You can train an AI model on acquired data only after establishing that the specific data use is permitted, compatible with people’s expectations and acceptably safe. Buying a dataset, licensing it, or acquiring the company that collected it does not by itself establish permission to use its customer or user records for AI. Assess both the dataset and the model it produces: trace the data’s origins and restrictions, evaluate likely effects on people, and test whether the trained model can reveal information about them.

What does it mean to assess privacy risks in acquired-data training?

It means evaluating two connected but distinct risk surfaces. The first is the data and the way it is collected, transferred, stored and used in training. The second is the trained model and the ways people may be able to extract or infer information from it. Approval of one surface does not settle the other: secure storage does not prove that training is permitted, and a dataset that can be used lawfully can still create model-disclosure risks.

Start by defining what was acquired and what the organization plans to do. A company acquisition, a data license, a third-party dataset purchase and access to an already-trained model are different fact patterns, not interchangeable grants of permission. Record whether the intended use is pretraining, fine-tuning, evaluation or deployment. These stages can have different purposes and risks. The UK Information Commissioner’s Office (ICO) distinguishes initial collection, core-model training and application development as potentially distinct purposes.

Ownership or access after a transaction is not, by itself, evidence that AI training is allowed. That is a practical inference from the ICO’s requirements to examine original collection and downstream reuse, not a universal ruling on every transaction. The relevant answer depends on the facts, applicable law, notices, permissions and contractual terms.

Can we train on data we bought or acquired with a company?

Not on the purchase alone. First establish the data’s chain of custody and the scope of the rights, notices and restrictions that apply to the particular training operation.

For a company acquisition

Do not assume that a company’s ability to hold or use its customer data for its existing services automatically extends to model development by the buyer. Identify who collected the information, what people were told, what purposes and legal bases applied, and whether the proposed use or controller has changed. Review the transaction documents and any privacy commitments or restrictions, but do not treat a transfer of ownership as a substitute for a privacy analysis.

For a dataset purchase or license

Ask the seller to identify the upstream collectors and provide evidence supporting the dataset’s provenance, collection notices, permissions and restrictions. A supplier’s generic statement that it has rights to sell data is not a substitute for an auditable account of how that data was collected and whether the intended AI use is covered. Check terms on training, onward transfer, retention, deletion and use of resulting models.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For an already-trained model

Ask what data and versions went into the model, what permissions applied, and whether the provider can explain its lineage and support relevant rights or remediation requests. Buying access to a model is not the same as acquiring an underlying dataset, but a model can still present privacy risks if it exposes or permits inferences about training examples.

How do I trace where the acquired data came from?

Create a lineage register that follows the data beyond the immediate seller. This makes it possible to connect a proposed use to the collection context, restrictions and model versions involved.

For each dataset, record:

  • Origin: supplier, upstream collectors, collection date and location where known, and the method of collection.
  • Contents: categories of information, approximate volume, whether the data is personal or sensitive, and what populations it concerns.
  • Permission evidence: the notices shown at collection, consent records where relevant, other asserted legal bases, and any documented purpose limitations.
  • Restrictions and transfers: contractual limits, onward-transfer terms, third-party access, and any conditions on training, use or disclosure.
  • Copies and lifecycle: where the information is held, how long it is retained, how copies are tracked, and how deletion or correction requests would be handled.
  • Model lineage: which dataset version was used in which training run, and which model versions or downstream applications consumed it.

Compare the register against supplier records, contracts, notices, consent documentation and internal processing records. The ICO’s AI guidance and audit toolkit emphasize supply-chain mapping, information audits and due diligence. If the seller cannot substantiate a material part of the chain, record the gap and hold the proposed use until the organization can resolve it or decide to exclude the data.

How do I check whether the proposed training use is permitted?

Compare the specific planned use with what people were told and the legal and contractual conditions that applied to collection and reuse. In UK and EU contexts, identify an appropriate lawful basis for each personal-data operation and any additional condition needed for special-category data.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Compare the purpose and expectations

Put the original collection purpose, the wording of the relevant notice and the proposed training purpose side by side. Consider whether people could reasonably expect this use, whether training changes the purpose, and whether further sharing or deployment introduces another use. Do not collapse collection, model development and deployment into one generic “AI” purpose.

Check the basis for each operation

If relying on consent, verify that the consent covers the intended use and the relevant data and has not been undermined by a change in purpose or processing chain. Consent is not categorically required for every AI use, but neither can it be assumed to cover a new one.

If relying on legitimate interests in the UK or EU, identify the real interest, explain why using personal data is necessary—including why a less intrusive source would not suffice—and balance that interest against people’s rights and reasonable expectations. A lawful basis that may have supported the original collection does not automatically answer whether a later training operation is lawful.

The ICO says each distinct personal-data operation needs an appropriate, documented lawful basis. In Opinion 28/2024, adopted 17 December 2024, the European Data Protection Board (EDPB) likewise describes legitimate interests as requiring an identified interest, necessity and balancing. The opinion is not a blanket ban on training with acquired data; its application depends on the circumstances.

Separate legal and contractual questions

Privacy-law permission does not necessarily settle contractual restrictions, and a contract with a supplier does not, by itself, establish that the people concerned were properly informed or that a privacy-law basis exists. Review both. For a transaction with material uncertainties—particularly involving sensitive information, changed purposes or cross-border transfers—have qualified privacy counsel assess the actual records and agreements rather than relying on a generic assurance.

What should an AI privacy-impact assessment cover?

Assess how people could be affected in practice, not just whether paperwork is present. Record the analysis before processing begins when a DPIA is applicable; the ICO’s AI governance toolkit says, “Complete a DPIA before starting the processing,” in the context of its described AI assessment and applicable UK requirements. A DPIA is not a blanket legal requirement for every AI project worldwide.

A useful assessment records:

  • People and data: who the data describes; its sensitivity, uniqueness and scale; whether it concerns children or other vulnerable groups; and whether combining it with other information could identify someone.
  • Purpose and reach: the intended training and application uses, foreseeable downstream uses, geographic reach, and who can access or query the model.
  • Potential harm: the likelihood and severity of identification, disclosure or inference; consequences if a private passage is returned; and how outputs might influence decisions about people.
  • Necessity and alternatives: whether personal data is needed for the stated purpose, whether less intrusive data or methods could work, and what information can be removed or minimized.
  • Mitigation and residual risk: safeguards, remaining risks after mitigation, the person accountable for them, consultation where applicable, and documented approval or escalation.

Make the decision specific to the dataset, purpose, model and access conditions. A low-risk internal evaluation setting is not automatically representative of a deployed service that can be queried by a broad audience.

Where can privacy exposure occur in the training pipeline?

Map each place the data moves, is copied, or can be accessed—not just the final training environment. A pipeline review should cover supplier transfers, ingestion, intermediate files, development environments, third-party access, retention and deletion.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use data minimization and access controls to reduce exposure: limit collection and copying to what is needed, restrict privileges, keep access logs, encrypt data where appropriate, and de-identify it before unnecessary sharing. Check that temporary files and derived copies follow the same retention and deletion rules as the original where applicable.

These measures reduce security exposure; they do not establish a right to train on the data. Keep the permission decision and the security assessment connected, but do not substitute one for the other.

Can a trained model still expose the original records?

It can. Training is not automatic anonymization, and removing direct identifiers from the dataset does not establish that a model cannot reveal personal information. Assess the model’s behavior and the way people can access it.

  • Membership inference: whether an attacker can infer that a person’s record was included in training.
  • Attribute inference: whether information about a person can be inferred from model behavior or in combination with other information.
  • Regurgitation or exfiltration: whether the model can return private training passages or examples, including after targeted prompting.
  • Inversion or reconstruction: whether information about training examples can be recovered or reconstructed from model outputs.

Consider whether the model is designed to contain examples, what an attacker can know or do, and whether access is internal, controlled through an API or broadly available. Public access can change the threat model by increasing the number and reach of possible queries. Record the model version, test scope, attacker assumptions, findings and remediation. Passing a selected set of tests is evidence about those tests—not proof that every possible attack is impossible.

Depending on the use case, mitigations may include filtering or minimizing source data, privacy-preserving training approaches, and measures limiting sensitive outputs. Decide whether each measure addresses the identified risk and whether it creates other limitations; do not present a mitigation as a substitute for establishing permission.

What changes between the UK, EU and United States?

The assessment must be tied to the jurisdiction and facts. The following points describe the supplied official materials, not a complete legal analysis of any unidentified transaction.

United Kingdom

The ICO’s guidance calls for an appropriate, documented lawful basis for each distinct personal-data operation and its audit toolkit calls for original-purpose and supply-chain checks and a DPIA before the assessed processing. The ICO warns that parts of its AI guidance are under review following the Data (Use and Access) Act, so consult the current guidance and legal position before relying on an older interpretation.

EDPB Opinion 28/2024 says the anonymity of an AI model is case-specific. Its analysis considers both direct extraction and whether personal data can be obtained through queries. The EDPB states: “The presence or absence of the elements listed below is not a conclusive criterion for assessing the anonymity of an AI model.” An unlawful development-stage use may affect later deployment, but that outcome requires case-specific analysis; the opinion does not make all acquired-data training impermissible.

Federal Trade Commission materials emphasize original privacy and confidentiality promises and warn against quietly changing policies retroactively to permit AI training. The FTC’s Office of Technology policy discussion says, “There is no AI exemption from the laws on the books.” In its finalized Everalbum matter, the FTC required deletion of certain user data and derived models and algorithms. State, sector-specific, biometric, children’s-data and transaction-specific rules may also apply; the available facts here do not establish which ones govern a particular deal.

How should we decide, document and monitor the use?

Use a documented gate for each dataset and model version. A practical internal workflow is to classify a proposal as approved with conditions, held pending evidence or remediation, or excluded. These are useful operational categories, not categories prescribed by a regulator.

  1. Define the use: identify the transaction, data, processing stages, model versions, deployment context and jurisdictions.
  2. Resolve lineage and permission: collect provenance and supporting records; identify the basis, purpose limits and restrictions relevant to each operation.
  3. Assess effects and exposure: complete the applicable impact assessment, map pipeline access, and test the model’s privacy risks for its intended access mode.
  4. Record conditions and ownership: document mitigations, unresolved risks, the accountable decision-maker, sign-off and any conditions that must be met before training or deployment.
  5. Reassess on change: reopen the decision after a new acquisition, source, vendor, retraining run, access change or new use. Track which model versions consumed the affected data.

If evidence indicates that data was unlawfully used, do not treat deleting the source files as an automatic resolution. Route the issue for specialist review of the relevant dataset, processing and derived models. Depending on the facts, remedies can extend to models as well as the underlying data.

What does a real-world example show—and not show?

In a 2026 action, the FTC alleged that an unrelated third party obtained access to nearly three million OkCupid user photos, together with other information, without formal or contractual use restrictions. The allegation illustrates why organizations should examine third-party access and permissions rather than assuming that a data source is controlled simply because it is available to a supplier or partner.

It is not evidence that those photos were used to train an AI model, nor that the arrangement involved a corporate acquisition. Do not use a case count or an individual enforcement action to infer an industry-wide training prevalence or risk rate; no general prevalence, breach-rate or risk-reduction percentage is established here.

Frequently Asked Questions

Does removing names from a dataset make it safe for AI training?

No. Removing direct identifiers may reduce one route to identification, but uniqueness, other available information and what the model reveals can still matter. The EDPB’s Opinion 28/2024 says no single checklist element conclusively establishes that an AI model is anonymous.

What if the acquired dataset was already public?

Public availability alone does not establish that the specific training use is permitted or consistent with the original collection context. Check the source, applicable notices, restrictions and jurisdiction rather than treating accessibility as a blanket grant.

What’s actually slowing this PC down?

Pick the symptom - the matching free tool is one click away.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a company fix the problem by deleting the original dataset after training?

Not necessarily. The ICO and FTC materials show that assessment and remedies can concern processing or derived models as well as source data, depending on the facts. Determine which model versions used the data and obtain specialist advice on appropriate remediation.

Does a privacy-impact assessment make an otherwise unlawful training use acceptable?

No. An impact assessment documents risks and decisions; it does not replace the need for an appropriate basis, compatible purpose and applicable permissions. Treat an unresolved permission issue as a decision gate, not as a risk that paperwork alone cures.
