A DeSoto County driver was cited after passing a stopped school bus, according to a WFLA report published by AOL and updated September 29, 2026. The report says she told a deputy, “I don’t have my glasses on, so I can’t see far,” and said she thought the vehicle was a construction vehicle stopping traffic. The report does not identify the exact charge or say how the case was resolved.
What the report says happened
WFLA’s report, carried by AOL, says a DeSoto County deputy stopped the driver after she passed a school bus with its lights on. The article attributes dash-camera video to a DeSoto County Sheriff’s Office post. It reports that the driver said she thought a construction vehicle was stopping traffic and told the deputy, “I don’t have my glasses on, so I can’t see far.” These are statements reported by the news article, not independently verified testimony.
The report says the driver was cited. It does not name the deputy, provide a citation number, establish which statutory subsection was cited, or report a court outcome. It also does not establish whether children were entering or exiting the bus at the moment of the pass. The sheriff’s office message, as quoted by the report, said there is “no excuse” to pass a stopped bus with children getting on and off; that statement is not a court finding about this driver’s case. What Florida law requires when a school bus stops
Under Florida Statutes §316.172, a driver approaching a school bus displaying a stop signal must come to a full stop while the bus is stopped. The driver may not pass until the bus withdraws its stop signal. The statute classifies a violation as a moving violation punishable under chapter 318.

The divided-highway exception
A driver traveling in the opposite direction may proceed only when the highway is divided by an unpaved space at least five feet wide, a raised median, or a physical barrier. This is a specific exception; an ordinary two-way road without one of those qualifying separations does not meet it.
How the statutory penalties differ
Florida’s penalty schedule distinguishes failing to stop from passing on the side where children enter and exit. The figures below are statutory amounts in the 2026 text, not reported penalties in the DeSoto County incident. Because the news report does not identify the subsection on the citation, neither amount can be assigned to that driver.
