In the United States, a federal political committee may accept bitcoin and, depending on its procedures, other cryptocurrency as an in-kind contribution. The committee must identify and screen you, apply contribution limits and source prohibitions, value the asset at its market value when received, and report it correctly. State and local campaigns follow different rules: Oregon prohibits cryptocurrency contributions, while Texas treats virtual-currency contributions as in-kind and requires fair-market-value reporting. Use only the campaign’s verified donation page or named processor, never an unverified wallet address, and keep complete transaction records.
First determine whether your campaign can legally accept crypto
Crypto legality depends on the office, committee type and jurisdiction—not simply on the coin you hold. A contribution to a US House, Senate or presidential committee is governed by Federal Election Commission (FEC) rules. State and municipal candidates are governed primarily by the law of the state or locality where the race is conducted. A method that is lawful for a federal committee may be forbidden for a state candidate.
Federal committees
FEC Advisory Opinion 2014-02 says a nonconnected political committee may accept bitcoin contributions. The FEC treats bitcoin as money or anything of value under the Federal Election Campaign Act. The committee must examine each contribution for prohibited sources and excessive amounts, record its value when received, and return or otherwise handle a contribution that cannot be accepted.

State rules vary sharply. Oregon Revised Statutes §260.011 prohibits using cryptocurrency to make a contribution. Texas Election Code §22.37 treats a virtual-currency contribution as an in-kind contribution, requires fair-market-value reporting when it is received, and requires a gain on sale to be reported when the applicable threshold is exceeded. A 2022 California Fair Political Practices Commission memorandum described nine states that prohibited crypto contributions and twelve states plus the District of Columbia that expressly allowed them in some form at that time. That count is historical, not a current nationwide map; statutes and agency rules change, so verify the rule for the specific race before sending anything.

Six questions the campaign should answer
- Is this committee federal, state, county, city or another type of political organization?
- Is the specific asset accepted, or only bitcoin or another named token?
- Which exchange-rate source and timestamp determine the US-dollar value?
- Does a processor convert the asset immediately, or will the committee hold it?
- What identity, address, occupation, employer and election-designation information is required?
- How are network fees, processor fees, failed payments and refunds handled?
Use the official donation route, not a wallet address sent in a message
The safest route is the candidate or committee’s official website, linked from a verified account or a government filing, followed by the donation page and the processor named there. FEC internet-fundraising guidance permits online confirmation that a contribution complies with limits and source prohibitions and requires authorization and best-efforts notices. A legitimate page should identify the committee, its treasurer or authorized committee name, and the processor or payment flow.
Do not send cryptocurrency to an address supplied only by an email, direct message, text or chat. A copied address can redirect funds permanently, and a campaign generally cannot recover a mistaken blockchain transfer. Check the domain character by character, use a fresh browser session or a bookmarked official page, and confirm that the address shown at checkout matches the committee’s published payment instructions. If the page is unavailable, call or email the committee using contact details published on its official site rather than replying to the suspicious message.
Step-by-step safe donation workflow
- Confirm the race and jurisdiction. Write down the candidate, office, election year and committee name. Federal committees use FEC rules; state and local committees use their own statutes, regulations and filing systems. If the race is not clearly identified, stop before opening a wallet transaction.
- Verify the committee and processor. Navigate from the official campaign site to its donation page. Read the authorization notice, contribution-limit certification, source-prohibition certification and privacy terms. Record the processor’s legal name and support contact.
- Check your eligibility. Federal committees cannot accept contributions from foreign nationals, anonymous or obscured sources, or another person’s funds. Do not donate on behalf of a friend, employer, client or family member. Use your own wallet or exchange account and provide the identity information the committee requests. Occupation, employer, address and election designation may be required for reporting.
- Calculate the dollar limit before choosing the amount. The committee may need to combine your crypto contribution with other contributions you made to the same candidate or committee. Treat the contribution as the dollar value that will be recorded, not merely as a number of tokens. If you are close to a limit, ask the committee for its current cumulative total and leave a margin for exchange-rate movement and fees.
- Confirm the asset and conversion terms. Ask whether the page accepts the exact token and network you intend to use. A token with the same ticker can exist on several networks; sending on the wrong network can make funds unrecoverable. Confirm the exchange-rate source, the valuation timestamp, whether the processor converts immediately, and whether network or processor fees reduce the credited amount.
- Complete the committee’s compliance fields. Enter your legal name, residential address and any occupation, employer or election-designation information requested. Answer source and limit certifications truthfully. A committee may reject a payment that does not contain enough information to establish a permissible source.
- Send only the displayed amount to the displayed address. Copy the address using the page’s copy control, compare its first and last characters, select the exact network, and send a small test only if the processor explicitly supports testing. Do not alter the amount to account for a fee unless the checkout instructions explain how the credited value is calculated. Wait for the required blockchain confirmations.
- Save the receipt and blockchain evidence. Keep the confirmation email or screen, date and time, asset and quantity, dollar valuation, wallet address, transaction hash, network, processor name and fee information. Save any later message about a refund, rejection or amended valuation.
- Review the final record. Compare the campaign receipt with your transaction history. If the receipt lists a different asset, value or committee, contact the processor through its official support channel immediately. Do not send a second payment to correct an apparent mismatch until the first payment is resolved.
How the committee values and reports a crypto contribution
The FEC says a political committee that receives bitcoin should value it at the market value of bitcoin when the contribution is received. In practice, the relevant time is the processor’s contemporaneous price and the time the committee or its processor receives the asset, not the price when you bought it or when the committee later sells it. FEC guidance prefers a contemporaneous processor valuation; if that is unavailable, the committee may use another reasonable exchange rate.

For a committee, the contribution is an in-kind receipt. If the committee immediately converts the asset, it records the receipt at the received value and deposits the proceeds through its campaign depository. If it holds bitcoin rather than liquidating it, the FEC describes offsetting receipt and disbursement entries and recommends memo text stating the amount received and that it was not liquidated. Bitcoin purchased as an investment must be sold and the proceeds deposited in the campaign depository before the committee spends the money.
These are treasurer obligations, but they explain why a campaign asks for a timestamp, transaction hash and identity details. A payment that cannot be tied to a permissible donor or a defensible dollar value can create a compliance problem even if the blockchain transfer succeeded.
What to record for your own protection
Keep a folder containing the following items for as long as you retain ordinary political-contribution records and for any period your tax or legal adviser recommends:

- The campaign’s legal committee name and the official donation-page URL.
- The processor’s name, terms and support contact.
- Date and time shown by the checkout page and the blockchain transaction.
- Asset name, network, quantity, wallet address and transaction hash.
- The processor’s US-dollar valuation, exchange-rate source and any fee.
- The campaign receipt, confirmation email and contribution certifications.
- Your funding trail showing that the assets belonged to you and were not supplied by a foreign national or another person.
- Any request for more information, rejection notice, refund transaction or correspondence about an excessive contribution.
Store records offline or in encrypted storage. A transaction hash is public, so do not publish it together with your home address, identity documents or other personal information. Never share a seed phrase or private key with a campaign, processor or support agent; compliance verification should require identity and source information, not wallet-control secrets.
Tax treatment: a political contribution is not a charitable donation
Political campaign contributions are not charitable donations. FEC fundraising guidance requires a notice that contributions are not tax deductible for committees whose gross annual receipts normally exceed $100,000. Do not claim a charitable deduction merely because the payment used cryptocurrency. A separate tax question can arise if you dispose of appreciated cryptocurrency; the contribution, the asset’s basis and any gain or loss may need review under applicable tax rules. Keep your acquisition records and ask a qualified tax professional if the transfer involves significant appreciation, a business account or a non-US tax residence.
State-law comparison points
Before paying a state or local committee, check all six items below. A campaign’s general statement that it accepts cryptocurrency is not enough if its jurisdiction imposes a different rule.

Volatility, rejected payments and refunds
Cryptocurrency can change value between the moment you authorize a payment and the moment the processor confirms it. The committee’s compliance value is generally fixed at receipt, but a delayed or failed payment may be treated differently under the processor’s terms. Confirm how long a checkout quote remains valid and whether an underpayment, overpayment or network delay is automatically returned.
A committee may need to return or refund a prohibited or excessive contribution. Holding crypto in a wallet does not remove that obligation. A refund may use the original asset, a dollar amount or another method permitted by the committee’s rules and processor agreement. Preserve the original transaction and the refund transaction, and do not treat a refund as complete until the funds have reached your controlled account and the committee confirms the correction.
Warning signs of a fraudulent crypto appeal
- A request arrives only through a direct message, text, QR code or shortened link.
- The sender claims an urgent deadline and refuses to provide the committee’s legal name or treasurer.
- The address changes between the campaign’s website and the message.
- The payment page asks for a seed phrase, private key or remote access to your wallet.
- The campaign promises a tax deduction, anonymity or a way to bypass contribution limits.
- The page accepts a token or network that the committee cannot describe in writing.
- Support staff ask you to send additional crypto to unlock a refund.
If any warning sign appears, stop the transfer, capture screenshots and contact the committee through its independently verified official contact details. Blockchain transfers generally cannot be reversed by a bank or card issuer.

International donors and campaigns
Readers outside the United States should not apply FEC rules to their own election. The UK Electoral Commission’s guidance dated 7 April 2026 treats cryptoassets as property rather than currency and requires non-monetary reporting, donor identification and permissibility checks. It also describes proposed legislation that could require the return or forfeiture of crypto donations received from 25 March 2026. Those rules illustrate why the country, election and date must be confirmed before payment. Obtain advice from the relevant electoral authority or a qualified local lawyer when donating across borders.
A final pre-send checklist
- I identified the exact office, committee and jurisdiction.
- I confirmed that the jurisdiction permits this type of cryptocurrency contribution.
- I reached the donation page from an official campaign source and verified the processor.
- I am donating my own funds and am not a foreign national or anonymous donor.
- I checked my cumulative contribution against the applicable limit.
- I confirmed the token, network, valuation source, timestamp and fee treatment.
- I completed every identity and source certification truthfully.
- I saved the receipt, valuation, wallet address and transaction hash.
- I understand that the contribution is not a charitable tax deduction.
Frequently Asked Questions
Can I donate any cryptocurrency a campaign lists on its website?
Only if the campaign or its named processor confirms the exact token and network. A similarly named token on a different network may be incompatible, and the processor’s valuation and compliance process may exclude it.
What if I accidentally exceed a contribution limit with a crypto payment?
Contact the committee’s treasurer or processor immediately, preserve the transaction record and follow its refund instructions. Do not send another payment to offset the error; the committee must determine the compliant correction.

No. Identity and source checks may require personal and funding information, but a seed phrase or private key would give control of your assets and should never be disclosed.
Does a blockchain transaction prove that my donation was legally accepted?
No. It proves that a transfer was broadcast or confirmed. The committee still has to verify your source, identity, limit and valuation and may return or refund the contribution.
