Check the itemized bill, point out the specific charge that looks wrong, and ask staff to explain or correct it before you pay. Then review the revised total. If the wrong amount later posts to a U.S. credit card, contact the issuer promptly and follow its written billing-dispute instructions.
How to dispute an incorrect restaurant bill before paying
- Review the itemized check. Look for an item you did not order, a duplicate, a price that differs from the menu or other displayed price, an unexpected fee, or a tip or service-charge calculation that appears wrong.
- Identify the exact line and amount. Be specific and keep the conversation calm. For example: “Could you help me check this line? I don’t think we ordered it,” or “The menu showed a different price; could you confirm which price applies?”
- Ask for an explanation or corrected check. Give the server a chance to clarify the charge. If they cannot resolve it, politely ask for a manager.
- Check the revision before authorizing payment. Confirm that the disputed line was handled as agreed and that the new total reflects the correction.
- Keep your records. Save the original check, corrected check or final receipt, and any relevant menu or posted price information. If the restaurant does not resolve the concern, make a brief note of what you disputed and the response you received.
These are practical steps, not a statutory script. If you decide to pay to conclude the visit, keeping the records can help if you need to contact your payment provider later. Paying does not guarantee that a later dispute will succeed, and it should not be described as automatically waiving every potential right.
What to do if the restaurant will not correct the bill
Keep the issue narrow: if one line is wrong, explain that line rather than treating the entire bill as disputed. Ask whether the manager can provide an itemized explanation or note the resolution on the check. If you choose to pay, retain the receipt and your record of the conversation, then contact your payment provider if an incorrect amount posts.
If an incorrect amount posts to a U.S. credit card
For qualifying credit-card billing errors, federal consumer guidance covers issues such as an incorrect amount or date, a duplicate charge, or a charge for something not accepted or not delivered as agreed. The FTC advises contacting the issuer promptly and sending written notice to the address it designates for billing inquiries or errors. See the FTC’s credit-card billing-error guidance.

Send written notice promptly
The CFPB says written billing-error notice must be sent within 60 calendar days after the charge appeared on the statement to protect rights. The FTC says notice should reach the issuer within 60 days after the first statement with the error was sent. Because the agencies describe the trigger differently, act immediately and follow your issuer’s instructions rather than waiting to calculate the deadline. The CFPB’s credit-card dispute guidance was last reviewed April 15, 2024.
Include the facts and keep copies
In a written dispute, identify the account holder and account, the disputed amount and date, and why you believe the charge is wrong. Include copies of supporting records, such as the check, receipt, or relevant price information—not originals—and keep a copy of the letter and attachments. The FTC sample dispute letter outlines these details. Keep a record of follow-up calls as well.

Pay the undisputed portion
For a qualifying billing-error dispute under the applicable credit-card process, FTC guidance says you may withhold the disputed amount and associated finance charges while the issuer investigates, but you remain responsible for the undisputed portion. Do not withhold the whole card balance based on a dispute about one restaurant charge; whether the billing-error process applies depends on the circumstances.
Fees and rules depend on the charge and location
A surprising fee is not automatically unlawful. The FTC’s fee FAQ says that when consumers add optional fees, a business must clearly and conspicuously disclose them and include them in the final amount before asking the consumer to pay. That guidance has a defined scope; requirements for a restaurant surcharge can depend on the fee type and state or local law. Consult the FTC fee FAQ and the relevant local consumer-protection authority before drawing a legal conclusion.

Other payment methods and service complaints
The federal sources above address U.S. credit-card billing errors; they do not establish one universal process for cash, debit cards, payment apps, gift cards, or other countries. Contact the relevant payment provider and check the rules where the restaurant is located. A disagreement about a wrong amount or duplicate charge may also follow a different process from dissatisfaction with service quality; the CFPB notes that a different process may apply to disputes about defective goods or services.
