A registered business can claim GST input tax credit (ITC) on hotel or resort accommodation only when the service is used, or intended to be used, in the course or furtherance of business and all other statutory conditions are met. The credit is not automatic because an employee travelled for work. Use the correct GST-registered recipient, obtain the hotel’s compliant tax invoice, preserve contemporaneous business-purpose records, and remove or apportion personal and other non-business amounts. Also check blocked-credit rules and unusual multi-state registration facts before claiming.
What the GST rule means for a hotel or resort stay
Section 16 of the Central Goods and Services Tax Act, 2017 provides the general gateway for ITC: a registered person must use, or intend to use, the inward supply in the course or furtherance of business, together with the other conditions imposed by the Act and rules. A hotel invoice can therefore support ITC, but the invoice by itself does not prove business use.
The credit belongs to the registered person that actually receives the accommodation service. The file should connect four facts: the legal entity and GST registration claiming the credit, the hotel or resort that supplied the stay, the dates and property where the service was supplied, and the business reason for the travel. If any of those facts is unclear, resolve it before posting the credit.
Section 17 limits credit where an inward supply is used partly for business and partly for another purpose. A personal extension, companion’s room, leisure activity, or other non-business charge must be excluded or apportioned so that only the business-attributable amount is claimed. The law does not provide a universal “number of business nights” formula for every hotel bill; the allocation must reflect the actual facts and applicable apportionment rules.

Specific blocked-credit provisions in section 17(5) still apply. The general business-use test does not make every hotel-related expense eligible. Review the nature of the actual supply, including separately billed food, events, or other services, and check whether a statutory restriction or exception applies.
The five questions to answer before claiming
1. Is there a real business purpose?
Identify the meeting, customer visit, site work, training, conference, project assignment, or other business activity that required the stay. “Business travel” in a booking system is only a label; keep a contemporaneous record that explains the assignment and dates.
2. Which registered person received the accommodation?
Use the GST-registered legal entity that is the recipient of the service. A group may have several GST registrations. A central travel desk or parent company booking does not automatically make the head-office registration the recipient for every property or employee. Establish which entity incurred and benefited from the stay before taking credit.

Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →3. Is the supplier’s final tax invoice available?
Rule 36 recognizes prescribed documentary sources, including the supplier’s tax invoice, as the basis for ITC subject to the applicable particulars and conditions. A reservation confirmation, card slip, bank statement, or internal expense claim is supporting evidence; none is a substitute for a compliant tax invoice.
4. Is any part personal or otherwise non-business?
Separate personal nights, leisure extensions, companion costs, upgrades chosen for private reasons, minibar or entertainment charges, and other non-business items. Claim only the business portion and document the allocation used.
5. Are location, tax and blocked-credit issues clear?
Accommodation place of supply is tied to the location of the hotel or other property under the IGST Act. The correct tax treatment and recipient GST registration can be fact-specific where the traveler, booking entity and property are in different states. Check the current legislation and GST procedures for unusual arrangements rather than applying a blanket “always use head office” rule.

Documentation workflow: from travel request to ITC reconciliation
Before or at booking
- Identify the recipient. Enter the exact legal name and relevant GSTIN of the registered business that will receive the accommodation. Tell the hotel which entity must appear as recipient on the final invoice.
- Record the trip. In the travel authorization or expense system, capture the traveler’s name, property and city, check-in and check-out dates, business purpose, approving manager or department, and project or customer code where applicable.
- Mark mixed-use facts early. Record personal days, companions, leisure extensions, room upgrades, spa or recreation charges, and other private elements separately. Ask the hotel to split charges where practical.
- Confirm the property and billing arrangement. Note whether the reservation is direct, through an intermediary, or paid by a central office. The entity that pays is not necessarily the entity that receives the accommodation service.
These controls are practical ways to substantiate the statutory business-use and invoice requirements; they are not an official hotel-specific checklist issued by CBIC.
At check-in and checkout
- Request the final supplier tax invoice. Do not leave with only a booking email or payment receipt. Ask for the invoice covering the actual stay and any separately supplied items.
- Check supplier details. Verify the hotel or resort’s legal name, address and GSTIN against the property and invoice. Escalate an invoice issued by a different legal entity or property.
- Check recipient details. Confirm the registered business name and GSTIN are the entity that will claim the credit. If the invoice names an employee or another group company, request a correction before accounting for ITC.
- Check transaction particulars. Compare invoice number and date, stay dates, description, taxable value, rate and tax amount with the folio and booking. Ensure the invoice contains the particulars required by the applicable invoice rules.
- Retain the evidence trail. Save the folio, booking confirmation, proof of payment and any corrected invoice with the tax invoice. These records corroborate the transaction but do not replace the tax invoice.
During expense review and GST reconciliation
- Attach the invoice and business-purpose evidence to the expense entry in the accounting system.
- Match the invoice to the correct GST registration and review the supplier-reported invoice information through the current GST portal process before claiming credit.
- Remove personal and other non-business amounts. Where the bill is mixed-use, retain the calculation and the factual basis for the allocation.
- Record the tax and ITC claimed in the accounts and retain the invoice and related records for the period required by current law.
- If a mismatch, duplicate invoice, wrong GSTIN, or unexplained tax treatment remains, place the item on hold and obtain a corrected document or professional advice instead of forcing it into the return.
Hotel GST invoice checklist
Use this review before approving the credit. The exact particulars depend on the transaction and the current invoice rules, so verify the consolidated rules in force for the relevant period.
| Check | What to verify | Why it matters |
|---|---|---|
| Supplier identity | Hotel or resort legal name, address and GSTIN match the actual supplier and property. | Establishes who supplied the service and supports invoice matching. |
| Recipient identity | Correct legal business name and GSTIN of the registered person claiming ITC. | Credit should be tied to the recipient that received the accommodation, not merely the person who booked it. |
| Invoice particulars | Invoice number and date, service description, taxable value, tax rate and tax amount, plus other particulars required by the applicable rules. | Rule 36 and the invoice provisions require prescribed documentary support. |
| Stay details | Property, room or accommodation description, check-in and check-out dates, and folio references where shown. | Connects the document to the actual service received. |
| Business evidence | Travel approval, meeting or event agenda, project assignment, customer correspondence or equivalent contemporaneous record. | Supports the section 16 business-use fact. These examples are prudent evidence, not an exhaustive statutory list. |
| Payment trail | Booking confirmation, folio and proof of payment retained with the invoice. | Helps reconcile the invoice and expense; it does not replace the tax invoice. |
| Mixed-use allocation | Personal nights, companions, leisure extensions and non-business charges identified and excluded or apportioned. | Section 17 restricts credit to the business-attributable amount. |
| Accounting record | Tax and credit posted to the correct registration and retained with supporting records. | Supports return preparation, audit trail and statutory record retention. |
Business stay versus mixed-use stay
The cleanest case is a stay wholly required for business, supported by a matching invoice and records. Real trips often combine work and private activity. Treat those components separately rather than claiming the entire bill and correcting it only if challenged.
| Fact pattern | Documentation approach | ITC treatment |
|---|---|---|
| All nights and charges relate to a business assignment | Keep authorization, itinerary, business record, final invoice and payment evidence. | Assess the business-use and other section 16 conditions; no personal allocation is needed if the facts genuinely show wholly business use. |
| Business meetings plus personal extension nights | List business and personal dates separately; ask for split billing or document the allocation. | Exclude or apportion the personal portion. Do not apply a fixed nights formula without considering the actual charges and rules. |
| Employee brings a companion | Identify companion-related room, meals, transport or activities and retain the company’s travel policy or approval. | Exclude the non-business portion unless a specific business-use fact supports it and no blocking rule applies. |
| Hotel bill includes accommodation and separately billed event, food or recreation | Obtain an itemized invoice and classify each supply. | Analyze each line under the applicable business-use and blocked-credit rules; accommodation eligibility does not automatically determine treatment of every other line. |
| Central booking for a different state GST registration | Document which entity received the service, where the property is located and how the cost is allocated. | Verify place-of-supply, invoice and registration treatment before claiming; do not assume the head-office GSTIN is correct. |
Place of supply and multi-state registrations
For hotel accommodation and related services connected with immovable property, the IGST Act places the supply where the property is located. A hotel in one state is therefore analyzed by reference to that property, even when the traveler works for an entity registered elsewhere.
This geographic rule does not by itself answer every ITC question. You still need to identify the recipient, confirm the invoice tax and GSTIN, and determine which registration is entitled to account for the inward supply. Booking intermediaries, group-company recharges, corporate travel desks and employees using another state’s registration can create facts that require transaction-specific review.

- Do not change the recipient GSTIN merely because the employee’s home office is elsewhere.
- Do not assume that a centralized payment card determines the recipient.
- Keep the property address, supplier registration and receiving registration together in the file.
- Where the arrangement involves more than one registration or a recharge, obtain current GST advice before taking credit.
Blocked-credit boundary: why “employee on a work trip” is not enough
Section 17(5) contains specific blocked-credit categories and statutory exceptions. The fact that an employee traveled for work establishes a business context, but it does not override a restriction that applies to the actual supply. Review the invoice line by line, especially where it includes food, recreation, employee-related benefits, event facilities or another service that may be treated differently from room accommodation.

The available statutory materials do not support either blanket statement that all hotel stays are blocked or blanket statement that all business hotel stays qualify. The defensible approach is to document the business purpose, identify each supply, apply the current wording of the relevant provision and retain the reasoning used for the claim.
What evidence is strongest when a claim is questioned?
No single document proves every element. A contemporaneous, internally consistent packet is stronger than an invoice uploaded months later with no explanation.
- Travel authorization: shows who approved the trip, dates, destination and business reason.
- Meeting, event or work record: agenda, customer appointment, site report, training roster, project assignment or similar evidence connects the stay to business activity.
- Traveler identity: confirms who stayed and why that person was assigned.
- Final tax invoice: establishes supplier, recipient, value and tax particulars.
- Folio and booking record: reconciles nights, room type and additional charges.
- Payment evidence: links the expense to the business account or approved reimbursement.
- Allocation worksheet: explains any exclusion or apportionment for personal nights, companions or mixed charges.
- Accounting entry and reconciliation: shows the amount posted to the correct GST registration and reviewed against supplier-reported information.
These records are prudent substantiation. They should not be described as an exhaustive CBIC-prescribed hotel checklist; the legal requirements come from the Act, rules and the invoice issued for the transaction.

The company claims the whole bill despite personal days
Problem: Section 17 requires restriction for non-business use. Fix: separate the charges, document a defensible allocation and claim only the business-attributable amount.

Problem: The current GST process may not support the credit as recorded, or the supplier may have reported an error. Fix: hold the item, contact the supplier for correction and follow the current portal and return requirements. Do not treat an internal expense form as a substitute for supplier correction.

- Was the accommodation used or intended for business? If no, do not claim business ITC. If partly business, proceed only with an allocation.
- Is the correct registered recipient shown on the final supplier tax invoice? If no, obtain correction or specialist advice before claiming.
- Does the invoice contain the applicable particulars and reconcile to the stay? If no, resolve the defect with the supplier.
- Are any charges personal, mixed-use or separately supplied? Exclude or apportion them and review each supply for blocked-credit provisions.

How to organize the file for audit or internal review
Use one electronic folder or accounting attachment set per stay. A consistent naming convention can include the legal entity, property, traveler and invoice number. Store the final invoice first, followed by the travel authorization, business-purpose record, booking and folio, payment evidence, allocation worksheet and reconciliation result.

The CBIC hotel-booking FAQ and what it does—and does not—answer
CBIC FAQ material includes the reader-style question, “I made booking for hotel for a trip in October.” The answer points to invoice particulars under Rule 46. That material is useful for checking what an invoice should contain, but it does not decide whether a particular stay was for business, whether a claimant is the correct recipient, whether mixed-use credit must be apportioned, or whether a blocked-credit provision applies.
Bottom-line compliance standard
A defensible hotel ITC file tells a coherent story: the registered business received a specific accommodation service at a known property; the stay had a documented business purpose; the supplier issued a compliant tax invoice to the correct GST registration; personal and other non-business components were removed or apportioned; and the claim survives the applicable blocked-credit, place-of-supply, reconciliation and recordkeeping checks. If one of those links is missing, pause the claim and correct the evidence rather than relying on the employee’s work status or a payment receipt alone.
Frequently Asked Questions
Can an employee’s personal credit-card payment still support the company’s hotel ITC?
Payment by an employee does not, by itself, decide eligibility. The company still needs the final supplier tax invoice in the correct registered recipient’s details, evidence that the stay was for business, reimbursement and accounting records, and compliance with all other statutory conditions. A card slip alone is not sufficient documentary support.
What if the hotel refuses to add the company GSTIN after checkout?
Ask the supplier to issue a corrected invoice before claiming. If the document continues to identify the wrong recipient, do not assume an internal expense claim cures the defect; obtain transaction-specific GST advice and retain the correspondence with the accounting file.
Does breakfast included in a room package automatically receive the same ITC treatment as the room?
No. Identify whether breakfast is part of the accommodation supply or a separately supplied line, then apply the current business-use and blocked-credit provisions to the actual invoice and facts. An accommodation conclusion does not automatically decide every bundled or separately billed item.
