chose to do next. Start by identifying the applicable jurisdiction, then consider care while waiting, a refund or re-routing, statutory compensation, and reimbursement of reasonable expenses as separate possibilities. A right to one does not automatically mean a right to all.

First, work out which rules cover your flight

Check the departure and arrival airports and the operating carrier for every affected leg. A flight can be covered because it departs a territory, arrives there on a qualifying airline, or both. The company that sold your ticket or the airline whose code appears on it may not be the carrier operating the flight. For connections, check each affected leg and preserve the full ticketed itinerary.

  • European Union: EU passenger rules cover flights within the EU on any airline, flights departing the EU to a non-EU country on any airline, and flights arriving in the EU from outside it on an EU airline. The Council of the EU summarizes this scope on its passenger-rights page.
  • United Kingdom: UK rules cover flights departing a UK airport on any airline, flights arriving in the UK on a UK or EU airline, and flights arriving at an EU airport on a UK airline. UK government guidance says coverage does not depend on how the flight was booked.
  • United States: US Department of Transportation (DOT) refund rules apply to US and foreign airlines for covered scheduled travel to, from, or within the United States. The federal refund right is focused on cancellation or a significant change when the passenger does not accept the alternative.
  • Canada: The Air Passenger Protection Regulations (APPR) cover flights to, from, and within Canada, including connections. The remedy depends in part on the disruption category and whether the airline is large or small.

These rules are not worldwide. For routes outside these jurisdictions, check the relevant country’s official passenger-rights rules and the operating airline’s commitments rather than assuming nationality, booking location, or airline brand determines your rights.

Which remedy are you looking for?

Before filing a claim, distinguish the remedy you want. These are separate questions, and more than one may apply to the same disruption.

  • Care while you wait: Meals, refreshments, communications, and, where needed, overnight accommodation and transport. The applicable trigger and what the airline must provide vary by jurisdiction.
  • Refund or re-routing: Depending on the event and rules, you may be able to abandon the trip for a refund, take an alternative flight, or choose a later flight. Choosing a refund can end a right to one of the re-routing choices, while a separate compensation claim may still be possible.
  • Fixed statutory compensation: EU and UK rules provide fixed amounts in qualifying cases. US federal refund rules do not create the same kind of fixed compensation for delay. Canadian inconvenience compensation depends on the APPR eligibility conditions.
  • Reasonable out-of-pocket costs: If the airline does not provide required care, necessary and reasonable costs may be claimable under the relevant rules. Keep itemized receipts; paying for your own arrangements does not itself establish that the airline owes reimbursement.

How the EU, UK, US, and Canadian rules differ

This comparison is a starting point, not a decision on an individual claim. In each row, eligibility still depends on the route, carrier, event, timing, and choices made.

Cancellation notice, re-routing offered, and extraordinary circumstances can affect eligibility; the carrier must prove extraordinary circumstances under European Commission guidance. Cancellation and denied boarding generally require a choice of ticket reimbursement, re-routing at the earliest opportunity, or re-routing later at the passenger’s convenience, subject to seats. A departure delay of at least five hours allows the passenger to choose a refund and, where relevant, a return to the first departure point. Care thresholds depend on distance. European Commission Your Europe guidance, last checked 21 September 2026, lists €250 for flights of 1,500 km or less; €400 for qualifying intra-EU flights over 1,500 km and other flights between 1,500 and 3,500 km; and €600 for other flights. It gives no general claim deadline in the cited guidance. Start with the airline. The cited guidance does not establish a single escalation route or claim deadline for every EU country.
UK Possible compensation if arrival is more than three hours late, subject to exceptions including extraordinary circumstances. Cancellation compensation also depends on notice, replacement journey, and cause. CAA care thresholds are at least two hours for flights under 1,500 km, three hours for flights between 1,500 and 3,500 km, and four hours for flights over 3,500 km. Care includes food and drink, two calls or emails, and necessary overnight accommodation and transfers, regardless of the reason for delay. At five hours’ delay, a passenger can choose not to travel and seek a refund for unused flights. For cancellation, UK government guidance describes a choice of refund or alternative flight. UK CAA guidance gives the thresholds above; the cited pages do not specify a general claim deadline. Claim directly with the airline. If unresolved, use the airline’s ADR provider if it is a member, or the CAA / Consumer Council for flights to and from Northern Ireland as applicable.
US A refund is due under DOT rules if the flight is cancelled or significantly changed or delayed and the passenger declines the alternative and does not accept travel credit, vouchers, or other offered compensation. Refunds include the ticket and relevant unused ancillary services. Taking the changed or alternative flight generally means no ticket refund is due under this rule. For meals, hotels, or other service commitments beyond a refund, check the operating airline’s customer-service commitments. DOT says refunds are due within seven business days for credit-card payment and 20 calendar days for other forms of payment. The federal rules do not promise fixed compensation for delay comparable to EU or UK schemes. Contact the airline first; submit a consumer complaint to DOT if the airline does not resolve a refund or service complaint.
Canada APPR categorizes disruptions as within airline control, within airline control but required for safety, or outside airline control. Inconvenience compensation generally requires a cause fully within airline control and not safety-related, notice 14 days or less before departure, final arrival at least three hours late, and a written claim within one year. Airline size also affects remedies. Rebooking and refund obligations vary by disruption category and whether the carrier is large or small. Rebooking or a refund may be owed even when inconvenience compensation is not. The Canadian Transportation Agency’s compensation guidance describes the one-year written-claim deadline and eligibility conditions above; compensation amounts depend on the applicable APPR rules. Make a written claim to the airline and keep proof of contact. If unresolved, use the Canadian Transportation Agency (CTA) complaint route.

The EU Council reported that updated air-passenger rules were approved in July 2026. The official materials described here do not establish an effective date or transition rules for all provisions, so do not assume the update governs a particular claim without checking the current legal text and commencement.

What happened, and what was your final arrival?

Identify whether the issue was a cancellation, delay, denied boarding, or a significant schedule change. Then record the reason the airline gave and when it notified you. The reason matters differently across regimes: for example, extraordinary circumstances can affect EU and UK compensation, while Canada’s control and safety categories affect compensation and rebooking duties.

For a connecting itinerary, record your actual arrival at the ticketed final destination, not only the delay at an intermediate airport or the late departure from the first airport. Keep the original itinerary and the replacement routing so the airline or regulator can assess the whole journey.

How to prepare and submit a claim

  1. Save your itinerary: Download the booking confirmation and note each flight number, operating carrier, origin, destination, and connection.
  2. Keep disruption evidence: Save cancellation or delay messages, the reason given, replacement-flight offers, boarding passes, and relevant airport notices. Note when notice arrived.
  3. Record the outcome: Write down the actual arrival time at the final ticketed destination and retain connection details.
  4. Ask about assistance first: Ask airline staff what care and re-routing are available before arranging your own food or lodging. If you must pay, choose reasonable options and retain itemized receipts.
  5. Choose your priority: Decide whether you want to continue the journey or abandon it and seek an available refund. Check the consequences of that choice under the applicable rules before accepting an offer.
  6. Write to the airline: Use its official claims channel. Include your name, booking reference, flight number, airports, what happened, when you were notified, actual final arrival time, the remedy you seek, and supporting documents. Keep a copy and proof of submission.
  7. Escalate if needed: If refused, ask the airline to identify the rule and facts it relied on. Then use the regulator, national enforcement body, ADR provider, CTA, or DOT route applicable to your itinerary.

Check travel insurance for costs not covered by the airline, but read the policy’s disruption triggers, exclusions, documentation requirements, and deadlines. Insurance is supplementary; it does not replace a claim to the airline for a statutory remedy.

How to read an airline’s refusal

A short explanation such as “weather,” “operational reasons,” or “safety” is not enough to determine every right. Ask the airline to identify the disruption category or legal basis it is relying on, explain how it assessed your itinerary and arrival time, and address each remedy separately. A refusal of fixed compensation does not necessarily settle a separate request for care, refund, re-routing, or reasonable expenses.
