International recognition is a state’s acceptance of an entity as a state. Under the prevailing declaratory approach, recognition acknowledges statehood rather than creating it. A breakaway region’s declaration, its ability to meet statehood criteria, recognition by other countries, and admission to the United Nations are separate questions—with different legal and practical consequences.
What has to happen before a breakaway region can be treated as a state?
A declaration of independence announces an intention to form a separate state; it does not by itself establish that one exists. The question of statehood is assessed separately, with attention to the region’s circumstances and the applicable law.
The commonly used statehood criteria
Article 1 of the 1933 Montevideo Convention sets out four familiar criteria: a permanent population, a defined territory, a government, and the capacity to enter into relations with other states. The Netherlands’ Advisory Committee on Issues of Public International Law described these criteria as generally accepted as part of customary international law in its 2018 report, The aspirations for independence by the Kurdish Autonomous Region of Iraq.
They are not a mechanical checklist that automatically turns a region into a state. The criteria were designed to identify an already independent state, and their application depends on facts such as whether the entity intends to act independently and whether it exercises effective, stable authority. A defined territory does not necessarily require every border to be undisputed. The capacity for external relations can also be difficult to assess in isolation: other states’ willingness to engage has a political dimension.

Control and circumstances matter
An aspiring state would generally need to establish its own institutions and exercise effective, stable control over the territory it claims. That control may be contested, could be lost, or may be restored by the existing state. The population’s support is relevant to understanding the situation, but it does not alone resolve the legal question.
Does international law give every region a right to secede?
No general right to unilateral secession is settled for every region. The Netherlands Advisory Committee’s 2018 report describes internal self-determination within existing state borders as the general rule. External self-determination is associated with particular contexts, including decolonization and foreign subjugation. Whether there is a broader right to secede as a remedy for serious mistreatment remains disputed.
Two questions must be kept distinct: whether a declaration of independence is prohibited, and whether the population has a positive legal right to secede. A declaration not being prohibited does not, by itself, establish a right to independence or prove that statehood has been achieved. The legality of a particular situation depends on its facts and the applicable rules.

There are also circumstances in which other states must not recognize a situation created through a serious breach of a peremptory norm of international law. The advisory report identifies unlawful force and other serious violations as barriers relevant to lawful state creation and non-recognition. Recognition is therefore not always just an optional diplomatic gesture.
What did the ICJ decide about Kosovo?
In its advisory opinion of 22 July 2010, the International Court of Justice considered whether Kosovo’s declaration of independence was in accordance with international law. The Court expressly noted that the question before it “does not ask whether or not Kosovo has achieved statehood.” It also did not decide the validity or legal effects of recognition by states that recognized Kosovo.
The opinion is therefore narrow: it is not a ruling that every unilateral secession is lawful, that Kosovo’s declaration alone established statehood, or that any particular number of recognitions settles the question. The declaration’s legality, the region’s statehood, and other states’ recognition are separate issues.

What does recognition by another country do?
Recognition is a decision by a state to accept an entity as a state. It may be stated explicitly or inferred from a state’s conduct, according to the Netherlands Advisory Committee. Under the prevailing declaratory approach described in that report, recognition is not itself the legal act that creates statehood; nor does that approach impose a general obligation to recognize every entity that appears to meet the statehood criteria.
Even so, recognition can have major practical effects. It can help an entity establish diplomatic relations, enter agreements, and take part in international affairs. Lack of recognition may obstruct those activities. States’ decisions can reflect both legal assessments and political choices, so a recognition decision is consequential without necessarily being a universal legal verdict.
Recognition of a state should also be distinguished from dealings with a particular government. A country can engage with a government without that conduct necessarily amounting to recognition of a new state.

How many countries have to recognize a new state?
There is no universal recognition-count threshold that, by itself, settles statehood. The criteria and legal context remain relevant, while recognition is a separate decision made by individual states. A count without a defined entity and date can also mislead because recognition positions may change.
To compare two breakaway regions, consider the same factors for each rather than relying on a tally alone:
- Effective control: Who governs in practice, and is that control stable?
- Population and territory: Is there a permanent population and a sufficiently defined territory?
- Independent capacity: Does the entity intend to act independently and have practical capacity for external relations?
- Legal context: Do rules on self-determination, decolonization, foreign subjugation, unlawful force, or serious breaches of peremptory norms affect the analysis?
- Recognition and institutional access: Which states recognize the entity, what relations follow, and has it separately joined relevant organizations?
Does recognition automatically make a region a UN member?
No. Recognition by individual states and membership in an international organization are distinct. Under Article 4 of the UN Charter, admission to the United Nations follows an institutional process; it does not happen automatically after a declaration or recognition by some countries. Other organizations have their own membership rules.

The World Bank’s World Bank Legal Review, in a chapter titled “International Norms and Standards,” gives the historical example that Kosovo was a member of the IMF and World Bank but not the UN at the time described in that publication. That example is not a statement of current membership status.
How to assess a particular breakaway region
For a specific case, keep the questions separate: what control and institutions exist on the ground; how the statehood criteria apply; whether the attempt to secede is lawful in its circumstances; which states recognize the entity; and whether it has been admitted to particular international organizations. A declaration, one criterion, a recognition count, or a UN membership decision cannot substitute for that full analysis.
Recognition positions are entity-specific and can change. Any current list or count should be checked against up-to-date, authoritative records for the particular region and date in question.
