AI agents are not a separate legal category under the EU AI Act. An agent is assessed as an AI system, and often alongside the general-purpose AI (GPAI) model it uses. Its intended purpose, autonomy, tools, deployment setting and effect on people determine whether it is prohibited, high-risk, subject to transparency duties, or generally minimal-risk.
A customer-service agent that drafts replies is treated very differently from an agent that ranks job applicants, approves credit, controls safety equipment or predicts criminal behaviour. The same underlying model can therefore fall under different obligations in different deployments.
What the EU AI Act means by an “AI agent”
The Act does not define “AI agent” as its own risk class. The European Commission’s AI Act Service Desk explains that the definitions of an AI system in Article 3(1) and a GPAI model in Article 3(63) are broad enough to cover agents. In practice, regulators look through the marketing label and examine what the system does.

Classification should be based on the provider’s documented intended purpose, not on whether the product is called an assistant, copilot, autonomous workflow or agent. The organization deploying it must also consider the real use, affected people, level of human control and applicable date.
The four practical EU AI Act risk levels
1. Prohibited (unacceptable) risk
Article 5 bans specific AI practices. A general-purpose or agentic system is not automatically prohibited; the concrete purpose and conduct must match a listed prohibition.
- Harmful subliminal techniques or manipulative or deceptive methods that materially distort a person’s behaviour and cause, or are likely to cause, significant harm.
- Exploiting vulnerabilities linked to age, disability or a specific social or economic situation to produce significant harm.
- Certain social-scoring practices that evaluate people over time and lead to unjustified or disproportionate treatment.
- Profiling-only systems that predict whether an individual will commit a crime, except where the prediction is based on a human assessment of already verified, objective facts directly linked to criminal activity.
- Untargeted scraping of facial images from the internet or CCTV to build or expand facial-recognition databases.
- Most emotion-inference systems used in workplaces or schools, subject to the Act’s narrow exceptions.
- Restricted uses of real-time remote biometric identification in publicly accessible spaces for law enforcement, with limited exceptions and safeguards.
Two additional Article 5 prohibitions concerning specified non-consensual intimate material and child sexual-abuse material apply from 2 December 2026. Because the exact legal conditions and exceptions matter, an agent that handles image, video or biometric content needs a use-case-specific review rather than a generic “it is only a chatbot” conclusion.

| Route | When it applies | Typical agent example |
|---|---|---|
| Annex I product or safety component | The AI system is a product, or a safety component of a product, covered by Union harmonisation legislation listed in Annex I, and that product must undergo a third-party conformity assessment. | An agent that is part of a regulated medical, machinery or other safety-critical product, where the relevant product law requires external assessment. |
| Annex III intended use | The intended use falls within a sensitive area listed in Annex III, such as employment, education, essential services, law enforcement, migration, democratic processes or safety-critical infrastructure. | An agent that ranks applicants, evaluates students, supports benefits eligibility or assists law-enforcement decisions. |
Some Annex III systems can be excluded by Article 6 filters when they perform a narrow procedural, preparatory or limited-support function and do not materially influence a decision. The provider must document that assessment. Profiling of natural persons keeps an Annex III system high-risk, so an organization cannot rely on a procedural exception when the system profiles people.
High-risk status is about the intended use and the rights or safety at stake, not how autonomous the interface appears. A mostly automated agent can be high-risk, but an agent with a human approval button is not automatically outside the category.
3. Limited or transparency risk
Article 50 imposes transparency duties on certain interactions and generated or manipulated content, even when a system is not high-risk. For agents intended to interact directly with natural persons, people generally must be told that they are interacting with AI, unless that is obvious from the circumstances and context.
Systems that generate or manipulate text, audio, images or video may have to disclose that the content was artificially generated or manipulated. Synthetic audio, image and video outputs require machine-readable marking or equivalent technical disclosure in the situations covered by Article 50. Deployers of certain deepfake or public-interest content also have disclosure duties.

The general Article 50 transparency milestone is 2 August 2026. Providers of systems already placed on the market before that date have a limited transition for the Article 50(2) marking and detection obligation until 2 December 2026. The transition does not turn every transparency duty into a blanket exemption, so the exact paragraph and system status must be checked.
4. Minimal or no risk
Systems that do not meet an Article 5 prohibition, an Article 6 high-risk route or an Article 50 transparency trigger generally have no mandatory AI Act controls specific to their risk level. Spam filters, many entertainment tools and ordinary recommendation features often fall here. Providers can still adopt voluntary codes of conduct, and other laws—such as privacy, consumer-protection, employment or product-safety law—may apply.
How to classify an agent: a practical procedure
- Describe the system and its boundaries. Record the model, prompts, memory, connected tools, data sources, action permissions, human checkpoints and target users. Separate the model provider, the agent provider and the organization deploying it.
- Write the intended purpose in operational terms. “AI assistant” is too vague. State whether the agent drafts text, recommends an option, makes a decision, executes a transaction, controls equipment or profiles an individual.
- Check Article 5 first. Test manipulation, exploitation of vulnerabilities, social scoring, criminal-risk prediction, facial-image scraping, workplace or school emotion inference, biometric identification and the additional prohibitions that apply from 2 December 2026. A system cannot be made lawful by relabelling a prohibited use as “high-risk.”
- Test the Annex I route. Determine whether the agent is itself a regulated product or a safety component of one, and whether the product requires third-party conformity assessment under the listed Union legislation.
- Test every Annex III use case. Consider employment, education and vocational training, essential private or public services, law enforcement, migration and border control, administration of justice, democratic processes, critical infrastructure and other listed areas. Assess the real deployment, not merely the sector in which the customer operates.
- Apply Article 6 filters carefully. If relying on a procedural or preparatory exception, document why the system cannot materially influence the outcome and why it does not profile natural persons. Keep the evidence with the technical and compliance records.
- Check Article 50 separately. An agent can be minimal-risk yet still need an AI-interaction notice or content marking. Review whether it talks directly to people, generates synthetic content or manipulates existing content.
- Map the dates and geography. Record when the system was placed on the EU market or put into service, whether it is an existing system, and which obligations have started. Recheck the current Commission Service Desk and consolidated legal text before relying on a deadline.
What providers and deployers must do when an agent is high-risk
High-risk obligations are split between the provider that develops or places the system on the market and the deployer that uses it in an organization.
| Provider responsibilities | Deployer responsibilities |
|---|---|
| Operate a quality-management system. | Use the system according to the provider’s instructions and intended purpose. |
| Prepare and maintain technical documentation and automatically generated logs. | Assign competent human oversight and ensure staff understand the system’s limits. |
| Complete the required conformity assessment before placing the system on the market or putting it into service. | Monitor operation, investigate anomalies and manage the quality of input data. |
| Issue an EU declaration of conformity and affix the required marking; register the system where the Act requires registration. | Keep logs for at least six months, unless another law or the provider’s instructions require longer retention. |
| Meet accuracy, robustness, cybersecurity, risk-management and accessibility requirements applicable to the system. | Report serious risks or incidents and suspend or correct use when the system presents a relevant danger. |
| Provide information needed for downstream users, including instructions, limitations and oversight measures. | When the system makes or assists decisions about natural persons, inform those persons that a high-risk AI system is being used, subject to the Act’s conditions. |
Organizations can have more than one legal role. A company that fine-tunes a model, packages it as an agent and deploys it internally may be both a provider and a deployer for different activities. Contracts should allocate documentation, monitoring, incident reporting and change-management duties rather than assuming the software vendor carries everything.

The GPAI model layer is separate from the agent layer
Many agents rely on a general-purpose AI model supplied by another organization. The GPAI chapter can impose duties on that model provider independently of the downstream agent’s classification. Model obligations began applying on 2 August 2025.
For GPAI models with systemic risk, the Commission’s FAQ notes that autonomous capabilities and agentic use are relevant to risk management. A model provider therefore needs to consider how the model can be used in autonomous workflows, while the downstream agent provider must assess the complete system, tools, permissions and intended purpose.
Do not treat a model’s “safe” or “general-purpose” label as a classification certificate for an agent. Maintain a two-layer map: first document the model provider’s GPAI status and information, then assess the assembled agent and its deployment. Changes to the model, tools or autonomy can change the downstream assessment.

| 2 December 2027 | Standalone Annex III high-risk rules apply under the current implementation schedule. | Agents used in listed sensitive areas need the high-risk compliance framework unless a valid, documented exclusion applies. |
| 2 August 2028 | High-risk rules for AI embedded in regulated Annex I products apply. | Providers of agents that are components of covered products must meet the product-related high-risk requirements by this date under the current schedule. |
These dates can change as amendments and implementation measures develop. Treat the schedule as a planning baseline, not a permanent legal guarantee. Verify the current date and transitional wording in the European Commission AI Act Service Desk and consolidated legal text before publishing a compliance statement or launching a regulated deployment.

How to compare two AI agents
Feature lists and claims of “autonomy” are poor substitutes for a legal comparison. Assess both systems against the same questions:
- Purpose and affected rights: Does either agent decide or materially influence hiring, credit, education, benefits, healthcare access, law enforcement, migration, voting or another rights-sensitive outcome?
- Autonomy and tools: Can it only draft and recommend, or can it execute payments, alter records, contact third parties, control machinery or take irreversible action?
- Regulatory route: Is either system part of an Annex I product or used for an Annex III purpose?
- Profiling: Does it infer or rank characteristics of identifiable people? Profiling can prevent reliance on an Annex III exception.
- Transparency: Does it identify itself as AI and mark generated or manipulated content where Article 50 requires it?
- Oversight and records: Are there trained reviewers, usable logs, escalation paths, retention controls and incident reporting?
- Model dependency: What GPAI model is underneath, and does that model have systemic-risk obligations?
- Date and location: When was each system placed on the EU market or put into service, and is the relevant deployment in the Act’s territorial scope?
Common mistakes and how to avoid them
“It is only an agent, so the Act does not apply.”
The label is irrelevant. Document the technical system and intended purpose, then run the Article 5, Article 6 and Article 50 checks.
“A human clicks approve, so it cannot be high-risk.”
Human approval does not remove high-risk status when the agent materially influences a listed decision or profiles natural persons. Oversight is a control requirement, not an automatic exemption.
“High-risk is the only category that requires work.”
Transparency obligations can apply to a non-high-risk customer-facing agent or content-generation tool. Check Article 50 independently.
“The model vendor’s compliance covers our workflow.”
GPAI-model obligations and downstream agent obligations are different layers. Obtain the vendor’s documentation, but assess your own tools, data, permissions and use case.
“The 2026 date is the only deadline.”
The Act is phased through 2028, with earlier prohibitions and GPAI obligations already applying. Keep a dated compliance register and update it when Commission guidance or the consolidated text changes.
