There is no single SEC or CFTC registry for every crypto platform. The correct check depends on what the business does. Investment advice and securities activity point you to the SEC’s Investment Adviser Public Disclosure system (IAPD), Investor.gov, FINRA BrokerCheck, and your state securities regulator. Futures, options, forex, commodity pools, and other derivatives point you to the Commodity Futures Trading Commission (CFTC) and the National Futures Association’s BASIC database.
Before sending money, identify the platform’s legal entity, classify its products, search the appropriate official databases, and reconcile the records with the website’s domain, address, representatives, and disclosures. A registration record is a compliance signal—not an SEC endorsement, an investment recommendation, insurance, or a guarantee that the business is honest.
Start with the right database
Use the platform’s actual activity to choose the check. A brand name alone is not enough, because one company may operate several websites or use a different legal entity for regulated services.
| What the platform does | Primary verification route | What to inspect |
|---|---|---|
| Provides investment advice about securities or manages portfolios | SEC Investment Adviser Public Disclosure (IAPD) | Current registration or reporting status, Form ADV, business details, and disciplinary disclosures |
| Buys or sells securities for customers, or operates an interface that enables securities trading | Investor.gov, FINRA BrokerCheck, and the relevant state securities regulator | Broker-dealer registration, FINRA membership, representatives, jurisdictions, and disclosures |
| Offers futures, options, commodity pools, forex, or virtual-currency derivatives | NFA BASIC, which contains CFTC-related registration and background information | Registration category, status, disciplinary history, regulatory actions, and available financial information |
| Only allows customers to buy or sell virtual currency for immediate delivery (the spot market) | No CFTC registration is required solely for that spot activity | Other possible obligations, including SEC, state, money-transmission, or foreign-jurisdiction requirements |
These routes answer different legal questions. A result in one database does not substitute for the others.

Why a crypto platform may not appear in an SEC or CFTC search
SEC and CFTC oversight is organized around activities and entities, not a universal category called “crypto exchange.” A platform might be an investment adviser, a broker-dealer, a derivatives intermediary, a technology provider, or an unregulated spot marketplace. It may also rely on an exemption, file a notice rather than register directly, or use a legal name that is different from its trading name.
Federal registration also does not answer every state or foreign-jurisdiction question. A company can have a federal record while lacking permission to serve customers in a particular state, or it can be subject to state money-transmission rules that are outside the SEC and CFTC databases.
Step 1: Capture the platform’s exact identity
Do this before opening a database. Save the information as it appears on the platform and in its customer agreement.
- Legal company name: Copy the full corporate name, including endings such as Inc., LLC, Ltd., or Corp.
- Trading name and product name: Record the brand, app name, and any separate name used for brokerage, custody, or derivatives.
- Website and app domains: Write the exact domain, including country-code domains and subdomains. A regulator record for a similarly named website may belong to an impersonator.
- Address and phone number: Capture the headquarters, U.S. office, mailing address, and customer-service number shown in legal disclosures.
- People: Note directors, executives, investment professionals, brokers, and any named regulated representatives.
- Claims about regulation: Copy statements such as “SEC registered,” “CFTC regulated,” “FINRA member,” “licensed,” “notice filed,” or “exempt.” These terms are not interchangeable.
- Product and contract documents: Save the terms of service, fee schedule, risk disclosures, Form ADV link if provided, and the name of the entity that will hold or receive your money.
Search the legal entity and relevant individuals, not just the logo or brand. If the platform refuses to disclose its legal entity, treat that as a serious verification problem rather than a minor paperwork omission.
Step 2: Classify what the platform actually offers
Read the product pages and legal terms in practical terms. Ask what happens when you click Buy, Sell, Earn, Margin, Perpetual, Futures, or Options—not what the marketing page calls the service.

| Customer-facing feature | Questions to ask | Likely regulatory path |
|---|---|---|
| Portfolio recommendations, automated allocation, or ongoing management | Does the firm recommend or manage securities for a fee? Is advice personalized? | SEC or state investment-adviser analysis; search IAPD and state records |
| Order-routing or a trading screen for stocks, tokenized securities, or other securities | Who executes the order? Is the platform acting for customers or merely providing software? | Broker-dealer analysis; search Investor.gov and FINRA BrokerCheck, then the state regulator |
| Perpetual contracts, futures, options, leveraged crypto contracts, or forex | Is there a future settlement date, leverage, margin, liquidation, or cash-settled contract? | CFTC/NFA analysis; search NFA BASIC |
| Commodity pool or managed derivatives fund | Are customer funds pooled and traded in futures, options, or swaps? | CFTC/NFA registration and disclosure analysis |
| Immediate purchase or sale of virtual currency | Do you receive the asset now, without a futures or options contract? | Not a CFTC registration requirement solely because it is spot trading; check other laws and regulators |
The same website can offer both spot transactions and derivatives. Check each product separately instead of assigning one regulatory label to the entire brand.
Step 3: Check investment-adviser registration in IAPD
IAPD is the SEC’s public system for investment-adviser registration and reporting information. It includes firm and individual records, Form ADV filings, business details, and disciplinary disclosures.
- Open the current firm search. Search the exact legal company name. Try distinctive words from the name rather than relying on a broad search for “crypto.”
- Repeat the search for people. Search the named investment professionals, executives, and representatives. A person’s record may reveal a different firm name or prior disciplinary disclosure.
- Match the identity. Compare the IAPD address, phone number, website, and principal office with the platform’s legal pages. A similar name is not a match.
- Read the status and effective information. Determine whether the firm is currently registered, reporting, or shown with another status. Check effective dates and the jurisdictions listed.
- Open Form ADV. Review services, fees, assets, affiliates, custody arrangements, conflicts, disciplinary answers, and the individuals associated with the adviser.
- Review disclosures. Read disciplinary and regulatory sections rather than stopping at the headline registration result. Note the event date, outcome, and entity involved.
- Save evidence. Record the search date, legal name, status, filing date, and any document version. Registration status can change.
An IAPD result supports an adviser-registration claim only for the entity and activity described in the record. It does not prove that every product on the website is an advisory service, that customer assets are safe, or that the firm is authorized in every state.
If IAPD returns no result
- The firm may not be an investment adviser subject to that search, or it may use a different legal name.
- It may be state-registered, exempt, notice-filed, newly formed, or outside the scope of the adviser database.
- The website may be making an inaccurate claim or impersonating a real firm.
Ask the firm to explain the absence in writing and provide its exact legal entity, registration number, Form ADV or exemption basis, and jurisdictions. Verify the explanation with the relevant regulator before depositing money.
Step 4: Check broker-dealer claims
If a platform buys or sells securities for customers, or operates an interface that enables securities trading, investigate broker-dealer status. The SEC states that brokers generally must register with the SEC and become members of FINRA.

- Search Investor.gov. Use the broker or firm search and enter the legal name and any individual representative’s name.
- Check FINRA BrokerCheck. Confirm the firm’s registration and FINRA membership, the states and jurisdictions where it is registered, and the records of associated people.
- Read the full report. Look for employment history, customer disputes, regulatory events, arbitrations, and disclosures. A clean headline does not eliminate the need to read the details.
- Confirm the state record. Contact the securities regulator in the state where you live or where the firm claims to operate. State registration, notice filing, or an exemption can affect whether the firm may serve you.
- Match the business details. Compare the regulator record’s address, phone number, website, and representatives with the platform. Do not rely on a FINRA logo or badge displayed on the website.
A securities-trading interface can raise broker-dealer questions even when the company describes itself as only a software provider. The legal analysis depends on what the platform does with customer orders and compensation, so read the disclosures and ask who is executing, clearing, and holding the assets.
Step 5: Check CFTC and NFA status in BASIC
For futures, options, commodity pools, forex, and other derivatives, use the National Futures Association’s BASIC system. It provides registration information, disciplinary and regulatory history, and available financial information for firms and individuals subject to the CFTC/NFA framework.
- Identify the derivative product. Look for futures, options, swaps, perpetual contracts, leverage, margin, liquidation, or a future settlement mechanism.
- Search the legal entity in BASIC. Try the exact company name, common abbreviations, and the names of associated principals or salespeople.
- Check the registration category. Confirm that the category fits the activity, such as a futures commission merchant, introducing broker, commodity pool operator, commodity trading adviser, or another listed status.
- Review current status and dates. Note whether registration is active, pending, withdrawn, or otherwise limited, and check the effective dates and listed locations.
- Read disciplinary and regulatory history. Review actions, settlements, restrictions, and outcomes. Open the underlying details rather than relying on a summary.
- Review financial information where available. This can show whether the entity has submitted required information, but it is not a guarantee that customer funds are protected.
“Before working with any person or firm to trade in commodity futures, commodity pools, options, forex, or other derivatives, verify that the entity is properly registered with the CFTC.” — Commodity Futures Trading Commission, Be Smart: Check Registration & Backgrounds Before You Trade.
If BASIC returns no result
No result can mean a name mismatch, an exemption, an activity outside the CFTC/NFA regime, or an unregistered operation. It is not proof of legitimacy. Ask for the entity’s legal name, NFA ID, registration category, and explanation, then confirm the answer independently.
Understand the spot-market caveat
The CFTC says that websites or companies allowing customers to purchase or trade virtual currencies on the cash or spot market are not required to register with the CFTC solely for that activity. Spot trading means an immediate purchase or sale rather than a futures, options, or similar derivative contract.

This limited point does not make a spot platform “CFTC approved.” It does not resolve SEC questions, state securities or money-transmission requirements, custody issues, anti-fraud obligations, or rules in another country. A platform that offers both spot and leveraged products may need a different analysis for each product.
Reconcile the record with the website
After finding a record, compare every identity detail before you trust it.
- Legal name: Does the database entity exactly match the contract and deposit instructions?
- Domain: Is the website or app domain listed in the regulator record, or is it a look-alike domain?
- Address and phone: Do the contact details match, including suite numbers and country?
- People: Are the executives and representatives the same people shown in the database?
- Products: Does the registered activity cover the product you intend to use?
- Money flow: Is the beneficiary of a wire, card payment, or crypto transfer the same legal entity?
- Documents: Do the terms, Form ADV, risk disclosures, and privacy notice identify the same company?
Fraudsters sometimes copy a real firm’s name, registration number, logo, or address. A genuine record can therefore be used to impersonate a different website. Never treat a badge, screenshot, or claimed registration number as conclusive without matching the entire identity.

| Term | What it generally indicates | What it does not establish |
|---|---|---|
| Registered | The entity is recorded with a regulator under a specified category and status. | That every product is covered, that the firm is solvent, or that the regulator endorses it. |
| Notice filed | The firm has made a filing required for a particular jurisdiction or exemption framework. | Full registration or permission to conduct every type of business. |
| Exempt | A legal exemption may remove or modify a registration requirement for a defined activity. | A blanket exemption from fraud, disclosure, state, or other obligations. |
| Licensed | A regulator or jurisdiction has issued a license for a defined activity. | SEC or CFTC registration, or authorization to serve customers everywhere. |
| Member | Membership in an organization such as FINRA or NFA may accompany a regulated status. | Approval of a particular token, strategy, website, or investment result. |
| Pending | An application or filing may be under review or not yet effective. | Current authorization to operate as though fully registered. |
Use the wording shown in the regulator’s record. Do not turn “notice filed,” “exempt,” or “licensed” into the broader claim “SEC registered” or “CFTC regulated.”

Registration is a threshold compliance signal. It can show that an entity has entered a regulatory framework, made required disclosures, and become subject to certain examinations or conduct rules. The associated records can also reveal disciplinary events and the people connected with the business.

Registration is not an endorsement. The SEC says it does not approve or endorse particular securities, issuers, products, services, credentials, firms, or individuals. The CFTC likewise warns that most scams involve unregistered entities, people, and products, while registration itself does not protect against fraud.
Continue checking custody arrangements, withdrawal rules, fees, conflicts, leverage, insurance language, cybersecurity practices, and the identity of the company receiving your money. Do not send funds merely because a search result exists.
Current context for crypto-asset securities interfaces
An SEC staff statement issued April 13, 2026, adds context for analyzing certain crypto-asset-securities user interfaces and broker-dealer questions. It does not create a universal “crypto exchange registration” category. Apply the same activity-based process: identify the legal entity, determine whether the interface handles securities transactions or advice, and verify the applicable registration or exemption.

- Pause deposits, withdrawals to a new address, and transfers to an unfamiliar beneficiary.
- Ask the platform for its exact legal entity, regulator, registration number, covered products, and explanation of any missing record.
- Verify the response using the regulator’s own database and the phone or email shown there—not contact details supplied only by the platform.
- Contact your state securities or financial regulator if the issue concerns residents of your state.
- Preserve advertisements, chats, wallet addresses, invoices, contracts, and transaction IDs.
- Report suspected impersonation, unregistered activity, or fraud to the appropriate regulator and law-enforcement channel. Do not pay a supposed recovery agent promising to unlock funds.
If the platform pressures you to act immediately, guarantees returns, demands payment in crypto to release a withdrawal, or refuses to identify the legal entity, stop the transaction until independent verification is complete.
