Yes, a U.S. school can use an AI grader, but not as a compliance shortcut. When a district sends identifiable essays, grades, voice recordings, images, account IDs or behavioral information to an AI service, the arrangement may fall under both FERPA and COPPA. FERPA governs personally identifiable information (PII) in education records held by covered schools and institutions; COPPA governs commercial online services that collect personal information from children under 13. The school must document the legal pathway, keep control of the data, limit the vendor’s purposes, and preserve parent and student rights.
The analysis below applies to U.S. schools and the federal rules in effect in 2025. State student-privacy, biometric, breach-notification, disability, records-retention and procurement laws can impose additional duties.
Which law applies to an AI grading deployment?
FERPA: education records and school control
FERPA generally covers public schools, school districts and postsecondary institutions that receive applicable U.S. Department of Education funds. Private and parochial K-12 schools are generally outside FERPA unless they receive those funds. The key question is whether the information is personally identifiable information from an education record maintained by a covered institution. A student’s essay, name, student number, grade, teacher feedback, accommodation information, recorded voice, handwriting image or activity log can identify the student directly or indirectly.
FERPA gives parents the right to inspect and review education records within 45 days, request amendment of inaccurate records, and consent to disclosure of PII unless an exception applies. Those rights transfer to the student at age 18 or when the student attends a postsecondary institution. An AI-generated score or feedback may become part of the education record when the school maintains it, but federal guidance does not decide every possible fact pattern; the school should analyze how the output is stored and used.

COPPA: commercial services and children under 13
COPPA applies to commercial websites and online services directed to children under 13, and to services that have actual knowledge they collect personal information from a child under 13. A covered operator generally must give notice and obtain verifiable parental consent before collecting, using or disclosing that information, subject to narrow exceptions. Personal information can include names and persistent identifiers as well as photos, audio, geolocation, online contact details and other data that identify a child.
An AI tool can trigger both laws at once: FERPA because a school discloses identifiable education-record data, and COPPA because a commercial service receives information from children below the age threshold. Meeting one law does not eliminate the other.
Can a district rely on FERPA’s school-official exception?
Four conditions must be met
The school-official exception can permit disclosure without separate parental consent, but it is conditional. The Department of Education’s Student Privacy Policy Office says an application or service collecting PII under this exception must:

- Provide a service or function the school would otherwise use its own staff to perform.
- Remain under the school’s direct control regarding the use and maintenance of the PII.
- Use the information consistently with the school or district’s annual FERPA rights notice.
- Not redisclose or use education data for unauthorized purposes.
AI-assisted essay scoring can fit the first condition when it performs an established instructional or assessment function. A vendor’s general-purpose model improvement, advertising, consumer profiling or resale normally is not a function the school would otherwise have its staff perform. The district therefore needs a contract and technical configuration that preserve its control and restrict every secondary use.
What “direct control” means in practice
Direct control is more than a promise that the vendor has a privacy policy. The district should decide which fields are sent, who can view prompts and outputs, how long records remain available, whether subcontractors may process them, and what happens when the agreement ends. It should be able to investigate an incident, require correction or deletion, and stop a new use that was not approved. If the vendor can unilaterally change training, advertising, retention or sharing terms, the school may no longer have meaningful control.
When written consent is safer
If the service does not clearly satisfy the school-official conditions, obtain FERPA consent from the parent or eligible student before disclosure. Consent should identify the records, purpose, recipient and duration. A consent form cannot cure an arrangement that violates other laws or a vendor’s unrelated commercial use, so the contract and product settings still need restrictions.

Why the FERPA “study” exception usually does not fit routine grading
FERPA has a separate exception for a genuine study. The permitted purposes are developing, validating or administering predictive tests; administering student aid programs; or improving instruction. A written agreement must specify the purpose, the information that may be disclosed, how it may be used, and when it will be destroyed. A district should not label ordinary outsourced grading as a “study” simply to avoid consent. If a vendor is evaluating a new scoring model, document the instructional-improvement purpose and destruction terms; otherwise use the school-official pathway or consent.

School-as-parent-agent is narrow
A school may consent on a parent’s behalf only when the operator collects the child’s information for the use and benefit of the school and for no other commercial purpose. The operator must give the school direct notice of its data practices. On request, it must support the school’s ability to review the information and obtain deletion. Schools should arrange deletion when the educational purpose ends.
School consent does not authorize targeted advertising, unrelated product development, sale of data, behavioral profiling or other commercial uses. If the operator wants those uses, it needs a separate lawful basis, including the required verifiable parental opt-in where COPPA requires one.

Parent controls that must work
COPPA gives parents rights to access their child’s information, request deletion, and stop further use or collection. Operators must use reasonable security, retain information only as long as necessary for the specific purpose, and not make participation conditional on collecting information that is unnecessary for the activity. The school’s procurement and technical teams should test these controls instead of relying on a vendor’s marketing description.
What changed in 2025?
The Federal Trade Commission announced amendments in January 2025; the final-rule notice is dated April 22, 2025. The amendments require separate verifiable parental opt-in for targeted advertising and certain disclosures to third parties, limit retention to what is reasonably necessary for a specific purpose, and expand the definition of personal information to include biometric and government-issued identifiers. Voiceprints, face images used for recognition and other biometric features therefore deserve explicit review even when a tool is marketed as an assessment product.
What should be inventoried before approving an AI grader?
- Map every input and output. List essays, handwritten pages, photographs, voice, names, student IDs, grades, accommodations, prompts, feedback, timestamps, device data, logs and inferred profiles. Record whether a human sees each item and where it is stored.
- Classify the population and records. Determine which items are education-record PII, which students are under 13, whether the service is directed to children, and whether the operator has actual knowledge of a child’s age.
- Choose the legal pathway. Document the FERPA school-official exception, written consent or qualifying study agreement. For under-13 users, document why school consent is valid or obtain verifiable parental consent.
- Approve the vendor and contract. Review the privacy policy, model-training terms, subprocessors, data locations, advertising and profiling practices, retention schedule, deletion process, security controls and parent-access mechanism.
- Configure minimization and oversight. Use pseudonymous identifiers where possible, send only fields needed for scoring, set automatic deletion, enforce role-based access, retain audit logs, require human review of consequential decisions and provide a way to correct inaccurate AI records.
- Notify families and staff. Explain the service, data elements, educational purpose, retention period, vendor role and procedures for access, deletion and correction. Train teachers not to paste unrelated student information into an unapproved tool.
- Reassess material changes. Repeat the review when the vendor changes its model, terms, subprocessors, storage location, age audience or commercial uses.

Security and data-minimization design for classroom use
Send less data
Remove names, email addresses and student numbers before scoring when the service does not need them. Use a district-controlled pseudonymous ID and keep the re-identification key inside the school environment. Crop unrelated faces from handwriting images, disable microphone or camera access when it is not required, and avoid transmitting disability or health details unless they are essential to an approved accommodation workflow.
Limit access and preserve evidence
Separate teacher, administrator, vendor-support and student permissions. Log uploads, views, exports, model changes and deletions. Keep an immutable record of the rubric version and human decision when an AI result affects a grade, placement or discipline. FERPA does not prescribe a particular technical standard, but the Department of Education warns that breaches can cause serious harm; least privilege, due diligence, monitoring and deletion are prudent safeguards.
Build a correction and appeal process
An AI score can be wrong because of handwriting recognition, language variety, disability-related expression, prompt mismatch or a model error. Teachers should be able to override a result, record the reason and prevent an erroneous output from silently propagating. Families need a clear route to inspect the underlying record and request amendment under FERPA, or access and deletion under COPPA where applicable.

Common failure modes and how to fix them
- “The vendor is educational, so it is automatically compliant.” Fix: verify the four school-official conditions, the exact data flow and the contract’s secondary-use bans.
- “A district consent covers any future product use.” Fix: limit consent to a named educational purpose and obtain a new basis for materially different uses.
- “De-identification is assumed because the model sees only an essay.” Fix: check metadata, writing style, embedded names, account identifiers, voice and image content that can re-identify a student.
- “School COPPA consent permits advertising.” Fix: separate educational processing from advertising and other disclosures; obtain the required parental opt-in or disable those features.
- “Deletion means removing the dashboard entry.” Fix: require deletion from active systems, backups, analytics stores, model-training sets and subprocessors, with confirmation.
- “The score is objective because software produced it.” Fix: retain human review, document limitations, test for disparate error patterns and provide an appeal.
- “Federal approval replaces state review.” Fix: have counsel check state student-record, biometric, breach, disability, retention and procurement rules for every jurisdiction involved.
Questions federal guidance does not settle automatically
Federal agencies have not issued a universal rule classifying every AI-generated score as an education record. Nor is it settled in every situation that a vendor’s machine-learning improvement is compatible with the FERPA school-official exception. The answer depends on the data, contract, model-training design, age group, storage and actual use. A district should obtain fact-specific legal and privacy review before deployment, especially when biometric data, special-education information or high-stakes decisions are involved.
Bottom line
A school may use AI to assist grading when it treats the service as a controlled education-record disclosure, not as a free consumer app. Keep the district in charge of purpose, fields, access, retention and deletion; use the FERPA exception only when all conditions are met; limit COPPA school consent to the school’s educational benefit; and give families workable access, correction and deletion rights. The 2025 COPPA changes make targeted-advertising opt-in, purpose-based retention and biometric identifiers important checkpoints in every vendor review.
