Audit a mortgage AI system as a regulated lending process, not as a standalone piece of software. The review must cover the full decision lifecycle: data collection, features and proxies, model outputs, thresholds, human overrides, pricing and terms, automated valuation, adverse-action notices, vendors, complaints, and ongoing monitoring. Preserve versioned evidence and repeat the tests after remediation.
There is no artificial-intelligence or “black-box” exemption from the Equal Credit Opportunity Act (ECOA), Regulation B, the Fair Housing Act, or consumer-protection law. A technically accurate model can still create fair-lending risk through biased data, geographic proxies, selective labels, a cutoff rule, an override process, or an inaccurate explanation.
What a mortgage AI audit should cover
A useful audit starts by defining the decisions that can affect a consumer, then traces each decision from input to outcome and notice. “Underwriting model” is usually too narrow: a lender may use separate statistical or machine-learning systems for marketing, fraud screening, eligibility, pricing, collateral valuation, servicing, and loss mitigation.
| Lifecycle area | Questions to answer |
|---|---|
| Lead generation and application handling | Who is shown an offer, routed to a channel, asked for additional documents, or subjected to extra verification? |
| Credit decision | What inputs, scores, thresholds, counteroffer rules, and human overrides determine approval or denial? |
| Pricing and terms | How are rate, points, fees, loan-to-value limits, debt-to-income exceptions, and other terms assigned? |
| Fraud and identity checks | Do screening rules create different fallout, delay, or manual-review rates for protected groups? |
| Collateral and valuation | How does an automated valuation model (AVM) select comparable properties, handle outliers, and trigger an appraisal or escalation? |
| Servicing and loss mitigation | Who receives payment assistance, modification offers, forbearance, or collection treatment, and how are cases prioritized? |
For every component, record its owner, vendor, business purpose, geography, model and configuration version, deployment date, inputs, outputs, decision thresholds, downstream users, and every point at which an employee can override or replace the result.

Legal and supervisory baseline
ECOA and Regulation B prohibit discrimination in any aspect of a credit transaction and require a written statement of specific reasons when adverse action is taken. CFPB Circular 2022-03 states that the duty applies when a complex or proprietary algorithm makes the decision; a creditor cannot defend an unexplained denial by calling the model a black box.
On September 19, 2023, the Consumer Financial Protection Bureau (CFPB) said creditors must provide accurate, specific reasons and cannot substitute a generic checklist that does not describe the actual reason. The CFPB’s mortgage guidance identifies ECOA and the Fair Housing Act as protections covering approval, pricing, terms, and application handling. A joint CFPB, Department of Justice, Federal Trade Commission, and Equal Employment Opportunity Commission statement dated April 25, 2023, likewise says that marketing a system as “artificial intelligence” does not excuse a violation of civil-rights, consumer-protection, or equal-opportunity law.
Executive Order 14110 (2023) encouraged the Federal Housing Finance Agency and CFPB to develop methods for evaluating disparities in underwriting and bias in automated collateral valuation. The Federal Financial Institutions Examination Council (FFIEC) examination principles issued February 12, 2024, address identifying and mitigating discrimination or bias in residential property valuation. The CFPB’s AVM quality-control rule applies to mortgage originators and secondary-market issuers that use AVMs to determine collateral worth.
These authorities do not prescribe one universal fairness metric or a single numerical pass/fail ratio. The appropriate analysis depends on the product, population, data quality, legal requirements, and documented methodology. An audit should therefore show the measure used, why it fits the decision, sample sizes, uncertainty, and limitations.
Step 1: Build a decision and evidence inventory
Start with a signed inventory rather than a model diagram supplied by one engineering team. Interview underwriting, pricing, operations, compliance, model-risk, servicing, appraisal, and vendor-management staff. Trace a real application through each system and record where data are transformed or decisions are recomputed.
- List every decision. Include eligibility, counteroffers, loan amount, interest rate, fees, exceptions, appraisal routing, fraud holds, document requests, servicing actions, and loss-mitigation outcomes.
- Identify the system of record. Map application and underwriting platforms, pricing engines, AVMs, bureau and alternative-data feeds, workflow tools, and spreadsheets or scripts used after the model runs.
- Capture versions. Preserve model binaries or code, feature definitions, training-data snapshots, configuration files, threshold values, reason-code maps, prompts or rules, release dates, and rollback versions.
- Document people and handoffs. Record who can override a score, approve an exception, change a price, select a comparable, suppress a reason code, or reopen a denied application.
- Set the review period. Include enough time to reveal seasonal, geographic, economic, and policy shifts. Note acquisitions, vendor changes, product launches, and policy changes within the period.
- Define the unit of analysis. Decide whether the audit examines applicants, applications, decisions, loans, properties, servicing cases, or notices. Prevent duplicate applications or repeat submissions from distorting rates.
The inventory is itself an important control: an unlisted spreadsheet, manual exception queue, or vendor feature can create risk that a formal model-validation report never sees.
Step 2: Map protected groups and possible proxies
Document which characteristics are legally protected and which can be collected and used for testing under applicable law and policy. Mortgage fair-lending analysis commonly examines race, ethnicity, national origin, sex, marital status, familial status, age, disability, religion, and receipt of public-assistance income. State or local law may add categories or impose different restrictions on collection and use.

Separate testing data from decision data. A lender may collect a characteristic, where legally permitted, to measure outcomes without allowing it to influence eligibility or price. Establish access controls, retention rules, and a documented statistical-use purpose.
Proxy review
Inspect variables that can encode a protected characteristic even when the direct field is absent. Examples include census tract or other geography, language preference, names, address history, device and digital-behavior signals, employment patterns, educational history, and data purchased from a vendor. A proxy is not automatically unlawful, but it requires a documented business purpose, validation, performance and fairness testing, and a rationale for retaining it.
Test intersections rather than only broad groups. For example, compare outcomes for Black women, older applicants with disabilities, or Hispanic applicants in rural areas when sample sizes support a meaningful analysis. If a cell is too small, report that limitation and use an appropriate aggregation or qualitative review instead of presenting an unstable percentage as a finding.
Step 3: Validate data, labels, and provenance
Reconcile application, underwriting, pricing, appraisal, servicing, and HMDA records. A model can appear fair because the data omit the people most affected by a decision or because a label reflects an earlier biased process.

- Completeness and coding: quantify missing, unknown, and inconsistent values by group, channel, geography, and time period. Check that categorical codes mean the same thing in every system.
- Lineage: identify the original source, collection date, refresh frequency, transformations, licensing restrictions, and vendor quality controls for every material feature.
- Label validity: determine whether “default,” “fraud,” “approval,” or “successful repayment” labels are observed equally across groups. Selective approvals and reject inference can hide risk among applicants who were never funded.
- Leakage: find variables created after the decision or influenced by an earlier decision, such as a post-application document flag or a servicing outcome used as if it were available at underwriting.
- Coverage and shift: compare training and production distributions by geography, property type, channel, income, and time. Investigate new markets, disasters, interest-rate changes, and portfolio acquisitions.
- Exclusions: scrutinize geographic, income, criminal-history, language, or other exclusion rules. CFPB supervisory work specifically includes HMDA data integrity and reviews of these exclusions.
Keep a reproducible data dictionary and a sample-level audit file showing the values presented to the model, the transformed values actually scored, and the outcome eventually recorded.
Step 4: Test outcomes and model behavior
Measure both what happened to applicants and how the system produced the result. A single approval ratio is not a complete fair-lending test.
| Area | Metrics or review questions |
|---|---|
| Access and decisions | Application completion, withdrawal, approval, denial, counteroffer, and manual-review rates by group and intersection. |
| Terms and pricing | Rate, points, fees, loan amount, loan-to-value, debt-to-income exceptions, and other conditions after controlling for legitimate risk factors. |
| Process treatment | Document requests, processing time, escalation, fraud holds, appraisal referrals, and communication frequency. |
| Overrides | Override frequency, direction, authority, reason, outcome, and whether overrides help or hurt particular groups. |
| Model performance | Error rates, calibration, score distributions, threshold effects, false positives and negatives, and performance under distribution shift. |
| Collateral | Valuation error, outlier frequency, appraisal overrides, and escalation rates by neighborhood and relevant proxy groups. |
Use more than one fairness lens
Outcome disparity asks whether groups receive different results. Error-rate analysis asks whether mistakes are distributed differently. Calibration asks whether a score means the same observed risk across groups. Explainability testing asks whether the stated reasons match the factors that actually drove a decision. Qualitative case review can reveal a workflow or data problem that aggregate statistics miss.

Do not declare a universal violation or “safe” result from one ratio. Record denominators, confidence intervals or other uncertainty measures, missing-group rates, weighting choices, and the legitimate-risk adjustments used. Explain whether a result is exploratory, statistically reliable, practically material, or inconclusive. Review adverse outcomes individually, including matched or near-matched cases, to identify threshold and override effects.

Two applicants can both be approved yet receive materially different rates, points, fees, loan amounts, or exception treatment. Analyze pricing decisions separately from approval. Preserve the base price, adjustments, discretionary additions, policy version, and employee or broker changes. Test whether geography, channel, relationship status, language, or digital behavior functions as a proxy in discretionary adjustments.
Step 5: Test explanations and adverse-action notices
For every adverse decision, rerun the same model and capture the principal factors at the time the decision was made. Compare those factors with the notice sent to the applicant.
- Specificity: the reason must identify the actual principal factor, such as a particular debt-to-income condition or credit-history element, rather than “internal policy” or “score too low.”
- Accuracy: the reason must correspond to the applicant’s data and the model version that produced the decision.
- Reproducibility: an independent reviewer should be able to reproduce the reason from retained inputs, configuration, threshold, and reason-code logic.
- Completeness: include the required principal reasons without adding factors that did not affect the outcome or omitting a material scored factor.
- Consistency: verify that counteroffers, withdrawals treated as adverse action, manual overrides, and vendor-generated notices follow the same legal and operational rules.
Generic checklists are inadequate when they do not reflect the actual reason. If the system cannot generate accurate, specific reasons, the lender must change the model, add a validated explanation layer, or stop using the output for the affected decision until the obligation can be met. A proprietary vendor model does not transfer this responsibility away from the creditor.
Step 6: Audit an automated valuation model separately
An AVM is not merely another underwriting feature. Its output can affect approval, loan-to-value, pricing, appraisal requirements, and secondary-market eligibility, so test it as a distinct decision system.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteAVM data and design
- Document property, transaction, neighborhood, and market data sources, refresh dates, geographic coverage, and missingness.
- Examine how comparable properties are selected, weighted, and replaced when data are sparse.
- Test treatment of renovations, distressed sales, unusual properties, new construction, and outliers.
- Measure accuracy and error dispersion by neighborhood, property type, price band, and relevant protected-group proxies.
- Check whether coverage gaps systematically trigger a manual appraisal or a lower valuation for particular communities.
Controls and escalation
Record confidence or validity indicators, human overrides, appraisal referrals, approval authority, and reasons for changing an AVM result. Test whether employees override valuations more often in some neighborhoods and whether the override direction is consistent. Review vendor monitoring, incident notices, model changes, and the contractual right to obtain data, performance evidence, explanations, and test artifacts.
The CFPB AVM quality-control rule and FFIEC examination principles require controls addressing accuracy and discriminatory bias. Treat a vendor’s “independent” label as a claim to verify, not as evidence that the control exists.

Step 7: Review governance, vendors, and security
Assess the organization around the model as carefully as the model itself.
- Model risk: confirm independent validation, documented assumptions, limitations, performance monitoring, and approval before deployment.
- Change management: require impact analysis, testing, sign-off, and rollback for code, data feeds, prompts, thresholds, reason codes, and vendor releases.
- Access and integrity: restrict who can change features, thresholds, overrides, and notices; log access and retain immutable decision records.
- Complaints and incidents: route complaints about discrimination, valuation, explanations, or processing delay to a team that can connect them to model versions and affected populations.
- Reporting: provide meaningful metrics and unresolved risks to the responsible committee and board-level oversight where applicable.
- Contracts: obtain rights to inspect data provenance, validation, performance, adverse-action factors, security controls, change notices, and audit artifacts. Define response times and remedies when a vendor cannot supply them.
- Retention: preserve applications, scored inputs, outputs, thresholds, notices, overrides, reviewer identities, complaints, and remediation evidence for the applicable legal and policy period.
Step 8: Report findings and remediate them
Every finding should be actionable and reproducible. Use a consistent record containing:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- the affected product, decision, model and version;
- the protected population or intersection, sample size, period, and geography;
- the metric, comparison group, uncertainty, and known data limitations;
- the applicable legal, policy, or model-risk control;
- the suspected root cause, such as missing data, proxy use, threshold design, vendor drift, or override behavior;
- an accountable owner, severity, deadline, and interim control;
- the remediation, including data correction, feature removal, threshold change, workflow change, notice correction, or vendor escalation; and
- the retest design, acceptance criteria, evidence to retain, and decision on whether to continue, restrict, or suspend use.
Interim controls may include manual review, a temporary hold on discretionary pricing, additional appraisal review, a narrower deployment population, corrected notices, or enhanced complaint monitoring. Document who authorized the control and when it ends. After a fix, rerun the original test and check for new error, access, pricing, or explanation effects; do not assume that improving one group-level metric removes all risk.
Choosing an audit approach
| Approach | Strength | Limitation to manage |
|---|---|---|
| First-line self-assessment | Fast access to systems, staff, and production data. | Independence and challenge may be limited. |
| Second-line model-risk validation | Structured technical testing and documented challenge. | May not cover application handling, pricing discretion, complaints, or servicing. |
| Independent third-party audit | Greater independence and specialized fair-lending expertise. | Requires secure data access, clear scope, and contractual rights; an outsider cannot test what records are missing. |
| Underwriting-only review | Focused and less costly for a narrow decision. | Can miss pricing, valuation, fraud, servicing, and human-override disparities. |
| Full-lifecycle review | Finds risk across lead generation, credit, terms, collateral, and servicing. | Needs broader evidence, coordination, and sustained monitoring. |
| Pre-deployment review | Can prevent release of a flawed model. | Cannot detect production drift, complaints, or real-world override patterns alone. |
| Continuous monitoring | Detects shifts in data, outcomes, notices, and complaints. | Requires versioned data, alert ownership, thresholds, and a response process. |
The strongest program combines independent challenge with production monitoring and a repeatable remediation process. Select the depth according to decision impact, population size, vendor access, and change risk, and document why the selected scope is sufficient.
Evidence package and repeat-monitoring checklist
Before closing an audit, verify that another qualified reviewer could reconstruct a decision without relying on an employee’s memory.
- Decision inventory with owners, vendors, versions, dates, inputs, outputs, and override points.
- Protected-group definitions, proxy assessment, data-use authority, and access controls.
- Data dictionary, lineage, missingness analysis, label and reject-inference assessment, and shift analysis.
- Outcome, pricing, process, error-rate, calibration, explainability, and intersectional analyses with denominators and uncertainty.
- Sample adverse-action notices matched to the exact scored records and reason-code outputs.
- AVM accuracy, coverage, comparable-selection, override, escalation, and vendor-monitoring evidence.
- Validation reports, approvals, change tickets, access logs, complaints, incidents, and committee reporting.
- Finding register with owners, deadlines, interim controls, retest results, and closure evidence.
Set monitoring triggers for material changes in group composition, approval or denial rates, pricing, processing time, overrides, valuation errors, complaints, missingness, and vendor performance. An alert should identify an owner, a response time, and the decision authority for restricting or suspending the system.
Common audit failures and how to correct them

Correction: Follow the application through the full lifecycle and analyze each consequential handoff.
Using a generic adverse-action menu
Problem: A notice selects a convenient reason that is not the factor that actually drove the decision.
Correction: Generate and validate reasons from the scored record and preserve the model and reason-code version.
Assuming unavailable protected data means no bias
Problem: The lender declines to test outcomes because a model does not receive race, sex, or another characteristic directly.
Correction: Use legally permissible testing data, carefully governed proxies, geography, complaint information, and qualitative review; document uncertainty when data are incomplete.
Accepting a vendor’s certification without evidence
Problem: A contract provides only a performance summary and prohibits meaningful testing.
Correction: Require data provenance, reason outputs, validation artifacts, change notices, audit rights, and remediation obligations before deployment or renewal.

What a defensible conclusion looks like
A defensible conclusion states exactly what was tested, for which period and population, under which model and policy versions, and what the evidence can and cannot establish. It identifies material disparities or control gaps, assigns owners and deadlines, applies interim safeguards where necessary, and schedules a repeat test after remediation and after material model, data, threshold, vendor, or workflow changes.
