To verify an Australian gas project, identify the exact project and proponent, search its Commonwealth EPBC Act record, retrieve the decision and every variation notice, then check separate state or territory approvals. Build a condition-by-condition matrix and compare the latest management plans, reports and audit findings. An approval record shows what was authorised; it does not, by itself, prove that the operator is complying today.

Start with an exact project identity

Gas projects often appear under different names in Commonwealth and state systems. A project may be described by its commercial name in one register, a petroleum tenement or pipeline name in another, and a facility name in a planning database. Before searching, create an identity record containing:

  • the public project name and any former names;
  • the proponent or approval holder, including corporate names used in approvals;
  • the state or territory, local government area and precise location;
  • the project type: liquefied natural gas (LNG), coal-seam gas, conventional gas, pipeline, processing plant, storage facility or gas-fired generation;
  • major components such as wells, gathering lines, water-treatment plants, export terminals, roads and offsets; and
  • the EPBC reference number, if the project has one.

Use the proponent and location to reconcile records when names differ. A matching name alone is not enough if the project has been expanded, split into stages or transferred to another approval holder.

Search the Commonwealth EPBC record

The EPBC Act pathway applies when an action may significantly affect a matter of national environmental significance. Search the EPBC Act Public Portal using the project name, proponent and EPBC number. Download the complete record rather than relying on the summary page.

Documents to download

  1. Referral. This describes the proposed action, location, components and the protected matters that triggered Commonwealth consideration.
  2. Assessment material. The assessment method and supporting documents explain the impacts considered and the evidence relied on.
  3. Decision on approval of action. This is the operative Commonwealth approval notice.
  4. Every variation notice. Variations may alter conditions, time limits, approved plans, components or the approval holder.
  5. Management-plan decisions and correspondence published with the record. These can approve or reject plans that conditions require before work starts or during operations.

Read the decision notice as a legal instrument

The Department of Climate Change, Energy, the Environment and Water (DCCEEW) states: “After the Environment minister approves your project, we publish a notice called a ‘decision on approval of action’ there. You must comply with everything in the notice.” The notice identifies the approved action, approval expiry, approver and conditions. Treat the approved-action description and maps as boundaries: an approval for one set of wells, pipelines or processing units does not automatically authorise later additions.

Conditions are legally binding. Breaching them can attract civil or criminal penalties. Administrative conditions may require commencement and completion notifications, compliance records, annual reports and independent audits. These obligations can be easy to miss because they do not describe a physical construction control, but failure to file a required notice or retain evidence can still be a breach.

Verify the EPBC number

Record the number exactly as displayed, including its year and slash format (for example, EPBC 2009/4974). Check that the number belongs to the same proponent, location and project components you are investigating. A similarly named gas field can have a separate referral, while a staged development can have several numbers.

Determine whether Commonwealth approval was required

Not every gas activity enters the same pathway. The trigger is a potential significant impact on a matter of national environmental significance, not simply the fact that the project produces or transports gas. The referral and assessment documents should identify the protected matters considered.

A Commonwealth approval does not replace state or territory approvals. The National Environmental Protection Agency explains: “Commonwealth and state regulations have distinct requirements, legal considerations, and levels of environmental protection.” A project can therefore have an EPBC approval and still lack a required development consent, environmental authority, water approval or pipeline licence.

Where a bilateral assessment agreement was used, a state or territory may conduct the environmental assessment for the Commonwealth. That arrangement changes who performs the assessment; it does not remove the need for both Commonwealth and state or territory approvals before the project proceeds.

Check state and territory instruments separately

Search the agency responsible for the project’s jurisdiction and list each instrument that applies to each component. Typical records include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • development consent or planning approval;
  • an environmental authority, pollution licence or operating licence;
  • petroleum, gas-field, well or production approvals;
  • pipeline construction and operating licences;
  • water extraction, discharge or allocation approvals;
  • vegetation-clearing or biodiversity permits;
  • land-access, rehabilitation and closure requirements; and
  • conditions imposed by a state or territory assessment decision.

Capture the instrument number, issuing agency, approval holder, issue date, expiry or review date and all attached conditions. State databases may use a tenement, lease, environmental-authority or planning number instead of the EPBC number. Match records by proponent, coordinates and project components.

Separate instruments can have different triggers. For example, a water approval may govern extraction volumes and discharge quality, while an environmental authority governs emissions, waste and rehabilitation. Do not assume that satisfying one instrument satisfies another.

Turn the conditions into a working matrix

A condition matrix is the most reliable way to test what the project must do and whether the evidence covers it. Enter every condition from the current Commonwealth decision and each applicable state or territory instrument. Preserve the exact wording in one column; paraphrases can hide qualifiers such as “before commencement,” “to the satisfaction of,” geographic limits or reporting deadlines.

Matrix field What to record Why it matters
Condition text and number Verbatim condition, subcondition and instrument Creates an auditable reference and prevents omitted clauses
Protected matter or impact Species, habitat, water resource, heritage value, emissions or other impact Shows what the condition is intended to protect
Geographic scope Coordinates, tenements, pipeline corridor, facility or offset site Prevents applying a control outside or inside the wrong area
Trigger Before construction, during clearing, operation, closure, a threshold event or a notification Identifies when the duty becomes active
Deadline and frequency One-time date, annual cycle, monitoring interval or event-based deadline Allows overdue actions to be identified
Required plan or control Management plan, monitoring program, procedure, limit or offset action Connects the condition to the document that implements it
Approval status of the plan Submitted, approved, varied, replaced or rejected, with decision date Only the approved version should govern the activity
Reporting recipient Commonwealth department, National EPA, state agency or another specified body Confirms where evidence must be sent
Verification method Proponent report, monitoring data, independent audit, inspection or certificate Defines what counts as evidence
Evidence location Report title, publication date, page, dataset or correspondence reference Makes the conclusion reproducible

Check management and offset plans before relying on them

Many approvals require an action management plan or offset management plan to be approved before a specified activity starts. Record the approval date and version. Then compare the plan’s maps, thresholds, monitoring methods, reporting schedule and contingency actions with the condition matrix.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not treat a draft, consultation copy or superseded plan as evidence of compliance. If a variation approved a replacement plan, use the replacement from its effective date and retain the earlier version to understand what changed.

Separate authorisation from performance

An approval answers “What may be done, and under what conditions?” It does not answer “Was it done correctly last month?” Keep the authorisation record and performance evidence in separate columns. This prevents a project from being labelled compliant merely because its approval is current.

Check offsets in the EPBC Offsets Register

Search the EPBC Offsets Register by EPBC number, project, approval holder or jurisdiction. Open the project’s Offset Conditions tab, then download the approval or variation decision notice for the complete wording. The register view is useful for locating an offset, but the decision notice controls the full condition set.

For each offset, record the protected matter, location, area or other measurable obligation, permanence requirement, implementation milestone, reporting duty and responsible holder. Compare the approved offset management plan with the project’s current maps and reports.

The register may withhold sensitive Indigenous or ecological locations and personal information. A missing public coordinate does not necessarily mean that an offset is absent; use the condition number and decision notice to establish what was approved and what information is restricted.

Check approval currency and project changes

Write the approval expiry date at the top of the matrix and maintain a chronology of all changes:

  • variations to conditions or approved plans;
  • transfers to a new approval holder;
  • extensions of time or revised expiry dates;
  • decisions approving, refusing or replacing management plans; and
  • changes to the project’s footprint, components, production profile or staging.

The National Environmental Protection Agency says an action cannot simply be changed after approval without considering a new referral. Compare the current physical project with the approved-action description, maps and limits. A new processing unit, wellfield, corridor, discharge point or expansion may require a new referral or a formal variation rather than an informal update to an existing plan.

Check dates carefully. A report published after an approval variation may assess the new conditions, while an earlier audit may cover only the former version. Note the effective date of each change and apply conditions to the period in which they were in force.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Test current compliance with published evidence

Search National EPA and DCCEEW audit-program pages by project name and EPBC number. Published audits usually report each condition as compliant, non-compliant or not applicable. Download the audit report and map every finding to your matrix.

Read an audit in context

An audit is time- and scope-specific evidence. Check:

  • the audit year and the period of records examined;
  • the conditions and project components included;
  • whether the auditor sampled sites, documents or both;
  • any limitations, exclusions or information gaps; and
  • events after the audit, including new reports, variations, enforcement action or plan approvals.

“Not applicable” is not the same as “compliant.” It means the auditor determined that the condition did not apply within the audited scope or period. A condition marked compliant in an older audit can require a fresh check after a project change or a new reporting cycle.

Published example: Australian Pacific LNG

The National Environmental Protection Agency’s 2026 audit-program page reports the 2025 audit result for EPBC 2009/4974: 73 conditions were compliant, three were non-compliant and 29 were not applicable. Those figures describe that audit’s year and scope; they are not a current, project-wide guarantee. Read the findings, corrective actions and any later records before drawing a present-day conclusion.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use more than an audit

Current status requires the latest approved plans, proponent compliance reports, regulator correspondence, audit findings and enforcement or variation records. Look for commencement and completion notifications, annual reports, monitoring results, incident notifications and evidence that corrective actions were closed. If a required report is not publicly available, record the gap rather than inferring either compliance or non-compliance.

Understand the key EPBC timing points

Timing What it means Qualification
10 business days A proponent is generally given this period to respond to a proposed decision and proposed conditions. Current EPBC approvals guidance; the actual period can depend on the process.
30–40 business days Final assessment decisions are commonly made within this period from the start of formal assessment. Current EPBC approvals guidance; timing varies by assessment method.
Approval expiry date The date in the decision notice by which the approved action must be commenced or completed, as specified. Read the exact notice and any extension or variation.
More than 100,000 tonnes of greenhouse-gas emissions in a financial year The Safeguard Mechanism applies to approved projects that generate over this amount. Threshold stated in current EPBC approvals guidance; confirm how it applies to the facility and reporting period.

Do not use the 30–40-business-day figure as a promise that every gas project will be approved within that time. It is a common decision timeframe after formal assessment begins, and assessment method, information requests and statutory steps can change the schedule.

Compare two gas projects on equal terms

If you are comparing projects, use the same evidence window and the same condition categories. A useful comparison table has these axes:

Comparison axis Questions to answer
Jurisdiction and pathway Which Commonwealth, state or territory instruments apply? Was a bilateral assessment used?
Protected matters and impact scope Which matters triggered assessment, and which project components can affect them?
Pre-clearance and construction controls What must happen before clearing, drilling, earthworks or commissioning?
Operating and closure controls What limits, monitoring, rehabilitation and closure duties apply?
Reporting and independent verification How often are reports required, and are independent audits mandated?
Offsets What is required, where is it located, and how permanent is the obligation?
Currency When does each approval expire, and how many variations, transfers or plan decisions have occurred?
Compliance record What published findings exist, including non-compliance, corrective actions and unresolved gaps?

Do not rank projects by the number of conditions alone. A shorter list can contain broad performance standards, while a longer list can contain detailed administrative requirements. Compare the protected matters, measurable limits, verification strength and consequences of non-compliance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Troubleshoot common search problems

The project name returns no result

  • Search the proponent’s legal name and known former names.
  • Search by location, pipeline, processing facility or tenement name.
  • Try the EPBC number from a planning document or annual report.
  • Check whether the project is a component of a larger approved action.

The EPBC record and state record do not match

Compare the proponent, coordinates, project components and dates. State systems may list a development consent or environmental authority, while the Commonwealth record lists an action description and EPBC number. Record both identifiers instead of forcing one number into the other system.

A condition appears to be missing

Open every variation notice and plan decision. A condition may have been amended, replaced, renumbered or moved into an approved management plan. Use the effective date to determine which wording applied when the activity occurred.

An audit says “not applicable”

Read the auditor’s scope and reason. Confirm whether the condition was inactive during the audit period, related to an unbuilt component or excluded from the sample. Then check later construction, operation or reporting records.

The public record does not show current compliance

State the evidence boundary precisely: the public record establishes the approval and published findings up to a stated date, but it does not establish performance after that date. Seek the latest regulator correspondence or formal information-access channel rather than treating silence as proof.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A repeatable verification procedure

  1. Define the action. Write the project name, proponent, location, gas type, components and suspected EPBC number.
  2. Collect Commonwealth records. Download the referral, assessment material, decision on approval of action and every variation or plan decision.
  3. Extract the legal boundaries. Record approved activities, maps, expiry, approval holder and each condition exactly.
  4. Collect state or territory instruments. Find planning, environmental, petroleum, pipeline, water and clearing approvals for the same components.
  5. Build the matrix. Add triggers, deadlines, plans, reporting recipients, verification methods and evidence locations.
  6. Verify offsets. Search the Offsets Register, open the Offset Conditions tab and read the underlying decision notice.
  7. Reconcile changes. Add transfers, extensions, variations and replacement plans in date order; test whether later project changes required a new referral.
  8. Assess performance. Map annual reports, monitoring records, regulator correspondence and audit findings to each condition.
  9. Report a qualified conclusion. Distinguish authorised, evidenced as compliant, non-compliant, not applicable and not publicly established.

How to state your conclusion responsibly

Use precise language tied to the evidence period. “The project has an EPBC approval” means a decision notice exists. “Condition 14 was reported compliant in the 2025 audit” describes a particular finding. Neither statement proves that every current condition is being met.

A defensible conclusion identifies the instruments reviewed, the latest variation and plan dates, the audit or reporting period, any non-compliance and any records that were unavailable. It also distinguishes Commonwealth requirements from state or territory requirements. That approach gives readers a verifiable answer without turning an approval search into an unsupported assurance about present environmental performance.
