Your heirs need two different things to inherit cryptocurrency: legal authority and the technical ability to move it. A will can identify beneficiaries and authorize an executor, but it cannot recreate a lost private key or bypass a wallet’s encryption. Build an inventory, document fiduciary authority, secure recovery material separately, choose a custody design, and test the recovery process while you are alive.

Why crypto inheritance is different

Cryptocurrency ownership is recorded on a blockchain, but control is exercised with private keys. A self-custody wallet does not hold coins in the device or app; it holds, or derives, the credentials needed to sign transactions. A recovery phrase is a human-readable backup for those keys. Anyone who obtains the phrase may be able to spend the assets, while a person who loses it may have no technical way to recover them.

HM Revenue & Customs states in its Cryptoassets Manual (CRYPTO22400): “If an individual misplaces their private key … they will not be able to access their tokens.” That is why inheritance planning must address both probate and key continuity.

Exchange accounts add a different layer. The provider controls the account interface and may have a death-notification, identity-check and probate process. Your executor’s legal authority does not guarantee immediate disclosure; the provider’s terms, jurisdiction and required documents still apply.

What an effective plan contains

  • An inventory: every exchange, wallet application, hardware device, blockchain network, account name, public address or wallet descriptor, and approximate balance.
  • Legal authorization: a locally valid will, trust, power of attorney or related document naming fiduciaries and beneficiaries and expressly authorizing digital-asset access.
  • Protected recovery material: seed phrases, private keys, PINs, passphrases and multisignature key shares held through a separate security process.
  • A recovery design: a clear single-signature or multisignature procedure, including thresholds, software, signing order and assistance contacts.
  • Tax records: basis, acquisition dates, transfers, income events, staking records and instructions for date-of-death valuation.
  • A tested handoff: heirs and the executor know where the non-secret instructions are and have rehearsed recovery with a small amount.

Step 1: Build an inventory without exposing secrets

Start with a map, not with passwords or seed phrases. HMRC recommends checking exchange accounts, bank statements, email, devices, paper records and recovery phrases when identifying cryptoassets. Search those sources methodically and record what you find in an encrypted document or other protected inventory.

Record each holding

Item What to document
Exchange or custodian Provider name, account email or username, jurisdiction, account type and the expected death-certificate or probate route.
Self-custody wallet Wallet application, hardware model, network or networks, public addresses or wallet descriptor, and the device’s physical location.
Blockchain assets Chain, token or coin, approximate quantity, and whether assets are staked, locked, bridged or held in a contract.
Backups Where the recovery phrase, passphrase, key share and any encrypted backup are stored; do not put the secret itself in the inventory.
Records Purchase confirmations, transfer history, staking or mining income records, and wallet-to-wallet mapping.

Include dormant accounts and small balances. A wallet may contain a token or non-fungible asset that is not visible in the application used most often. Note which addresses are watch-only and which wallet software can restore them.

Keep the map current

Set a review trigger after any new wallet, exchange, chain, phone, firmware update, passphrase change or transfer. Tell the executor where the inventory is stored, but do not give an untrusted person the location and the unlocking secret in the same message.

Step 2: Separate legal authority from technical secrets

An executor or personal representative does not automatically gain access to a decedent’s online accounts without specific consent from the decedent, according to the American Bar Association. Most United States states have adopted some form of the Revised Uniform Fiduciary Access to Digital Assets Act (RUFADAA), but the scope and required wording vary. Florida’s 2026 statute, for example, permits fiduciary requests to custodians only under specified statutory conditions.

Ask an estate-planning lawyer in the relevant jurisdiction to draft explicit authorization for digital assets. The document should identify the fiduciary, authorize access to account information and digital assets, state the intended beneficiaries, and address privacy and confidentiality. A trust may be useful where ongoing management or staged distribution is needed; a power of attorney can help during incapacity but normally ends at death, so it does not replace a will or trust.

Do not place raw seed phrases, PINs or passphrases in a will that may become a public probate filing. Instead, make the legal document point to a separate, protected process. The executor should be able to prove authority without learning a spending secret until the correct time.

Step 3: Choose the custody path

Approach How heirs gain access Strength Failure to plan for
Exchange custody Executor follows the provider’s death, identity and probate procedure. The provider may offer an established estate process. Terms, jurisdiction, identity checks or delays can block access.
Single-signature self-custody Heir restores the wallet using recovery material and any required passphrase. Simple operating model and no provider approval. One lost secret causes permanent loss; one disclosed secret can enable theft.
Multisignature self-custody A threshold of several keys signs a transaction. No single device or key is a point of failure. Heirs may not understand descriptors, thresholds, signing order or key locations.
Professional multisignature service A service key combines with heir or executor keys after verification. Guided recovery and distributed custody. Provider continuity, fees, jurisdiction and program terms require diligence.

Exchange-held assets

For each exchange, document the exact account identifier and the provider’s published estate route. The executor will commonly need a death certificate, proof of identity, proof of authority and probate documents, but requirements differ. Do not assume that a beneficiary designation on a bank account applies to a crypto account. Keep a current copy of the provider’s terms with the inventory and verify changes during annual reviews.

Single-signature self-custody

Use redundant, durable backups stored in separate secure locations. Document the wallet software, restoration order, network selection and any passphrase. A hardware signer is not itself the inheritance plan: without the recovery phrase, required PIN or compatible software, the device may be unusable to heirs. Conversely, anyone who finds an unprotected phrase may spend the funds.

Multisignature self-custody

Multisignature, or multisig, requires a defined number of keys to authorize a transaction. A 2-of-3 vault needs any two of three keys; a 3-of-5 vault needs any three of five. Casa describes both models, and its explanation notes that every paid vault uses multiple keys for each transaction. These designs can tolerate one lost key, but only if the remaining keys, wallet descriptor and signing procedure are preserved.

Distribute keys among locations and people without creating a new concentration risk. For example, an heir may hold one key, a second key may be in a safe-deposit arrangement, and a third may be held by a trusted service or technical custodian. Document who can provide help and what happens if one participant is unavailable. Never store all key shares together with the descriptor and instructions.

Step 4: Write a non-secret recovery guide

Create a short instruction sheet that explains the process without revealing the credentials. Store it where the executor can find it after death.

  1. Identify the event and authority. Name the executor, alternate executor and lawyer; state which document proves authority and where the original is held.
  2. Locate the inventory. Give the exact storage location and the method for opening it.
  3. Classify each asset. Mark exchange, single-signature or multisignature holdings, and identify the relevant chain and wallet software.
  4. Follow the provider route. For an exchange, contact the custodian through its official support channel and submit only the documents it requests.
  5. Restore a self-custody wallet. Install the documented wallet software from its official source, select the correct network and restore using the protected recovery material. Never type a phrase into a website or send it to support.
  6. Complete a multisignature transaction. Open the documented wallet descriptor, connect the required number of signers, verify the destination and fee on each device, then broadcast only after all signatures are present.
  7. Move assets conservatively. Use a newly verified destination controlled by the estate or beneficiary, send a small test amount first, and preserve transaction IDs.
  8. Record the outcome. Update the inventory, tax ledger and beneficiary distribution record after each transfer.

Include screenshots or plain-language descriptions of labels that heirs will see, but remove seed phrases, PINs and passphrases. Identify a technical helper who can explain software and transaction mechanics without being able to act alone.

Step 5: Test recovery while you are alive

A recovery drill exposes errors that paperwork cannot. Use a small-value wallet or a small amount in the real wallet and have the intended heir follow the guide under your supervision.

  • Confirm the phrase restores the expected addresses and balances.
  • Verify the correct network, wallet derivation path and multisignature descriptor.
  • Check that every required key is present, functional and stored at the stated location.
  • Practice creating, reviewing, signing and broadcasting a small transaction.
  • Confirm that the executor can find the legal authorization and the non-secret instructions.
  • After the drill, rotate any temporary credentials and secure all notes.

Repeat the drill after changing a wallet, phone, firmware, provider, passphrase or key location. Ledger’s estate-planning guidance warns that a hardware signer without the device and PIN may be unusable to heirs; the same practical issue applies to any design whose prerequisites are undocumented.

Tax records and valuation

Maintain a ledger that connects every wallet and exchange to acquisition records. Keep purchase price, fees, dates, transfers, disposals, staking or mining income, airdrops and other taxable events. A transfer between wallets you control should be identifiable as such, rather than mistaken for a sale.

The IRS digital-assets guidance page links Notice 2014-21, Revenue Procedure 2024-28 and related materials. Its basis rules and reporting requirements can change, and treatment depends on the asset and transaction. HMRC says identified cryptoassets should be valued and included in estate information where appropriate; if assets are identified but inaccessible, the estate records should explain why and state the believed value.

Do not assume a universal stepped-up-basis or estate-tax result. Date-of-death valuation, inheritance tax, capital gains, income and later beneficiary transactions depend on jurisdiction and circumstances. Give the executor the records and ask a qualified tax professional for advice before distributing or selling assets.

Security rules that prevent inheritance theft

  • Never email or text a recovery phrase, private key, PIN or passphrase.
  • Do not photograph secrets or store them in an unencrypted cloud note.
  • Use tamper-evident or otherwise durable backups in separate locations.
  • Verify wallet software and support contacts through the provider’s official domain; legitimate support will not ask for a seed phrase.
  • Require two people to verify a beneficiary address before a large transfer.
  • Document an emergency plan for a lost device, compromised key or unavailable executor.
  • Keep a public-address inventory separate from spending credentials so balances can be monitored without enabling transfers.

Common failure modes and fixes

The will names the heirs but no wallet is found

Search statements, email, devices, paper records and exchange notices. Contact custodians through their estate process. If no private key or recovery phrase exists, a lawyer cannot manufacture one; record the asset as inaccessible and preserve evidence of its believed value.

The phrase works but the balance appears to be zero

Check the blockchain network, derivation path, address type and wallet descriptor. The phrase may restore a different account than the one used, or the asset may be on another chain. Do not enter the phrase into an unfamiliar recovery website.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A multisignature wallet cannot sign

Confirm the threshold, descriptor version, software compatibility and key order. Locate every surviving key and use the documented signing sequence. If one key is lost, a 2-of-3 or 3-of-5 design may still work; if fewer than the threshold remain, the funds may be inaccessible.

An exchange refuses an executor’s request

Ask for the provider’s formal estate checklist and submit complete proof of death and authority. Escalate through the provider’s legal or compliance channel where available. A court order or additional probate step may be required under the account’s jurisdiction.

When professional help is justified

Use an estate-planning attorney familiar with digital assets when holdings are substantial, beneficiaries are in different jurisdictions, a trust is involved, or the ownership structure is complex. A tax professional should review basis and valuation records. A technical specialist can document wallet restoration and multisignature operations, but should not receive unilateral control over the estate.

For any custody service, investigate supported assets, fees, provider continuity, geographic availability, legal process and what happens if the service closes. Treat a service key as one component of a threshold design, not as a substitute for your own inventory and legal documents.

Final checklist

  • Every exchange, wallet, chain, device and public address is listed.
  • The executor knows where the inventory and non-secret guide are stored.
  • Legal documents expressly authorize digital-asset access in the relevant jurisdiction.
  • Seed phrases, PINs, passphrases and key shares are secured separately from the will.
  • The custody model and, for multisig, threshold and descriptor are documented.
  • Heirs know the software, signing sequence and technical helper.
  • A small-value recovery drill succeeded and is scheduled for repeat testing.
  • Basis, transaction and valuation records are complete and backed up.
  • Instructions are reviewed after every material wallet or provider change.
