Yes—an assessee that generates power through a captive plant can potentially claim additional depreciation under Section 32(1)(iia), but the project label alone is not enough. The claim is tested asset by asset. Each item must generally be new tangible plant or machinery, owned wholly or partly by the assessee, acquired and installed after 31 March 2005, and used for the qualifying business of generation, transmission or distribution of power. The ordinary additional-depreciation allowance is 20% of actual cost. If an eligible item is used for fewer than 180 days in the previous year, only half of that amount is claimed in the first year and the balance is claimed in the immediately succeeding previous year, subject to the statutory conditions.
What Section 32(1)(iia) allows for a captive plant
Section 32(1)(iia) of the Income-tax Act, 1961 provides an additional deduction for qualifying new machinery or plant, other than ships and aircraft. The deduction is equal to 20% of the asset’s actual cost. The provision covers an assessee engaged in manufacture or production, or in generation, transmission or distribution of power.
A captive generating unit can fall within the power-generation category, even though the electricity is primarily consumed by the owner’s own industrial operation. “Captive” is not, however, a separate automatic entitlement. The statutory tests apply to each asset that makes up the project, and the claim must be supported by records showing acquisition, installation, ownership, actual cost and business use.
Eligibility tests to apply to every asset
Prepare the claim at component level rather than applying one percentage to the total EPC invoice. For each proposed item, document the following tests.

1. The item is new
Additional depreciation is for new plant or machinery. A machine or component that was used by another person before its installation is a statutory exclusion risk. “New project” or “new unit” wording in an internal project document does not prove that every item was new; inspect invoices, import records and vendor declarations.
2. It is plant or machinery, not land, a building or civil work
Section 32(1)(iia) applies to qualifying plant and machinery. Land, buildings, foundations and other civil works should be separated from machinery costs. A mixed EPC bill therefore requires a defensible allocation between equipment, installation and civil elements. Where a disputed structure is functionally integrated with generation equipment, obtain a current Indian tax opinion instead of assuming that integration alone settles its classification.
3. It is owned wholly or partly by the assessee
The statute requires ownership, wholly or partly, together with use for business or profession. Confirm the contracting entity, capitalization entry and ownership terms for leased, jointly funded, transferred or vendor-financed equipment. A group company’s payment or operation of an item does not by itself establish that the claiming assessee owns it.

4. It was acquired and installed after 31 March 2005
Retain the acquisition and installation dates for each item. The relevant statutory cut-off is acquisition and installation after 31 March 2005. A single commissioning date for an entire plant may be insufficient where separate packages were delivered, installed or placed in service at different times.
5. It is used for the qualifying power business
The assessee must be engaged in generation, transmission or distribution of power (or manufacture or production). For a captive facility, connect the asset to the generation activity through technical descriptions, the plant layout, synchronization records and accounting entries. If an item is used partly for a non-qualifying activity, quantify the business use and obtain advice on the allowable portion rather than claiming the full cost automatically.

6. It is not a statutory exclusion
Screen every item for the exclusions discussed below before calculating the deduction. Passing the “power plant” description does not override an express exclusion.
Which captive-plant components need separate analysis?
Typical project schedules contain multiple packages with different tax characteristics. Use an asset register that can show the engineering description and the tax conclusion for each line.

| Project component | Questions to document | Why the answer matters |
|---|---|---|
| Boiler or heat-recovery boiler | Is the unit new, separately identifiable and capitalized as plant? When was it installed and first used? | Supports the newness, plant classification and timing tests. |
| Turbine | What is the invoice allocation for the turbine, auxiliaries and civil supports? | Prevents civil or building costs from being included with equipment. |
| Generator or alternator | Who owns it, and what record proves synchronization or first generation? | Links ownership and first use to the power-generation business. |
| Waste-heat recovery unit | Is it used in the generation process, and is its cost separately allocated? | Functional integration should be evidenced, not assumed. |
| Transformer and switchgear | Are the items dedicated to the generating facility or used elsewhere? | Business-use and partial-use questions may affect the claim. |
| Control and protection systems | Are software, panels and hardware separately described and capitalized? | Only qualifying tangible plant or machinery should enter the calculation. |
| Foundations, buildings and other civil work | Can the EPC invoice be split from the equipment it supports? | These costs generally require exclusion or a carefully supported classification analysis. |
The table is a review framework, not a ruling that every listed item qualifies. Engineering form, contractual rights, use and current judicial authority can change the result for a particular component.
The 180-day rule and the two-year claim
If an eligible asset is acquired during the previous year and put to use for fewer than 180 days in that year, the additional-depreciation deduction is restricted to 50% of the amount calculated at the applicable rate. At the ordinary 20% rate, that produces a 10% deduction in the first year. The remaining 10% is allowed in the immediately succeeding previous year, provided the statutory conditions continue to be met.
| First-use position | Additional depreciation in the first year | Additional depreciation in the immediately succeeding year | Evidence to retain |
|---|---|---|---|
| Used for at least 180 days in the previous year | 20% of actual cost | No balance under the 180-day split | Installation, commissioning and first-use records showing the date. |
| Used for fewer than 180 days in the previous year | 10% of actual cost (half of the 20% amount) | Remaining 10% of actual cost, where permitted | Exact first-use date, the short-use calculation and a carry-forward schedule. |
Use the date the asset was first put to use, not merely the invoice date. For a generating unit, synchronization, trial-operation and generation logs can help establish first use; the facts should be reconciled with the commissioning certificate and fixed-asset register. The 180-day test is applied to the individual asset or identifiable package, so a plant-wide date should not conceal earlier or later use of separate items.

Statutory exclusions and frequent captive-plant errors
Previously used machinery
Machinery or plant used by another person before installation is excluded. Second-hand equipment, refurbished imports and transferred group assets require particular care. A vendor’s statement that equipment is “as new” is not a substitute for evidence of prior use.
Office or residential installations
Machinery or plant installed in office premises or residential accommodation falls within the statutory exclusions. Do not include office-building equipment merely because it supports the project’s administration or monitoring function.
Office appliances
Office appliances are excluded. Separate ordinary administrative equipment from control hardware that is genuinely part of the generation plant; the technical description, location, capitalization and function should all be recorded.
Road transport vehicles
Road transport vehicles are excluded. A vehicle used to move fuel, staff or maintenance material is not converted into eligible generating machinery by its connection with the plant.
Ships and aircraft
The provision itself is for qualifying new machinery or plant other than ships and aircraft. Those categories should not be included in a captive-project computation.

Project-label and EPC-invoice errors
Claiming 20% on the entire “captive power plant” or “turnkey EPC” value is a common error. Land, buildings, foundations, roads and other civil works can be embedded in the invoice, while some equipment may be used outside the qualifying business. Split the bill, map each cost to an asset and record the reason for inclusion or exclusion.
Step-by-step claim workflow
- Freeze the project population. Obtain the EPC agreement, purchase invoices, bills of entry, change orders, installation certificates and capitalization details. List every package and subcomponent rather than starting with one project total.
- Allocate the cost. Separate land, buildings and civil work from machinery. Allocate common EPC charges on a documented basis and preserve the calculation used to arrive at each asset’s actual cost.
- Test newness and ownership. Mark whether each item is new, identify the seller or importer, and confirm that the claiming assessee owns it wholly or partly. Flag used, transferred, leased or jointly owned items for specialist review.
- Confirm acquisition and installation. Record the invoice or import date and the physical installation date. Retain installation certificates, photographs or site records where available, and reconcile them to the fixed-asset register.
- Confirm qualifying use. Link the asset to generation, transmission or distribution of power. Record the first-use or synchronization date and identify any period or portion used for another activity.
- Apply exclusions. Remove previously used machinery, office or residential installations, office appliances, road transport vehicles, ships, aircraft and non-plant costs.
- Apply the 180-day test. For each surviving item, determine whether it was put to use for at least 180 days in the previous year. Use 20% for the full-use case; use 10% in the short-use year and schedule the remaining 10% for the immediately succeeding previous year where the law permits.
- Reconcile the tax computation. Tie the asset schedule to the general ledger, fixed-asset register, book depreciation, tax depreciation schedule and return computation. Investigate every difference before filing.
- Review the return-year presentation. Confirm the current assessment-year return utility and applicable fields with an Indian tax professional. Return-field labels and filing mechanics can change even when the underlying statutory test does not.
- Archive the evidence. Keep the schedule, invoices, import documents, certificates, generation logs, ownership records, allocation workings and review memo together for the relevant assessment and any later enquiry.
Worked calculation pattern
Assume an eligible generator has an actual cost of ₹10,000,000 and all statutory conditions are satisfied. If it is first put to use for at least 180 days in the previous year, the additional depreciation calculation is:
- Actual cost: ₹10,000,000
- Additional-depreciation rate: 20%
- Additional depreciation for that year: ₹2,000,000
If the same asset is put to use for fewer than 180 days:
- First-year amount: 10% of ₹10,000,000 = ₹1,000,000
- Immediately succeeding year: remaining 10% = ₹1,000,000, where the statutory conditions are met
These figures illustrate the statutory percentages; they do not decide whether the generator, its auxiliaries or any associated EPC cost is eligible. The actual-cost base must be the amount defensibly allocated to qualifying plant or machinery.

Evidence that makes the calculation defensible
Maintain an asset-level evidence file. The strongest file allows a reviewer to move from the tax schedule to the invoice, the site record and the first-use date without relying on oral explanations.

- Purchase invoices, purchase orders and import bills of entry.
- EPC measurement sheets and the allocation of equipment, installation and civil costs.
- Installation certificates, erection records, commissioning certificates and synchronization approvals.
- Generation, trial-run and first-use logs showing when each identifiable unit entered service.
- Fixed-asset-register extracts showing description, location, capitalization date, cost and ownership.
- Plant layout, technical specifications and photographs that distinguish equipment from foundations or buildings.
- Records of any prior use, refurbishment, transfer, lease or shared ownership.
- General-ledger reconciliations and the tax depreciation working used in the return.
Keep the evidence consistent. A commissioning certificate dated after the claimed first-use date, or an asset-register description that says “civil structure” while the tax schedule says “generator,” can undermine an otherwise correct calculation.
How to handle uncertain components
The statute does not resolve every engineering classification. Obtain a current project-specific tax opinion where an item is a mixed civil-and-plant structure, a replacement asset, a shared utility, a control system with embedded software, or an asset used partly outside the qualifying power activity.
Ask the adviser to address the physical description, function in the generation process, ownership, actual-cost allocation, installation and first-use dates, exclusions and current judicial authority. Preserve the written analysis with the return file. A conservative exclusion may reduce the deduction but can be preferable to an unsupported project-wide claim; the appropriate choice depends on the facts and materiality.

- Does every line represent new tangible plant or machinery rather than land, a building or civil work?
- Is the assessee the owner, wholly or partly, and is the item used in its business?
- Was it acquired and installed after 31 March 2005?
- Is the use connected to generation, transmission or distribution of power?
- Has each statutory exclusion been checked?
- Is actual cost supported by an asset-level EPC allocation?
- Is the first-use date documented independently of the invoice date?
- Was the 180-day threshold applied separately to each relevant asset?
- For short-use assets, is the remaining 10% scheduled in the immediately succeeding previous year?
- Do the books, fixed-asset register, tax schedule and return computation agree?
- Has an Indian tax professional reviewed disputed classifications and the current assessment-year return fields?
What the captive-plant owner should conclude
Captive generation can satisfy the power-business limb of Section 32(1)(iia), but eligibility is not granted to the project as a single package. Claim 20% of actual cost only for each qualifying new plant or machinery asset that passes the ownership, acquisition, installation, use and exclusion tests. Apply the 180-day split precisely: 10% in the short-use year and the remaining 10% in the immediately succeeding previous year. The quality of the asset schedule and first-use evidence is as important as the arithmetic, especially where an EPC invoice combines equipment with civil work.
