Start with the security job, not the vendor’s “AI-powered” label. Define the decision the system must improve, the environment and data it will encounter, the people who will act on its output, and the evidence that would demonstrate useful results. Then investigate the supplier and its dependencies, assess AI-specific trustworthiness and conventional product security, test material claims on representative tasks, and contract for monitoring, incident response, continuity, updates, and exit.

The process below turns that sequence into a repeatable buying evaluation. It is based on the NIST Cybersecurity Supply Chain Risk Management: Due Diligence Assessment Quick-Start Guide (SP 1326), NIST’s AI Risk Management Framework and Generative AI Profile, and CISA’s Secure by Demand Guide. These frameworks organize questions and evidence; they do not certify a product or guarantee that it will be safe or effective for your use case.

1. Define what you are buying the system to do

An AI security product is suitable only in relation to a specific task and operating context. Write a one-page use-case statement before taking demonstrations or scoring vendors.

Specify the security task

Describe the job in operational terms: for example, triaging a defined class of alerts, finding suspicious code in a stated development workflow, summarizing incident evidence for an analyst, or identifying a particular control gap. Avoid objectives such as “use AI to improve security,” which cannot produce a measurable acceptance test.

Describe the operating environment

  • List the networks, cloud accounts, endpoints, repositories, identity systems, ticketing tools, and other systems the service would access.
  • State whether it runs in your tenant, a vendor-hosted environment, an on-premises deployment, or a hybrid architecture.
  • Identify latency, availability, isolation, and geographic requirements. Include regulated or classified environments if they are in scope.
  • Record the administrators, analysts, developers, or business users who can see results or trigger actions.

Map the data exposure

Inventory the information entering prompts, sensors, connectors, logs, or training pipelines. Mark credentials, personal information, customer content, source code, vulnerability data, and intellectual property separately. For each category, decide whether the vendor may retain it, use it for model improvement, transfer it to a subcontractor, or export it to another region. Do not accept a generic “enterprise data is secure” statement as an answer to these questions.

Set a useful-result definition

Choose outcomes that a buyer can verify, such as analyst time saved without an unacceptable increase in missed incidents, a defined reduction in duplicate investigations, or a specified quality level for evidence summaries. Include limits: what false positives, false negatives, unsafe recommendations, or unavailable integrations would make the system unsuitable? These criteria become the basis for a controlled pilot and an acceptance decision.

2. Investigate the supplier and its supply chain

NIST SP 1326, published July 8, 2026, defines due diligence research as “the investigative process of researching all available, pertinent information about a given supplier or product so that informed decisions can be made on new acquisitions or existing systems.” Its due-diligence assessment components are a useful first-pass structure.

Foreign ownership, control, or influence

Establish the legal entity that will sign your contract, its ownership and control, and any jurisdictional exposure that could affect access to your data or support. Ask which parent companies, investors, or government relationships can influence the product or service. Request the scope and date of any ownership or control representation rather than relying on a marketing description.

Provenance

Trace where the product, models, training data, software, telemetry, and major services originate. Ask for a software bill of materials or equivalent component inventory, model and dataset provenance statements, licensing information, and a process for correcting provenance records when components change. Evidence should identify the version and configuration you would receive.

Resilience

Examine the supplier’s ability to continue delivering the contracted function through outages, attacks, cloud-provider disruption, staff loss, or a strategic change. Request recovery objectives, backup and restoration practices, alternate hosting or support arrangements, and the results or dates of relevant exercises. Confirm whether your organization can operate safely if the service is unavailable.

Foundational cyber practices

Review identity and access management, vulnerability handling, secure development, logging, encryption, incident response, employee access controls, and independent assurance reports. Separate evidence about the supplier’s corporate environment from evidence about the AI product itself; a company-level certification does not automatically prove that a particular model, connector, or hosted instance is secure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Supply-chain tiers

Identify critical dependencies beyond the direct vendor: model providers, cloud platforms, data processors, managed detection partners, open-source packages, and support subcontractors. Ask how the vendor assesses those tiers, what happens when a dependency changes, and whether you receive notice of material changes. Determine which commitments flow down contractually and which remain only the vendor’s internal policy.

3. Evaluate AI trustworthiness across the lifecycle

NIST’s AI Risk Management Framework organizes trustworthiness considerations across pre-design, design and development, deployment, use, and testing and evaluation. Its official FAQ says the framework helps developers, users, and evaluators manage AI risks affecting individuals, organizations, society, or the environment. Treat it as voluntary guidance and a question set, not as a product approval.

Validity and reliability

Ask what the system is intended to detect or predict, under which conditions it has been evaluated, and how performance changes when data drifts. Request definitions for the relevant metrics, the test population, the decision threshold, and confidence intervals or error ranges where available. A high score on a vendor-selected benchmark may not predict results on your telemetry, languages, infrastructure, or attack patterns.

Safety, security, and resilience

Determine how the product handles adversarial inputs, prompt injection, poisoned or manipulated telemetry, data exfiltration attempts, model abuse, and loss of a dependent service. Ask what actions are blocked by default, what permissions are required for automated remediation, and how the vendor detects and contains model or integration failures.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Accountability and transparency

Identify the people and teams responsible for model governance, release approval, incident response, and customer notification. Request a model or system card, change log, evaluation methodology, known limitations, and a description of material updates. You should be able to tell which model, rules, connectors, and policies produced a particular result.

Explainability and human oversight

Find out what evidence accompanies an alert or recommendation, whether an analyst can inspect the underlying events, and how a human can override or reject an action. Clarify which decisions are advisory and which can execute automatically. Require approval gates for high-impact actions such as disabling accounts, isolating systems, deleting data, or changing production controls.

Privacy and harmful-bias management

Ask how personal and sensitive data are minimized, segregated, retained, deleted, and used for training or tuning. Determine whether outputs can expose confidential information from another customer or reproduce protected data. For systems that prioritize people, entities, or investigations, ask how the vendor tests for harmful bias and how customers can report and correct problematic behavior.

4. Ask AI-specific acquisition questions

NIST’s Generative AI Profile recommends updating procurement due diligence for intellectual-property, data-privacy, security, third-party, and related risks. Convert those themes into written questions with evidence requirements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Data and model provenance

  • What data sources and model families are used in the offered configuration?
  • How are customer prompts, logs, labels, and feedback separated from training data?
  • Can the vendor identify the model version and retrieval or fine-tuning components used for each result?
  • What process verifies that training and evaluation data can legally be used?

Privacy and intellectual property

  • Where is customer data processed and stored, and which subprocessors can access it?
  • What retention, deletion, export, and legal-hold controls are available?
  • Who owns inputs, generated outputs, derived features, and fine-tuned artifacts?
  • What commitments address infringement claims, confidential information, and use of your data for product improvement?

Security and abuse resistance

  • How are prompts, connectors, tools, and model endpoints authenticated and authorized?
  • What controls address prompt injection, malicious files, data poisoning, model extraction, and denial-of-service attempts?
  • How are secrets prevented from appearing in prompts, logs, traces, or outputs?
  • Which security events trigger customer notification, and within what contractual time?

Third-party services and components

Request the names or categories of external model, cloud, data, and software providers that are material to the service. Ask how a provider change affects data location, performance, retention, or legal terms. Require advance notice or an approval right for changes that materially increase risk.

Monitoring and contingency

Ask what the vendor monitors for drift, unsafe output, abnormal use, and control failure; who reviews those signals; and what customers can see. NIST’s profile calls for contingency processes for failures or incidents involving high-risk third-party AI systems. Obtain a documented fallback procedure, including how to pause automation, preserve evidence, continue essential detection, and restore service.

5. Test material claims independently

A demonstration is a hypothesis, not proof. Ask the vendor to express each material claim in measurable terms and test it against representative work and deliberate failure cases.

Turn marketing claims into testable statements

  1. Write the claim exactly: identify the task, population, model or product version, configuration, and expected outcome.
  2. Define the measurement: precision, recall, time to triage, analyst acceptance, unsafe-action rate, availability, or another metric that matches the use case.
  3. Specify the test set and controls, including examples the vendor did not select and cases known to be difficult.
  4. Set pass, fail, and escalation thresholds before seeing results.
  5. Record assumptions, exclusions, manual interventions, and any vendor assistance used during the test.

Use representative and adversarial cases

Include your normal telemetry, naming conventions, languages, cloud services, ticket formats, and permission model. Add noisy data, missing fields, benign events that resemble attacks, novel attack patterns, prompt-injection attempts, malformed files, and dependency outages. Evaluate not only whether the system is correct but whether its explanation gives an analyst enough evidence to act safely.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Verify the offered configuration

Match the pilot to the version, region, model, connectors, retention settings, and automation permissions in the proposed contract. A benchmark performed on a different model or a fully staffed vendor test environment does not establish performance for your deployment. Preserve test inputs, outputs, configuration, and dates so that later updates can be compared.

Understand the legal scope of independent evaluation

United States Code, Title 15, Chapter 119 (2024 edition) contains a federal procurement provision that expressly includes independent evaluation of vendors’ AI effectiveness and risk-mitigation claims. That provision has federal scope; it is not a universal legal requirement for every private-sector purchase. Private buyers can still require independent testing as a procurement condition and should obtain jurisdiction-specific legal advice where obligations apply.

6. Review conventional product security

AI features do not replace ordinary software-security requirements. CISA’s Secure by Demand Guide encourages software customers to ask questions and use available resources before procurement so they can understand a manufacturer’s approach to product security.

Product-security evidence to request

  • Secure-development lifecycle description, vulnerability disclosure process, and remediation targets.
  • Independent penetration-test scope and date, with findings and corrective-action status.
  • Authentication, authorization, tenant isolation, encryption, key management, and administrative logging details.
  • Update, rollback, and emergency-patch procedures, including how customers are notified.
  • Security contact, incident-severity definitions, evidence preservation, and post-incident reporting process.

Evaluate these controls for the actual service, agents, APIs, browser extensions, sensors, and integrations you will deploy. Enterprise assurance documents can be useful context, but they should not substitute for product-level evidence.

7. Compare candidates on a common decision sheet

Once at least two candidates meet your minimum requirements, compare them using the same evidence requests, test data, and weighting. The following dimensions synthesize NIST and CISA guidance; they are a practical buyer’s framework, not an official universal scoring formula.

Dimension Questions to answer Evidence to retain
Use-case performance Does the offered configuration perform the defined task on representative and failure cases? Controlled test plan, raw results, thresholds, configuration, and dated outputs
Product security and resilience Are the application, integrations, identity controls, updates, recovery, and outage behavior suitable? Architecture, test reports, recovery objectives, incident procedures, and remediation records
Data, privacy, and intellectual property How are inputs, outputs, logs, retention, training use, subprocessors, and deletion governed? Data-flow diagram, processing terms, subprocessor list, retention schedule, and contractual commitments
Provenance and dependencies Can the supplier explain ownership, model and dataset origins, critical components, and change control? Ownership disclosures, model or system documentation, component inventory, and change notices
Transparency and oversight Can users understand results, override actions, and identify the version and policy behind an output? System documentation, audit logs, role matrix, human-approval controls, and release notes
Incident handling, monitoring, and fallback How are drift, abuse, outages, and unsafe behavior detected and managed? Monitoring plan, alert examples, notification commitments, pause procedure, and continuity runbook
Evidence quality and contract protection Are claims current, specific, independently supported, and enforceable? Evidence register, exceptions, service levels, audit rights, liability terms, and exit provisions

Use a minimum-gate approach

Set non-negotiable gates before assigning preference: lawful data handling, acceptable access control, incident notification, a safe disablement path, and evidence that the system can perform the defined task. Do not allow a strong demonstration to compensate for a failed privacy, provenance, or continuity gate.

Record uncertainty instead of hiding it

For every answer, mark whether it is contractually committed, independently verified, vendor documentation, a demonstration observation, or an unresolved assumption. Assign an owner and due date to open items. A candidate with slightly lower measured performance but substantially stronger evidence and fallback may present less operational risk than a candidate with impressive but unverifiable claims.

8. Contract for the operational reality

Important expectations must survive staff changes, model updates, and a dispute. Put them in the agreement, order form, data-processing terms, security addendum, and service-level schedule as appropriate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Define data rights and handling

  • List permitted data categories, processing purposes, regions, subprocessors, retention periods, deletion verification, and export formats.
  • State whether customer data, prompts, outputs, feedback, or telemetry may train or tune any model.
  • Require notice and, where appropriate, approval for material changes to processors, regions, models, or data use.

Control updates and model changes

Require version identification, release notes, security and performance impact information, and a testing window for material changes. Specify when the vendor may roll back, what happens if a new model fails your acceptance criteria, and whether you can pin a version temporarily.

Set incident and cooperation duties

Define security and AI-specific incident categories, notification clocks, evidence preservation, investigation cooperation, customer communications, and corrective-action reporting. Include unsafe outputs, unauthorized data disclosure, model compromise, dependency failure, and loss of critical functionality—not only conventional breaches.

Plan continuity and exit

Document how to suspend automated actions, preserve logs and investigation history, switch to manual or alternate controls, and restore service. At termination, require data and configuration export in usable formats, deletion or return of data, assistance with transition, and continued access to records needed for investigations or legal obligations.

9. Operate a pilot with explicit stop conditions

Run the evaluation in a constrained environment before granting production authority.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Limit data, users, connectors, and permissions to the approved pilot scope.
  2. Route recommendations to a human reviewer and disable irreversible actions initially.
  3. Log prompts or inputs, outputs, evidence, user decisions, overrides, model version, and configuration changes, subject to your privacy rules.
  4. Review false positives, false negatives, unsafe recommendations, latency, outages, and analyst workload at agreed intervals.
  5. Stop or roll back when a predefined threshold is exceeded, such as unauthorized data exposure, unexplained behavior after an update, or failure of the fallback process.
  6. Approve production use only after the evidence register, exceptions, contract terms, and operating runbook are complete.

10. Reassess after purchase

AI systems and their dependencies change. Schedule reassessment after material model, connector, hosting, ownership, data-use, or automation changes, and at a regular interval appropriate to the risk. Re-run a representative regression set, review new incidents and drift signals, confirm that subprocessors and regions remain approved, and verify that emergency contacts and fallback procedures still work. Treat renewal as a fresh evidence checkpoint rather than an automatic extension.

Common failure modes to avoid

  • Buying the label: “AI-powered” describes a feature category, not suitability, safety, or measurable value.
  • Scoring a demo instead of the job: A polished scenario can conceal poor results on your data, permissions, and failure cases.
  • Checking only corporate certifications: Supplier-level assurance does not prove product-level model, integration, or tenant security.
  • Ignoring dependencies: A change by a model, cloud, data, or software provider can alter risk, performance, and legal terms.
  • Automating before observing: High-impact actions need human approval, logging, and a tested pause path until reliability is established.
  • Leaving promises outside the contract: Unwritten retention, notification, version, and exit expectations are difficult to enforce.
  • Assuming a framework is a guarantee: NIST frameworks structure risk management; applying them does not certify a trustworthy system.
  • Failing to revisit the decision: Model versions, controls, ownership, and terms can change after the original procurement.

A compact pre-purchase checklist

  • Use case, environment, users, data, and success criteria are written and approved.
