A responsible generative-AI policy for a game studio is an operating system for decisions, not a one-time memo. It should inventory every AI use, classify risk, protect confidential and player data, document rights and provenance, require human review, set player-safety and disclosure controls, protect workers, assess vendors, and name people who can approve, pause, or roll back a system.
Start with a register of tools and use cases. Then apply risk-based approval gates: low-risk assistance can move through a lightweight review, while player-facing generation, synthetic likenesses, model training, personal data, and employment decisions need written approval, security and rights checks, safety testing, a rollback plan, and an accountable owner.
Why a game studio needs a living AI policy
Generative AI now touches design, engineering, art, audio, localization, testing, marketing, customer support, and live game systems. Google’s games-industry survey reports that 90% of developers already use AI in their work. The same survey says 63% are concerned about data ownership and 35% about player-data privacy; the publication year is not stated on the reviewed PDF. Those figures describe practical governance problems, not a reason to prohibit every tool.
A policy gives teams a repeatable way to answer four questions before an experiment becomes a shipped feature:

- What data and rights are entering the system?
- What can the model produce, and who could be affected?
- Which human must review, approve, monitor, and repair the result?
- How can the studio stop or replace the system if it fails?
Review the policy at least quarterly and whenever a model, provider, platform rule, law, or serious incident changes. Treat registrations, approvals, test results, and incident records as evidence that the policy is being followed.
1. Define the policy’s scope and vocabulary
Write the scope broadly enough to cover how a studio actually works. Include employees, contractors, interns, outsourcing partners, agencies, and vendors. Cover internal models and third-party APIs, model fine-tuning, retrieval systems, generated text, code, images, audio, video, 3D assets, NPC dialogue, localization, QA, analytics, marketing, support, and live player interactions.
Require the same controls whether a team calls a system “AI-assisted,” “procedural,” “copilot,” or “automation.” Names do not change the risk.

- AI assistance: A model helps a person create, transform, analyze, or test material, while a person remains responsible for the result.
- AI-generated content: Material whose expressive or substantive elements are produced by a model, including text, code, images, voices, music, video, animation, or 3D files.
- Training or fine-tuning: Using data to alter a model’s parameters or adapt a model for a domain, project, character, or workflow.
- Player data: Account, device, behavioral, chat, voice, location, purchase, support, moderation, and other information linked or linkable to a player.
- Confidential information: Unreleased builds, source code, roadmaps, security details, contracts, business plans, internal metrics, and non-public partner material.
- Synthetic voice or likeness: Generated or modified speech, face, body, performance, or identifiable style that represents a real person or a recognizable character.
- Human review: A named person with enough context, authority, and time to evaluate an output, reject it, request changes, and document the decision. Clicking “approve” without examining the result is not meaningful review.
State what the policy does not permit by default
Make the default rule explicit: no employee may upload restricted studio, player, personal, regulated, or third-party confidential material to an external model unless the use case and provider have been approved. No team may assume that a prompt, subscription, or “enterprise” label transfers rights or guarantees confidentiality.
2. Create an AI-use inventory before approving tools
Every team should register a use case before production use. A central register can be a controlled spreadsheet, ticket type, or governance application, but it must have an owner and an audit trail.
Required inventory fields
- Team, project, and accountable owner
- Tool, provider, model name, and exact version or endpoint
- Purpose and workflow step
- Input data classes and examples
- Output type and where it will be stored or shipped
- People affected, including players, children, workers, contractors, and performers
- Geography, platform, and release channel
- Human reviewer and approving authority
- Provider retention, training, deletion, and subprocessor settings
- Expected quality, bias, safety, cost, latency, and availability constraints
- Retention period for prompts, outputs, logs, and approvals
- Rollback method and replacement owner
Apply practical risk tiers
| Tier | Typical uses | Minimum control |
|---|---|---|
| Low | Brainstorming; summarizing public material; draft documentation; debugging non-sensitive code | Approved tool, public or non-sensitive inputs, user review before use, and no player-facing output without a separate review |
| Medium | Code suggestions; gameplay balancing; localization; internal concepting; test generation; editing studio-owned assets | Registered use case, data classification, rights check, named reviewer, quality testing, and versioned outputs |
| High | Player-facing generation; NPC memory; synthetic voices or likenesses; training or fine-tuning; personal or unreleased data; automated moderation; employment decisions | Written approval, rights and provenance review, security review, safety and abuse testing, disclosure plan where required, rollback plan, and named accountable owner |
The tier follows the consequences of failure, not the novelty of the technology. A small model that handles player voice data can be higher risk than a large model used to summarize a public design article.

Separate assistance from training
Using a model to suggest a debugging approach is different from sending studio assets into a training or fine-tuning pipeline. Gotcha Gotcha Games illustrates this distinction: AI assistance for events, plugins, project analysis, debugging, and balancing is generally allowed, while using its assets or programs as training data is restricted. Your policy should make the same boundary clear for studio-owned, licensed, and third-party material.

3. Protect copyright, intellectual property, and provenance
Do not promise that raw model output is copyrightable. The U.S. Copyright Office’s current position is that protection can exist where a human determines sufficient expressive elements. Human arrangement or modification may qualify; a prompt alone does not.
“Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.”
“Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright.”
Keep a provenance record for each material asset
For any AI-assisted or AI-generated asset that may ship, store:
- The source and license of every important input, reference, dataset, voice, likeness, or character.
- The provider, model and version, relevant settings, and whether the model was fine-tuned.
- Prompts, transformations, retrieval documents, and edits that materially shaped the result.
- The names or roles of human contributors, reviewers, and approvers.
- The final asset location, version, date, and disposition: shipped, rejected, quarantined, or replaced.
- Permissions, releases, restrictions, and any required attribution or notice.
Preserve enough information to reproduce a decision without retaining unnecessary personal data. Version prompts and source files alongside the asset so a later rights claim can be investigated.

Prohibit unsafe inputs and imitation
Ban prompts or uploads containing third-party confidential material, unreleased game assets, personal data, copyrighted material without permission, or trademarked characters used to imitate a rights holder. Require legal or rights review when a team wants to use a performer’s voice, a recognizable person’s likeness, a living artist’s distinctive style, or licensed characters.
Add a takedown and quarantine process. If provenance becomes uncertain, stop distribution, preserve the relevant logs, remove the asset from builds and marketing, investigate the source, and replace it with cleared material. A policy should not force a team to keep a questionable asset merely because it is already integrated.
4. Classify data and secure every AI connection
Use a data-classification rule that follows the data, not the interface. An external chat window, an internal plugin, and a hosted API can all create exposure.
| Class | Examples | Default treatment |
|---|---|---|
| Public | Published patch notes, public documentation, released screenshots | Permitted in approved tools after checking output quality and licensing |
| Internal | Routine schedules, non-public process notes, non-sensitive test plans | Use only with approved retention and access settings |
| Confidential | Source code, unreleased assets, contracts, roadmaps, security details | No external processing unless procurement, security, and legal approve it |
| Personal or regulated | Player accounts, voice, chat, support records, employee information | Purpose limitation, documented legal basis, regional controls, minimization, and approved processing |
| Restricted third-party material | Partner data, licensed datasets, performer files, embargoed builds | Follow the contract; prohibit use unless the rights holder and studio approve the exact purpose |
Set provider and infrastructure requirements
- Default to no provider training on studio data and no retention beyond the documented purpose.
- Use least-privilege identity and access management, separate project environments, and secrets management.
- Require encryption in transit and at rest, key-management controls, deletion workflows, and tested backups.
- Record hosting regions, cross-border transfers, subprocessors, and incident-notification deadlines.
- Log prompts, outputs, model versions, access, moderation events, approvals, and administrative changes, while minimizing sensitive content in logs.
- Apply input and output filters, malware scanning for generated code, and sandboxing before execution.
AWS describes concrete controls for isolated model customization: a separate studio-accessible model copy, no use of studio data to train the original base model, encryption, and IAM. Treat those as examples of controls to verify in any provider contract, not as a substitute for your own review.
5. Add player-safety, age, and disclosure gates
Player-facing AI has a different risk profile from an internal writing assistant. It can produce harassment, sexual content, self-harm encouragement, hate, personal-data exposure, deceptive impersonation, or unsafe instructions at scale. The feature owner remains responsible even when a third-party model produced the words, image, voice, or action.
Pre-release controls
- Test adversarial prompts, multilingual abuse, prompt injection, role-play attempts, evasion, and repeated-session behavior.
- Moderate both inputs and outputs, with policy rules appropriate to the game’s age rating and audience.
- Use rate limits, spending limits, context limits, and circuit breakers to contain abuse and runaway cost.
- Prevent the system from revealing secrets, personal data, hidden prompts, moderation rules, or other players’ information.
- Provide escalation to trained human support and a clear way to report harmful output.
- Keep audit logs sufficient to investigate incidents, with access restricted to authorized staff.
- Define what happens when the model, moderation service, or safety dependency is unavailable.
Disclose the interaction where required
Disclosure may be required by a platform, store, jurisdiction, or the game’s own trust-and-safety commitments. Roblox states that developers remain responsible for third-party AI content, that AI interactions must comply with its Community Standards, and that extended chatbot-like interactions require disclosure in the Content Maturity questionnaire and a Restricted label. A studio shipping on multiple platforms should map each platform’s current requirements and retain the submitted answers and disclosure copy.

Make notices understandable: tell players when they are interacting with an AI system, whether conversations are stored or reviewed, how to report a problem, and whether a human can intervene. Do not hide a material AI interaction in a general privacy policy.
6. Protect workers, contractors, and creative contributors
Worker governance belongs in the same policy as technical controls. The U.S. Department of Labor’s October 16, 2024 roadmap calls for meaningful human oversight, worker transparency and input, labor-rights protection, training, and worker-data security.
Required workforce safeguards
- Tell workers which tools are used, what information is processed, and how outputs may affect their work.
- Provide training on data handling, rights, bias, hallucinations, prompt injection, and reporting.
- Do not make hiring, evaluation, scheduling, discipline, compensation, or termination decisions solely through an automated system.
- Require a qualified human to review employment recommendations, record the reasons, and allow the affected person to challenge an error.
- Protect worker data with minimization, access controls, retention limits, and secure deletion.
- Give employees, contractors, and performers a non-retaliatory channel to report unsafe, discriminatory, or rights-infringing use.
- Clarify ownership and consent for generated voices, likenesses, performances, and derivative materials in contracts.
“We have a shared responsibility to ensure that AI is used to expand equality, advance equity, develop opportunity and improve job quality.”
Do not treat a worker’s silence as consent. Consultation, notice, and a practical appeal path are controls against both legal exposure and avoidable damage to trust.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.7. Review vendors, models, and platform dependencies
Procurement should approve a model for a defined use, not for every possible future use. Before approval, record:
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problems- Representations about training data, rights, and output ownership
- License, indemnity, warranty, and acceptable-use terms
- Prompt and output retention, provider training, deletion, and backup behavior
- Subprocessors, hosting regions, transfer mechanisms, and age controls
- Security attestations, access controls, encryption, logging, and penetration-test summaries where available
- Content filters, moderation interfaces, abuse-response commitments, and service-level limits
- Audit rights, incident-notification timing, and assistance with legal or platform inquiries
- Model-version change notices, deprecation rules, pricing, latency, and capacity limits
- Shutdown, export, replacement, and rollback options
Recheck the record when the provider changes a model version, terms, retention behavior, safety system, region, or subprocessor. A contract approved for one endpoint may not cover a later endpoint.

Use a structured EU reference when relevant
For EU-facing operations, map the deployment to the EU AI Act and use the European Commission’s GPAI Code of Practice, published July 10, 2025, as a reference for its transparency, copyright, and safety-and-security chapters. The Commission describes the code as voluntary and provider-focused, so counsel should confirm how the studio’s role and deployment trigger legal obligations.
8. Make release approval evidence-based
Before a high-risk feature or asset reaches a release branch, require a short evidence packet:
- Use-case record: Approved purpose, model and version, owner, affected people, geography, and platform.
- Data decision: Input classification, minimization, retention, regional processing, and provider-training setting.
- Rights and provenance log: Inputs, licenses, permissions, human contributions, edits, and disposition.
- Human sign-off: Named reviewer confirms quality, bias, safety, and compliance checks were actually performed.
- Safety results: Abuse tests, age-rating behavior, moderation performance, escalation tests, and known limitations.
- Vendor review: Current terms, security controls, subprocessors, incident contacts, and change-notification process.
- Player communication: Store, platform, in-game, or support disclosure text where required.
- Operations plan: Monitoring, alert thresholds, on-call owner, rollback command or configuration change, and replacement path.
Keep generated assets, prompts, model versions, test cases, and approvals versioned. If a model changes behavior, the studio should be able to identify affected builds and replace unsafe content without rebuilding its entire pipeline.

Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →9. Define incidents, escalation, and rollback
Write the response before an incident. Include severity levels for an IP claim, privacy leak, harmful player output, impersonation, labor complaint, security compromise, or platform rejection.
- Contain: Disable the feature, revoke access, quarantine outputs, or switch to a safe fallback.
- Preserve: Secure relevant prompts, outputs, model versions, access logs, moderation events, and approval records without spreading sensitive material.
- Notify: Contact the accountable owner, legal, security, privacy, trust and safety, and platform or partner contacts according to severity.
- Assess: Determine affected players, workers, assets, jurisdictions, builds, and contractual obligations.
- Remediate: Remove or replace outputs, correct data handling, update filters, retrain staff, and address the underlying vendor or workflow failure.
- Communicate: Provide accurate player, worker, partner, or regulator notices when required.
- Learn: Record the cause, decision points, controls that failed, and the owner and date for corrective action.
Define who can pause a feature immediately. Requiring a committee meeting while harmful output is live is not a control.
10. Compare use cases before choosing an approach
When teams propose alternatives, score each one against the same dimensions rather than comparing model quality alone.
| Decision dimension | Questions to ask |
|---|---|
| Data sensitivity | Does the workflow process public, confidential, personal, regulated, or restricted third-party data? |
| Rights and provenance | Are inputs licensed, are outputs traceable, and can human contributions be shown? |
| Human-review burden | Can reviewers understand the context and reject errors before release? |
| Player and child safety | Could the system generate harmful content, reveal data, or be manipulated by a minor? |
| Worker impact | Does it change a person’s job, evaluation, opportunity, or consented performance? |
| Vendor retention and training | What is stored, for how long, in which region, and for whose model improvement? |
| Security controls | Are IAM, encryption, logging, isolation, deletion, and incident response adequate? |
| Geography and platform rules | Do regional laws, stores, consoles, or platform questionnaires impose extra duties? |
| Quality and bias | How often does the output fail, hallucinate, stereotype, or drift after a model update? |
| Cost and latency | Can the studio afford peak usage and meet gameplay response requirements? |
| Auditability | Can the studio reproduce what happened and explain the decision? |
| Rollback complexity | Can the feature be disabled and its outputs replaced without corrupting saves or live operations? |
11. Put the policy into operation in 30 days
Days 1–7: establish ownership and stop unsafe defaults
- Name an executive sponsor and operational policy owner.
- Freeze unapproved uploads of confidential, player, personal, and licensed data to external tools.
- Publish the definitions, risk tiers, reporting channel, and emergency shutdown authority.
- Ask every team to list current tools, models, integrations, and live features.
Days 8–14: register and classify
- Complete the inventory fields for each use case.
- Classify inputs and identify affected players, workers, performers, and partners.
- Assign low, medium, or high risk and document the reason.
- Identify uses that involve training, synthetic likenesses, player interaction, moderation, or employment.
Days 15–21: review rights, security, and safety
- Check provider terms, retention, training, subprocessors, regions, and incident contacts.
- Create provenance records for assets already in production.
- Run abuse, privacy, bias, and failure-mode tests for high-risk systems.
- Draft player notices, support escalation, and worker communications.
Days 22–30: approve, monitor, and rehearse
- Obtain written approvals and human sign-offs.
- Version the evidence packet with the build or deployment.
- Test rollback, access revocation, data deletion, and provider outage procedures.
- Schedule quarterly review and assign owners for every corrective action.
12. Use this decision checklist for every new request
- Is the purpose specific, necessary, and registered?
- What exact data enters the system, and is any of it personal, confidential, unreleased, or third-party restricted?
- Does the provider retain prompts or outputs, train on them, use subprocessors, or move them across borders?
- Who owns the inputs, and what permissions cover the intended use?
- What human contribution, review, and approval will be documented?
- Could the output affect a child, player safety, a worker’s rights, or a performer’s identity?
- What disclosure, age control, moderation, or platform submission is required?
- How will quality, bias, security, and abuse be tested before launch and after updates?
- Who can pause the system, and how will the studio replace its outputs?
- When will the use case be reviewed again?
A policy is responsible when it makes safe behavior easier than accidental disclosure, makes human accountability visible, and leaves the studio able to explain and undo an AI-assisted decision.
