Short answer: A custodial exchange gives your heirs an institution-mediated claim process, while a hardware wallet gives them no provider to petition. With self-custody, access depends on the recovery phrase, device PIN, any passphrase, and clear instructions. With an exchange, the provider verifies the estate instead: Coinbase’s published U.S. deceased-account process asks for a death certificate, probate or equivalent estate documents, government identification, and signed transfer instructions. Coinbase also says individual accounts cannot currently name a beneficiary directly.

Choose the arrangement your executor can actually complete. A hardware wallet can reduce dependence on a company, but a lost or exposed recovery phrase can permanently destroy or transfer the assets. An exchange can be easier for a nontechnical family, but heirs must satisfy the provider’s current rules and wait for review. Many owners use a documented hybrid: long-term holdings in self-custody and a smaller custodial balance for liquidity.

The core difference: who can authorize the transfer?

Crypto inheritance is an access and authority problem, not merely a matter of leaving an account number in a will. The person or institution able to authorize a transaction controls whether heirs receive anything.

Question Hardware wallet (self-custody) Custodial exchange
Who controls the signing keys? The owner, through a wallet and its recovery material. The exchange holds or controls the custody system and processes withdrawals.
How does an heir gain access? By following instructions for the device, PIN, recovery phrase, passphrase, and wallet configuration. By proving the account holder’s death and the heir or estate’s legal authority under the provider’s procedure.
Main failure mode Lost, damaged, stolen, exposed, or incomplete recovery information. Frozen account, missing estate documents, provider-policy changes, or a failed identity review.
Security model Offline signing and physical backups can reduce online attack exposure, but physical custody is the owner’s responsibility. Institutional account controls and review, balanced against dependence on the provider.
Costs Device purchase and transaction-network fees; amounts vary by device, network, and transaction. Possible custodian transaction, transfer, setup, and closure fees; amounts depend on the provider and current terms.
Estate work Technical preparation and executor training. Probate or equivalent authority, identity checks, and provider paperwork.

The U.S. Securities and Exchange Commission (SEC) explains that a private key authorizes transactions and cannot be replaced if it is lost. That makes a self-custody inheritance plan a chain of operational decisions: preserve the key, preserve the instructions, and make sure a trusted person can use them without giving an attacker the same opportunity.

How a hardware-wallet inheritance works

The device is only one part of access

A hardware wallet is generally a physical signer that keeps transaction approval away from an internet-connected computer. The SEC says this type of cold wallet is typically more secure from cyberthreats than an online wallet, but it can still be lost, damaged, or stolen. Owning the device alone does not prove that anyone can spend the assets.

Depending on the wallet setup, an heir may need the physical signer and its PIN, or the complete recovery (seed) phrase. A passphrase, multiple accounts, network-specific addresses, or other configuration details can also matter. Ledger’s inheritance guidance specifically recommends documenting where the device, PIN, and backup are stored and notes that heirs may need the device and PIN or the complete seed phrase.

The recovery phrase is the decisive backup

The recovery phrase is not a password that a manufacturer can reset. It is the backup from which wallet keys can be restored. Anyone who obtains it may be able to move the assets; anyone who loses it may be unable to recover them. Keep it off ordinary email, cloud notes, messaging apps, and a publicly filed will. A will can identify the existence of digital assets and direct the executor to a separate, protected instruction, but publishing the phrase itself creates a permanent disclosure.

What an executor must be able to do

  • Locate the device or the protected backup and understand which one is intended for recovery.
  • Know the PIN and whether a separate passphrase is required.
  • Identify the wallet application, supported networks, and accounts that hold assets.
  • Recognize the correct addresses and avoid sending funds to an address supplied by an impersonator.
  • Understand whether the plan is to transfer the assets, sell them, or move them into an estate-controlled account.

Give the executor enough information to follow the plan, but do not place the complete secret in a location that many people can access. A common approach is to separate the location of the device, the recovery backup, and the explanatory instructions, with access governed by the estate plan.

How a custodial exchange inheritance works

The provider verifies authority instead of handing over a key

In a custodial arrangement, the exchange maintains the account and controls the withdrawal process. An heir does not normally recover the account by guessing a password or presenting a device. The provider must determine that the account holder has died and that the claimant is authorized to act for the estate.

Coinbase’s published U.S. deceased-account process lists four core items: a death certificate, probate or equivalent estate documents, government identification, and signed transfer instructions. The same page says individual accounts cannot currently name a beneficiary directly. That means a family cannot assume that a named beneficiary field will bypass the estate process.

Documents to prepare

  • An official death certificate accepted by the provider.
  • Letters testamentary, probate documentation, or another document showing equivalent authority, depending on the jurisdiction and estate structure.
  • Government identification for the person submitting the claim.
  • Signed instructions that tell the provider where and how the assets should be transferred.
  • Account-identifying information, such as the account holder’s legal name and known email address, gathered without attempting unauthorized login.

Requirements, acceptable substitutes, processing times, and fees can change. Before relying on an exchange as an inheritance vehicle, check its current deceased-account page for the relevant country and account type. Substantial estates should have a lawyer or tax professional confirm which documents and transfer method fit the local probate and tax rules.

What happens after approval

Once the provider accepts the evidence, it may transfer assets to an estate account, an heir’s account, or another destination permitted by the instructions and applicable law. Keep copies of the submission, approval, transaction records, and any closing statement. These records help the executor establish the date and value of the transfer for estate administration and tax reporting.

Security and failure modes compared

Risk Hardware wallet response Custodial exchange response
Recovery phrase lost No provider can replace the private key; recovery may be impossible. Not applicable to the heir’s direct access, but the account still depends on the provider’s records and recovery controls.
Recovery phrase exposed An attacker may transfer funds without waiting for probate. Provider monitoring, authentication, and withdrawal controls may add barriers, but account credentials can still be targeted.
Device lost or damaged Restore the wallet with the protected recovery phrase on a compatible signer; the phrase and configuration must be available. Provider retains the account infrastructure, subject to its continued operation and policies.
Heir is nontechnical Requires a written, rehearsed procedure and possibly help from a trusted technical adviser. Provider staff guide the claimant through document review, although the legal paperwork remains necessary.
Provider changes policy or fails No provider approval is needed, but the owner bears all operational responsibility. Access depends on the custodian’s procedures, solvency, records, and ability to authenticate the estate.
Unauthorized claim Anyone with the signing secrets may appear authorized to the network. The provider can require evidence and signed instructions, which is why the process can take longer.

The SEC’s Crypto Task Force written submission of November 16, 2025, recommended that qualified digital-asset custodians adopt formal written succession policies covering evidentiary standards, transfer procedures, and safeguards against unauthorized claims. That recommendation describes a governance goal, not a guarantee that every custodian already follows the same standard.

Set up a hardware-wallet inheritance plan

  1. Inventory the holdings. Record each asset, network, wallet account, and approximate location. Include staking, smart-contract positions, or other arrangements that an executor might not recognize from a simple balance screen.
  2. Map the access dependencies. Write down whether the plan requires the physical signer, PIN, recovery phrase, passphrase, a particular wallet application, or more than one account. Do not put the secret phrase in the ordinary will or in an unencrypted digital note.
  3. Create protected, redundant backups. Keep the recovery material in a durable offline form and in more than one controlled location where a single burglary, fire, or loss cannot destroy every copy. Redundancy must not become broad distribution: each additional copy increases the number of places that must be secured.
  4. Write an executor playbook. Explain what to locate, what not to photograph or upload, how to identify the correct wallet, and who to contact for legal or technical help. Include a dated inventory and the location of each component without placing the secrets in an ordinary publicly filed document.
  5. Choose and train a successor. The executor should understand the sequence without being given unnecessary access before it is needed. A supervised recovery exercise on a separate test wallet can reveal missing PINs, passphrases, adapters, or software knowledge without exposing the principal holdings.
  6. Define the destination and decision authority. State whether the executor should transfer the assets in kind, sell them, or divide them among beneficiaries. Identify the estate account or exchange that may receive them and require independent verification of every destination address.
  7. Coordinate with the legal plan. Tell the estate attorney that digital assets exist and that the technical instructions are stored separately. Probate, fiduciary duties, inheritance taxes, and community-property rules differ by jurisdiction.
  8. Review after every material change. Update the inventory after buying, selling, migrating, changing a PIN, adding a passphrase, replacing a device, or moving a backup. Set a regular review date and record which version of the instructions is current.

Set up a custodial-exchange inheritance plan

  1. Confirm the account’s jurisdiction and ownership type. A personal account, business account, trust account, and joint arrangement may have different procedures. Do not assume a process published for U.S. individual accounts applies elsewhere.
  2. Read the current deceased-account procedure. Record the provider’s required death certificate format, probate or equivalent documents, identification standards, signed forms, submission channel, and any stated fees. Store a copy of the page or terms with the estate records because procedures can change.
  3. Give the executor an account locator. A legal name, account email, and institution name can help an executor identify the account without sharing a password. Never ask an executor to defeat account security or impersonate the account holder.
  4. Keep estate documents current. Make sure the will, trust, powers of attorney, and beneficiary designations use consistent names and authorities. A power of attorney generally addresses incapacity while the account holder is alive; death usually triggers a different estate process.
  5. Prepare transfer instructions. Specify whether assets should move to an estate-controlled account, be distributed in kind, or be sold. Include a verification step for destination details and require the executor to retain the provider’s confirmation.
  6. Reconcile and close deliberately. After the transfer, download transaction history and statements, document fees and valuations, and close or maintain the account according to the estate’s instructions. Keep records for tax and fiduciary reporting.

When a hybrid plan makes sense

A hybrid arrangement separates the reasons people choose each model. Long-term holdings can remain in self-custody, where no exchange approval is required, while a smaller custodial balance can provide a familiar route for an executor who is uncomfortable with recovery phrases. The two pools must be documented separately; otherwise an heir may find one account and overlook the other.

For each pool, state the asset list, access method, intended destination, and person authorized to act. Reconcile the combined inventory so that a market move or transfer does not make the written instructions misleading. A hybrid plan does not eliminate legal or tax work, and it creates two sets of security controls to maintain.

Privacy, legal, and tax safeguards

  • Keep secrets out of public filings. A probate file may be accessible to people who are not beneficiaries. Identify the existence and location of the instructions without publishing the recovery phrase, PIN, or passphrase.
  • Use jurisdiction-specific advice. Probate, fiduciary authority, marital-property rules, digital-asset statutes, and tax treatment vary. An attorney and tax professional can align the technical plan with the governing estate documents.
  • Plan for incapacity as well as death. A person may lose the ability to manage keys while still alive. Address who can act, under what evidence, and how access is revoked when authority ends.
  • Limit the number of informed people. Every person who knows a complete recovery secret is a potential point of theft or coercion. Use background-checked professional help when appropriate and document the scope of any access.
  • Preserve valuation records. Keep acquisition records, transaction history, and dates needed to establish the estate’s reporting basis. An exchange statement may be useful, but it does not replace the executor’s duty to maintain complete records.

Troubleshooting common inheritance failures

The heir has the device but it will not unlock

Do not repeatedly guess a PIN or connect the device to an unfamiliar computer. Find the written instructions and determine whether the recovery phrase or a passphrase is required. If the phrase is unavailable, the SEC’s warning applies: a lost private key cannot be replaced by a provider.

The recovery phrase is present, but the balance is missing

Check whether the phrase restores the intended wallet, whether a separate passphrase created another account, and whether the assets are on a different network or address set. Compare the written inventory with the restored accounts before moving anything. If the configuration is unclear, use a qualified specialist who can work without receiving an unrestricted copy of the secrets.

The exchange rejects the estate submission

Read the rejection reason, confirm that the death certificate and identification match the account’s legal details, and ask which probate or equivalent document is acceptable. Submit only through the provider’s official support channel. Do not send documents to an unsolicited social-media or messaging contact claiming to be support.

The family expects a beneficiary shortcut

For Coinbase individual accounts, the published process says there is currently no direct beneficiary designation. The executor should therefore prepare for the death-certificate, estate-document, identification, and signed-instruction process rather than relying on a beneficiary field.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The owner has changed wallets or exchanges

Update the inventory immediately after a migration. Mark old devices and accounts as retired only after confirming that the assets moved and that the surviving recovery information restores the current holdings. An outdated instruction can be as dangerous as no instruction.

Which option fits your family?

  • Choose primarily self-custody if you can maintain redundant, protected backups, document every access dependency, and train a trusted executor to follow the procedure.
  • Choose primarily custody if your heirs are unlikely to manage recovery material and the family prefers an institution to verify authority, while accepting paperwork, review time, provider dependence, and possible fees.
  • Choose a documented hybrid if you need self-custody for long-term control but want a smaller, familiar custodial balance for estate liquidity.

The best plan is the one that remains usable when the owner is unavailable. Test the instructions, protect the secrets, tell the legal adviser that digital assets exist, and verify the custodian’s current inheritance procedure before relying on it.
