An AI vendor is safe enough to use only when it can demonstrate, for your specific deployment, that foreseeable harms are controlled, legal duties are mapped, and someone remains accountable when the model fails. A polished trust page, questionnaire, framework logo, or certificate is supporting evidence—not proof of compliance.

Assess the actual product and use case: what the system does, whose data it handles, who can be affected, where it operates, how autonomous it is, and what happens when it is wrong. Then verify documented controls, test the system yourself, assign duties in the contract, and monitor it throughout its life.

Start with the use case, not the vendor’s marketing

The same model can present very different risks depending on its job. A writing assistant used for internal brainstorming is not equivalent to a system that ranks job applicants, recommends medical treatment, approves credit, or controls industrial equipment. Your assessment should therefore describe the proposed deployment before you judge the supplier.

Record the system boundary

  • Product and version: name the application, underlying model, model version, plug-ins, retrieval sources, APIs, and configuration or tenant settings.
  • Architecture: document where prompts, outputs, logs, embeddings, fine-tuning data, and backups are processed and stored; include cloud regions and connections to your systems.
  • Purpose and users: state the intended task, user groups, administrator privileges, and whether external people will see or be affected by outputs.
  • Data: identify personal data, confidential business information, health or financial information, children’s data, copyrighted material, and any data sent to subprocessors or used for training.
  • Geography and law: list the countries of the provider, your organization, users, and affected individuals. Regulatory duties can attach in more than one place.
  • Autonomy and decisions: specify whether the system only suggests, takes an action after approval, or acts automatically. Record every downstream decision involving access, eligibility, employment, safety, liberty, or other rights.
  • Failure impact: describe the maximum plausible harm, not merely the average error. Include physical injury, discrimination, privacy loss, fraud, security compromise, financial loss, and service interruption.

Ask the supplier to identify its role in each jurisdiction: model provider, deployer, distributor, importer, or service provider. Those labels can determine which obligations apply and which party must provide documentation or post-market monitoring.

Classify EU exposure early

Under the EU AI Act, obligations depend on the system and the provider or deployer category. A system can be prohibited, subject to transparency duties, high-risk, or related to a general-purpose AI model. High-risk treatment is tied to potential effects on health, safety, or fundamental rights; the European Commission’s guidance describes high-risk systems in those terms. Do not rely on a vendor’s label alone: document your own intended purpose, affected people, and decision pathway.

General-purpose AI provider obligations began applying on 2 August 2025, with duties that vary by model and provider category. The enforcement timeline also states 2 December 2027 for certain rules covering high-risk areas. Confirm the current text and transitional provisions for your jurisdiction before launch, because dates and duties differ by category.

Build an evidence pack you can verify

Request a versioned evidence pack and keep each item in an evidence register. For every document, record the author, approval date, test population, system and configuration covered, geographic scope, exceptions, expiry or review date, and the person responsible for answering follow-up questions.

Governance and intended use

  • System description, architecture diagram, model card or equivalent technical documentation.
  • Intended-use, prohibited-use, limitation, and known-failure statements.
  • Named risk owners, approval forums, escalation paths, and policies for responsible AI, security, privacy, and change management.
  • Risk assessments and impact assessments, including residual-risk acceptance and remediation deadlines.
  • A register of applicable laws, regulations, standards, and contractual requirements.

NIST’s AI Risk Management Framework (AI RMF) Core states: “Legal and regulatory requirements involving AI are understood, managed, and documented.” Treat that as an operating requirement: ask to see the mapping, not just a statement that the vendor is “aligned.”

Data and model provenance

  • Sources, collection methods, licensing basis, and quality controls for training, fine-tuning, retrieval, and evaluation data.
  • Policies for personal, confidential, and customer-provided data, including whether prompts or outputs are retained or used to improve a model.
  • Data-subprocessor list, processing locations, transfer mechanisms, deletion procedures, and backup-retention periods.
  • Copyright and content-complaint processes, with a clear description of what the vendor can and cannot warrant.

Safety, reliability, and fairness evidence

  • Pre-release and post-release evaluation reports, test sets, metrics, confidence intervals where appropriate, and known blind spots.
  • Red-team reports covering harmful content, misuse, prompt injection, jailbreaks, data exfiltration, and tool abuse.
  • Robustness results under distribution shift, degraded inputs, outages, rate limiting, and dependency failures.
  • Bias and fairness tests for relevant protected groups, including sampling decisions, outcome definitions, and remediation.
  • Human-oversight design: review points, override authority, operator training, workload limits, and what happens when the model is uncertain.

Security, privacy, and assurance

  • Security architecture, identity and access controls, tenant isolation, encryption, secrets management, vulnerability handling, and penetration-test summaries.
  • Independent assurance reports or certifications, with the audited locations, products, control period, exceptions, and complementary customer controls.
  • Privacy notices, data-processing terms, retention and deletion controls, rights-request procedures, and breach-notification process.
  • Business-continuity and disaster-recovery objectives, dependency maps, and tested restoration results.

Operations and incidents

  • Monitoring dashboards and alert thresholds for reliability, safety events, security incidents, privacy complaints, fairness indicators, drift, latency, and response times.
  • Incident register, root-cause analyses, corrective actions, and evidence that lessons reached the affected model or process.
  • Model and policy change logs, release approvals, rollback procedures, and advance-notice rules.
  • Subcontractor inventory, regulatory correspondence relevant to the service, and records of unresolved findings.

Reject undated screenshots, generic policy PDFs, and reports that cover a different model, region, or tenant configuration. A report can be genuine yet irrelevant to your deployment.

Test the vendor’s claims in your environment

Documentation cannot reveal every failure mode. Run an acceptance test using representative workflows and define pass/fail thresholds before you see the results. Include normal cases, edge cases, adversarial attempts, and recovery from failure.

  1. Create a test set: use de-identified production-like examples, minority and low-frequency cases, multilingual inputs if relevant, long context, missing fields, conflicting instructions, and deliberately ambiguous requests.
  2. Test quality and reliability: measure accuracy, false positives and negatives, calibration or confidence behavior, repeatability, latency, rate-limit handling, and graceful degradation when dependencies fail.
  3. Probe safety: attempt prohibited-use prompts, unsafe advice, dangerous instructions, self-harm content, fraud scenarios, and requests that combine benign data into a harmful result. Record whether the system refuses, explains the boundary, and escalates appropriately.
  4. Probe security: use prompt injection, indirect instructions in retrieved documents, cross-tenant access attempts, tool-call manipulation, malicious files, and data-exfiltration scenarios. Verify that least privilege and output filtering hold.
  5. Check privacy: test memorization and unintended disclosure with canary strings, another customer’s identifiers, deleted records, and sensitive attributes. Confirm that logs and support workflows do not expose the data.
  6. Check fairness and accessibility: compare outcomes and error patterns across relevant demographic, language, disability, and socioeconomic groups. Investigate disparate impact rather than accepting a single aggregate score.
  7. Exercise human control: confirm that a qualified person can understand the recommendation, override it, stop automation, and reach a timely escalation path. Test what the operator sees when the model is uncertain or unavailable.
  8. Retest change: repeat the critical suite after a model, data, policy, prompt, infrastructure, or subprocessor change. Preserve inputs, outputs, configuration, and reviewer decisions so results are reproducible.

NIST places trustworthiness considerations across pre-design, design and development, deployment, use, and test and evaluation. A one-time pilot therefore cannot stand in for lifecycle assurance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Set practical acceptance thresholds

Thresholds should reflect the consequence of an error. For a low-impact drafting tool, a human may review every output. For a rights-affecting or safety-related workflow, require demonstrably lower error tolerance, mandatory review, a safe failure mode, and a documented stop condition. Specify what happens when a threshold is missed: block release, restrict the use case, add controls, or retire the system.

Understand what major frameworks do—and do not do

Framework or law What it provides What it does not prove How to verify a vendor claim
NIST AI RMF 1.0 Voluntary lifecycle guidance for managing AI risk. Released January 26, 2023, with the functions Govern, Map, Measure, and Manage. It is not a law, certification, or guarantee that a particular model is safe. Request the vendor’s mapped controls, owners, metrics, residual risks, and evidence for your product and use case.
NIST trustworthiness characteristics A vocabulary covering validity and reliability; safety; security and resilience; accountability and transparency; explainability and interpretability; privacy enhancement; and fairness with harmful bias managed. Listing characteristics does not demonstrate performance against them. Demand test methods, populations, results, limitations, and retest commitments for each characteristic that matters to you.
ISO/IEC 42001 An AI management-system standard for establishing, operating, and continually improving organizational processes. A certificate does not certify every model output or cover every product, location, supplier, or customer configuration. Check certificate scope, issue and expiry dates, audited sites, exclusions, applicable statement of applicability, and surveillance status.
EU AI Act Binding obligations within its scope, with duties determined by risk level and provider, deployer, distributor, importer, or model category. “EU AI Act compliant” without a classification and control mapping is not meaningful. Obtain the classification rationale, technical-documentation plan, post-market monitoring, incident process, and allocation of provider/deployer duties.

NIST AI RMF 1.0 is explicitly voluntary. The NIST AI RMF Generative AI Profile, released July 26, 2024, adds generative-AI-specific risk considerations but does not turn the framework into law. An ISO/IEC 42001 certificate and a NIST alignment statement are different kinds of evidence; a NIST crosswalk does not make the standards interchangeable. Binding legal duties still apply where the EU AI Act or another law covers your deployment.

Make accountability enforceable in the contract

Move important promises out of marketing material and into signed terms, schedules, and technical exhibits. Assign every control to a named party and define evidence, deadlines, and remedies.

Contract topics to cover

  • Permitted use and scope: approved purposes, prohibited uses, user roles, geographic limits, and any requirement for human review.
  • Data rights: ownership, confidentiality, training restrictions, retention, deletion verification, backups, and return or export formats.
  • Security and privacy: minimum controls, subprocessors, access reviews, vulnerability remediation, audit cooperation, and data-transfer obligations.
  • Evidence and audit: access to relevant reports, test results, logs, control attestations, and reasonable customer or independent audits, with protection for other customers’ data.
  • Incidents: notification deadline, required facts, investigation cooperation, regulator support, customer communications, containment, and post-incident report.
  • Model changes: advance notice for material changes to model, training data, safety policy, hosting region, subprocessor, or autonomy; include validation and rollback rights.
  • Performance and service: service levels, support response, maintenance windows, rate limits, recovery objectives, and remedies for repeated failure.
  • Liability: responsibility for confidentiality, privacy, security, intellectual-property claims, regulatory cooperation, and losses caused by unauthorized use or failure to follow agreed controls.
  • Exit: portability, transition assistance, deletion certificates, continued read-only access to records, fallback procedures, and termination rights for material risk or regulatory change.

Do not accept a clause that makes your organization solely responsible for a vendor-controlled model, data flow, or security boundary. Shared responsibility must match who can actually operate each control.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Set up continuous monitoring and review

Approval is a point in time; an AI service changes through model updates, new data, policy changes, infrastructure migrations, and evolving law. Set a documented review interval appropriate to the risk and trigger an out-of-cycle review when any of the following occurs:

Compare vendors with a decision scorecard

Use the same questions and weighting for every supplier, then write a narrative justification for critical scores. A cheap or feature-rich service can be the worse choice if it creates unmanageable evidence or exit obligations.

Scoring dimension Questions to answer Red flags
Use-case and regulatory fit Does the provider understand your purpose, affected rights, geography, and role under applicable law? Vendor supplies a generic risk label or refuses to discuss classification.
Independent evidence quality Are reports current, independent where appropriate, scoped to the exact product, and reproducible? Expired certificates, unnamed test populations, or marketing-only summaries.
Safety and reliability Do your tests meet predefined thresholds, including edge cases and safe failure? No access to evaluation methods, unstable results, or no rollback.
Security and privacy Are isolation, access, retention, deletion, transfer, and incident controls demonstrable? Unclear training use, indefinite logs, or unlisted subprocessors.
Fairness, transparency, and oversight Can affected people receive an explanation or remedy, and can trained staff override the system? Automation cannot be stopped or outputs cannot be challenged.
Monitoring and response Will you receive timely alerts, metrics, change notices, and incident cooperation? Vendor promises to notify only at its discretion.
Contract and exit Are duties, audit rights, liability, portability, deletion, and fallback enforceable? One-sided terms and no practical way to retrieve data or switch providers.
Total cost and operational burden What will testing, human review, logging, assurance, integration, and compliance operations require? Low subscription price hides extensive manual controls or bespoke audits.

Common failure modes and how to correct them

“The vendor has an ISO certificate, so we are compliant.”

Correct this by checking scope and then testing your deployment. A management-system certificate can show that processes were audited within defined boundaries; it does not establish that your tenant, workflow, or model output meets every legal requirement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“NIST alignment” is treated as a pass/fail badge

NIST AI RMF is voluntary guidance intended to improve the incorporation of trustworthiness considerations into design, development, use, and evaluation. Ask for the mapped outcomes, evidence, gaps, and risk acceptance instead of accepting the phrase as a certification.

A questionnaire replaces technical testing

Use questionnaires to discover claims and missing evidence, then verify high-risk claims with controlled tests, logs, and independent reports. Include adversarial and representative cases; a vendor’s average benchmark score will not reveal your deployment’s failure modes.

The contract ignores model changes

Require notice, impact analysis, regression testing, and rollback or termination rights for material changes. A silent upgrade can invalidate your original risk assessment.

Human oversight exists only on paper

Observe the real workflow. The reviewer must have enough information, time, authority, training, and technical ability to reject or correct an output. If the system’s recommendation is effectively irreversible, label the process automated and apply the stricter controls that follow.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Exit is postponed until an incident

Test export, deletion, replacement, and fallback before production. Preserve prompts, outputs, decisions, approvals, and audit records in a usable format, subject to legitimate retention duties.

A practical go/no-go decision

Approve the vendor only when the evidence, testing, contract, and operating plan jointly answer four questions:

  1. Can you explain the system’s purpose, affected people, data flows, autonomy, maximum plausible harm, and applicable legal category?
  2. Does documented and independently credible evidence cover the exact product, version, configuration, geography, and use case?
  3. Do your own tests meet predefined safety, reliability, privacy, security, fairness, and human-oversight thresholds, with a tested incident and rollback path?
  4. Are accountability, change notice, monitoring, audit access, liability, portability, deletion, and termination enforceable and funded?

If any answer is no, restrict the deployment, add compensating controls, or select another supplier. Framework alignment, a certificate, or a completed questionnaire can strengthen the decision, but none substitutes for use-case-specific testing and contractual accountability.
