Indian dividends are normally taxable in the shareholder’s hands. For dividends received on or after 1 April 2020, include the gross amount under Income from Other Sources, calculate tax at the rate that applies to your residential status and security, and claim eligible tax deducted at source (TDS) as a credit. TDS does not remove the filing obligation.

  • A resident company generally deducts 10% TDS under section 194 before paying a resident shareholder, subject to the ₹5,000 non-cash exception for individuals.
  • Only interest incurred to earn dividend income can be deducted, and the deduction is limited to 20% of total dividend income. Collection commissions and similar costs are not deductible under the cited guidance.
  • Enter the gross dividend and its quarterly breakup in Schedule OS, then reconcile the TDS credit with your tax-information statement.
  • ITR-1 is available only to an eligible resident individual with total income up to ₹50 lakh and none of the listed exclusions. Foreign income or assets, business income, and several other conditions generally move you to another form.

Why dividend tax is in your return

The Finance Act, 2020 ended the dividend-distribution-tax model and moved India to a classical system in which dividends are taxed in the hands of shareholders. The Income Tax Department describes dividend income as taxable either at the applicable tax rate or at a flat statutory rate, depending on the case. This change matters even when a company has already withheld TDS: withholding is an advance collection of tax, while the return reports the income and computes the final liability.

The relevant year is the year in which you receive or become entitled to the dividend under the applicable rules. A return for assessment year (AY) 2026–27 generally covers income of financial year (FY) 2025–26. Use the assessment year shown in your filing utility and statements rather than assuming that the year printed on a dividend advice is the filing year.

How the taxable amount is calculated

Start with the gross dividend

Report the dividend before TDS. If a company declares ₹20,000 and credits ₹2,000 as TDS, the amount to report is ₹20,000, not the ₹18,000 that reached your bank account. Statements from your broker, registrar or the company should show the gross figure and withholding separately.

Apply the limited interest deduction

Interest expense incurred for earning dividend income may be deducted, but the Income Tax Department’s dividend guidance caps the deduction at 20% of total dividend income. If total dividends are ₹1,00,000, the maximum possible interest deduction is ₹20,000, and only actual, supportable interest can be used. A deduction cannot exceed the cap or create an artificial loss from dividend income. Commissions for collecting dividends, portfolio-management charges and similar expenses are not deductible under that guidance.

Item Illustration Tax treatment
Gross dividends ₹1,00,000 Include the full amount in Schedule OS
Documented interest paid to earn dividends ₹15,000 Potentially deductible because it is below the ₹20,000 cap
Collection or brokerage charges ₹3,000 Not deductible under the cited dividend guidance
Dividend income after permitted deduction ₹85,000 Combined with your other income for the applicable rate calculation

The illustration shows the mechanics, not a universal tax rate. Your final tax depends on the regime and slab or statutory rate that applies to you, the type of dividend and your other income.

Use the rate that actually applies

Ordinary dividend income is generally taxed at your applicable rate. Some securities or non-resident categories can have a special statutory rate, and a treaty can provide a different rate where its conditions are met. Do not apply one blanket percentage to every dividend merely because TDS was 10%.

For AY 2026–27, the Income Tax Department’s rate information includes ordinary dividend income in the surcharge framework and states a maximum 15% surcharge for the listed ordinary dividend-income category. Health and education cess is 4% of income tax plus surcharge. The surcharge and cess calculation is made on the tax computed under the applicable regime; it is not a substitute for determining the correct base rate.

How section 194 TDS works for resident shareholders

The general rule

Section 194 requires the principal officer of an Indian company to deduct income tax at 10% from a dividend paid or distributed to a resident shareholder. The 10% figure is the statutory TDS rate identified in the Income Tax Department’s AY 2026–27 rate table. The company withholds before crediting or paying the dividend and reports the deduction against your tax identifier.

The ₹5,000 exception

An individual resident shareholder can fall outside section 194 withholding when both conditions are met: the dividend is paid by a mode other than cash, and the aggregate dividend from that company during the financial year does not exceed ₹5,000. The threshold is tested company by company and for the financial year. A cash payment does not qualify for this particular exception.

Situation Section 194 result What you still do
Resident individual, non-cash payment, total from one company up to ₹5,000 in the FY Statutory exception can apply Report the dividend if you are required to file and pay any final tax due
Resident individual, total from one company above ₹5,000 Generally 10% TDS Report gross dividend and claim the TDS credit
Resident shareholder receiving cash The stated non-cash exception is unavailable Check the withholding shown in your tax statement

TDS is a credit, not the final calculation

A 10% deduction may be higher or lower than your eventual effective rate. If your applicable rate is higher, you pay the shortfall when filing; if it is lower, the excess can contribute to a refund after all return data is accepted. If no TDS was deducted because the exception applied, the dividend is still taxable and must be included in the return when your filing obligation requires it.

Before filing, compare each dividend advice with the tax-information statement available through the Income Tax Department’s systems. Investigate a missing or duplicated entry with the payer rather than claiming a credit that does not appear in the department’s records.

Which ITR form should you use?

Dividend income itself is classified as income from other sources, but your complete profile determines the form. For AY 2026–27, the department’s eligibility guidance makes ITR-1 conditional rather than automatic.

Form When it may fit Important exclusions or triggers
ITR-1 Eligible resident individual with total income up to ₹50 lakh and income within the form’s permitted categories, including dividend income Not available where the listed exclusions apply, including business or professional income, disqualifying capital-gain situations, foreign assets or foreign income, director status, certain unlisted-share holdings and other conditions in the AY 2026–27 guidance
ITR-2 Individual or Hindu undivided family with dividend income and other non-business sources that do not fit ITR-1 Use when exclusions such as foreign income or assets, specified capital gains or director status prevent ITR-1, provided there is no income from business or profession
ITR-3 Individual or Hindu undivided family with dividend income together with income from business or profession Business or professional income is a principal reason ITR-1 is unavailable

The department’s downloads page lists utilities for ITR-1 through ITR-4 and records the latest common-utility release on 16 October 2026. Select the utility for the correct assessment year and read its eligibility screen; a prior-year form or a form chosen only because it is shorter can create a defective return.

Where and how to enter dividend income

Use Schedule OS (Income from Other Sources). AY 2026–27 validation rules require the dividend amount and quarterly breakup to reconcile with the dividend-rate rows selected, including a DTAA-rate dividend category where applicable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Gather payer records. Download dividend statements from your broker and registrar, bank credit records, corporate-action notices and any consolidated annual statement. Keep the declaration date, payment date, company name and gross amount.
  2. Reconcile tax information. Compare the gross dividend and section 194 TDS with the tax-information statement available in the department’s portal. Resolve differences with the payer before submitting the return.
  3. Open Schedule OS. Choose the row matching the dividend’s applicable rate category. Do not place the net bank credit in the gross-income field.
  4. Enter the quarterly breakup. Allocate each dividend to the quarter in which it belongs under the utility’s instructions. The quarterly total must agree with the selected rate row; a mismatch can trigger a validation error.
  5. Enter permitted interest only. If you are claiming interest incurred to earn dividends, enter the supported amount within the 20% of total-dividend limit. Retain the working showing how the cap was tested.
  6. Claim TDS in the tax-credit schedule. Use the amount that matches the department’s statement and the payer’s certificate. TDS credit cannot exceed the tax actually reported and deposited against your identifier.
  7. Run validation and preview. Correct rate-category, quarter and credit mismatches before signing or verifying the return. Save the acknowledgement, schedules and supporting workings.

Resident, non-resident and treaty cases

Resident investor decision path

  1. Confirm that you were resident for the relevant financial year under the applicable residential-status rules.
  2. Identify whether the dividend is ordinary domestic-company income or a category carrying a special statutory rate.
  3. Report the gross amount in Schedule OS, apply only the permitted interest deduction and compute tax at the applicable rate plus any surcharge and cess.
  4. Subtract eligible TDS credit and pay the balance or claim the resulting refund.

Non-resident investor decision path

There is no single universal NRI dividend rate. The outcome depends on residential status, the security, the source country, the treaty article and the documentation required to claim treaty treatment. The return validation rules include a DTAA-rate dividend category, while the department’s dividend explanation describes special-rate treatment for specified non-resident categories.

  1. Establish non-resident status for the financial year and separate Indian-source dividends from foreign dividends.
  2. Identify the security and payer. A dividend from an Indian company, an overseas company or a fund distribution may fall under different statutory provisions.
  3. Check the relevant treaty article and its maximum rate. A treaty claim generally requires proof such as a tax-residency certificate and any other forms or declarations required for that treaty.
  4. Enter the amount in the Schedule OS rate category that matches the statutory or DTAA treatment. Keep the treaty rate and documentation together with the computation.
  5. Reconcile Indian TDS and any foreign tax information separately. Do not assume that Indian TDS equals the treaty rate or that foreign withholding automatically becomes an Indian credit.

Material foreign income, foreign assets or a treaty claim usually means ITR-1 is unavailable. Use the form that captures the required foreign-income and asset schedules, and obtain professional advice when the treaty, beneficial ownership or foreign-tax-credit rules are unclear.

Typical rate approach Applicable slab or specified statutory rate Applicable Indian rate, special statutory rate or treaty rate, depending on the facts

Form risk May fit ITR-1 if every eligibility condition is met Foreign income or assets generally exclude ITR-1

Worked filing examples

Example 1: dividend below the TDS exception threshold

An eligible resident individual receives ₹4,800 by bank transfer from one company during the financial year and no other dividend from that company. The payment is non-cash and the aggregate is within ₹5,000, so the stated section 194 exception can apply. The investor still reports the gross ₹4,800 if required to file, calculates tax under the applicable regime and pays any balance; the absence of TDS is not a tax exemption.

Example 2: TDS lower than final tax

A resident receives ₹1,00,000 and the company withholds ₹10,000. The investor has documented interest of ₹15,000 incurred to earn the dividends and no other relevant adjustment. Schedule OS shows ₹1,00,000 gross dividend, the permitted deduction is ₹15,000, and the taxable dividend component is ₹85,000. The ₹10,000 appears as a credit against the final tax computed at the investor’s applicable rate, surcharge and cess. If that computation exceeds ₹10,000, the difference is payable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Example 3: treaty-rate question for an NRI

An NRI receives an Indian-company dividend and has a tax-residency certificate from the country of residence. The investor must first determine whether the treaty article can be used, whether its conditions are met and whether the statutory rate or treaty rate is more appropriate under the facts. The dividend is then entered in the corresponding Schedule OS category, with the treaty documentation retained. A generic 10% assumption is unsafe because the correct result depends on the security, status, treaty and records.

Common mistakes and how to correct them

  • Reporting only the bank credit: replace the net amount with the gross dividend shown on the payer’s statement and claim the withholding separately.
  • Treating TDS as the final tax: complete the full computation. A 10% deduction is an advance credit, not a universal final rate.
  • Deducting every portfolio cost: remove collection commissions and similar expenses. Test interest against the 20% cap and retain evidence.
  • Using ITR-1 automatically: review resident status, the ₹50 lakh limit and every exclusion. Foreign income or assets, business income, specified capital gains, director status and certain unlisted-share holdings can require another form.
  • Ignoring quarterly validation: make the Schedule OS quarterly breakup agree with the selected dividend-rate row before submission.
  • Claiming unmatched TDS: wait for the payer’s correction or use the amount reflected in the department’s statement; an unsupported credit can lead to a demand.
  • Applying a treaty rate without proof: keep the tax-residency certificate and other treaty documents and use the DTAA-rate category only when the conditions are satisfied.
  • Mixing financial and assessment years: map each payment to the financial year in which it belongs, then choose the corresponding assessment-year utility.

Records to keep with your return

  • Company or registrar dividend warrants and corporate-action notices.
  • Broker ledger, consolidated account statement and bank credits.
  • Tax-information statement, TDS certificate and any payer correspondence correcting an entry.
  • Interest statements and a calculation demonstrating the 20% dividend-income cap.
  • For foreign dividends, source-country statements, conversion-rate records, foreign-tax evidence and treaty documents.
  • ITR utility preview, validation results, submitted return and verification acknowledgement.

These records let you explain why the gross amount, rate category, deduction and TDS credit in the return differ from the amount that arrived in your bank account.

A practical pre-submission checklist

  1. Confirm the financial year and assessment year shown by the utility.
  2. List every dividend payer and total the gross dividends by payer.
  3. Separate domestic, foreign, special-rate and potential DTAA items.
  4. Check residential status and whether foreign income or assets are present.
  5. Test ITR-1 eligibility; move to ITR-2 or ITR-3 when an exclusion applies.
  6. Enter gross dividends and the quarterly breakup in Schedule OS.
  7. Claim only documented interest within the 20% cap.
  8. Match TDS credits to the department’s statement and payer records.
  9. Review surcharge, 4% health and education cess and any special-rate calculation generated by the utility.
  10. Validate, submit, verify and preserve the acknowledgement and working papers.

The reliable rule is simple: report the gross dividend in the correct Schedule OS category, calculate the rate that matches your status and security, use only the permitted interest deduction, and treat TDS as a credit. Because ITR eligibility and treaty treatment depend on facts beyond the dividend amount, check the AY 2026–27 utility’s current guidance whenever your return includes business income, foreign items, special rates or a DTAA claim.
