Short answer: An EU data-centre address is only one part of cloud sovereignty. A defensible purchase decision checks jurisdiction, ownership, administrator access, operations, supply-chain dependencies, technical portability, security and sustainability for the exact service you will use. Score each dimension, verify certification scope, test support-access controls and model the cost of leaving before you sign.
Start with a sovereignty scorecard
Use the following six axes for every shortlisted service. Score each from 0 (no evidence), 1 (partial evidence) to 2 (contractual, independently verified evidence). Keep the evidence beside the score: a marketing statement is not equivalent to a certificate, audit report or contract clause.
| Axis | Questions for the provider | Evidence to request |
|---|---|---|
| Data and region sovereignty | Where are primary data, replicas, backups, logs and telemetry processed? Can support staff or subprocessors access them? | Service-specific region map, data-flow diagram, backup policy and subprocessor list |
| Legal and ownership control | Which legal entities own and operate the service? What foreign-parent, compelled-disclosure or jurisdictional exposure exists? | Corporate structure, governing-law clause, disclosure process and transparency reporting |
| Technical autonomy | Can you move identity, encryption keys, orchestration, APIs and recovery procedures to another operator? | Open-interface documentation, export samples, key-management design and recovery runbook |
| Certification evidence | Which exact service, region, operator and facilities are covered, and when does each attestation expire? | Certificate or attestation, scope statement, version, issuing body and validity dates |
| Support and operations | Where are support personnel located? Who can enter production? What are response, escalation, maintenance and audit arrangements? | Support operating model, privileged-access logs, SLA, incident process and audit rights |
| Exit and resilience | What are current egress and switching charges, export limits, transfer times, conversion work and deletion requirements? | Tariff, export test, migration estimate, deletion certificate procedure and restore exercise |
Set a minimum score for regulated workloads rather than averaging away a critical failure. For example, a service with excellent encryption but no credible administrator-access controls should not pass a sovereignty gate.
What “sovereign cloud” means in Europe
Sovereignty is control over the full service, not simply the postcode of a data centre. The European Commission’s Cloud Sovereignty Framework, published 1 June 2026, evaluates 48 criteria in eight categories: data sovereignty, legal and ownership control, operational control, technological autonomy, security, supply-chain control, sustainability and related assurance factors. It expresses results as Sovereignty Effectiveness Assurance Levels (SEAL) from SEAL-0 through SEAL-4.
#1 Best Overall

The framework distinguishes a data-sovereignty outcome from technological autonomy and from full sovereignty. A provider may keep customer files in the EU while relying on a non-EU parent, foreign administrators, proprietary control-plane software or an external identity service. Those dependencies can matter more than the location of the storage disks for a public-sector, defence, health or critical-infrastructure workload.
Jurisdiction is not the same as geography
EU rules generally permit storage and processing anywhere in the EU, subject to sector-specific requirements and exceptions. “Hosted in Europe” therefore does not, by itself, answer whether a foreign government could compel a parent company, whether support personnel can view production data, or whether backups and telemetry leave the selected region.
Ask which entity signs your contract, which law governs it, where that entity and its parent companies are incorporated, and how a disclosure request is handled. Require notice, challenge and minimisation procedures where legally possible. Treat a provider’s statement that it is “European” as a starting point for due diligence, not a conclusion.
Operational and supply-chain control
Cloud sovereignty includes the people and suppliers who keep the platform running. A European facility can still depend on non-European hardware, firmware, software updates, managed security tools, payment systems or remote maintenance. Request a material-subprocessor register, change-notification period and a description of emergency access. For high-assurance workloads, require approval or termination rights for material changes.

Verify the exact region and control plane
Cloud region labels are not enough. Build a service-by-service worksheet before comparing prices.
| Component | Record for each service |
|---|---|
| Primary data | Physical country and facility; available availability zones; encryption at rest |
| Replicas and backups | Automatic replication destinations, retention, disaster-recovery region and provider-managed snapshots |
| Control plane | Where API endpoints, metadata, IAM, billing and orchestration run; whether a global control plane is mandatory |
| Logs and telemetry | Audit logs, diagnostic traces, support bundles and monitoring data; retention and export location |
| Support access | Staff location, approval workflow, session recording, break-glass procedure and customer notification |
| Subprocessors | Names, countries, function, access level and change-notification process |
| Deletion | Cryptographic erasure, media sanitisation, backup expiry and certificate of deletion |
Questions that expose a misleading region claim
- Does selecting an EU region force all backups, snapshots and managed-service metadata to remain there?
- Are identity, key management, container registries, DNS, content delivery or threat-detection services global dependencies?
- Can a support engineer outside the EU access a console, ticket attachment, log stream or encrypted snapshot?
- What happens during a regional outage: is failover automatic, and to which country?
- Can you disable cross-region replication and still receive the contracted service level?
Document the answers in the contract or an incorporated data-processing schedule. A dashboard setting that can change without notice is weaker evidence than a binding location and access commitment.
How to interpret European cloud certifications
Certifications are scoped evidence, not interchangeable sovereignty badges. Gaia-X’s 2024 compliance document references SecNumCloud 3.2.a in France, BSI C5:2020 in Germany, ISO/IEC 27001:2022 and the EU Cloud Code of Conduct. Each addresses a defined control set and assessment method; none automatically proves that every product, region or support process is sovereign.
Recommended Free Tools
| Scheme | What it can evidence | What it does not establish by itself |
|---|---|---|
| SecNumCloud 3.2.a | French high-assurance requirements for an in-scope cloud service and operator | Coverage of other products, regions, parent entities or your specific configuration |
| BSI C5:2020 | A catalogue of minimum requirements for secure cloud computing, assessed for professional providers, auditors and customers | EU-only ownership, immunity from foreign law or portability of your workload |
| ISO/IEC 27001:2022 | An information-security management system within a stated organisational and control scope | Data residency, sovereign ownership, product-level isolation or no administrator access |
| EU Cloud Code of Conduct | Declared compliance commitments for covered cloud services | Independent proof of every sovereignty criterion or a guarantee of technical autonomy |
Certification-scope checklist
- Obtain the certificate or attestation PDF, not a logo.
- Check the legal operator named on it against your contracting entity.
- Read the scope: product, service tier, region, facilities, support operations and exclusions.
- Record the scheme version (for example, SecNumCloud 3.2.a or BSI C5:2020), issuing body and validity dates.
- Ask how subcontractors, control-plane services and disaster-recovery sites are treated.
- Set a renewal and withdrawal-monitoring date in your vendor-management calendar.
If a provider offers a certified virtual machine service but your workload also uses an uncertified managed database, the combined architecture is not automatically covered. Map every component and record compensating controls for gaps.

Use assurance levels without turning them into a ranking
The Commission framework’s SEAL-0 to SEAL-4 scale is intended to show increasing effectiveness of sovereignty controls. The Commission’s Cloud and AI Development Act materials describe four cloud and AI sovereignty assurance levels; level 4 requires full transparency and control over the software supply chain and no third-country interference. A level or label is meaningful only when you know which service and criteria were assessed.
Ask the provider for the assessment date, covered criteria, unresolved findings and change-control process. Do not treat a higher advertised level as proof that a service meets your sector’s legal obligations; use it as one input to your risk assessment and contract requirements.
Make support part of the sovereignty decision
Support can create the same exposure as storage. A ticket may include database dumps, credentials, stack traces or customer-identifying information. An engineer with production privileges can bypass a regional boundary unless access is tightly controlled.

- In which countries are first-line, specialist and emergency support teams located?
- Which roles can view plaintext data, keys, logs or console sessions?
- Is customer approval required for privileged access, and can you deny it outside an emergency?
- Are sessions time-limited, recorded, independently reviewed and included in audit exports?
- Who owns escalation during a security incident, and where is that team based?
- What are response and restoration targets by severity, time zone and language?
- How are maintenance windows, emergency changes and subcontractor access notified?
- Can your auditors inspect access records and test the incident process?
Compare support models on measurable terms: 24/7 versus business-hours coverage, first-response and workaround targets, named escalation ownership, communication cadence, and the remedies available when targets are missed. A low price with opaque support access can increase both sovereignty risk and outage cost.

Model the real cost of leaving
Egress is only one line in an exit budget. Include data extraction, format conversion, replacement of proprietary managed services, licence changes, parallel operation, testing, retraining, transfer time and temporary capacity. Estimate each workload separately; a stateless web tier and a tightly coupled analytics platform have very different migration profiles.
| Cost category | How to estimate it |
|---|---|
| Provider charges | Current egress, API extraction, snapshot and switching tariffs; include minimums and support fees |
| Transfer capacity | Data volume divided by achievable encrypted throughput, plus throttling, retries and a cutover window |
| Format conversion | Engineering hours for proprietary databases, queues, functions, machine images and observability formats |
| Re-platforming | Replacement of provider-specific IAM, networking, autoscaling, key management and managed services |
| Parallel running | Overlapping compute, storage, licences, connectivity and staff during rehearsal and rollback |
| Validation and testing | Performance, security, reconciliation, backup-restore and user-acceptance testing |
| People and training | Migration engineers, application owners, operators, auditors and new-platform training |
| Decommissioning | Final export, retention, secure deletion, certificates and contract close-out |
A practical exit-cost formula
Total exit budget = provider charges + transfer capacity + conversion + re-platforming + parallel operation + testing + people/training + decommissioning contingency. Add a contingency for an unplanned move and a separate amount for temporary capacity if the destination must be provisioned before the source is retired.
Run a pilot export before procurement approval. Measure usable throughput, completeness, metadata preservation, restore time and the effort to recreate permissions. Repeat the test after major architecture changes. An export promise that has never been exercised is an assumption, not resilience.
What the EU Data Act changes
The Data Act entered into force on 11 January 2024. During its first three years, providers may charge costs incurred for switching and data egress, but those charges are limited to the costs incurred. EU guidance says customers must be able to switch, receive data in a common machine-readable format and obtain materially comparable outcomes for shared IaaS features.
Best Value

The European Commission states that “The Data Act will also entirely remove switching charges, including charges for data egress (i.e. charges for data transit), from 12 January 2027.” Removal of a fee does not remove engineering work, downtime, conversion or destination capacity, so retain those items in your business case. Ask the provider to identify which charges are cost-based during the transition period and to state the calculation method in the contract.
Procurement signals and market diversification
On 17 April 2026, the European Commission announced a sovereign-cloud procurement worth up to EUR 180 million over six years. It selected multiple providers to diversify supply and improve resilience. The announcement named a Luxembourgish-French partnership led by Post Telecom with OVHcloud and CleverCloud, and Germany’s STACKIT.
These awards are dated procurement signals, not a universal ranking or proof that every listed service fits your workload. Use them as investigation leads, then verify current region availability, certification scope, support location, contractual terms and exit performance for the specific product you would buy. Public procurement selection does not replace your own threat model or sector compliance review.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesA buying process that produces defensible evidence
- Classify the workload. Identify personal, health, financial, classified or operationally sensitive data; recovery objectives; and countries in which processing is legally permitted.
- Draw the data-flow map. Include primary data, replicas, backups, logs, telemetry, control plane, identity, keys, support channels and subprocessors.
- Set non-negotiable gates. Define acceptable jurisdictions, administrator locations, certification schemes, audit rights, incident notice and portability requirements.
- Issue an evidence-based questionnaire. Require scope documents, subprocessor details, access controls, tariffs, export formats and sample contracts rather than yes/no marketing answers.
- Score and test. Apply the six-axis scorecard, run a support-access exercise and perform a representative export and restore.
- Negotiate protections. Put region restrictions, privileged-access approval, change notice, audit rights, deletion evidence, assistance and exit pricing into enforceable schedules.
- Reassess continuously. Track certificate expiry, ownership changes, new subprocessors, control-plane changes, legal developments and annual exit-test results.
Common failure modes
- “EU region” treated as a complete sovereignty claim: global metadata, support or backups may still cross borders.
- Logo-based certification checks: the logo may cover a different service, operator or expired version.
- Support omitted from the threat model: tickets and emergency access can expose production data.
- Egress-only exit budgets: re-platforming, parallel operation and testing usually dominate engineering effort.
- Single-provider resilience: a second region in the same control plane may not provide operational independence.
- Uncontracted promises: a portal setting or sales email may not survive an ownership, subprocessor or product change.
Questions to ask before signature
- Can the provider attach a current region-and-control-plane diagram to the contract?
- Will it notify you before changing a subprocessor, operating entity, administrator location or certified scope?
- Can you approve, deny and audit privileged production access?
- What machine-readable formats, interfaces and assistance are included in a switch?
- Which charges remain before 12 January 2027, how are they calculated, and what happens afterward?
- Can you obtain a deletion certificate covering replicas, backups and support copies?
Frequently Asked Questions
Does a sovereign cloud have to be operated by an EU-owned company?
Not necessarily. Ownership and foreign-jurisdiction exposure are separate criteria in a sovereignty assessment. Require evidence about the contracting entity, parent structure, compelled-disclosure process and operational control, then apply the requirements of your sector and risk model.
Is a multi-cloud design automatically more sovereign?
No. Two providers can share the same foreign control-plane dependency, support subprocessors or proprietary interface. Independence improves only when you test portable data and identity, maintain recovery procedures and contract genuinely separate operators and regions.
How often should a sovereignty assessment be repeated?
Repeat it at least on certificate renewal and annually, and trigger an additional review after an ownership change, new subprocessor, region change, major control-plane release or serious incident.
What should a small organisation do if it cannot negotiate custom cloud contracts?
Use the same worksheet and scorecard, prefer services with published scope documents and export tools, minimise sensitive data, enable customer-controlled keys where practical, and maintain a tested export and restore procedure. Document residual risks for management approval.
