Campaigns can reduce the risk of exposing donor or voter data by keeping identifiable records out of AI prompts unless a tool and its current terms have been reviewed and approved for that specific use. For routine drafting, use public material or fictional examples; restrict access to campaign records; independently verify suspicious requests and voting information; and require human review before AI-generated content is used externally. These are risk-management recommendations, not a guarantee that any tool is safe or a complete statement of every campaign’s legal duties.
How can political campaigns use AI without exposing donor or voter data?
Start by separating the task from the sensitive information. A request to draft a fundraising email usually does not require a donor’s name, home address, employer, giving history, or payment details. A request to explain a voting process usually does not require a voter file. Give an AI tool only the material needed for the task, and use public or fictional examples whenever they will work.
“Donor data” and “voter data” are not one legal category. Federal campaign-finance disclosure rules address particular contributor information reported to the Federal Election Commission (FEC); they do not, by themselves, establish a complete privacy rule for every campaign-held file, voter file, state or local committee, or AI service. Campaigns should have counsel and security staff review the relevant jurisdiction’s requirements and the actual product and contract before sensitive records are used.
Know which dataset you are handling

Can campaigns put donor lists into ChatGPT?
Do not upload an identifiable donor list to ChatGPT—or another AI service—just because it is convenient or because the provider is familiar. The available sources do not verify any provider’s current retention, model-training use, deletion, access, subcontractor, incident-response, or contractual terms. That means they cannot support a claim that a particular service is safe for identifiable campaign records.

Before any sensitive use, the campaign should review the specific product, account configuration, and contract in force at the time. A general product description or a staff member’s assumption is not evidence of the controls that apply to the campaign’s account. If those controls cannot be established and approved, keep identifiable records out of the service.
What to verify before approving a tool
- How long prompts, uploads, and outputs are retained, and whether the campaign can control or request deletion.
- Whether prompts or files may be used to improve models, and what account or product settings govern that use.
- Who can access campaign content, including the provider’s personnel and subcontractors, and what access controls are available.
- How the provider handles security incidents, and what notification and response terms apply.
- Who administers the campaign account, how access is granted and revoked, and whether the configuration is documented.
These are review questions, not findings about any named vendor. The cited material does not certify a product or establish that any specific tool meets these criteria.

How should staff handle prompts and campaign files?
A cautious workflow keeps routine creative work moving while making sensitive-data use a deliberate exception rather than the default.
- Classify the material. Identify whether a task involves public campaign content, identifiable donor or voter records, credentials, financial records, or confidential strategy before opening an AI tool.
- Try a lower-risk input first. Use public campaign material, a fictional example, or a version with identifying details removed for drafting, summarizing, and brainstorming when it can produce a useful result.
- Minimize what remains. Include only the details required to complete the task. Removing names does not guarantee anonymity: an unusual combination of location, occupation, donation, or other details may still identify someone.
- Use only an approved workflow for sensitive data. If a task genuinely requires identifiable records, proceed only after the campaign’s legal and security reviewers have examined the product, configuration, and terms for that purpose.
- Restrict access and assign a reviewer. Give access to records and AI-enabled workflows only to staff who need it. Name a human reviewer responsible for checking sensitive outputs and important external communications.
- Keep protected, recoverable backups. CISA’s election-security toolkit search-result excerpt identifies secure offline backups as a resilience measure. The toolkit page itself could not be opened for this review, so consult its live instructions and confirm that the campaign’s own backup and restoration controls are appropriate before relying on implementation details. What does federal campaign-finance guidance say about contributor information?
The FEC’s November 2, 2018 guidance says federal committees must report a contributor’s name, address, occupation, and employer when an individual’s contributions exceed the applicable itemization threshold: more than $200 per election cycle, or per calendar year for PACs and party committees. The FEC says reports are made publicly available within 48 hours of receipt. Both figures describe the FEC’s guidance, not a blanket rule for every record a campaign possesses. The same guidance says individual contributor information taken from FEC reports may not be sold or used to solicit contributions—including political or charitable contributions—or for commercial purposes. Its examples distinguish uses and sources of information, and the FEC says the restriction does not bar a committee from compiling and distributing its own contributor list. The page also cautions that its explanation does not replace the law. Do not turn those examples into a general authorization to upload, reuse, or solicit from any donor or voter dataset.
How can campaigns guard against AI-enabled phishing and bad voting information?
The U.S. Election Assistance Commission (EAC), in guidance dated June 3, 2026, warns that AI can accelerate existing election threats such as phishing and impersonation. It also warns that AI-generated voter information can sound plausible while being inaccurate. Those risks make independent verification important even when a message or answer looks polished. - For requests involving credentials, donor lists, or urgent transfers: verify through a known, separate channel, such as a previously established phone number—not by replying to the unexpected message or using contact details supplied in it.
- For voting dates, hours, and locations: check the relevant election office’s official source before publishing or sending the information to voters.
- For AI-generated summaries or answers: have a responsible staff member check factual claims against authoritative sources before operational use or publication.
What rules apply to AI-generated campaign ads?
In a September 27, 2024 interpretive rule, the FEC said the existing federal fraudulent-misrepresentation statute and implementing regulation are technology neutral and apply to AI-assisted media. The Commission said applications would be considered case by case. It summarized its position this way: “The statute, and the Commission’s implementing regulation, is technology neutral.” FEC: Interpretive Rule on artificial intelligence in campaign ads.
This is a statement about the existing fraudulent-misrepresentation provisions, not a comprehensive federal privacy regulation for all AI use. Have counsel assess media that could falsely appear to speak or act for another candidate or party, or falsely claim authority when soliciting contributions.

When should a campaign pause an AI workflow?
Stop and seek the campaign’s designated legal or security review when a task requires uploading identifiable donor or voter records but the approved handling terms are unknown; when a request for credentials, a list, or money arrives unexpectedly; or when AI-generated voting details or political media cannot be independently verified. The sources cited here address federal campaign-finance guidance and election-administration security concerns, not the full range of state and local privacy laws. Federal rules, agency interpretations, and product terms can change, so confirm the current requirements for the campaign’s jurisdiction and use case.
