FRAND licensing matters when a construction product implements a communications standard covered by standard-essential patents (SEPs). A smart-building sensor, controller, gateway, machine or safety system using 5G, NB-IoT, Wi‑Fi, Bluetooth, Zigbee, Ethernet or another standardized link may rely on patented technology owned by companies outside the construction industry. FRAND means fair, reasonable and non-discriminatory; it is a licensing commitment, not a published royalty price and not proof that every declared patent is essential.

What FRAND and SEP mean in construction technology

A standard-essential patent is a patent that protects an invention necessary to implement a particular technical standard. If a product must use the patented technique to comply with that standard, avoiding the patent may be impossible without changing the standard implementation. Standard-setting organizations (SSOs) therefore commonly require participants that declare relevant patents to make licenses available on FRAND terms.

In construction, the exposure is usually indirect. The relevant patent may concern cellular radio, wireless networking, device authentication, data transport or another communications function embedded in a building sensor or industrial controller. The patent owner may be a telecommunications or semiconductor company, while the potential licensee is a component maker, building-automation supplier, system integrator or construction-equipment manufacturer.

FRAND does not automatically mean free licensing, identical pricing for every company or a license to every patent in a declared portfolio. The commitment is a framework for negotiating a license in good faith. The eventual contract determines covered patents, territory, products, payment method and other terms.

Where SEPs can arise in a connected building

Technology used in a construction product Typical role SEP question
5G or other cellular standards Wide-area connectivity for gateways, equipment telemetry, private networks and remote monitoring Which cellular SEPs are needed by the implemented release and product functions, and which supply-chain party is licensed?
NB-IoT Low-power, wide-area links for meters, sensors and distributed building devices Does the module implement the relevant cellular specifications, and does an existing module or device license cover the intended use?
Wi‑Fi Local wireless networking for controls, cameras, sensors and building-management systems Which Wi‑Fi generations and optional features are actually implemented, and are relevant portfolio or pool licenses available?
Bluetooth Short-range commissioning, occupancy sensing, access and device-to-device communication Does the product implement patented portions of the applicable Bluetooth specification or profiles?
Zigbee Low-power mesh networking for lighting, controls and sensors Which specification version and profiles are implemented, and what declarations apply in the target countries?
Ethernet and related networking Wired links between controllers, gateways, equipment and building networks Are any mandatory implemented features covered by declared patents, and at what product level should licensing occur?

A product can implement several standards at once. A gateway might use Ethernet to a building network, Wi‑Fi for local devices and cellular connectivity for a cloud service. Each standard has its own specifications, declarations and licensing practices; one license cannot be assumed to cover the others.

BIM standards are a different issue from SEP licensing

Building Information Modeling (BIM) standards primarily define information structures, properties, data dictionaries and interoperability rules. They are not automatically FRAND-encumbered merely because software or construction products use them.

ISO 23386:2020

ISO 23386:2020 establishes rules for defining and maintaining properties in interconnected data dictionaries used for BIM sharing. The ISO page records that this 2020 edition was reviewed and confirmed in 2025. The material available for this topic does not identify an SEP pool or a FRAND patent licensing program attached to ISO 23386:2020. A company should therefore treat its information-governance obligations separately from any communications-technology patent analysis.

GB/T 45393.1-2025 in China

China’s national standard GB/T 45393.1-2025 sets general requirements for BIM software. The State Administration for Market Regulation published it on 25 April 2025, and it took effect on 1 November 2025. That publication and implementation schedule does not, by itself, establish that the standard contains patented technology subject to FRAND licensing. A separate patent declaration and applicable SSO policy would be needed.

A BIM application may run on a device that also contains a Wi‑Fi or 5G module. In that case, BIM conformance and communications SEP exposure are parallel questions: the former concerns data and interoperability, while the latter concerns implementation of a technical communications standard.

Why an essentiality declaration is only a starting point

WIPO describes an SEP as a patent protecting an invention essential to implementing a particular technology standard. However, WIPO’s FRAND economics material also states: “An essentiality declaration, however, does not by itself establish that a patent is in fact essential.” A declaration is a lead for investigation, not a legal finding that the patent is valid, infringed or enforceable.

Essentiality depends on the patent claims, the exact standard version and the product’s implementation. Optional features, profiles and later releases can change the analysis. A claim may appear relevant to a standard but fail to read on a mandatory requirement, or the product may avoid the claimed feature. Patent validity, expiration, ownership and national-law differences must also be checked.

How to find and evaluate declared SEPs

  1. Define the product and markets. Identify each model, module and software release, the countries where it will be made or sold, and every communications standard and version it actually implements. Keep optional features separate from mandatory ones.
  2. Search declaration records. WIPO PATENTSCOPE marks declared SEPs from ETSI, IEEE and ITU. ETSI also maintains an IPR database and tells potential licensees to contact the declarant before relying on a declaration. Use these records to assemble candidate patents and owners, not to conclude that all listed patents are essential.
  3. Obtain the patent documents. Read the granted claims and relevant prosecution or family information in each target jurisdiction. Record priority dates, expiration, current ownership, continuations and national validations.
  4. Create a claim chart. Map every claim limitation to precise text in the applicable standard and to the corresponding function in the product, module or component. For a large portfolio, sampling can be appropriate, as WIPO notes, but the sampling method should match the purpose and be documented.
  5. Test validity and infringement. Check prior-art risks, claim construction, essentiality opinions and whether the product actually practices the mapped feature. A declaration does not answer any of these questions.
  6. Ask targeted licensing questions. Request the portfolio list, essentiality explanation, proposed royalty base, comparable licenses, pool terms and the products or supply-chain levels the licensor considers licensed. Ask how the offer treats components, modules, systems and finished products.
  7. Assess geographic coverage. A patent may be enforceable in one country, expired in another or never granted in a third. Match the license territory to manufacturing, importation, sale and use locations.
  8. Document the negotiation. Exchange specific offers and responses, preserve confidentiality and maintain a record showing good-faith engagement. Clear records help manage competition-law and injunction disputes.

Who should pay a FRAND royalty?

There is no universal rule that the finished construction product maker must pay directly. Liability and commercial practice depend on the patent, the standard policy, the jurisdiction and the supply-chain contract.

  • Component or module supplier: A cellular or Wi‑Fi module maker may hold a license covering its own sales, or it may sell without a license and require downstream licensing. Never assume the module price includes all necessary rights.
  • Equipment manufacturer: The maker of a sensor, controller, gateway, crane system or safety device may need a license for features not covered by an upstream agreement.
  • System integrator: An integrator combining modules, firmware and building-management software should verify which party is licensed for the complete implementation and territory.
  • Finished-product or brand owner: A company placing a connected product on the market can face a direct demand even when it bought a standardized module, particularly if the supplier’s license is limited.
  • Multiple licensed levels: A contract may license components, end products or both. It should state whether sales are exhausted, whether pass-through rights exist and how double charging is avoided.

Ask for written evidence of the supplier’s scope, including covered standards, versions, territories, products and sublicensing rights. If the answer is unclear, obtain an independent claim and contract review before launch.

How FRAND rates are determined

ETSI states that “Specific licensing terms and negotiations are commercial matters between the companies.” There is therefore no official construction-specific FRAND rate in the available sources, and no single posted percentage for 5G, Wi‑Fi or IoT equipment used in buildings.

Negotiators commonly examine the following evidence:

Rate factor Questions to answer
Royalty base Is the payment calculated on a component, communication module, complete device, subscription or another value? Is the base tied to the patented functionality?
Portfolio strength How many patents are in scope, in which countries, with what remaining terms and what demonstrated essentiality?
Comparable licenses Are the comparisons for the same standard, product level, territory and economic conditions? Are confidential differences understood?
Aggregate burden What would the total burden be after considering other SEP owners, pools and existing supplier licenses?
Geography and term Which national patents are live, and how does the payment change as patents expire or products enter new markets?
Product contribution How much of the product’s value comes from standardized connectivity versus sensors, software, mechanics and construction-specific functions?

“Fair” and “reasonable” do not require the same price for every licensee. A portfolio’s geographic reach, strength, licensing level, volume, cross-license position and other evidence can produce different outcomes. “Non-discriminatory” generally addresses comparable licensees; it does not erase legitimate commercial distinctions.

Patent pools: useful route, incomplete answer

A pool can simplify administration by offering one agreement for a defined group of patents and owners. Pools differ in membership, standards covered, countries, royalty structure, essentiality review and allocation. A pool for one cellular release may not include later releases, Wi‑Fi patents or every owner of relevant SEPs.

Before relying on a pool, compare its published scope with the product’s claim chart. Confirm whether the pool licenses the component or finished product, whether suppliers receive pass-through rights, and whether uncovered owners still need separate agreements. A bilateral license may be preferable when a portfolio is especially important or the pool’s territory and product definitions do not fit.

Comparison axis What to record
Standard and version Named standard, release, profiles and optional features covered.
Essentiality evidence Claim charts, independent opinions, sampling method and unresolved disputes.
Patent status Validity challenges, expiration dates, ownership and national coverage.
Royalty economics Base, unit definition, caps or floors, reporting period, currency and aggregate burden.
Supply-chain treatment Licensed level, supplier pass-through, exhaustion, sublicenses and double-payment protections.
Compliance duties Reports, audits, records, confidentiality and treatment of prototypes or free samples.
Dispute terms Governing law, forum, arbitration or mediation, security requirements and injunction provisions.

Reducing injunction and competition risk

Courts and competition authorities look closely at conduct by both sides. A potential licensee should identify the relevant standards promptly, provide enough technical information to make the issue concrete, respond to offers on a reasonable timetable and preserve a written record. A patent owner should identify the relevant portfolio and explain the offer sufficiently for the implementer to evaluate it.

Do not make blanket statements that all declared patents are invalid, or that a pool covers an entire standard without checking its terms. Keep negotiations confidential where appropriate, separate technical essentiality analysis from competitors’ sensitive pricing information, and obtain jurisdiction-specific advice before making a counteroffer or refusing a license.

WIPO’s SEP Case Law Collection described more than 100 rulings on its 2026 page, illustrating how outcomes vary by court and issue. Questions about injunctions, security, validity, damages and negotiation conduct should therefore be analyzed in the countries where patents are asserted, not generalized from one decision.

A practical decision path for a new connected construction product

Before design freeze

  • List every radio, wired protocol and standard release in the bill of materials and software architecture.
  • Ask module suppliers for license scope and indemnity language, and identify gaps before contracts are signed.
  • Decide whether the product will support optional features that create additional patent exposure.

Before pilot deployment

  • Run declaration searches and build a prioritized claim-chart sample.
  • Check live patents in each pilot and sales country.
  • Estimate the aggregate royalty burden using several plausible royalty bases rather than one untested percentage.

Before commercial launch

  • Resolve or document material licensing gaps, including pass-through rights and audit duties.
  • Confirm that the contract covers the actual product level, model range, standard versions and territories.
  • Prepare a response plan for a licensing letter: preserve evidence, acknowledge receipt, identify technical contacts and avoid admissions until the claims are reviewed.

Answers to common questions

Do I need a FRAND license for every smart-building device?

Not automatically. The need depends on the standards actually implemented, relevant patents in the countries concerned, existing supplier licenses and the product’s claim exposure. A device using only non-standardized or unpatented functions may have no SEP license requirement, while a cellular or Wi‑Fi device may have several.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Are BIM standards standard-essential patents?

No conclusion follows from BIM use alone. ISO 23386:2020 and GB/T 45393.1-2025 address BIM data or software requirements; the available material does not identify them as FRAND SEP pools. Any patent question must be tied to a specific declaration, claim and applicable SSO policy.

How can I check whether a declared SEP is truly essential?

Use WIPO PATENTSCOPE, the ETSI IPR database and relevant SSO records to find declarations, then obtain the claims and map them to the exact standard version and product implementation. Verify validity, ownership, expiration and jurisdiction. A declaration alone is not proof.

What is a fair FRAND rate for 5G, Wi‑Fi or IoT building equipment?

No authoritative construction-specific rate is published in the available sources. The figure must be negotiated from portfolio evidence, comparable licenses, royalty base, territory, product level and aggregate burden. Treat any universal percentage as a claim requiring substantial supporting evidence.
