Drawing fan art yourself does not automatically make it safe to submit. A character, photograph, logo, screenshot, pose, composition, or other expressive source may be protected even when every mark in your final file was made by you. Before submitting, run three separate checks: copyright permission, originality or plagiarism, and the exact eligibility rules of the school, contest, gallery, portfolio, or platform.
The practical workflow is to inventory every source, verify rights, compare your finished piece against references, run reverse-image searches, preserve dated process evidence, and read the submission terms. If a source remains central and permission is unclear, revise, obtain permission, or do not submit. This is general educational information, not individualized legal advice.
What you are actually checking
“Copyright,” “plagiarism,” and “eligibility” describe different systems. A work can pass one and fail another, so treating them as synonyms creates false confidence.
| Question | What it concerns | Who decides | Typical consequence |
|---|---|---|---|
| Could this use infringe copyright? | Reproducing or adapting protected expression, including characters, photographs, illustrations, logos, screenshots, and distinctive visual designs. | The copyright owner, a court, or an agreement such as a license. | Permission request, takedown, dispute, or litigation risk. |
| Could this be plagiarism? | Presenting another artist’s expression, composition, reference image, or distinctive choices as your own, even when a legal infringement claim is uncertain. | The school, contest, gallery, publisher, or professional community reviewing the work. | Disqualification, loss of credit, reputational damage, or disciplinary action. |
| Is this eligible for this submission? | Whether the organizer permits fan art, derivative work, references, AI assistance, and later display or licensing. | The target program’s written rules and certification language. | Rejection, removal, or breach of the submission agreement. |
These systems overlap but are not interchangeable. A contest can reject fan art under a strict originality policy even when the artist might have a fair-use argument. Conversely, a work can be accepted by a program and still create a copyright dispute later.

Step 1: Build a complete source inventory
Start before the final upload. List every preexisting element that influenced the piece, not only the image you called a reference.
- Recognizable characters, creatures, costumes, props, insignia, logos, and symbols.
- Photographs, screenshots, film frames, game assets, illustrations, concept art, and other images.
- Specific poses, camera angles, crops, lighting patterns, color arrangements, textures, brush packs, fonts, stock images, 3D assets, or generated assets.
- Images found through social feeds, image boards, search results, tutorials, or another artist’s portfolio.
For each item, save the creator or rights holder, title or description, source URL, date accessed, license terms, and a lawful local reference copy. Note whether you created it, received written permission, bought a license, used public-domain material, or are considering a legal exception. If you cannot identify the source, mark it for replacement rather than assuming that “reference” means free to use.
Separate an idea from its expression
A broad idea, genre, theme, or fictional premise is different from a particular image’s expressive execution. The same idea of “a masked hero under a red moon” can be drawn independently. Copying one image’s unusual silhouette, exact pose, lighting, line arrangement, and character design is much closer to reproducing expression.

Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →Under Title 17, section 101, a “derivative work” is based on one or more preexisting works and may recast, transform, or adapt them. The copyright owner generally controls preparation of derivative works. Drawing by hand, painting over a printout, or using a tablet does not remove that relationship.
Step 2: Confirm permission, license, or a defensible exception
For every source, answer one of four questions:
- Did I create the source myself?
- Do I have written permission covering this use?
- Does a license clearly cover submission, public display, editing, and any later commercial use?
- Am I relying on a recognized legal exception, and have I assessed its limits?
Keep the actual license text, receipt, permission email, or terms page with your project records. A license for private study may not cover a public contest, portfolio publication, merchandise, or an organizer’s right to reproduce entries. If the license is silent on a use that matters, treat that use as unresolved.

Credit is not authorization
Attribution can satisfy a contest’s citation rule or a license condition, but it does not transfer the owner’s exclusive rights. Copyright owners generally control reproduction, distribution, public display, and preparation of derivative works. A caption saying “character by” or “reference from” may be courteous and required by a program, yet still leave permission unanswered.
Step 3: Evaluate fair use without a percentage rule
Fair use is a case-specific balancing analysis, not a pre-submission checkbox. The U.S. Copyright Office states that “whether a particular use qualifies as fair use depends on all the circumstances” and that no legal rule permits a fixed number of words, musical notes, or percentage of a work.
- Purpose and character. Is the use commercial, educational, nonprofit, critical, parodic, or commentary? Does the new work add a genuinely different purpose, message, meaning, or audience rather than serve as a substitute?
- Nature of the source. Is the source mainly factual, or highly creative and imaginative? Creative photographs, illustrations, characters, and paintings generally make this factor harder for the user.
- Amount and substantiality. How much was taken, and did you take the source’s “heart”—the most recognizable expressive portion? A small crop can still be qualitatively important.
- Market effect. Could your piece substitute for the source, compete with it, or interfere with an existing or likely licensing market? Selling prints, merchandise, or commercial commissions raises the stakes.
These factors can point in different directions, and no formula guarantees an outcome. A nonprofit submission is not automatically fair use, and a transformative purpose is not a blanket defense. When the use is commercially important or the consequences of error are serious, obtain advice from a qualified attorney in the relevant jurisdiction.
Step 4: Compare the finished art with every reference
Open the final file beside each source and inspect more than the subject or character name. Use a written comparison so you do not rely on a vague feeling that the work is “different enough.”
- Overall silhouette and proportions.
- Pose, gesture, camera angle, perspective, and crop.
- Facial expression, hand placement, and distinctive anatomy.
- Lighting direction, shadow shapes, highlights, and color relationships.
- Costume details, symbols, props, background arrangement, and unusual marks.
- The sequence and placement of major lines, shapes, and focal points.
Ask: “Could a reviewer identify one source as the blueprint for this finished composition?” If yes, replace the source, redesign the composition, or obtain permission.

Why a style or medium change may not solve the problem
Turning a photograph into a painting, applying a filter, changing software, cropping, resizing, or adding cosmetic edits does not automatically create an original work. Scholastic Art & Writing Awards states in its policy that changing another artist’s medium or visual style alone is not transformative for its award review.
For fan art, make a second inquiry: does the piece add an observable new perspective, interpretation, criticism, parody, or meaning, or is it mainly a polished rendering of a preexisting character? A recognizable character can remain the dominant expressive element even when the background and brushwork are new.
Step 5: Run reverse-image searches as a screening tool
Search the finished artwork and, where the service permits, distinctive crops and major elements. Use more than one image-search service when available. Save a screenshot or export of the search, the date, the image submitted, close matches, and your notes about each match.
- Export a clean copy of the final image without watermarks or platform overlays.
- Search the whole image.
- Crop and search unusual details such as a distinctive pose, background arrangement, or character design.
- Open likely matches manually and identify the earliest credible creator or source.
- Compare dates, licenses, and your process notes; then resolve or document each match.
Submission programs use reverse-image tools to flag copied artwork. Scholastic says entries may be scanned by a reverse-image search engine, and other official rules describe reverse-image checks as part of originality review.
What a search result can and cannot prove
No match does not prove originality. The source may be offline, unindexed, altered, private, or newly uploaded. A match does not automatically prove infringement or plagiarism either: it could be your own earlier upload, licensed or public-domain material, or an independently created similar image. Treat the search as evidence to investigate, not as a legal clearance certificate.

- Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft
Step 6: Preserve evidence of your creative process
Keep a dated process folder or sketchbook containing:
- Thumbnail sheets, gesture studies, anatomy studies, and rough compositions.
- Layered working files, version history, and time-lapse recordings where available.
- Source inventory, license receipts, permission emails, and citation notes.
- Short notes explaining why you changed the pose, lighting, costume, or composition.
- Exports showing major stages from block-in to final rendering.
Scholastic says artists may be asked for evidence of individual creative process when originality is questioned. Process records can support your claim of authorship and show independent decisions, but they do not cure unauthorized copying. A carefully documented tracing can still be an impermissible copy or an ineligible entry.
Step 7: Read the exact submission rules
Read the rules before finalizing the piece, not after uploading it. Search the document for “original,” “fan art,” “derivative,” “reference,” “transformative,” “AI-generated,” “citation,” “permission,” “release,” and “infringement.”
Confirm all of the following:
- Whether fan art or recognizable copyrighted characters are allowed.
- Whether references must be cited and whether permission records must be submitted.
- Whether the organizer requires an originality certification.
- Whether generative AI, enhancement tools, or editing assistance must be disclosed.
- Whether entry grants the organizer rights to reproduce, display, edit, or license the work.
- Whether the rules differ by age group, country, category, or exhibition format.
Rules can be stricter than general copyright law. Scholastic’s current policy says fan art is not considered original work for that award program and should not be entered. AP Art and Design permits referenced material in some contexts when it is properly cited and substantially transformed. NASA competition terms require the work to be the student’s sole and full creation and ask entrants to certify that it was not copied and does not infringe third-party rights. These are program policies, not universal statutory rules.

Step 8: Disclose AI use accurately
If the form asks about AI, answer the exact question rather than choosing the most favorable interpretation. Describe whether AI was used for research, brainstorming, cleanup, reference generation, compositing, or the final image. Keep prompts, source files, and editing history when the rules require evidence.

Competition terms may distinguish research or editing assistance from an AI-generated final image. Editing an AI output does not automatically make it eligible; the controlling questions are the program’s policy and whether you can truthfully describe the human creative decisions involved.
Choose a submission path based on risk
When a source remains recognizable, compare the available actions against the same decision axes.
| Option | When it fits | What to verify first | Main remaining concern |
|---|---|---|---|
| Submit as is | Your composition is independently conceived, sources are licensed or clearly permitted, and the program allows the subject. | Rules, citations, AI disclosure, and release language. | A reviewer may still find substantial copying or an undisclosed rights issue. |
| Revise | One source still acts as the blueprint but you can redesign the composition and expressive details. | New thumbnails, comparison notes, and a fresh reverse-image search. | Cosmetic edits may leave the source’s distinctive expression intact. |
| Seek permission | The source is essential and the owner can be identified. | Written scope covering submission, display, reproduction, edits, and commercial uses that matter. | Silence, informal comments, or credit are not a license. |
| Withdraw or replace | Rights are unclear, the program bans fan art, or the consequences of a dispute are unacceptable. | A replacement concept using your own references or clearly licensed materials. | You lose time invested in the original, but remove the unresolved submission risk. |
Use these questions to make the choice: Is the source still the recognizable blueprint? Does the work add a new purpose or meaning? How much of the source’s distinctive expression remains? Could the work be sold or licensed in a way that competes with the source? Does the organizer permit it? Can you show a coherent process and rights record? What is the consequence of a challenge—an assignment grade, disqualification, takedown, lost award, commercial dispute, or potential litigation?
Common assumptions that fail
- “I drew it myself, so it is automatically legal.” Hand execution does not eliminate derivative-work or source-image issues.
- “I changed the medium, so it is transformative.” A medium change alone may not satisfy an originality policy.
- “I gave credit, so I have permission.” Attribution and authorization answer different questions.
- “There is no reverse-image match, so I am cleared.” Search indexes are incomplete and cannot decide legal rights.
- “Fair use lets me use a small percentage.” The Copyright Office rejects a fixed-percentage rule.
- “The contest accepted similar work before.” A prior decision does not guarantee eligibility or legal safety for the current work.
A final pre-submission checklist
- Name every source and record its rights status.
- Separate copyright permission, plagiarism risk, and program eligibility.
- Remove or replace unlicensed references when practical.
- Compare the final image with each source for pose, composition, lighting, and distinctive expression.
- Run whole-image and distinctive-crop reverse searches; investigate matches manually.
- Keep dated drafts, source notes, permissions, licenses, and process evidence.
- Read the target rules, including AI disclosure and organizer release language.
- If the work is commercial or uncertain, pause and obtain qualified legal advice.
The safest submission is one whose sources, creative decisions, and eligibility can be explained clearly without relying on a credit line, a style change, a percentage claim, or a clean search result.
