The safest enterprise AI purchase is not the vendor with the longest certification list. It is the architecture whose service scope, data flows, processing regions, contracts and customer controls match your workload. A SOC 2 report or ISO certificate covers only the systems and period named in its scope. Storage residency does not guarantee in-region inference, logging or support access. Before signing, require evidence for the exact product and region, map every subprocessor and processing purpose, and pilot with synthetic or redacted data.

  • Certification: verify the service boundary, audit period, certificate validity and customer responsibilities.
  • Residency: distinguish storage at rest from GPU inference, routing, metadata, logs and support access.
  • Jurisdiction: review the contracting entity, governing law, subprocessors, transfer mechanisms and government-access exposure.
  • Architecture: compare provider SaaS, regional API projects, hyperscaler-hosted models and dedicated or self-hosted deployments feature by feature.

Start with the control your data actually needs

Classify the information an AI workload will handle before comparing platforms. Personal data, health information, payment data, export-controlled material, trade secrets and public text have different legal and operational limits. Record prohibited destinations, maximum retention, encryption requirements, recovery objectives and whether humans may view prompts or outputs.

Then turn those requirements into pass/fail controls. A requirement such as “data must stay in Europe” is incomplete unless it says whether that means storage, inference, network termination, telemetry, backups, support access or all of them. Procurement should test each layer separately.

The nine residency and control questions

  1. In which country or region is customer content stored at rest, including backups?
  2. Where do GPUs execute prompts, files and generated outputs?
  3. Where are requests routed and where is TLS terminated?
  4. Where are system metadata, audit logs, abuse signals and billing records stored?
  5. Which subprocessors can access content, and from which countries?
  6. Can support, trust-and-safety or incident teams view content?
  7. Are customer-managed keys, external key management or dedicated keys available?
  8. What retention, deletion and zero-data-retention choices apply to this endpoint and plan?
  9. Which features are unavailable or processed elsewhere in the selected region?

What the major certifications do—and do not—prove

Certifications and assurance reports are evidence about a defined management system or service boundary. They are not a blanket declaration that every model, endpoint, deployment, customer configuration or output is compliant.

Evidence What it can demonstrate What to verify before relying on it
SOC 2 Type 2 Operating effectiveness of controls against the trust-service criteria during a stated examination period. Request the report period, criteria covered, exceptions, complementary user-entity controls and exact systems and products in scope.
ISO/IEC 27001:2022 An independently certified information-security management system. Check the certificate scope, issuing body, validity dates and whether the AI service and processing environment are inside that scope.
ISO/IEC 27701:2019 Privacy-information-management practices associated with defined controller or processor activities. Read the data-processing agreement, controller/processor allocation and data-subject-rights process; the certificate does not replace those terms.
ISO/IEC 42001:2023 An AI-management-system framework covering governance processes. It does not certify a particular model’s outputs, accuracy, safety or every customer deployment.
CSA STAR, FedRAMP, HIPAA/HITRUST or PCI DSS Additional assurance or regulatory alignment for specified services and environments. Match the authorization or attestation to the exact service, region, workload, edition and customer obligations.
GDPR references Information about privacy roles, safeguards and regulatory support. Confirm lawful basis, transfer mechanism, retention, rights handling and where processing actually occurs.

OpenAI assurance scope

OpenAI documentation dated 2026 states that it has undergone a SOC 2 Type 2 examination and maintains ISO/IEC 27001:2022 and ISO/IEC 27701:2019 certifications for specified API and ChatGPT business services. Its documentation also identifies ISO/IEC 42001:2023 for its AI management system. “Specified” is the operative word: obtain the current report or certificate and its scope statement for the product, plan, endpoint and region you will buy.

Azure assurance scope

Azure publishes a portfolio that includes SOC 2, ISO 27001, ISO 27017, ISO 27018, ISO 27701, CSA STAR, GDPR guidance, FedRAMP and regional programs. The portfolio is broad, but coverage changes by service, geography and deployment model. A certificate for the underlying cloud does not automatically include a marketplace model, a managed AI feature, your tenant configuration or a third-party subprocessor. Request the service-specific compliance entry and the shared-responsibility description.

Storage residency versus inference residency

Storage residency specifies where in-scope customer content is kept at rest. Inference residency specifies where the compute that processes a request runs. A service can store content in one region while routing a request to GPUs elsewhere, or run inference locally while retaining account metadata in another country.

Neither control automatically covers every operation. Authentication, routing, TLS termination, rate-limit decisions, abuse monitoring, diagnostics, billing, support tickets, backups and transient buffers may follow separate locations and retention rules. Ask for a data-flow diagram that labels each category rather than accepting a single “regional” label.

OpenAI describes ChatGPT data residency as allowing customers to keep in-scope customer content stored at rest in a specific geographic region.

OpenAI also answers the question “Does inference residency guarantee that all processing stays in-region?” with “No.”

OpenAI ChatGPT residency options

OpenAI’s 2026 ChatGPT documentation says eligible customers can select Australia, Canada or Europe (the European Economic Area plus Switzerland) for data residency at rest. Inference residency is available only to eligible customers and in supported regions; eligibility, model, plan and feature restrictions must be confirmed in the contract or service documentation.

The same documentation warns that some information can remain outside the selected region, including workspace metadata, billing information, user logins and transient processing. Treat the regional setting as a scoped content-at-rest control, not as a promise that every service activity is local.

OpenAI API project controls

OpenAI’s API documentation describes residency as a per-project configuration that controls the infrastructure location used to provide supported services. It applies to customer content for supported endpoints, not to system data. If a region lacks regional processing, customer content may be processed or temporarily stored outside that region. Confirm endpoint-by-endpoint support before moving a workload.

Compare hosting architectures, not just platform names

The same model family can expose materially different controls depending on where it is delivered. Score the complete workload and feature set against the following architectures.

Architecture Typical strengths Questions and trade-offs
Provider-managed SaaS Fastest deployment, integrated identity and collaboration, provider-operated upgrades and security controls. Can have separate locations for content, metadata and support. Regional settings may exclude features, and customer control over keys, networks and runtime versions can be limited.
Regional API project Programmatic isolation, project-level routing and the possibility of regional processing or zero-data-retention eligibility. Residency may apply only to supported endpoints and customer content. System data, logs and operational telemetry can remain outside the region.
Hyperscaler-hosted model Integration with an existing cloud account, private networking, regional virtual networks, customer-managed keys and centralized logging. Responsibility is split among the cloud, model publisher and your configuration. Model availability, safety features and certification scope vary by region and SKU.
Dedicated or self-hosted deployment Maximum control over network paths, storage, keys, retention and physical or logical isolation. You operate patching, capacity, model updates, monitoring, abuse controls and much of the compliance evidence. Hardware location alone does not remove legal obligations.

Use a feature-level comparison matrix

For every candidate, record the storage-at-rest region, inference/GPU region, routing and TLS-termination location, metadata and log locations, subprocessor and support access, customer-managed-key or external-key-management options, retention and deletion behavior, private-connectivity choices, dedicated capacity and regional feature exclusions. Mark each cell as contractually committed, documented but conditional, or not stated.

Jurisdiction is a supply-chain and contract question

Residency is only one part of jurisdiction. The legal entity signing your agreement determines governing law and often the primary route for government requests. Processors and support teams in other countries can create additional transfer and access considerations even when content is stored locally.

Map every participant

  1. Contracting entity: record its full legal name, address, governing law, venue and notice contacts.
  2. Subprocessors: obtain the current register and record each entity, country, purpose and access path.
  3. Data classes: separate prompts and files from account data, billing, telemetry, logs, abuse-monitoring records and support tickets.
  4. Transfer mechanism: identify the applicable standard contractual clauses, adequacy decision or other lawful mechanism for each cross-border transfer.
  5. Human access: ask whether support, trust-and-safety, abuse-monitoring or model-improvement personnel can view content, under what approvals and from which locations.
  6. Government access: understand the provider’s disclosure process, notification commitments and ability to challenge or minimize requests.
  7. Responsibility split: document which controls are provider commitments and which remain your configuration or operational duties.

OpenAI’s subprocessor register, updated October 14, 2026, lists entities such as Cloudflare, Microsoft and Google Cloud Platform for particular products and purposes, with entity, product, purpose and location fields. A regional storage setting therefore should not be treated as proof that every processing activity is local; review the register for the exact service.

Evidence to demand before purchase

Marketing badges are a starting point, not approval evidence. Put the following artifacts in the procurement record and note their effective dates.

  • Current SOC 2 Type 2 report, including examination period, trust-service criteria, exceptions, complementary user-entity controls and service boundary.
  • Current ISO certificates showing ISO/IEC 27001:2022, ISO/IEC 27701:2019 or ISO/IEC 42001:2023 scope, issuer and validity.
  • Data-processing agreement defining controller and processor roles, purposes, retention, deletion, rights requests and transfer safeguards.
  • Subprocessor register with country, purpose, access method, change-notice period and objection process.
  • Written regional-processing matrix identifying content, inference, routing, logs, backups, support and transient processing locations.
  • Encryption design, key ownership, customer-managed-key or external-key-management availability, rotation and revocation behavior.
  • Retention schedule, deletion SLA, backup expiry, zero-data-retention eligibility and legal-hold exceptions.
  • Incident-response commitments, notification clock, investigation cooperation and evidence preservation terms.
  • Private-networking, dedicated-capacity and tenant-isolation documentation where required.
  • List of features unavailable in each chosen region and the fallback processing location when regional processing is unavailable.

A five-stage buying process that produces defensible decisions

Stage 1: classify data and destinations

Inventory representative prompts, uploaded files, outputs, logs and support interactions. Label personal, health, financial, export-controlled, confidential and public data. Set prohibited countries, retention ceilings and rules for human review. Decide which classes may be used in a pilot.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Stage 2: write mandatory controls

State minimum certification scope, DPA language, encryption and key requirements, storage and inference regions, private connectivity, deletion, incident response, audit rights and subprocessor notice. Include an explicit requirement to disclose system-data locations rather than allowing “regional” to remain undefined.

Stage 3: compare architectures

Score provider SaaS, regional API, hyperscaler-hosted and dedicated or self-hosted options against the nine control questions. Give “not stated” a failing or escalation status; do not infer an answer from the provider’s headquarters or a cloud region name.

Stage 4: verify evidence

Read the actual SOC report or certificate, test its scope against the proposed service, and reconcile the data-flow diagram with the DPA and subprocessor register. Record feature-level regional exceptions, not just the headline region.

Stage 5: pilot safely

Use synthetic or redacted data. Test account creation, prompt submission, file upload, retrieval, deletion, exports, logs, support escalation and incident notification. Confirm what remains after deletion and obtain written answers to unresolved jurisdiction questions before production access.

Common purchasing mistakes and how to correct them

“The vendor is ISO certified, so the AI service is compliant.”

Why it fails: the certificate may cover a different entity, product, region or management system. Correction: attach the certificate scope and applicability statement to the order record and map it to the exact endpoint and plan.

“EU storage means all processing is in the EU.”

Why it fails: storage, inference, metadata, support and transient processing can use different locations. Correction: require a regional-processing matrix and identify every out-of-region exception.

“A cloud region solves jurisdiction.”

Why it fails: the model publisher, support personnel, subprocessors and governing law may be elsewhere. Correction: review the contracting entity, subprocessor register, transfer mechanism and access controls together.

“Zero retention means no data leaves the service.”

Why it fails: zero-data-retention terms can apply only to eligible endpoints or customer content, while account data, logs or abuse signals follow separate rules. Correction: document each data category and retention rule independently.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A regional feature is available everywhere.”

Why it fails: inference residency and regional processing can be limited by customer eligibility, model, endpoint or plan. Correction: test the actual workload in the intended region and obtain a written fallback behavior.

How to make the final decision

Choose the least complex architecture that satisfies the strictest data class you will actually process. A provider-managed service may be appropriate for public or low-risk content when its scope and retention terms fit. A regional API or hyperscaler deployment can add project isolation, private networking and key control for regulated workloads. Dedicated or self-hosted infrastructure is justified only when those controls outweigh the operational burden of capacity, patching, model updates and evidence collection.

Document residual risk instead of hiding it behind a certification logo. The approval record should name the service and region, list excluded features, identify out-of-region processing, assign customer tasks, and specify the review trigger for certificate expiry, subprocessor changes, new models or altered data flows.
