There is no single tax treatment for every Indian homestay or short-term rental. GST registration depends mainly on aggregate turnover and the state where the supply is made; the GST rate depends on the room’s tariff; income-tax treatment depends on whether you own the property and how you operate it; and a booking platform may withhold tax before paying you. Rent paid to a landlord can create a separate TDS obligation. Local tourism, municipal, safety and guest-reporting rules must also be checked for the property’s city and state.
Start with the four questions that determine your tax treatment
Before calculating anything, classify the arrangement along four axes. The answers determine which registrations, rates and withholding rules you need to examine.
| Question | Why it matters |
|---|---|
| Do you own the property or lease it? | An owner’s rental receipts may fall under Income from House Property. A lessee who sublets, or an operator who is not the owner, is generally considered under business or residual income instead. |
| Is this occasional letting or an organised hospitality activity? | Limited letting of rooms can look different from a business that provides regular accommodation, cleaning, meals, reception or other substantial services. |
| What is the tariff per unit per day? | CBIC’s accommodation rate bands are based on the value of the unit per day, not simply on the total value of a booking. |
| Are bookings direct or facilitated by an online platform? | A platform that facilitates a resident participant’s services may deduct income tax under section 194-O from the gross amount credited or paid. |
| Where is the property located? | GST thresholds and local licences are state- and city-sensitive. Tourism registration, municipal permissions, local levies, police reporting and fire or safety rules are not uniform across India. |
When must a homestay register for GST?
Use the turnover threshold, not the number of rooms
Airbnb’s India tax guide states that a host generally is not liable to register until aggregate turnover exceeds ₹20 lakh. The guide identifies a lower ₹10 lakh threshold for specified northeastern and hill states listed in that guide. These are not universal figures for every property: confirm the applicable state and the current rule before relying on them.

Aggregate the taxable supplies that count toward the threshold rather than looking at one listing or one platform in isolation. A host with several rooms, properties or booking channels should assemble the relevant turnover in one calculation. Keep the state of each property and the legal entity or person making the supply clear in the records.

Decide whether you are making a taxable supply in business
Short-term paid accommodation is normally analysed as a supply made in the course of business, even when the host is an individual. Heading 9963 in the GST Council’s material covers accommodation supplied by a hotel, inn, guest house, homestay, club or campsite. A room occasionally made available for payment therefore needs to be examined under the accommodation rules rather than assumed to be private residential use.
A dwelling rented for use as a residence is a distinct concept from transient accommodation. The length of stay, the agreement with the occupant and the services supplied can affect the classification. Do not label a stay “residential” merely because it lasts several weeks, or “hotel accommodation” without checking the actual arrangement.
What changes after registration
Once registration is required and obtained, charge the applicable GST on taxable accommodation, issue compliant tax invoices and report the supplies in the prescribed returns. Keep booking confirmations, invoices, cancellations, refunds, platform statements and bank records together so the figures reported to GST can be reconciled to the money received.

Which GST rate applies to accommodation?
Use the tariff bands in the CBIC rate table
| Value of the accommodation unit per day | Total GST rate listed by CBIC | Important qualification |
|---|---|---|
| At or below ₹7,500 per unit per day | 12% | Subject to the conditions in the applicable notification, including provisions concerning specified premises and input-tax-credit treatment. |
| Above ₹7,500 per unit per day | 18% | Subject to the same notification framework and classification of the accommodation. |
The ₹7,500 test is a tariff test for the unit and day. A weekly or monthly booking should be broken down consistently for classification; do not compare the full invoice total with the daily threshold. If a booking includes separately identifiable services, review whether they form part of the accommodation supply or require separate treatment.
Specified-premises changes from 1 April 2025
Notification 05/2025 changed the definition of “specified premises” with effect from 1 April 2025. It includes premises from which the supplier provided hotel accommodation above ₹7,500 per unit per day in the preceding financial year, as well as premises for which a registered supplier files the required declaration in the prescribed window. The notification’s conditions can affect the rate entry and input-tax-credit treatment, so a host near the tariff boundary should check the notification and declaration procedure rather than relying on an old description of specified premises.

Who actually charges the GST?
A host below the applicable registration threshold generally does not charge GST as a registered supplier. A registered host must apply the correct rate to taxable accommodation and account for it in the GST records. A platform’s collection, fees or payout calculation does not by itself settle whether the host is registered or which rate applies; establish the underlying supply and the host’s registration status first.
Is the income house-property income or business income?
Owner letting a building or appurtenant land
The Income Tax Department states: “The income is taxable under the head ‘house property’ if it arises from a property consisting of any building or land appurtenant thereto,” when the statutory ownership conditions are met. An owner who mainly lets rooms with limited services may therefore need to consider the house-property head for the relevant receipts.
Hospitality operations and substantial services
Regular guest turnover, active marketing, housekeeping, linen changes, meals, reception, transport, concierge work or other substantial services can indicate an operating hospitality business rather than passive letting. The exact facts matter: the tax return head affects the way receipts and allowable deductions are computed and reported.
Lessee, manager or non-owner operator
The department’s guidance says that when the person receiving rent is not the owner, the receipts are chargeable as business income or residual income rather than house-property income. A person who leases an apartment and sublets it on short stays should not claim house-property treatment simply because the underlying asset is a building. Management agreements, revenue-sharing arrangements and who bears operating costs should be documented and reviewed on their own facts.
Keep the ownership document or lease, the operating agreement, booking ledger and service description. If the activity combines passive letting with a service-heavy hospitality operation, obtain fact-specific advice instead of forcing every receipt into one category.

Why did the booking platform deduct tax from the payout?
Section 194-O withholding
Section 194-O applies where an e-commerce operator facilitates a resident participant’s sale of goods or provision of services through its digital or electronic platform. The current statutory text requires the operator to deduct income tax at 0.1% of the gross amount of those sales or services. A resident host whose bookings are facilitated online can therefore see a 194-O deduction in the platform payout statement.

Find and replace yours safely.Free scan · under a minute“Gross amount” is not the same as the net bank transfer. Start with the booking value used by the platform, then reconcile platform commissions, GST collected, cleaning or other separately shown charges, cancellations, refunds and adjustments. The 194-O amount is a withholding credit, not a statement that your final income-tax liability is only 0.1%.
A practical reconciliation example
Suppose the platform’s statement shows ₹1,00,000 of gross services for the period and a separate 194-O deduction of ₹100. Record the gross figure, identify which amounts are platform fees or taxes, and verify that the ₹100 credit appears in the income-tax statement used for your return. Do not calculate tax only from the amount that reached your bank account.
When must you deduct TDS from rent paid to a landlord?
Section 194-IB threshold and rate
The TDS Centralised Processing Cell’s official FAQ states that section 194-IB applies when an individual or Hindu undivided family tenant pays monthly rent above ₹50,000 to a resident landlord. It also states that the rate is 2% from 1 October 2024, replacing the earlier 5% rate, and identifies Form 26QC as the challan-cum-statement.
This is the host’s obligation on rent paid to the landlord. It is separate from GST charged to guests and separate from section 194-O withholding by a booking platform. A host who rents a property for short-term operation should review the monthly rent, the landlord’s residential status and the tenancy dates before making payments.

Keep the rent-TDS trail separate
Maintain the lease, rent schedule, landlord details, payment proof, TDS calculation and Form 26QC acknowledgement in a separate file from guest GST records. Mixing the landlord’s rent TDS with platform withholding makes it harder to prove which tax was deducted by whom and why.
Local registrations and taxes are a separate compliance track
GST and income tax do not replace local permissions. Depending on the state and city, a homestay or short-term rental may need tourism registration, a municipal trade or lodging permission, local taxes, guest identity or police reporting, and fire, building or safety clearances. Some jurisdictions distinguish owner-occupied homestays from whole-property vacation rentals; others impose caps, inspections or prescribed registers.
Check the tourism department and municipal authority for the property’s exact address, then ask whether the building’s society, lease or zoning rules restrict short-term accommodation. Confirm guest-reporting requirements before accepting bookings, and retain evidence of any registration, renewal, inspection or local-tax payment.
A workable compliance process for a new listing
- Identify the supplier. Record whether the owner, a lessee, a manager or another entity contracts with the guest and receives the booking income.
- Map the property and state. List every unit, its address, ownership or lease status and the state-specific GST threshold that may apply.
- Classify the stay. Describe the accommodation, duration, guest use and services supplied. Separate transient hospitality from a dwelling rented for residence.
- Build the turnover calculation. Aggregate the taxable supplies relevant to the threshold across booking channels and retain the working papers.
- Test the tariff. Determine the value of each accommodation unit per day and apply the CBIC band, including the notification conditions for specified premises and input-tax credit.
- Register and invoice when required. After registration, issue compliant invoices, charge the applicable GST and report the figures in the required returns.
- Reconcile withholding. Match platform gross bookings and 194-O deductions to payout statements and the tax credit shown in the income-tax records.
- Review landlord TDS. If monthly rent exceeds the 194-IB threshold, calculate the 2% deduction applicable from 1 October 2024 and complete Form 26QC as required.
- Complete local checks. Obtain tourism or municipal permissions, satisfy guest-reporting and safety rules, and track renewals and local taxes.
Records that prevent the most common disputes
- Booking-level data showing dates, unit, nightly tariff, taxes, cancellations and refunds.
- Separate platform statements showing gross services, commissions, GST collected, 194-O withholding and net payout.
- Ownership deeds, lease agreements, management contracts and revenue-sharing terms.
- Invoices issued to guests and evidence supporting the tariff classification.
- GST registration and return records, income-tax working papers and 194-O credit reconciliations.
- Rent payment proofs, landlord details and Form 26QC records where section 194-IB applies.
- Tourism registrations, municipal permissions, safety certificates and guest-reporting logs required locally.
Common mistakes and how to correct them
Treating the ₹20 lakh figure as universal
The general threshold and the lower threshold for specified northeastern and hill states are starting points, not a blanket exemption. Correct the mistake by confirming the property’s state and rebuilding aggregate turnover from every taxable booking channel.
Using the booking total instead of the daily unit tariff
GST accommodation bands use the value per unit per day. Recalculate the tariff on a consistent daily basis and document how bundled charges were handled.

Assuming every host has house-property income
Ownership, services and the operating model matter. A lessee or a service-heavy operator may have business or residual income. Review the contracts and actual activity before selecting the return schedule.
Confusing withholding with final tax
The 0.1% section 194-O amount is a credit withheld by the platform. Reconcile it and claim the credit correctly; it does not replace computation of taxable income.
Ignoring the landlord’s TDS
Rent paid for the property can trigger section 194-IB even when guest bookings are handled correctly. Test the monthly rent separately and keep Form 26QC evidence.
Relying on a national rule for local permissions
A GST registration does not prove that a property is licensed to host guests. Verify the city and state requirements before listing and whenever the operating model changes.
Bottom line for owners and operators
For an Indian homestay or short-term rental, begin with the supplier, ownership, services, tariff and property location. Apply the state-specific GST turnover test, then classify the accommodation under the ₹7,500-per-day tariff bands and applicable notification conditions. Report income under the head that matches the ownership and operation, reconcile any 0.1% section 194-O platform withholding, and separately test rent paid to a landlord under section 194-IB. Finish with the tourism, municipal, safety and guest-reporting checks required where the property actually operates.
