Unsplash, Pexels and Pixabay each publish terms allowing broad free use, but their restrictions differ and none of those licenses automatically clears recognizable people, brands, logos or artwork shown in a picture.
Use the comparison below as a starting point, then open the exact image page and current license before publishing. Keep a record of the creator, source URL and applicable terms.
What “no copyright” means for a website background
Copyright normally exists as soon as an original photograph or illustration is created. A library may give you permission to download, modify and publish that work without paying a stock fee, while copyright still exists. The permission is a license, not a declaration that nobody owns rights.
Free image permission also concerns only the image license. A photograph can contain separate rights involving a person’s likeness, a company’s trademark, a logo, an artwork on a wall or a property release. The library’s terms do not necessarily grant those rights. Context matters: a neutral editorial background and an advertisement implying that a person or brand endorses your product can create very different risks.

Choosing a background from Unsplash
Unsplash is suitable when you need a photographic hero, texture or landscape and do not want to add a credit line. Its license allows free commercial and non-commercial use, but it prohibits unmodified or insignificantly modified resale. A website background is generally part of a larger design rather than a standalone resale, yet selling downloadable wallpaper or a near-identical image requires a closer review.
Unsplash’s help guidance states that its license does not include the right to use trademarks, logos, brands, recognizable people or depicted copyrighted works. Crop, blur or recolor an image for design, but do not treat those edits as a substitute for permission when the surrounding content creates an endorsement or publicity issue.
Choosing a background from Pexels
Pexels expressly describes its photos and videos as free for commercial use and says attribution is not required. Credit the photographer when practical, especially where a designer or client wants a transparent asset trail.

Do not present a pictured person as recommending your product, use a photo as your trademark, sell an unaltered copy, or upload the file to a competing stock or wallpaper service. A background embedded in your site is different from redistributing the original file as a product, but check the license if visitors can download it.
Choosing a background from Pixabay
Pixabay permits free use without attribution and allows modification under its Content License, subject to prohibited uses. Its summary is an explanation; Pixabay says the complete Content License is legally binding. Do not distribute an image on a standalone basis.
Pay special attention to recognizable trademarks, logos and brands in commercial material. For example, a photo containing a visible logo may be acceptable as incidental editorial decoration but restricted when used to sell goods or services. Check the image and the planned placement rather than assuming every Pixabay result has identical rights.
Rights checklist before publishing
- Open the asset page. Record the exact creator name, image URL, download date and license link.
- Read the current terms. Confirm commercial use, modification, attribution and redistribution rules for that service.
- Inspect the pixels. Look for recognizable people, logos, products, artwork, signage and private locations.
- Evaluate the message. Avoid a layout that implies a pictured person, company or brand endorses you.
- Check your delivery method. A CSS background or hero image is normally different from selling the original file or operating a wallpaper library.
- Preserve evidence. Save a screenshot or PDF of the asset page and terms with your project records. This is good administration, not a guaranteed legal safe harbor.
- Credit when practical. None of the three general terms requires attribution, but a linked credit can support creators and make later audits easier.

Use a dark overlay to preserve text contrast, provide a solid-color fallback, and compress a large photograph to WebP or another format supported by your browsers. Do not remove a required credit or notice when a particular asset’s terms ask for one.

Accessible content
Decorative CSS backgrounds do not receive useful alternative text. If the image conveys information, use an HTML image with meaningful alt text or provide the information in nearby text. Test keyboard focus, contrast and mobile cropping; a visually attractive background is not a reason to reduce readability.
Performance and privacy
Resize to the largest display size you actually need, use responsive image variants where appropriate, and lazy-load below-the-fold imagery. Host files over HTTPS and retain the license record even if you later replace the asset. Avoid hotlinking: it creates availability, attribution and privacy dependencies on another site.
Common mistakes and fixes
“Free” means I can sell the file
Cause: confusing free use with ownership or standalone redistribution. Fix: use the image as part of a design and verify the service’s resale restrictions before offering downloads, templates or wallpaper packs.
A logo appears in the photo
Cause: the image license covers the photographer’s work, not every trademark or brand shown. Fix: choose a clean alternative, crop or obscure incidental branding where appropriate, and obtain permission when the mark is central to a commercial message.

A person is recognizable
Cause: copyright permission is not the same as publicity or privacy permission. Fix: avoid implying endorsement and obtain the necessary release or choose an image without an identifiable person.
The image is displayed on a stock-like gallery
Cause: redistribution restrictions. Fix: do not build a competing stock, wallpaper or image-download service from these files; link users to the original library instead.
The license page changed
Cause: online terms and asset availability can change. Fix: retain the source and date in your records, recheck terms during major redesigns, and replace an asset if its current permission no longer fits.
