Choose cover by country, activity and worker status—not by app name. First establish whether people are employees or genuinely self-employed, then verify mandatory motor, occupational-accident and profession-specific requirements in every country, and add liability and income protection for risks the compulsory schemes do not cover.
Start with the operating map, not an insurance product
A platform that arranges food delivery in France, ride-hailing in Spain and online design work across several Member States does not have one “European gig-work policy” that automatically solves every obligation. Insurance duties attach to the service being performed, the country where it is performed, the vehicle or equipment used, and the legal relationship between the platform and the person doing the work.
Build a written operating map before asking a broker for a quotation. Record:

- Subcontractors, fleet owners, agencies and other parties that may need to be insured or named in certificates.
- The customer contract and who is promising the service: the platform, an individual worker or a separate business.
This inventory determines which policies are legally required and which are sensible risk controls. A policy bought for personal use, or for one country, cannot be assumed to cover paid work elsewhere.

Classify workers before deciding who needs cover
Worker status is the first insurance decision because employee protections and employer duties can apply even when a contract calls someone an “independent contractor.” Directive (EU) 2024/2831 applies to digital labour platforms organising work in the Union. It requires procedures to determine the correct employment status and creates a rebuttable presumption of employment when the facts indicate control and direction.
The directive does not automatically turn every courier or freelancer into an employee, and it does not itself set one EU-wide insurance policy. It does mean that a platform should preserve evidence supporting its classification and be ready for a national authority or court to examine how work is actually organised.
Document the control-and-direction facts
For each role, document who:
- Sets or materially constrains working hours, locations, routes or availability.
- Determines prices, fees, cancellation rules and payment timing.
- Provides equipment, branding, training or mandatory procedures.
- Monitors performance through ratings, GPS, acceptance rates or automated scoring.
- Can suspend or deactivate a worker, and the reasons and appeal process.
- Controls whether the person may substitute another worker or serve competing customers.
Compare those facts with the employment test in each country where the work occurs. Keep contracts, onboarding records, schedule data, policy documents and deactivation decisions together; a label in a contract is weaker evidence than day-to-day practice.
If workers are employees or deemed employees
Identify the legal employer and check the country’s compulsory occupational-accident, employer-liability and social-insurance rules. The employer may be the platform, a local subsidiary, a staffing company or another contractor, but the allocation must be real and documented. Obtain certificates that cover the actual activity and the territory, and confirm whether subcontracted workers are included or must carry their own policies.
If workers are genuinely self-employed
Self-employed people may not receive employee-style sick pay, unemployment benefits or income support. Those gaps are not automatically a platform’s statutory liability, but they are material welfare and continuity risks. Explain optional personal-accident, sickness and income-protection insurance in plain language, state who pays, and avoid presenting voluntary cover as a universal legal requirement.
Separate compulsory insurance from protection you choose to add
National law controls what is mandatory. Your Europe explains that some policies, such as motor insurance, are compulsory while others are optional; Member States can also require professional-liability insurance for particular professions. A platform should maintain a country register showing the rule, the insured party, the required limit or equivalent guarantee, the evidence held and the renewal date.
| Risk or obligation | When it commonly applies | What to verify |
|---|---|---|
| Third-party motor liability | Cars, motorcycles and other legally defined road vehicles used on public roads | Statutory policy, paid-use permission, territory, vehicle ownership and permitted drivers |
| Occupational-accident and employer liability | Workers who are employees or treated as employees under national law | Legal employer, registration duties, work activity, limits and reporting procedure |
| Professional indemnity | Regulated or higher-risk professional services where national rules require cover or an equivalent guarantee | Profession, trigger for cover, minimum amount, territorial scope and retroactive requirements |
| Public or general liability | Third-party injury, property damage or premises and operations exposures | Who is insured, customer property, unattended items, subcontractors, driving and hazardous-work exclusions |
| Personal accident, sickness or income protection | Usually optional support for genuinely self-employed workers | Waiting periods, benefit duration, exclusions, taxation and whether cover follows the worker between platforms |
Do not infer a legal minimum from a quote or from another Member State. If a comparable value is not stated by the applicable authority, record “not stated” and obtain country-specific advice rather than guessing.

Check commercial motor insurance for every delivery or passenger vehicle
For cars, motorcycles, cargo bikes and other vehicles, confirm statutory third-party motor insurance and that the policy expressly permits paid delivery or passenger transport. Personal-use wording commonly excludes commercial platform work. Written confirmation from the insurer is more reliable than an app’s onboarding screen or a worker’s assumption.
Questions to ask about a motor policy
- Is the exact vehicle category covered, including e-bikes, mopeds, scooters, cars or rented vehicles?
- Does “hire and reward,” delivery, courier work or passenger transport appear as a permitted use?
- Are all drivers, substitute drivers and subcontracted fleet operators covered?
- Does the policy apply in every country where the vehicle works, and for how long during a temporary visit?
- Are loading, unloading, food bags, customer goods and theft from an unattended vehicle excluded?
- What excess applies, who pays it and does a claim affect a worker’s personal no-claims history?
Where a platform supplies vehicles, it should control certificates, driver eligibility and maintenance records. Where workers use their own vehicles, the platform should require evidence of compliant paid-use insurance and a process for checking expiry dates. A platform liability policy is not a substitute for the vehicle’s compulsory motor cover.
Add public liability for accidents involving customers and the public
Public or general liability responds to third-party bodily injury and property damage arising from operations. Examples include a courier injuring a pedestrian, a worker damaging flooring while installing equipment, or a customer slipping in a service area. Match limits to the worst credible loss in the countries and activities involved, rather than choosing the cheapest limit shown in a comparison screen.
Read the insured-person definition carefully. It should state whether it covers the platform, its subsidiaries, workers, agency staff, subcontractors and any host or customer that must be protected by contract. Check whether the policy is primary or excess over another policy and whether one occurrence, aggregate and jurisdiction limits differ.
Exclusions that frequently change the result
- Motor liability or any driving-related incident.
- Professional errors, negligent advice or failure to deliver a contracted result.
- Damage to property in the worker’s care, custody or control, including unattended customer goods.
- Cyber incidents, data breaches and loss of digital records.
- Hazardous work, construction, medical treatment, alcohol, fire or other regulated activities.
- Intentional damage and criminal acts, which EU guidance notes can be excluded.
If an exclusion applies, decide whether a separate policy, contractual control or operational procedure addresses the gap. Do not promise customers that “platform insurance” covers every incident.
Use professional indemnity where the service can cause financial harm
Professional indemnity, also called professional-liability insurance, addresses claims that a service error, negligent advice, omission or failure to meet a professional duty caused a customer financial loss or other covered damage. It is different from public liability: a damaged laptop and a flawed tax filing are not the same claim.
Services Directive Article 23 allows a Member State to require professional-liability insurance or an equivalent guarantee when a service presents a direct and particular risk to the health or safety of the recipient or to the recipient’s financial security. National rules determine which professions are covered, the minimum amount and acceptable evidence. This can affect regulated advice, technical design, health-related services, legal or accounting work and other high-consequence activities, but it is not a blanket requirement for every freelancer.

Match the policy to the contract and work product
- Define the professional activity in the schedule; a generic “consulting” description may not cover engineering, medical, financial or legal advice.
- Check whether claims-made wording requires a retroactive date and continuous renewal to preserve protection for earlier work.
- Confirm cover for subcontracted work, intellectual-property allegations where relevant, and the countries whose courts may hear a claim.
- Require the worker or professional firm to maintain its own policy when the platform is not the service provider.
Handle temporary cross-border work explicitly
A worker may live in one country, accept a job through a platform in another and perform it in a third. Your Europe states that a host country can impose insurance requirements for temporary cross-border professional services. It may recognise equivalent existing cover for a permanent establishment, subject to conditions. Recognition is not automatic for every activity or policy wording.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsBefore allowing cross-border work, verify:
- The countries and territories listed in the policy, including territorial waters or travel corridors where relevant.
- Which law governs the contract and where claims can be brought.
- Whether local compulsory insurance, registration or certificate requirements still apply.
- Language, notification and claims-handling arrangements in the host country.
- Whether a temporary assignment becomes a permanent establishment or recurring local business.
Keep evidence of equivalent cover and any host-country notification. A European Economic Area reference in a policy schedule is not, by itself, proof that every local professional or motor requirement is satisfied.
Compare policies on substance, not just premium
There is no defensible EU-wide premium or minimum liability limit without a named country, activity, vehicle, turnover, claims history and worker classification. Obtain quotations only after those facts are fixed. Compare each option on the same basis:
| Comparison axis | What a decision-maker should record |
|---|---|
| Legal compliance | Country rule, worker status, compulsory class and evidence required |
| Insured activity | Exact service, paid-use permission, equipment and customer property |
| Limits and deductibles | Per claim, aggregate, sublimits, excess and who bears each amount |
| Exclusions and conditions | Driving, unattended goods, cyber, professional error, hazardous work, intentional or criminal acts |
| Territory and jurisdiction | Countries, temporary travel, governing law and claims venue |
| Who is insured | Platform entities, workers, substitutes, agencies, subcontractors and additional insureds |
| Claims service and financial strength | Notification deadline, emergency assistance, language, reserving and insurer stability |
| Total cost | Premium, taxes, fees, deductibles, adjustment clauses and renewal volatility |
A low premium with a business-use exclusion is not a cheaper version of a compliant commercial policy; it is a different risk transfer with a potentially uninsured claim.
Follow a country-by-country implementation process
- Inventory operations. Freeze the operating map of countries, services, vehicles, workers, subcontractors and customer promises.
- Run the status assessment. Apply each country’s employment test, document control-and-direction facts and identify the legal employer where applicable.
- List mandatory classes. Check motor, occupational-accident, employer-liability and profession-specific requirements with the relevant national authority or qualified adviser.
- Design the liability programme. Select public and professional liability limits from realistic worst-case scenarios and align insured parties with contracts.
- Close worker-protection gaps. For genuine self-employed workers, offer clearly voluntary personal-accident, sickness and income-protection options and explain exclusions.
- Validate cross-border use. Confirm territory, jurisdiction, equivalent-cover recognition and any host-country filing before enabling a new route or service.
- Vet the intermediary. Use an insurer or broker authorised for the relevant country. Obtain the full wording, schedule, endorsements and certificates—not just a summary page.
- Set controls. Record renewal dates, driver and worker certificates, incident contacts, notification deadlines and approval for new countries or services.
- Review after change. Reassess cover when pricing, algorithms, vehicles, subcontractors, customer contracts or worker classification changes.
Governance records that prevent coverage disputes
Maintain one insurance register with a row for each country and activity. Link every row to the policy number, insured entities, limits, exclusions, territory, renewal date and certificate location. Store worker-status evidence, subcontractor certificates, vehicle documents, incident logs and insurer notifications under the same country and activity code.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Give operations and product teams a change-control rule: launching a new service, entering a new country, adding a vehicle type or changing deactivation logic requires an insurance review before release. Train workers on accident reporting, evidence preservation and emergency contacts; late notification or missing records can be as damaging as an incorrect limit.
How EU platform-work rules affect insurance decisions
On 11 March 2024, the Council confirmed agreement on the platform-work directive. Member States have two years after formal adoption to incorporate it into national law. The timing and detailed national procedures therefore depend on each country’s transposition. The directive’s employment-status and algorithmic-management rules can change who is treated as an employer and which occupational protections must be arranged, but they do not create a single EU-wide policy wording or premium.

The Council describes the sector as involving more than 28 million people in the EU in 2022 and expected to reach 43 million in 2025. It also reports about 500 digital labour platforms and revenue growth from an estimated €3 billion in 2016 to around €14 billion in 2020. Those scale figures explain why a platform should treat insurance governance as a core compliance process rather than an onboarding checkbox.
Insurance-distribution governance also changes over time. The European Commission’s Insurance Distribution Directive page lists a delegated regulation dated 24 April 2024 updating euro base amounts for professional-indemnity insurance and financial-capacity requirements for intermediaries. Those amounts concern insurance intermediaries’ regulatory requirements; they are not a universal liability limit for platform operators or workers. Re-check the Commission and national regulator material when renewing or appointing an intermediary.

Common failure modes and fixes
Assuming the app provides all required insurance
Why it fails: platform protection may be limited, conditional or unavailable for a worker’s vehicle or profession. Fix: obtain the actual wording and identify which party’s policy responds first.
Using personal motor insurance for paid work
Why it fails: personal-use policies may exclude delivery or passenger transport. Fix: secure written commercial-use confirmation before the first paid trip.
Relying on contractor wording
Why it fails: control and direction in practice can support an employment presumption. Fix: document the status assessment and insure the legal employer where required.
Buying public liability for professional errors
Why it fails: a bodily-injury policy may not answer a financial-loss claim caused by bad advice or defective work. Fix: add professional indemnity when the service warrants it or national law requires it.
Ignoring customer property and subcontractors
Why it fails: care, custody and control exclusions or unnamed subcontractors can leave a gap. Fix: test a lost parcel, damaged premises and subcontractor error against the wording before purchase.

Why it fails: host-country rules, jurisdiction and certificate requirements may differ. Fix: complete the cross-border checklist for every new country and recurring route.
Practical answers to common platform questions
What insurance does a gig-economy platform need in Europe?
At minimum, determine country-specific motor, employer or occupational-accident and profession-specific requirements, then assess public and professional liability. The exact programme depends on activity, vehicles, worker status, turnover and claims history.
Do delivery drivers need commercial motor insurance?
They need the compulsory motor cover required in the country, and the policy must permit paid delivery. Personal-use permission should never be assumed; obtain written confirmation.
Who pays insurance for self-employed couriers?
National law and the contract determine payment. A genuinely self-employed courier may need to arrange personal motor and optional protection personally, while a platform can require evidence or purchase group cover. Do not describe voluntary benefits as legally universal.
Is public liability mandatory for every freelancer?
No EU-wide rule makes it mandatory for every freelancer. A Member State may require professional-liability insurance for specified professions, and customers or contracts may require public liability even when statute does not.
Does the EU platform-work law make platforms insure workers?
The directive creates status-determination procedures and a rebuttable employment presumption where control and direction are indicated. It does not prescribe one EU-wide insurance policy; national employment and insurance duties still determine the required cover.
What cover is needed to drive for a ride-hailing or delivery app?
Confirm statutory motor liability, explicit paid-use permission, driver and vehicle eligibility, territorial scope and any platform or operator liability. Add personal-accident or income protection if employee-style benefits do not apply.
