A flying-car deposit should be treated as three separate decisions: an aircraft transaction, a road-vehicle transaction, and a contract for your money. A demonstration video, preorder counter, or aviation certificate headline cannot prove that the exact vehicle you will receive is certified for your intended use, legal on your roads, or likely to be delivered. Before paying, identify the promised configuration and jurisdiction, verify the certificate and its operating limits, document a road-registration path, test the company’s evidence, and obtain a deposit agreement with workable refund and delay protections.
What you are actually buying
“Flying car” is a marketing description, not a single legal category. The product may combine an aircraft, a motor vehicle, software, batteries or fuel systems, and specialized maintenance. Each part can have a different approval pathway. A prototype may be allowed to fly for a restricted test program while lacking permission to carry paying passengers, enter ordinary airspace, take off from public roads, or operate as a registered road vehicle.
Write down the transaction in three columns before discussing price:

- Road vehicle: the vehicle identification number (VIN), manufacturer of record, applicable Federal Motor Vehicle Safety Standards (FMVSS), certification label, title and registration process, insurance, and whether the flight hardware changes the road-certified configuration.
- Deposit contract: who receives the money, where it is held, what the deposit reserves, refund and cancellation rights, delivery obligations, specification changes, and remedies if certification, production or the company fails.
Do not assume that one approval substitutes for another. Ask the seller to identify the exact legal basis for every promised activity: driving on public roads, flight testing, carrying passengers, operating from a particular site, and providing service in your country or state.

What an FAA certificate does—and does not—prove
Certification is a process, not a single permission
FAA airworthiness resources distinguish certification procedures, airworthiness certificates and operating rules. Part 21 contains certification procedures, while Part 91 contains general operating rules. FAA guidance also identifies AC 90-89 as the Amateur-Built Aircraft Flight Testing Handbook; the FAA page listing it was updated April 1, 2026. A certificate number alone is therefore insufficient. You need the certificate category, the aircraft identification, the issue date, and the operating limitations attached to that certificate.
For powered-lift concepts, the FAA says it determines certification requirements by evaluating the design, production, airworthiness and operation. New concepts may require additional airworthiness criteria rather than fitting neatly into an existing aircraft category. Ask the company for the written certification basis or criteria being used, the stage reached in that process, and which items remain open.
Ask for the limits in writing
Request a complete copy of the certificate and its limitations, not a screenshot of a headline. Check:
- certificate number and category (for example, special or experimental);
- aircraft make, model, serial or registration identification;
- issue date and issuing authority;
- authorized purpose, such as research, development, demonstration or flight testing;
- geographic and airspace limits;
- pilot qualifications, endorsements or additional training;
- passenger restrictions;
- required inspections, maintenance and test cards; and
- conditions that must be met before changing configuration or expanding operations.
Use the phrase “authorized for flight testing” precisely. Aerospace America reported that Alef and Aska had FAA certificates for prototype flight testing, while first customer flights would require a licensed pilot and public-road takeoff was not permitted under the rules described at that time. That is materially different from unrestricted owner operation or a commercial air-taxi service.

Do not confuse an airworthiness certificate with operational approval
An airworthiness certificate addresses the aircraft’s eligibility to operate under specified conditions. It does not by itself grant permission to use a public road as a runway, carry passengers for hire, or operate outside the listed limitations. Ask which pilot will control the aircraft during customer demonstrations and initial flights, what transition training is required, and when (if ever) an owner may act as pilot in command.
How to verify that the prototype is the product you would receive
Identify the legal seller and the exact article
Record the seller’s full legal entity, manufacturer of record, assembly location, model designation, prototype serial or chassis number, promised configuration, country of delivery and intended operation. Put those details in the contract. DTA Aircraft’s JP1 terms illustrate why chassis allocation and manufacturer of record matter: a reservation should identify what production position, if any, it represents, rather than merely naming a brand or concept.
Ask whether the aircraft shown in a demonstration is the same article offered to depositors. If it is a different prototype, obtain a written list of differences and the validation plan for the production configuration. A prototype can change its motors, batteries, flight-control computers, software, structure, landing gear or safety systems after a public demonstration.

- dated flight-test reports and test cards;
- telemetry summaries showing flight time, energy use, temperatures, transition events and margins;
- failure, incident and forced-landing logs, including corrective actions;
- battery, motor, inverter, propeller and propulsion endurance results;
- maintenance instructions, inspection intervals and replacement limits;
- software and hardware configuration-control records; and
- the names of any independent designated engineering representative, test organization or regulator who witnessed or reviewed results.
Ask which numbers are measured results and which are targets or simulations. A tethered hover demonstrates that a tethered hover occurred; it does not establish range, transition reliability, crashworthiness, production repeatability, noise compliance, or legal operation. ASKA’s investor materials describe tethered hover and continuing flight testing as company-reported milestones. Treat them as evidence of those events, not as proof of completed certification or customer readiness.
Check configuration control
Have the seller identify the software build, battery chemistry and capacity, propulsion units, flight-control hardware, structural revision and safety systems used in each quoted performance number. Require a change-notification clause covering substitutions, software updates and weight changes. Range, payload, takeoff distance and endurance can shift when any of those items changes. If the contract permits unilateral changes, ask for a cancellation and refund right when a change materially affects performance, certification or road registration.
Road legality is a separate investigation
Understand the United States self-certification system
For U.S. road use, NHTSA does not pre-approve vehicles before sale. Manufacturers self-certify compliance with applicable FMVSS, and NHTSA can later investigate and conduct enforcement tests. NHTSA’s interpretation describes the process this way: “Under the self-certification process used in the United States, NHTSA does conduct periodic enforcement tests on vehicles and items of equipment that have been certified by their manufacturer to ensure that the products do, in fact, comply with the safety standards.”

Verify that the VIN decodes to the promised vehicle and that the label identifies the same manufacturer and vehicle class named in your contract. A prototype allowed on a closed test site may not have the equipment, labeling or crash compliance needed for public roads.

Map the registration and operating path in your jurisdiction
Obtain written answers to these questions from the seller and, where necessary, your state, provincial or national authorities:
- Who issues the title and registration?
- Which vehicle class and license are required?
- Can the vehicle be driven with the flight hardware installed?
- Where may it legally take off and land?
- Which aviation authority controls the airspace and pilot licensing?
- What insurance policies cover road use, flight, storage and a forced landing?
- Who performs inspections, software updates and safety recalls?
Do not treat a road-registration promise as complete until you have the VIN and certification-label evidence for the configuration you will receive. A design may be airworthy for restricted testing yet impossible to title, insure or operate on public roads.
Read the deposit contract as a risk document
Terms that must be explicit
Before paying, have an aviation or commercial attorney review the complete terms and every incorporated web page. Confirm each item in writing:

| Specifications | Promised configuration, performance conditions, permitted substitutions, certification obligations and your remedy for a material change. |
| Failure scenarios | Certification failure, inability to register, model cancellation, insolvency, recall or failure to provide support. |
| Legal terms | Governing law, dispute forum, arbitration or court rights, attorney-fee rules and deposit transferability. |
Examples of published terms
DTA Aircraft’s JP1 pre-order terms, version October 11, 2026, state: “The Deposit transfers no title and does not oblige the Purchaser to buy.” That language means a reservation is not ownership and does not itself guarantee a completed sale; read the rest of the terms for refund and delivery mechanics.

ASKA’s current preorder page, accessed October 19, 2026, describes a $5,000 deposit held in escrow and refundable after one year if the buyer cancels. Confirm that the version you sign contains the same amount, escrow arrangement, one-year condition and refund procedure. A sales representative’s email cannot safely replace conflicting signed terms.

A deposit is only the first financial exposure. Obtain written estimates for:
- pilot licensing, endorsements and transition training;
- recurrent training and proficiency checks;
- hangar, charging, fueling or approved landing-site access;
- aviation, road, liability and hull insurance;
- battery replacement and end-of-life handling;
- scheduled inspections, service labor and software support;
- parts lead times and approved repair facilities;
- warranty exclusions and damage limits; and
- recovery, storage and repair after a forced landing or road incident.
Ask who pays when a software update grounds the vehicle, a battery falls outside its warranty, or a component is unavailable. Require a service-area map, response times and parts policy rather than relying on a general statement that support will be provided. The buyer-verification checklist used for this category recommends checking training, support, insurance and unanswered red flags; it also warns that a checklist cannot prove reliability or delivery capability.
A practical evaluation workflow
- Define your use case. Write the country, state or province, road routes, intended launch and landing sites, passenger plans, weather limits and whether you expect personal, commercial or demonstration use.
- Identify the seller and article. Capture the legal entity, manufacturer of record, model, serial or chassis number, assembly location and promised delivery configuration.
- Verify the aviation certificate. Obtain the certificate, issue date, aircraft identification, authorized purpose, geographic limits, pilot requirements and operating limitations. Confirm whether the authorization is only for flight testing.
- Audit the evidence. Match dated test reports, telemetry, incident logs, battery and propulsion results and maintenance instructions to the exact configuration. Ask what was independently witnessed or reviewed.
- Verify road compliance. Request the FMVSS certification label, VIN, manufacturer identity and applicable-standard list. Confirm title, registration, insurance and service arrangements in your jurisdiction.
- Audit the contract. Check escrow, refund triggers, delay rights, specification changes, certification failure, insolvency, governing law and dispute forum. Have counsel review it before payment.
- Model ownership. Add training, recurrent checks, storage, insurance, energy, inspections, software, parts and recovery costs to the purchase price.
- Set a written go/no-go gate. Proceed only when the evidence, legal path, contract protections and support plan meet your requirements. Keep the money unpaid while a material answer remains verbal or ambiguous.
How to compare two prototypes without being misled
Use the same evidence standard for every candidate. Keep advertised targets separate from demonstrated results, and compare the configuration that will actually be delivered.

| Insurance | Have insurers confirmed coverage for both road and flight operations in your jurisdiction? |
| Total cost | What are the purchase, training, storage, energy, maintenance, software, insurance and recovery costs? |
Warning signs that justify stopping the payment
- The seller shows a video or reservation count but will not identify the test article or configuration.
- A certificate headline is presented without the certificate, limitations or authorized purpose.
- The company calls a flight-test authorization “customer approval” or implies that public-road takeoff is automatically legal.
- Performance figures lack date, payload, weather, energy or test-condition information.
- Failures, incidents or software and battery changes are not disclosed.
- The road vehicle has no VIN, FMVSS certification-label plan or named manufacturer of record.
- Refund rights appear only in advertising, while the signed terms are silent or contradictory.
- Urgency about a disappearing reservation slot replaces answers to technical or legal questions.
- Current customer deliveries cannot be inspected and no credible training, service or insurance provider is identified.
When one of these occurs, pause the transaction, request a written answer and set a deadline. Do not send additional money merely to preserve a queue position while foundational evidence is missing.
Decision rule
Pay a deposit only after you can independently connect four things: the certificate and limitations to the exact aircraft; the test evidence to the promised production configuration; the road-compliance and registration path to your jurisdiction; and the refund, delay and failure protections to a signed contract. If any link is missing, the rational classification is an unverified high-risk reservation, not a ready-to-own vehicle. No published independent statistic establishes the probability that a flying-car prototype will reach production or the average time from deposit to delivery, so treat schedule and production claims as claims to verify rather than probabilities to rely on.
