Public evidence supports a credible similarity allegation, but it does not establish that Jackbox Games intentionally plagiarized Sam Greszes’s board game Die On This Hill. Greszes says Jackbox received a playable demo and a physical copy while discussing a possible adaptation. More than a year later, Jackbox released Debate and Switch in The Jackbox Party Pack 12. The two games share a distinctive-looking structure—players build or submit absurd debate topics, argue opposing positions, let others vote, and alter a word before another round—but the public record does not prove copied expression, a broken contract, or legal infringement.

What is the allegation against Jackbox Games?

Sam Greszes developed Die On This Hill after being laid off in 2024. He had a working prototype by summer, launched a Kickstarter in November, and reached his funding goal in December. Before sending every physical copy to backers, he contacted Chicago-based Jackbox Games about turning the board game into a video game.

According to Greszes’s account, the parties held two long meetings about licensing economics. Jackbox asked for a demo, but he says the studio made clear there was no formal or verbal agreement. He also asked whether Jackbox would guarantee his involvement if it made a game based on his concept; he says the studio declined.

Greszes sent a physical copy in March 2025. After Jackbox confirmed receipt, his follow-up messages reportedly received only replies that nobody had played it yet. He eventually assumed the adaptation discussion had ended. In October 2026, previews of Debate and Switch prompted him to speak publicly about the resemblance. Kotaku published his account on October 27, 2026, and reported that it had asked Jackbox for comment.

  5. October 15, 2026: Jackbox releases The Jackbox Party Pack 12, listed at $29.99 in its launch announcement.
  6. October 27, 2026: The allegation becomes public through Greszes’s account and Kotaku’s report.

How closely do Die On This Hill and Debate and Switch match?

The overlap is strongest in the sequence of play rather than in the games’ presentation. Greszes’s game uses physical word cards; Jackbox’s game uses digital player submissions, but both make a changing proposition the centerpiece of a social debate.

Feature Die On This Hill Debate and Switch
Topic creation Players assemble word cards into mad-lib-style statements, such as “math paved the way for ketchup.” Players submit goofy opinions digitally, according to Jackbox’s official description.
Debate format Two participants argue for or against the resulting topic. Two players argue for or against a submitted opinion.
Audience role Other players vote for their preferred argument. Non-debating players indicate which stance they support.
Mid-round change The reported design changes the wording of the proposition, requiring a response. After the first round, players select a word and edit it, forcing the debaters to adapt.
Presentation and scope A physical board game built around cards and face-to-face play. A digital town-hall setting with running voter characters, spectator comments, and moderation settings; official listing: 2–8 players and approximately 15 minutes.

Those shared elements are not a single isolated gimmick. They form a loop: create an intentionally odd topic, stage a two-sided argument, let a crowd choose, then mutate the wording and argue again. That combination is why the comparison has drawn attention even though the implementations differ.

What does Jackbox say inspired Debate and Switch?

Jackbox’s published PlayStation Blog preview gives a different origin story. Senior Audio Lead Nate Sandberg said the original inspiration was the movie Rat Race, followed by his realization that there was already a board-game version of the concept, Pricetitution. Game Director Michael Siciliano described the running voter characters and the game’s evolution toward player-crafted topics. That account does not mention Die On This Hill.

Loquacious Games Trivia for Everyone - Trivia Game for Adults & Teens, 1500+ Questions & 2 Difficulty Levels - Fun Family Card Game for Game Night, Parties & Travel - Gift Idea
  • TRIVIA FOR EVERYONE: NEW! UPDATED FOR 2026. Unique to Amazon, we’ve created a game for both trivia and non-trivia people alike. We’ve taken feedback from people that both love and hate trivia, designing a game with classical general knowledge questions, like “How many hearts does an Octopus have?” and fun entertaining questions like “Who lives in a pineapple under the sea?” Questions are meticulously curated so subject matter is suitable for adults, teens, and families.
  • 1500+ QUESTIONS: While most other Amazon quiz games have a paltry 400-500 questions, we supercharge the fun with over 1500 questions spanning an incredibly large array of topics! Trivia For Everyone contains 190 cards with 1520 questions, requires 2 or more players, and is suitable for those 14 years and older.
  • 2 DIFFICULTIES: Unlike other Amazon trivia games that have one level of difficulty, we provide 2! Party Mode is for more accessible questions with lower difficulty and Expert Mode covers more obscure and challenging topics. Trivia for Everyone allows you to play the game the way you want to!
  • 3 WAYS TO PLAY: Rather than just having one set way to play like most Amazon games, Trivia for Everyone includes three different modes of play. Free-For-All is designed for fast, competitive play. Question Master is more suited for relaxed play that can take place while socializing. Teams allows you to combine with your friends in a group to take out the competition.
  • INNOVATIVE CARD DESIGN: Unlike other Amazon card games which use drab cards that spoil the answer for the reader, we’ve engineered beautiful multi-colored cards that don’t immediately give away the answer and allow for smooth play. It’s simple. Easier questions are in blue; their answers are on the other side of the card, also in blue. Harder questions are in red; their answers are on the other side of the card, also in red. No learning curve required!

An inspiration statement is not proof that no other source influenced development, nor is its omission proof that Jackbox used Greszes’s game. It is simply the studio’s published explanation of the project’s origins.

Does the similarity establish plagiarism or copyright infringement?

No. “Plagiarism” is commonly used to mean presenting another creator’s work as one’s own, while copyright infringement is a specific legal claim. Rules, abstract game mechanics, and general ideas are usually treated differently from protectable expression such as original artwork, text, audio, or software code.

Greszes said he understood that game mechanics cannot be copyrighted and acknowledged that there was no signed or verbal contract. Those are statements in the report, not a court ruling or independent legal opinion. A legal analysis would also need to examine what Jackbox accessed, what was actually copied, whether any protectable expression was reproduced, and whether another agreement or promise created obligations.

What should readers make of the two games’ differences?

Jackbox appears to have added substantial audiovisual and social layers: a town-hall environment, animated voters, spectator commentary, digital moderation controls, and online delivery. Those additions may make the finished game feel distinct in use, but they do not by themselves answer whether an earlier concept influenced its core loop.

Conversely, changing physical cards into digital submissions does not erase a structural resemblance. The relevant question is how much of the sequence, wording, and expressive implementation overlaps, and whether that overlap is better explained by access to Greszes’s prototype or by independent development of a broad debate-party-game idea.

What evidence would clarify the dispute?

  • Contemporaneous design documents showing when each mechanic was conceived.
  • Emails, meeting notes, or build histories documenting what Jackbox received and when.
  • Comparisons of rule text, card wording, interface scripts, artwork, and software—not only high-level rules.
  • Statements from participants in the meetings or anyone who reviewed the submitted demo and physical copy.
  • A direct Jackbox response explaining its development timeline and the relationship, if any, to Greszes’s materials.

Until that evidence becomes public, readers can reasonably recognize the unusual similarities while separating an accusation from a proven legal or ethical conclusion.

Frequently Asked Questions

Could two developers independently create games with this structure?

Yes. Debate parties, audience voting, and changing prompts are ideas that multiple designers could reach independently. The unusual combination increases interest in the allegation, but only development records and the specific materials exchanged could show whether the resemblance came from access or coincidence.

What is the difference between copying a game idea and copying its expression?

An idea is the broad concept, such as staging arguments around absurd propositions. Expression is the particular rulebook language, illustrations, recorded audio, software implementation, or other fixed creative material used to present that idea; those categories can receive different legal treatment.

What did Greszes say he wanted from Jackbox?

He told Kotaku that the situation “feels like a betrayal.” He also said he would have welcomed acknowledgment or promotion if Jackbox believed the games were similar but sufficiently different.
