Phosphogypsum stacks are engineered waste-management systems, not simply dry piles. They receive a water-based slurry left over from phosphate processing; solids settle into the stack while process water is captured and managed. A leak can occur if part of that containment and water-management system fails to perform as intended, but visible water alone does not establish a leak’s cause or prove contamination.
What a phosphogypsum stack stores
Phosphogypsum is the solid byproduct of processing phosphate ore to make phosphoric acid. Rather than being delivered as dry material, it is commonly pumped to a stack as slurry. As the solids settle and consolidate, water separates and pools. That makes water handling an essential part of operating the stack, alongside storing the solid waste. EPA’s overview of phosphogypsum describes this process and the associated management controls; EPA’s explanation of radioactive material from fertilizer production also describes slurry settling and pooled water.
How the stack system contains waste and water
The waste mass is only one part of the system. Depending on the design, containment and water management can involve liners, ponds, pipes or ditches that carry water, drainage features, seepage collection, pumps, and monitoring. Effluent may be captured for recycling, treatment, or other management under applicable requirements. Inactive stacks typically receive an engineered cover intended to limit additional water infiltration, according to EPA’s overview.
EPA says newer stacks contain liners to help prevent effluent from entering soil and groundwater, while older stacks may not. A liner is a containment measure, not a guarantee against leakage: performance also depends on the design and condition of the system and on how water is collected and controlled.

Design details vary by jurisdiction and facility
Florida provides one example of more detailed containment requirements. An EPA-hosted technical submission describing Florida provisions identifies composite liners, perimeter underdrains, lined ditches or chemically compatible collection pipes, and toe drains or seepage-collection systems located within the lined system. These are examples of specific regulatory design provisions, not a checklist that applies identically to every stack. The EPA-hosted technical submission discusses those Florida requirements.
Florida law also addresses the broader system around the stack: structures and associated pumps, pipes, ditches, drainage, water-control, collection, cooling, and surge systems are to use sound engineering practices and operate to avoid harmful spills or discharges, with inspection logs maintained. See Florida Statutes § 403.4155. Other states and facility permits may set different requirements.

What can cause a leak?
Water is part of normal stack operation. It can escape if a liner, containment feature, drainage route, pipe, or seepage-collection path does not perform as intended. The exact cause at a particular facility cannot be inferred from the general design description: it requires site-specific inspection, operating and monitoring records, engineering analysis, and relevant water-quality data.
EPA operational requirements identify conditions that merit prompt investigation, including concentrated seepage such as springs or boils, signs of piping, slope sloughing, bulging or heaving, lateral movement or subsidence, new cracks that are not ordinary shrinkage cracks, enlargement of wide cracks, suspected liner damage, and turbid water in drains. These are warning indicators, not proof that a particular liner has ruptured, that water is contaminated, or that a collapse is imminent. The listed indicators appear in EPA’s May 23, 2010 stack-system construction and operational requirements.

How to interpret visible seepage or other warning signs
Visible seepage should be treated as a reason to investigate, not as a diagnosis. A wet area by itself does not show where the water originated, whether it passed through a liner, or whether it contains contaminants. Similarly, an isolated crack or turbid drain water needs context: location, change over time, inspection findings, and monitoring results matter.
- Concentrated seepage, springs, or boils: report and investigate, especially where flow is localized or changing.
- Movement or deformation: sloughing, bulging, heaving, lateral movement, or subsidence can indicate a stability or seepage concern.
- New or growing cracks: distinguish them from ordinary shrinkage cracks and document changes.
- Drain or liner concerns: turbid drain water or suspected liner damage warrants investigation under the applicable operating requirements.
Determining whether there has been a release, what caused it, and what its consequences are calls for facility-specific evidence rather than a visual observation alone.

What regulation does—and does not—tell you
EPA says federal rules require phosphogypsum to be managed in engineered stacks, principally to limit public exposure to radon and other radionuclides. The federal air rule has specified exceptions and allows case-by-case review for other uses; it is not the only control relevant to water, seepage, or facility operation. Water and seepage management can also be governed by state requirements, facility permits, and site-specific operating controls. For a claim about a named stack or a reported release, the meaningful evidence is the facility’s applicable permit and jurisdiction, dated inspection findings, drainage and groundwater-monitoring records, and any engineering or water-quality analysis. A general description of how stacks are designed cannot establish the condition of an individual site.
