To check whether a U.S. industrial facility’s Title V air operating permit is current, identify the responsible permitting authority, find the latest final permit and amendments, check the renewal record, and ask the authority to confirm status if anything is unclear. An expiration date on an older permit is not conclusive: a timely, complete renewal application can extend a Title V permit beyond that date.
This guide covers Title V operating permits, not every kind of air authorization. You will need the facility’s name and location to check a specific site; a company name alone may point to multiple facilities.
First identify the permit and the facility
“Air permit” can mean a Title V operating permit, a preconstruction permit, or another approval. The steps below address Title V permits. Check other permit types separately, especially if the question concerns construction or a facility modification.
Gather the facility’s legal or commonly used name, physical address, county, state or territory, and any known permit number or EPA facility identifier. A single site may have multiple permitted units or authorizations. Match records by both name and location wherever possible.

Find the authority responsible for the permit
Most Title V permits are issued by state or local permitting authorities operating approved Clean Air Act Part 70 programs. A county or local air district may handle permits in place of, or alongside, a state agency. EPA issues Part 71 permits in specified settings, including Indian Country, the Outer Continental Shelf, some territories, and certain program gaps or unresolved objections. EPA’s Part 71 program page describes the program and regional responsibilities.
Start with the state environmental or air-quality agency, then check whether a local district is the permitting authority for that address. If the facility falls under Part 71, use the EPA regional contact responsible for that location.
Search the public permit records
Search the state or local agency’s records
Use the authority’s permit database, facility page, public docket, or permit search. Try the facility name, address, and permit number. Look for the final permit and subsequent actions, not only an application or draft.
Search EPA’s Permit Hub as a second source
EPA’s Permit Hub displays permit-action documents submitted through CAAPS. Depending on the action, records may include applications, draft permits, statements of basis, responses to comments, and final permits. The Hub is not a guaranteed complete inventory of every permit issued by every state, local, or tribal authority. An absent result does not establish that a facility has no permit.

Use the Title V petition deadline table only for action tracking
EPA’s Title V public petition deadline table can help track proposed Title V permits submitted for EPA review. It shows EPA’s review period and the subsequent public petition period; it is not a general status register proving that every final permit remains operative. The displayed table data was last updated September 17, 2026.
Determine which document is operative
Open the latest final, issued permit—not just a draft, application, or proposed action. Match the source name and address and record the permit number, issuing authority, issue or effective date, and stated expiration date. Then check the docket for later final actions such as a renewal, amendment, significant revision, transfer, revocation, or superseding permit.
A Title V permit is a legally enforceable document containing the operating terms and conditions applicable to the facility. The operative record may therefore consist of the original final permit together with effective amendments or later actions. If identifiers do not match, ask the authority to confirm whether the record applies to the facility in question.
Check whether renewal preserves authorization after the printed date
EPA describes the usual Title V permit term as five years and says the permit must state its expiration date. EPA also explains that a timely, complete renewal application can automatically extend the permit beyond that date. Its FAQ describes a timely application as one filed at least six months but no more than 18 months before expiration. These general rules do not establish whether a particular facility filed on time or whether its application was complete.

Find the renewal application and related agency records, then confirm with the permitting authority whether the application was received on time, deemed complete, and remains under review. EPA’s 2026 renewal guidance says authorities may allow applicants to reuse or incorporate by reference prior application material when permit terms and applicable requirements have not changed, with referenced material available for public review. The form of an application alone does not prove that the facility qualifies for continued authorization.

If public records do not establish the status, contact the state or local authority responsible for the permit. For a Part 71 matter, contact the appropriate EPA regional air permitting office. Provide the facility name, address, and permit number, and request:
- The latest effective final permit and all effective amendments.
- The permit’s stated expiration date.
- Whether a renewal application was received, filed timely, and deemed complete.
- Whether the facility currently has authorization to operate under that permit or a later action.
- Copies or docket references for relevant records that are not posted online.
For a disputed status, rely on the responsible authority’s current record rather than an old PDF or a status page alone.
Keep the finding narrow
State the conclusion as of a specific date and identify the facility and permit type. A current Title V operating permit does not establish that separate preconstruction or other environmental authorizations are current. Nor does permit currency by itself establish compliance with emissions limits, monitoring, recordkeeping, or reporting requirements. Title V generally consolidates applicable requirements and associated monitoring and reporting duties rather than creating new substantive controls.

A member of the public may petition EPA to object to a state, local, or tribal Title V permit under defined conditions. EPA says petition issues generally must have been raised during the permitting authority’s public comment period, subject to limited exceptions. The petition deadline table helps follow review and petition timing for an active action; it is not required to determine whether an already issued permit remains operative.
