There is no single U.S.-wide deadline. How long police keep license plate reader data—also called automatic license plate reader (ALPR) data—depends on the state, the agency’s policy, why the data was collected, and whether it has been preserved for a case. Routine reads may be deleted on a short schedule, while data linked to an investigation, warrant, prosecution, or court matter may be kept longer.

Why the answer depends on where and how the data was collected

ALPR systems capture plate information and related data as vehicles pass a camera. State law may impose a retention limit, while an agency policy may specify the ordinary deletion schedule and explain exceptions. The clock may also start at different points, such as capture, collection, or a request to preserve data.

Separate routine records from records retained for a specific purpose. A standard deletion period may not apply to data preserved under a warrant, investigation, prosecution, court order, or valid preservation request. Vendor-hosted copies are a separate issue: the laws and agency policy described here do not establish a universal deletion schedule for vendors. Check the agency’s policy and applicable vendor terms if copies held outside the department matter.

Examples of retention rules in the United States

These examples illustrate different kinds of rules; none establishes a nationwide period. Statutes and policies can change, so check the current law and agency documents for the location in question.

North Carolina Covered captured data may not be preserved for more than 90 days after capture. Exceptions include qualifying preservation requests and search warrants. For a preservation request, the statute requires destruction one year after the initial request unless another request resets the period. North Carolina General Statutes § 20-183.32.
Washington The general limit for covered data is 21 days. Exceptions include evidence of specified unlawful conduct and distinct schedules for court-authorized data, parking enforcement, traffic studies, and commercial vehicle enforcement. The current statute page reflects 2026 legislation. RCW 10.130.040.
Virginia agencies surveyed in 2025 Among responding agencies, 74% (106 of 143) with fixed cameras, 94% (47 of 50) with mobile cameras, and 84% (31 of 37) with portable cameras reported periods of 21 days or less. The survey also found that 21% (33 of 159) of responding agencies reported a period over 21 days. These are Virginia survey results, not a national estimate. Henrico County, Virginia The police division’s policy sets 21 days for fixed and portable system data and requires mobile-system settings to purge data within 21 days. Data tied to a specific ongoing criminal investigation, prosecution, or civil action may be retained through specified milestones. This is a local policy, not a Virginia-wide rule. California No single statewide retention period is established by the cited California Attorney General draft report. SB 34 requires agencies’ policies to state how long ALPR data is kept. A separate rule limits California Highway Patrol ALPR images to 60 days unless used in felony investigations or as evidence; do not apply that CHP rule to every California police department. Washington’s purpose-specific exceptions

Washington’s general 21-day limit is not the whole schedule. Under the statute, court-authorized data is deleted at the conclusion of the case under the applicable records schedule; parking enforcement data is deleted no later than 12 hours after final disposition; traffic-study data no later than 30 days after collection; and commercial vehicle enforcement data no later than six months after collection. Data retained as evidence of specified unlawful conduct may be kept as long as needed for that purpose. RCW 10.130.040.

Why older state comparisons need a date

A Virginia State Crime Commission report published in 2025 presented a staff legal-analysis snapshot dated September 8, 2024. It listed New Hampshire at three minutes, Utah at 14 days, Maine at 21 days, North Carolina at 90 days, and Florida at three years, among other entries. It also said Virginia then had no statewide ALPR retention regulation and noted local policy differences. How to find the period for your police department

  1. Identify the agency and jurisdiction. Start with the police department or sheriff’s office that operates the system; state law and local policy can both matter.
  2. Find the current policy. Search the agency’s official site for “automated license plate reader policy,” “ALPR policy,” or the system vendor’s name plus “retention.”
  3. Read beyond the headline retention number. Check what event starts the clock, which systems and data types are covered, and whether the policy allows longer retention for investigations, warrants, evidence, or court proceedings.
  4. Compare the policy with state law. Look for the statute’s ordinary limit and its exceptions. A department schedule may clarify practice, but it does not erase applicable legal requirements.
  5. Ask the records custodian if the documents leave questions. Request the current retention schedule and ask whether case-preserved data, vendor-hosted copies, shared access, or audit logs follow different schedules.

What to ask about a specific read or investigation

If you need to know whether a particular plate read still exists, ask the agency when it was captured, whether it was preserved for a case or request, and whether the record is held by the department or a vendor. The ordinary retention period alone cannot establish whether a particular record was deleted: an exception may apply, and the governing schedule may distinguish routine reads from records retained for a legal or investigative purpose.
