Possibly. Whether GST applies depends on who supplies the subscription, how the service is classified, whether you are GST-registered, and whether you use it for your creator business. An overseas invoice alone does not settle the answer. A registered creator may need to consider reverse charge on an imported service; for certain foreign-supplied OIDAR services to qualifying non-taxable online recipients, the foreign supplier is liable under section 14 of the IGST Act.

Why the answer depends on your specific subscription

“Cloud streaming” is a product description, not a GST classification. The tax treatment can turn on the supplier named in your contract and invoice, whether an Indian entity or intermediary is involved, what the service actually does, and how you use it. The available facts do not identify a particular platform, invoice issuer, creator’s registration status, or business use, so there is no reliable universal yes-or-no answer or guaranteed rate.

Start by identifying the transaction rather than assuming that payment to an overseas company automatically makes you responsible for GST—or that being unregistered automatically removes any tax issue.

How the GST rules fit together

First establish whether it is an import of services

Under the IGST Act, an import of services requires the supplier to be outside India, the recipient to be in India, and the place of supply to be in India. The general place-of-supply rule for services is the recipient’s location, subject to specified exceptions. The invoice issuer, contracting entity, recipient location and any applicable exception therefore matter. Read the Integrated Goods and Services Tax Act, 2017.

Then assess whether the service is OIDAR

OIDAR means online information and database access or retrieval services. The statutory definition covers services delivered over the internet or an electronic network that are essentially automated, involve minimal human intervention and cannot be supplied without information technology. The Act lists “providing cloud services;” among its examples, alongside services such as supplying movies, music and software online. That example does not, by itself, establish that every cloud-streaming subscription is OIDAR: the service’s actual functions and contract still need to be examined.

Identify who is liable to account for tax

For OIDAR supplied by a supplier outside a non-taxable territory to a qualifying non-taxable online recipient, section 14 places the IGST liability on the supplier. The section also contains rules for intermediaries, which can affect who is treated as supplying and receiving the service unless the statutory conditions are met. A direct overseas subscription and one involving an intermediary or Indian contracting entity may therefore require different analysis.

For an imported service received by a GST-registered creator for business, check whether a notified reverse-charge category applies. Notification 10/2017-Integrated Tax (Rate) is the relevant reverse-charge notification identified by CBIC; the current entry and the transaction’s facts must be checked before deciding whether reverse charge applies. CBIC’s notification index and its official FAQ provide context. The FAQ’s reference to an 18% rate for IT services is not proof that every streaming subscription is an IT service taxed at that rate.

What your registration and use may mean

If you are GST-registered

Registration does not make every subscription taxable by reverse charge automatically. Establish whether the recipient is your registered business, whether the service is imported, how it is classified and whether the current notification covers it. Keep the invoice and contract details needed to support that analysis, and confirm the applicable reporting and payment treatment with a GST practitioner if liability is unclear.

If you are not GST-registered

The statutory definition of a non-taxable online recipient considers both registration and purpose. It includes an unregistered person receiving OIDAR for a purpose other than commerce, industry or another business or profession. A creator using a streaming subscription to produce monetized content should not assume that non-registration alone settles the GST treatment. For qualifying foreign-supplied OIDAR, section 14 places liability on the supplier, subject to the intermediary provisions; whether that framework applies depends on the facts.

If your use is mixed

Separate business use from personal or other non-business use as accurately as your records allow. Mixed use can affect the tax analysis and, if you are registered and seek input tax credit, the amount of credit that may be available.

Input tax credit is a separate question

Whether GST applies and whether you can claim input tax credit are not the same question. A registered person’s credit is restricted to the portion attributable to business and taxable or zero-rated supplies; use for non-business or exempt purposes can restrict it. Your activity, records, supplies and compliance position all matter. Do not assume that a tax charge on an invoice—or a reverse-charge payment—means the full amount is creditable. CBIC’s FAQ is a starting point, not a substitute for applying the credit rules to your records.

Checklist: facts to gather before deciding

  • Who issued the invoice, and is that supplier located outside India?
  • Does the contract identify an Indian affiliate or intermediary, and what entity is named as supplier or recipient on the invoice?
  • Are you GST-registered, and which registered place of business receives the service?
  • What does the subscription actually provide? Is it automated OIDAR, another imported service or a different kind of supply?
  • Is the service used for your business or profession, personal purposes, or both?
  • If you intend to claim input tax credit, what portion relates to business and taxable or zero-rated supplies, and do your records support that claim?

Use these facts to check the applicable statutory provision and the current notification entry. If the supplier arrangement, service classification or business-use position leaves material uncertainty about your liability, ask a qualified Indian GST adviser familiar with creator businesses to review the invoice and contract.
