Choose a cross-border technology consultancy through a documented, country-by-country procurement process—not by technical expertise or price alone. Shortlist firms with relevant work in every target jurisdiction, named senior staff, verifiable security and privacy controls, transparent ownership and subcontractors, resilient delivery capacity, and a credible exit plan. Before signing, map every data flow and third-country access path, test legal and regulatory fit, and contract for measurable outcomes, service levels, audit rights, incident duties, data return, and knowledge transfer.
Why an international technology consultancy needs a different selection process
A domestic project can often be evaluated mainly on capability, references, price, and availability. A cross-border project adds a second layer of risk: the firm may access systems from several countries, use subcontractors in additional jurisdictions, move personal or confidential information across borders, and rely on laws that give foreign authorities access to data or infrastructure.
That makes supplier selection a governance decision as well as a skills decision. You are evaluating the consultancy, its owners, delivery locations, affiliates, subcontractors, tooling, continuity arrangements, and ability to comply with the laws that apply to each country and industry. A technically excellent provider can still be unsuitable if it cannot lawfully process your data, disclose where staff work, maintain service during a regional disruption, or return your systems in a usable form.

1. Define the cross-border requirements before contacting firms
Write a short requirements brief that is specific enough for every bidder to price and design against the same facts. Ambiguity at this stage becomes change requests, disputes, and unplanned data movement later.
Document the business outcome
State the result the project must produce, how it will be measured, and what is explicitly out of scope. Examples include deploying a regional customer platform, integrating two country systems, migrating a regulated workload, or establishing a follow-the-sun support operation. Describe the current state, target architecture, major dependencies, and the decisions that are still open.
List countries, entities, and regulated data
Identify every country in which your organization, users, infrastructure, consultants, support staff, or subcontractors will operate. Classify information such as personal data, financial records, health information, government data, trade secrets, source code, credentials, and telemetry. For each class, note the owning entity, permitted processors, retention period, localization rule, and any sector-specific restriction.
Clarify the provider’s legal role
Decide whether the firm will be your processor, subprocessor, operator, adviser, systems integrator, or a combination. The role determines which instructions, contracts, security controls, audit rights, and assistance duties are required. It also affects who may sign the agreement and which entity is responsible when work is performed by an affiliate.
Set commercial and delivery constraints
- Target dates, mandatory milestones, and acceptable schedule tolerance.
- Budget ceiling and preferred pricing basis.
- Required local presence, language capability, and working-hour overlap.
- Systems, vendors, standards, and interfaces the firm must support.
- Internal staff availability for decisions, testing, security review, and handover.
- Required certifications, background checks, clearance, or residency restrictions.
Country and sector requirements can change where data may be stored, who may access it, and which entity may contract. Treat those as design inputs, not legal details to resolve after award.
2. Build a longlist and demand evidence
Start with enough candidates to test the market, then reduce the list only when evidence—not a polished presentation—supports it. Give every firm the same requirements brief and request the same information in a structured response.
Evidence to request from every candidate
- Comparable projects in the same countries, industry, technology, and risk category, with client references where disclosure is permitted.
- Names, roles, locations, allocation percentages, and availability of the proposed delivery leaders and key specialists.
- Legal entities that will contract, employ staff, process data, and provide support; include ownership and control information.
- Delivery centers, language capability, time-zone coverage, holiday calendars, and backup staffing.
- Independent audit reports, certifications, control descriptions, penetration-testing summaries, and security-policy excerpts.
- Security and privacy incident history, material regulatory findings, and the process for notifying customers.
- Complete subcontractor and affiliate list, the services each performs, and the countries in which they operate.
- Financial and operational continuity information, including recovery arrangements and dependency on key individuals or suppliers.
- Sample statements of work, service-level schedules, change-control terms, and termination-assistance language.
EU guidance on due diligence specifically points to reputation, expertise, resources, information-security standards, organization, risk management, internal controls, subcontractors, third-country processing, audit consent, and continuity measures. Ask for documents that demonstrate each point and record when a firm provides only an assertion.

NIST describes due diligence as “the investigative process of researching all available, pertinent information about a given supplier or product so that informed decisions can be made.” Use that principle to verify claims through references, audit evidence, interviews, and contract commitments.
3. Map data, systems, and jurisdiction exposure
Do not approve a provider until you can draw the complete path of your information. The map should cover normal operations, support, backup, disaster recovery, testing, monitoring, and deletion—not only the production database.
What the data-flow map should show
- Where information is collected and which legal entity owns it.
- Which applications, networks, repositories, and staff can access it.
- Where processing, storage, caching, logging, backup, and recovery occur.
- Every consultant affiliate and subcontractor that can view, copy, administer, or transmit it.
- Remote-access paths, management tools, service desks, and privileged-identity systems.
- Retention, archival, return, and deletion locations, including offline or immutable backups.
Ask each finalist to validate the map and identify any location not shown in your draft. Require advance notice and approval for changes to processing countries or subcontractors.
Check the legal issues country by country
For every transfer or remote access path, determine whether privacy law, data-localization rules, export controls, sanctions, customs requirements, tax rules, trade-secret protections, sector regulation, or foreign-state access laws apply. UNCITRAL identifies these issues as material to cross-border cloud and technology contracts. A consultant’s nationality, employer, hosting location, and support route can each create a separate exposure.
Where personal information is involved, the controller’s contract with the processor should specify documented instructions, technical and organizational safeguards, onward transfers, and assistance with individual rights. Confirm which transfer mechanism is available for the countries involved and who is responsible for maintaining it when law or guidance changes.
Questions that expose hidden access
- Can support staff in a third country access production data, logs, or credentials?
- Can the provider’s parent company or another affiliate compel access?
- Are backups replicated to a different country or cloud region?
- Do monitoring, ticketing, collaboration, or artificial-intelligence tools transmit project data outside the approved locations?
- Can subcontractors appoint their own subprocessors?
- What happens if a country becomes subject to sanctions, a localization requirement, or a new foreign-access rule?
4. Run a scored proof-of-capability stage
After the evidence review, invite a small number of finalists to respond to the same written scenario. A consistent exercise reveals how a firm thinks, communicates, and manages uncertainty far better than a generic capabilities deck.
Give every finalist the same scenario
Provide an anonymized architecture, data classification, country list, regulatory constraints, target dates, and one or two known risks. Request an architecture proposal, delivery plan, staffing model, security design, risk register, communications cadence, incident response, and transition approach. Limit presentation time and require written assumptions so that answers remain comparable.

Use a weighted scorecard
| Evaluation axis | Evidence to request | Decision question |
|---|---|---|
| Relevant international experience | References, case details, named staff in target countries | Has this team handled the same jurisdictions and coordination complexity? |
| Technical quality | Architecture, estimates, test strategy, dependency plan | Is the proposed design feasible and maintainable? |
| Security and privacy | Independent audits, certifications, control descriptions, incident process | Can the firm protect systems and personal information under the required rules? |
| Data and jurisdiction | Validated data-flow diagram, processing countries, transfer mechanism, subcontractor list | Are localization, foreign-access, and onward-transfer risks understood? |
| Delivery resilience | Continuity plan, recovery objectives, staffing depth, supply-chain tiers | Can delivery continue if a person, site, supplier, or country is unavailable? |
| Governance | RACI, reporting cadence, escalation and dependency process | Will decisions and accountability remain clear across time zones? |
| Commercial model | Price basis, assumptions, milestones, change-control method | Can total cost and scope risk be compared fairly? |
| Exit readiness | Data return and deletion, documentation, transition assistance | Can you operate without the firm if the relationship ends? |
Set minimum pass marks for non-negotiable areas such as lawful data handling, security evidence, and named staffing. Do not allow an exceptionally low price to compensate for a failed control or an unproven delivery location.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute5. Compare local, nearshore, and offshore models on facts
Labels such as local, nearshore, and offshore describe distance, not quality. A local firm may subcontract overseas; an offshore firm may provide excellent governance and local regulatory specialists. Compare the actual delivery footprint and control environment.
| Model | Potential advantages | Questions and trade-offs |
|---|---|---|
| Local | Same-country legal familiarity, easier face-to-face work, simpler time-zone coordination | Does the firm actually perform the work locally? Are specialist capacity and resilience adequate? Is the price premium justified? |
| Nearshore | Closer time zones, shorter travel, often useful language and cultural overlap | Which staff and subcontractors are outside the stated region? Do their countries satisfy data and sector rules? |
| Offshore | Larger talent pools, extended-hours coverage, potential capacity for repetitive or specialized work | How are language, handoffs, foreign-access, sanctions, localization, and incident response controlled? What is the backup if a location is disrupted? |
Make the comparison using named sites, staff locations, working-hour overlap, escalation routes, data access, and continuity evidence. Never infer risk or capability from geography alone.
6. Contract for measurable outcomes and control
Put the commercial agreement, statement of work, security schedule, privacy terms, and subcontractor schedule together. A strong master agreement cannot rescue an incomplete statement of work, and a detailed statement of work cannot override an unsuitable data-transfer arrangement.
Define scope and acceptance
- Deliverables, milestones, dependencies, assumptions, and customer responsibilities.
- Functional, performance, security, accessibility, and compliance acceptance tests.
- Who supplies environments, licenses, test data, approvals, and production access.
- What constitutes a defect, how it is corrected, and when acceptance is deemed to occur.
Set service levels and remedies
Specify availability, response and resolution targets by severity, support hours, maintenance notices, recovery objectives, reporting, service credits or other remedies, and the measurement method. State whether targets apply separately to each country, service, and subcontractor.
Allocate security and privacy duties
Identify the controls each party must operate for identity, least privilege, encryption, vulnerability management, secure development, logging, backups, personnel screening, physical security, and key management. Require prompt incident notification with minimum content, cooperation with investigation and regulator duties, evidence preservation, and post-incident corrective actions.
Control subcontractors and affiliates
List approved entities and countries in an annex. Require notice and approval—or a defined objection process—for additions, substitutions, ownership changes, and changes to processing locations. Flow down equivalent security, confidentiality, privacy, audit, incident, and deletion obligations. Canada’s privacy regulator advises organizations to “Confirm with the provider whether any personal information will be handled by a subcontractor.” Treat that confirmation as a written contractual requirement, not a sales answer.

Preserve audit and access rights
Define how you can review relevant policies, certifications, independent reports, penetration-test summaries, and remediation evidence. Include targeted audits after a material incident or control failure, reasonable notice rules, confidentiality protections, cost allocation, and access to records needed for regulators or customers.
Address data ownership, location, and deletion
State that your organization owns its data, configurations, documentation, and custom work product, subject to clearly identified pre-existing materials. Specify approved locations, retention periods, export format, return deadlines, deletion standards, and evidence such as deletion certificates. Cover replicas, caches, logs, test data, and backups; define when backup copies may be overwritten and how access is blocked during that period.

7. Govern delivery across borders
Good contracting fails without active governance. Name an executive sponsor, product owner, security or privacy lead, service manager, and country-level contacts on both sides. Give each role decision authority and a documented backup.
Use a cadence that matches risk
- Weekly delivery meeting for milestones, blockers, decisions, and upcoming changes.
- Monthly service and risk review covering service levels, incidents, vulnerabilities, staffing, subcontractors, and spend.
- Quarterly executive review for outcomes, regulatory changes, resilience tests, and strategic risks.
- Immediate escalation for security incidents, missed critical milestones, unauthorized access, or changes to processing locations.
Maintain a decision log, dependency register, risk register, action owners, and version-controlled architecture. Record time-zone and holiday impacts in the delivery plan. Use written handoffs for overnight work and require the receiving team to acknowledge critical changes.
Federal acquisition guidance highlights schedule, cost, feasibility, dependencies, simultaneous high-risk projects, funding, and program-management risk in IT procurements. Apply the same discipline here: verify that your internal reviewers, environments, funding, and decisions are available when the supplier’s plan assumes they will be.

8. Test resilience before you need it
Ask the finalist to demonstrate continuity rather than merely provide a policy. Review staffing depth, alternate locations, communications, recovery objectives, supplier dependencies, and the last exercise date. Determine which functions can continue if a delivery center, network route, identity system, or key specialist is unavailable.

Run practical scenarios
- A country where support staff are located becomes unavailable for two weeks.
- A subcontractor suffers a security incident and cannot provide evidence immediately.
- A regulator restricts transfer of a particular data class.
- A critical consultant leaves during testing or cutover.
- A ransomware event affects the provider’s ticketing or build environment.
Require a written response with decision owners, customer actions, communication deadlines, workarounds, recovery targets, and assumptions. Include the most important scenarios in the contract and exercise them during delivery.
9. Keep an exit path from the first day
Exit planning is not an admission that the project will fail. It is protection against provider distress, geopolitical change, unacceptable performance, acquisition, a regulatory order, or a strategic decision to bring work in-house.
Specify what must be transferable
- Source code, infrastructure-as-code, configuration, architecture, runbooks, test cases, inventories, and credentials.
- Data exports in a documented, machine-readable format with schema and validation instructions.
- Issue history, decision records, dependency maps, monitoring rules, and security evidence.
- Current subcontractor and license information, including renewal dates and restrictions.
- Training and shadowing for replacement staff.
Set a transition period, response times, rates, and obligations for both ordinary and emergency termination. Test a sample export and restoration before go-live. Confirm that the buyer can recover data and continue essential operations if the consultant, a subcontractor, or an entire country becomes unavailable.

There is no authoritative cross-market benchmark for consulting-firm price, project duration, or success rate. Those figures vary with scope, jurisdictions, sector regulation, delivery model, contract structure, and the amount of customer work included. A low headline rate may exclude security reviews, travel, local counsel, testing, transition, or support.
Make commercial proposals comparable
Ask each firm to separate one-time implementation, recurring support, travel, third-party licenses, taxes, mandatory local entities, security testing, and transition assistance. Require assumptions for staffing, working hours, data volumes, environments, integrations, and customer dependencies.
| Pricing approach | Useful when | Main control needed |
|---|---|---|
| Fixed price by milestone | Scope and acceptance tests are stable | Detailed assumptions, change-control rules, and milestone acceptance |
| Time and materials | Discovery or evolving work makes scope uncertain | Rate card by role and country, spending cap, approval thresholds, timesheet evidence |
| Outcome or service-based | Performance can be measured objectively | Reliable metrics, service-level remedies, data access, and attribution rules |
| Blended model | Discovery, build, and support have different certainty | Separate statements of work and a clear transition between pricing phases |
Compare total expected cost and risk, not the lowest hourly rate. Include the cost of your own staff, legal and privacy review, travel, duplicated controls, delays caused by time zones, and eventual exit.
11. Red flags that should stop or reset the procurement
- The firm will not identify the legal entity, owners, delivery countries, or subcontractors.
- Proposed senior staff appear only in sales meetings and are unavailable for the proof-of-capability exercise.
- Security certifications are presented without scope, issuing body, dates, or independent reports.
- The provider cannot draw a complete data-flow map or says support access is “global” without detail.
- It refuses reasonable incident, audit, deletion, or termination-assistance terms.
- References are generic, unverifiable, or unrelated to the target countries and data sensitivity.
- The plan depends on one individual, one site, one network route, or an unnamed subcontractor.
- Pricing omits assumptions, taxes, travel, third-party tools, testing, or transition work.
- The firm promises compliance as a conclusion instead of identifying the applicable law, transfer mechanism, and assigned responsibilities.
A red flag does not always require automatic rejection, but it does require a documented explanation, compensating control, and approval at the appropriate risk level. If the provider cannot supply evidence before award, do not assume it will become more transparent after signing.

12. A practical award decision
- Score written responses and proof-of-capability work independently before discussing price.
- Remove candidates that fail a mandatory legal, security, staffing, or data-location requirement.
- Interview proposed delivery leaders and verify that they understand the country-specific risks.
- Call references with questions about incidents, subcontractors, turnover, missed milestones, and handover—not just satisfaction.
- Reconcile the preferred bid’s architecture, staffing, data map, assumptions, and contract schedules so they describe the same service.
- Negotiate unresolved risks with owners, deadlines, and evidence requirements; record any accepted residual risk.
- Obtain security, privacy, procurement, finance, and legal approvals before issuing a notice to proceed.
- Make early payment conditional on required onboarding evidence, access controls, named staff, and approved subcontractors.
The best choice is the firm that can prove it will deliver the required outcome lawfully, securely, and continuously in every relevant country—and can help you leave without losing control of your data or systems. Technical fit matters, but transparent jurisdictional exposure, accountable people, measurable obligations, and a tested exit path determine whether the partnership remains safe when conditions change.
