Use the channel that matches the problem. Send benefit, contribution, document, calculation, or claim-processing disputes to the retirement plan administrator under the plan’s Summary Plan Description (SPD). Send an insurer’s delay, denial, cancellation, or communication problem to the insurer first, then to the insurance department in the state that regulates the policy. A private-employer plan may be governed by ERISA, while government plans and some church plans generally are not.
Keep the plan or policy documents, a dated timeline, every letter and portal message, proof of delivery, and the specific correction you want. Follow the plan’s internal claim and appeal process even if you also ask a regulator for help.
Choose the right complaint route first
The same retirement benefit can involve two different legal relationships: the plan administrator decides what the plan owes, while an insurer may process or pay benefits under a policy. Filing with the wrong organization can delay a correction or leave an appeal deadline running.
| Problem | Start with | Governing rules | What the route can do |
|---|---|---|---|
| Missing SPD, statements, or other plan documents | Plan administrator, using the SPD’s contact and delivery instructions | Plan terms; ERISA document rights when ERISA applies | Obtain the document or create a record of the request |
| Wrong contribution, account balance, benefit calculation, or payment amount | Plan administrator | Plan document and SPD; ERISA where applicable | Correction, recalculation, or payment under the plan |
| Denied retirement-plan claim | Plan administrator’s claim and appeal process | SPD, claims-procedure booklet, and applicable ERISA procedures | Internal review and a written decision |
| Plan does not respond, provide required documents, or follow its procedure | Employee Benefits Security Administration (EBSA), after preserving your plan submissions | ERISA administration and fiduciary standards, when ERISA covers the plan | Benefits-advisor assistance and possible informal resolution or investigation |
| Insurer delay, denial, cancellation, policy interpretation, or poor communication | Insurer’s complaint or claims department | Policy or certificate and state insurance law | Written explanation, correction, or reconsideration |
| Insurer does not resolve the issue | Insurance department in the proper state | State insurance law and the department’s procedures | Regulatory review of possible unfair delay, denial, policy violations, or communication failures |
A state insurance department does not replace a plan’s required appeal, and EBSA does not replace that appeal either. Preserve every internal deadline while seeking outside help.

Confirm which law and regulator apply
Check the plan sponsor
ERISA is a 1974 federal law that sets minimum standards for most voluntarily established private-sector retirement plans. It requires plan information, fiduciary standards, claim and appeal procedures, and specified enforcement rights. The employer or other legal sponsor is identified in the SPD or plan documents.
Federal, state, and local government plans, and some church plans, may be outside ERISA. Their complaint channels can be set by a public-employer system, a state retirement statute, or the plan’s own rules. Do not assume that a plan using an insurance company is an ERISA plan, or that every pension is regulated by the same agency.
Use the SPD as the control document
The SPD describes eligibility, covered benefits, where and how to file a claim, required information, appeal levels, deadlines, and the address or electronic method for delivery. A separate claims-procedure booklet may add the operational details. If you cannot find either document, request it in writing from the plan administrator and retain your request and delivery proof.
Separate the plan’s decision from the insurer’s conduct
An insurer may be performing administrative or payment work for a retirement plan, but the complaint still needs to identify what went wrong. A dispute over whether the plan owes a benefit belongs in the plan’s claim and appeal process. A complaint that the insurer lost paperwork, delayed a response, miscommunicated policy terms, or handled a policy claim unfairly should be raised with the insurer and, if necessary, the state insurance department.
Build an evidence file before contacting anyone
Create one dated folder, digital or paper, and use consistent file names. Send copies rather than irreplaceable originals. Redact unrelated personal information when a submission method permits it.
- The current SPD and any claims-procedure or appeal booklet.
- Plan statements, contribution records, distribution calculations, and account-history screenshots.
- The insurance policy or certificate, policy number, and claim number, if an insurer is involved.
- Claim forms, supporting bills, medical or employment records that the plan or policy actually requires, denial letters, and explanation-of-benefits documents.
- Your complaint, appeal, attachments, and proof of delivery, such as a certified-mail receipt, delivery confirmation, or portal acknowledgment.
- Letters, email, secure-portal messages, call dates, names, job titles, reference numbers, and promised follow-up dates.
- A one-page chronological timeline and a short statement of the exact remedy requested.
Write a one-page timeline
- Record the date of the event, such as a contribution, retirement application, claim, payment, or document request.
- Record the date and method of each submission or call and identify the recipient.
- Quote or summarize the response, including any reason given for a delay or denial.
- Mark the deadline stated in the SPD, denial letter, policy, or regulator correspondence.
- State the correction you seek in one sentence, such as “recalculate the monthly benefit under section X and issue the unpaid amount.”
A factual timeline is more useful than a long narrative about motives. Attach the documents that prove each important date.
File a retirement-plan complaint or claim
1. Follow the SPD’s filing method
Address the submission to the plan administrator or claims administrator named in the SPD. Use the required mailing address, portal, fax, or other method; an informal email to a payroll contact may not count as a claim. Plans cannot charge a fee for filing a claim or appeal.

2. State the facts and requested correction
Identify yourself and the plan, provide the relevant dates, describe the benefit or document at issue, cite the plan provision when you can, and list the attachments. Ask for a written decision. If you are requesting a document, name it precisely and state when you first requested it.
3. Keep complete submission proof
Save the exact text, every attachment, the transmission receipt, and any automated acknowledgment. If you mail the package, use a service that records delivery. A complete copy lets you show what information the administrator had and when the procedural clock began.
4. Track the decision period
For a covered benefit claim, the Department of Labor guide describes a normal maximum of 90 days for the initial decision. The plan may take an additional 90 days only with the required extension notice, making the outer period 180 days. Other claim categories can have different rules, so check the SPD and the notice you receive.
A denial must give the specific reasons, identify the plan provisions relied on, explain any additional appeal levels, tell you how to obtain relevant claim documents, and explain judicial-review rights. A vague statement that the claim is “not covered” is not the detailed explanation described by the DOL procedure.

Count the appeal period from the denial
The DOL guide says a claimant generally has 60 days to request a full and fair review. The denial notice and SPD control the exact deadline and delivery method. Calendar the date immediately and allow time for receipt, not just mailing.
Submit the complete record
Identify each reason for denial and answer it with the plan language, calculations, statements, correspondence, and other evidence that supports your position. Ask for access to relevant documents you have not received. Include a short index so the reviewer can locate each item.
Expect a written appeal decision
An appeal decision can take up to 60 days, with an additional 60 days when the plan gives the required extension notice. Keep monitoring the deadline and save any extension notice. If the plan misses a required response, document the missed date rather than assuming silence means approval.

Do not abandon the appeal because you contacted a regulator
An EBSA inquiry or an insurance-department complaint does not automatically suspend the plan’s appeal clock. Submit the internal appeal as required unless the plan gives you a written alternative.

Contact the U.S. Department of Labor’s Employee Benefits Security Administration through Ask EBSA or by telephone at 1-866-444-3272 when an ERISA-covered plan does not respond, withholds required documents, fails to provide a written decision, mishandles a claim or appeal, calculates benefits incorrectly, or may violate ERISA. Provide your evidence file and explain the procedural step you already completed.
EBSA benefits advisors may help participants obtain benefits and seek an informal resolution. EBSA is a federal assistance and enforcement channel; it is not a substitute for submitting the claim or appeal required by the SPD. Explain whether your plan is private-sector and why you believe ERISA applies. If it is a government or potentially exempt church plan, ask the plan or the relevant public retirement authority for its designated review process instead.
What to send EBSA
- Plan name, sponsor, administrator, and your contact information.
- SPD pages showing the filing and appeal rules.
- Your claim, denial, appeal, and proof of delivery.
- A concise description of the error, missed response, or missing document.
- The remedy you want and any deadline that is approaching.
Do not send unrelated account information. Keep the originals and note the date and name of every EBSA contact.
Know your protections and when to seek legal advice
ERISA can support actions to recover benefits, obtain requested plan documents, clarify rights to future benefits, or address fiduciary-duty breaches. After a final internal denial, the DOL advises that you may seek legal advice. A lawyer who handles ERISA benefits can evaluate the plan language, administrative record, review standard, and any filing deadline. Do not wait for an informal inquiry to expire a court or plan deadline.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsThe Department of Labor states that employers are prohibited from firing or disciplining employees to avoid paying a benefit, as retaliation for exercising rights provided by a plan or ERISA.
Keep evidence of any adverse employment action, including dates, decision-makers, stated reasons, and witnesses. A retaliation concern is distinct from the underlying benefit calculation, so describe both issues clearly.

Complain about an insurer handling retirement benefits
1. Start with the insurer
Ask the insurer’s claims or complaint department for a written explanation and the correction you want. Include the policy or certificate number, claim number, relevant dates, bills or other required proof, and copies of prior correspondence. Request a response by a stated date that is reasonable under the policy or the insurer’s published process.
Maintain a call log with the date, representative’s name and title, reference number, promises made, and the date promised for follow-up. Save portal messages and screenshots because access can change after a claim closes.

2. Prepare the state-regulator submission
The National Association of Insurance Commissioners advises gathering the policy number, documentation, bills, and communication record; writing a factual timeline; using policy language where useful; and stating the outcome sought. Explain what the insurer did, when it did it, and why the policy or applicable law appears to require a different result.
3. File with the correct state insurance department
Use the NAIC directory to identify the insurance department for the state with jurisdiction over the policy and to find its online, mail, or telephone process. State procedures and response times vary. The department may investigate possible unfair claim delay or denial, failure to honor the policy, violations of state insurance law, or inadequate communication. It may request the insurer’s records and a response, but it does not necessarily award every type of private remedy a court could provide.
4. Continue responding to requests
Send the regulator only the documents it requests, in the format it specifies, and keep a copy of everything. Answer factual questions promptly. If the insurer offers a resolution, compare it with the policy and your requested correction before accepting it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Coordinate overlapping plan and insurer complaints
One dispute can require two tracks. For example, if a plan’s administrator incorrectly calculates a pension and an insurer also fails to answer calls, appeal the calculation under the SPD while separately filing the insurer complaint. Describe the same event consistently, but identify which entity made each decision.
| Question | Plan track | Insurer track |
|---|---|---|
| Who decides the first review? | Plan administrator or claims administrator named in the SPD | Insurer’s claims or complaint department |
| What document controls? | SPD, plan document, and claims-procedure booklet | Policy or certificate and endorsements |
| What deadline matters first? | Claim and appeal deadlines in the SPD and denial notice | Policy, insurer, and state-department deadlines |
| Outside escalation | EBSA for ERISA administration and procedural failures | State insurance department for insurer-regulated conduct |
| Typical remedy | Benefit correction, documents, procedural compliance, or legal action | Reconsideration, explanation, corrective handling, or regulatory action |
Tell each organization that another complaint exists when relevant. Neither filing automatically pauses the other process.

Common mistakes and how to fix them
Sending a complaint to payroll instead of the administrator
Payroll may not be the entity authorized to decide a claim. Locate the administrator and required address in the SPD, then resend the complete submission using the specified method.
Missing an appeal deadline while waiting for a phone call
A phone promise is not a written extension. File the appeal on time, explain that a separate complaint is pending, and attach the denial and your prior communications.
Submitting conclusions without evidence
Replace statements such as “the insurer is cheating me” with dates, policy sections, payment amounts, and the document that proves each fact. State the remedy in measurable terms.

Assuming every retirement plan is covered by ERISA
Check the legal sponsor and the SPD. If the plan is governmental or a potentially exempt church plan, ask for its governing complaint process instead of assuming EBSA has jurisdiction.
Treating regulatory contact as a lawsuit
EBSA and a state insurance department can help investigate or seek correction, but they do not guarantee a particular payment or replace legal advice after a final denial. Preserve all court and contractual deadlines.
A practical filing checklist
- Identify whether the issue is plan administration, a plan claim, or insurer conduct.
- Find the SPD, claims-procedure booklet, policy or certificate, and sponsor information.
- Confirm whether the plan is private-sector and potentially ERISA-covered, or governmental or church-sponsored.
- Create the dated evidence folder and one-page timeline.
- Write the requested correction in one sentence.
- Submit to the plan administrator or insurer using the required method.
- Save the complete submission and proof of delivery.
- Calendar every response and appeal deadline.
- Appeal a plan denial with all supporting evidence within the stated period.
- Escalate procedural or ERISA problems to EBSA, and unresolved insurer conduct to the proper state insurance department.
- After a final denial, obtain qualified legal advice promptly if the benefit is significant or a deadline is near.
The strongest complaint is specific, timely, and documented: it identifies the responsible entity, cites the governing document, shows the chronology, and asks for a defined correction.
